&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El 12 de desembre de 2024 els membres de la Comissió Negociadora es van reunir per aprovar un acord en matèria salarials dels centres d'atenció especialitzada a persones amb discapacitat i centres especials d'ocupació de les Illes Balears per l'any 2024 (codi de conveni: 07100085082025)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El 23 de desembre de 2024, Antònia Bauzà Vives, en representació de la Comissió Negociadora, va sol·licitar el registre, el dipòsit i la publicació de la citada Acta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. L'article 90.3 del Text Refós de la Llei de l'Estatut dels Treballadors, aprovat pel Reial decret legislatiu 2/2015, de 23 d'octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El Reial decret 713/2010, de 28 de maig, sobre registre i dipòsit de convenis i acords col·lectius de treball.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. L'article 45 de la Llei 39/2015, d'1 d'octubre, de Procediment Administratiu Comú de les Administracions Públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot això, dicto la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Inscriure i dipositar l'Acta de l'acord en matèria salarial aplicable a les empreses de les Illes Balears incloses en l'àmbit d'aplicació del Conveni Col·lectiu estatal de centres d'atenció especialitzada a persones amb discapacitat i centres especials d'ocupació de les Illes Balears per l'any 2024, de 12 de desembre de 2024 en el Registre de Convenis Col·lectius de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Publicar l'acord en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Fer constar que la versió catalana del text és l'original signada pels membres de la Comissió Negociadora i que la versió castellana és la seva traducció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Notificar aquesta Resolució a la persona interessada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dia 17 de març de 2023, es va signar per les entitats patronals i sindicals i el Govern de les Illes Balears, un nou acord per a la millora de l'Ensenyament privat concertat de les Illes Balears, aquest inclou la reactivació de l'acord de 2016 i un nou acord marc (2023-2027) de millora per a l'ensenyament privat concertat. El desenvolupament de l'acord contempla una revisió i millora del mòdul de despeses de funcionament dels centres concertats i la millora del mòdul de personal complementari dels centres d'Educació Especial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Al contingut del referit 'Acord del Consell de Govern de 27 de març de 2023 pel qual es ratifica l'Acord de la Mesa d'Ensenyament Privat Concertat de la Comunitat Autònoma de les Illes Balears de Reactivació de l'Acord de 2016 i Nou Acord Marc (2023-2027) de millora per a l'Ensenyament Privat Concertat (BOIB número Núm. 39 de 28 de març de 2023), en quant a l'àmbit subjectiu d'aplicació es preveu: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;“&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;En el pacte primer, àmbit d'aplicació 1.1 Àmbit subjectiu Aquest acord és d'aplicació als col·lectius següents: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f) El personal d'administració i serveis i l'afectat pel complement retributiu de les Illes Balears (CRIB) finançat mitjançant el mòdul de despeses de funcionament.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g) El personal complementari dels centres d'educació especial pel que fa al finançament del mòdul de despeses de funcionament.”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per part de les patronals i sindicats, en data 3 de març de 2004, es va signar un acord d'adaptació i establiment de les noves clàusules que regiran a partir d'aquella data el Complement retributiu Illes Balears . Concretament, la clàusula quarta de l'esmentat acord. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;En data 28 de juny de 2023, es va reunir la comissió negociadora de millores d'àmbit autonòmic per al personal afectat pel XV Convenio Colectivo General de centros y servicios de atención a personas con discapacidad&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, i es va acordar redactar un nou acord d'actualització del complement específic per al personal en pagament no delegat, és a dir, el personal complementari, auxiliars tècnics educatius i personal d'administració i serveis. Aquest acord inclou un increment del 10'5% per a l'any 2023 del complement específic (complement retributiu de les Illes Balears).Boib Núm. 58 de 2 de maig de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;A 25 de novembre de 2024, es va reunir la comissió negociadora de millores d'àmbit autonòmic per al personal afectat pel XV Convenio Colectivo General de centros y servicios de atención a personas con discapacidad&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, i es va acordar redactar aquest nou acord d'actualització del complement específic per al personal en pagament no delegat, és a dir, el personal complementari, auxiliars tècnics educatius i personal d'administració i serveis. Aquest acord inclou un increment del 7% per a l'any 2024 del complement específic (complement retributiu de les Illes Balears).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Per tot això&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; i donat que es fa necessari l'actualització per a l'any 2024 del complement específic per al personal en pagament no delegat, les patronals i les organitzacions sindicals del sector, conforme els articles 3, 4, 105, 112 i la Disposició Addicional Segona del &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;XV Convenio Colectivo General de centros y servicios de atención a personas con discapacidad&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ACORDAM:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMER: &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Actualitzar el complement retributiu Illes Balears per a l'any 2024 de la següent forma:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Mentre els centres afectats per aquest acord mantenguin la seva condició de centres concertats totalment o parcialment sostinguts amb fons públics, abonaran al personal &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;en pagament no delegat&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; a jornada completa, un complement en dotze mensualitats i juntament amb la mensualitat ordinària, incrementat per a l'any 2024 en les quantitats següents i resultant les quantitats expressades:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Les parts acorden autoritzar les empreses perquè puguin fer pagaments a compte dels increments pactats en aquest acord, des de la seva signatura i fins que es procedeixi a la publicació en el Butlletí Oficial corresponent.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TERCER&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;: Remissió a la Comissió Paritària. Les parts acorden remetre la traducció castellana del present acord a la Comissió Paritària del &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;XV Convenio Colectivo General de centros y servicios de atención a personas con discapacidad &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;per tal que es pugui procedir a la seva publicació al Butlletí Oficial de l'Estat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;QUART&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;: Es manté l'aplicació de les clàusules, segona i tercera de l'acord de data 3 de març de 2004, relatives a compensació i absorció i a la informació als representants legals dels treballadors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;DISPOSICIÓ ADICIONAL: &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Aquest acord serà d'aplicació amb caràcter retroactiu a partir de dia 1 de gener de 2024, i serà exigible un cop es produeixi la seva publicació al BOIB i siguin liquidats els augments de mòduls per part de la Conselleria d'Educació i Formació Professional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
