    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;En data de la signatura electrònica, el director general d'Economia Circular, Transició Energètica i Canvi Climàtic ha formulat la proposta definitiva següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Fets&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. L'11 de setembre de 2021, en el BOIB núm.&amp;nbsp;125 es va publicar la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021 per la qual s'aprova la convocatòria pública de subvencions per a la realització d'instal·lacions d'autoconsum amb fonts d'energia renovable, amb o sense emmagatzematge, i la incorporació d'emmagatzematge en instal·lacions d'autoconsum amb fonts d'energia ja existents, en el sector residencial, les administracions públiques i el tercer sector en el marc del Pla de Recuperació, Transformació i Resiliència europeu, modificada per la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 19 d'octubre de 2022 (BOIB núm.&amp;nbsp;137, de 22 d'octubre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;2. Les persones o entitats que figuren en l'annex d'aquesta Proposta varen presentar una sol·licitud de subvenció en el marc de la convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;3. Els tècnics de la Direcció general d'Economia Circular, Transició Energètica i Canvi Climàtic, han informat desfavorablement sobre les sol·licituds de subvenció descrites en l'annex, amb la motivació que també hi figura.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;4. El 5 de març de 2025 es va emetre una proposta de resolució provisional denegatòria del director general d'Economia Circular, Transició Energètica i Canvi Climàtic (BOIB núm. 30, de 8 de març de 2025) i s&lt;span style="background-color:#ffffff"&gt;'ha exhaurit el termini de deu dies que es concedien per presentar al·legacions sense que n'hi hagin presentat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;1. La Llei&amp;nbsp;38/2003, de 17 de novembre, general de subvencions&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;2. El Reial decret&amp;nbsp;887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei&amp;nbsp;38/2003, de 17 de novembre, general de subvencions. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;3. El Decret legislatiu&amp;nbsp;2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions (BOIB núm.&amp;nbsp;196, de 31 de desembre de 2005).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;4. El Decret&amp;nbsp;75/2004, de 27 d'agost, pel qual es despleguen determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears (BOIB núm.&amp;nbsp;122, de 2 de setembre de 2004).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;5. El Reial decret&amp;nbsp;477/2021, de 29 de juny, pel qual s'aprova la concessió directa a les comunitats autònomes i a les ciutats de Ceuta i Melilla d'ajuts per a l'execució de diversos programes d'incentius lligats a l'autoconsum i a l'emmagatzematge amb fonts d'energia renovable, així com a la implantació de sistemes tèrmics renovables en el sector residencial, en el marc del Pla de Recuperació, Transformació i Resiliència europeu.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;6. La Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021 per la qual s'aprova la convocatòria pública de subvencions per a la realització d'instal·lacions d'autoconsum amb fonts d'energia renovable, amb o sense emmagatzematge, i la incorporació d'emmagatzematge en instal·lacions d'autoconsum amb fonts d'energia ja existents, en el sector residencial, les administracions públiques i el tercer sector, en el marc del Pla de Recuperació, Transformació i Resiliència europeu (BOIB núm.&amp;nbsp;125, d'11 de setembre de 2021).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;7. La Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica per la qual es modifica i amplia el crèdit de la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021 per la qual s'aprova la convocatòria pública de subvencions per a la realització d'instal·lacions d'autoconsum amb fonts d'energia renovable, amb o sense emmagatzematge, i la incorporació d'emmagatzematge en instal·lacions d'autoconsum amb fonts d'energia ja existents, en el sector residencial, les administracions publiques i el tercer sector, en el marc del Pla de Recuperació, Transformació i Resiliència europeu NextGenerationEU &lt;span style="color:#000000"&gt;(BOIB núm.&amp;nbsp;137, de 22 d'octubre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Proposta de resolució definitiva&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;Propòs al conseller &lt;span style="color:#000000"&gt;d'Empresa, Ocupació i Energia&lt;/span&gt; que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;1. Denegar la concessió d'una subvenció als beneficiaris que figuren en l'annex, d'acord el motiu que també hi figura.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;2. Declarar conclòs el procediment i, per tant, arxivar els expedients indicats en l'annex.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;3. Publicar aquesta Resolució en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Empresa, Ocupació i Energia en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació de la Resolució, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
