    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El conseller Medi Ambient, Medi Rural i Esports del Consell Insular de Mallorca, en data 14 de març de 2025, ha adoptat la següent Resolució:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;FETS: &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell de Mallorca és propietari i exerceix la gestió de diverses finques adscrites al Departament de Medi Ambient, Medi Rural i Esports, entre elles: Son Fortuny, Son Amer, Sa Coma d'en Vidal, Son Massip, Tossals Verds.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquestes finques estan declarades actualment, segons la Llei 6/2206 balear de Caça i pesca fluvial, refugi de fauna, si bé en el passat aquestes finques han tengut la declaració de vedat de caça o de caça controlada, segons la finca i el moment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Conseller de Medi Ambient, Medi Rural i Esports ha donat instruccions per a la declaració de les finques esmentades com a vedat de caça:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. &lt;strong&gt;La Mola de Son Massip&lt;/strong&gt;, en el terme municipal d'Escorca. Adquirida l'any 1981 per acord de Ple del Consell Insular de Mallorca de dia 29 de desembre de 1980.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. &lt;strong&gt;Son Fortuny&lt;/strong&gt;, en el terme municipal d'Estellencs. Adquirida l'any 1981 per acord de Ple del Consell Insular de Mallorca de dia 30 d'octubre de 1981. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. &lt;strong&gt;Tossals Verds&lt;/strong&gt;, en el terme municipal d'Escorca. Adquirida l'any 1986 per acord de Ple del Consell Insular de Mallorca de dia 23 de desembre de 1985.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. &lt;strong&gt;Son Amer&lt;/strong&gt;, en el terme municipal d'Escorca. Adquirida l'any 1999. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. &lt;strong&gt;Sa Coma den Vidal&lt;/strong&gt;. Cedida per l'Administració de la CAIB. Acord del Consell de Govern de dia 28 de desembre de 2012, i acceptada per Acord del Consell Executiu del Consell de Mallorca de dia 10 de desembre de 2014. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CONSIDERACIONS JURÍDIQUES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Llei Orgànica 1/2007, de 1 de març, (BOE 52 de 01.03.07) per la qual s'aprova l'Estatut d'Autonomia de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;2. Decret 106/2010, de 24 de setembre (BOIB 142 de 30 .09.10), sobre el traspàs als consells insulars de les funcions i els serveis inherents a les competències pròpies d'aquestes institucions insulars que actualment exerceix l'Administració de la Comunitat Autònoma de les Illes Balears en matèria de caça i de regulació, vigilància i aprofitament dels recursos cinegètics, com també de pesca fluvial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Llei 6/2006 de caça i pesca fluvial, de data 12 d'abril (BOIB núm. 61, de 27.04.06), modificada per 6/2007, de 27 de desembre, de mesures tributàries i econòmic-administratives (BOIB núm. 196 de 29.12.07), i per la Llei 3/2013, de 17 de juliol (BOIB núm. 106 de 30.07.13), secció Primera “Dels terrenys cinegètics”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Reglament 1/2012 del Consell Insular de Mallorca pel qual es regulen les vedes i els recursos cinegètics, aprovat definitivament en data 9 de febrer de 2012.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Llei 4/2022, de 28 de juny, de consells insulars. (BOE núm. 197, de 17 d'agost de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Decret de la presidència del Consell Insular de Mallorca, de dia&amp;nbsp;10 de juliol&amp;nbsp;de 2023, pel qual es creen els departaments que han d'estructurar el govern (BOIB núm. 95, d'11 de juliol&amp;nbsp;de 2023)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Decret de la presidència del Consell Insular de Mallorca, de dia&amp;nbsp;12 de juliol&amp;nbsp;de 2023, pel qual es creen les direccions insulars i les secretaries tècniques en què han d'estructurar-se els departaments (BOIB núm. 97, de&amp;nbsp;13 de juliol&amp;nbsp;de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Decret de la Presidència del Consell Insular de Mallorca pel qual s'estableixen les competències dels departaments del Consell Insular de Mallorca (BOIB núm. 106 de&amp;nbsp;29 de juliol&amp;nbsp;de 2023)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. El&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;Decret de la Presidenta del Consell Insular de Mallorca, de dia 9 de desembre de 2019, pel qual es determina l'organització del Consell Insular de Mallorca de 09.12.2019 modificat pel Decrets de 06.03.2020, de 22.05.2020, de 09.07.2020, de 10.11.2020, de 03.12.2020 i de 26.01.2021 (BOIB núm. 167, de 12.12.2019, BOIB núm. 29, de 07.03.2020, BOIB núm. 95 de 25.05.20, BOIB núm. 131, de 25.07.2020, BOIB núm. 196, de 17.11.2020, BOIB núm. 208, de 15 de desembre de 2020 i BOIB núm. 12, de 28 de gener de 2021). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. Decret llei 3/2024, de 24 de maig, de mesures urgents de simplificació i racionalització administratives de les administracions públiques de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CONSIDERACIONS TÈCNIQUES:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La declaració de vedat de caça suposa que el dret a la caça queda restringit en la finca objecte de declaració, és a dir, que no es pot exercir la caça llevat que es compti amb una autorització expressa i reglada per a aquesta activitat emesa pel titular, en aquest cas l'administració titular. Les actuacions de control de fauna estan incloses dintre del règim cinegètic i estan igualment sotmeses a autorització.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Segons el Decret llei 3/2024, de 24 de maig, de mesures urgents de simplificació i racionalització administratives de les administracions públiques de les Illes Balears, ja no és necessari que els vedats comptin amb un pla tècnic de caça. En cas d'inexistència de pla tècnic, l'activitat cinegètica dins vedats queda adscrita al règim general.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El control de cabres, necessari per a la gestió de diverses finques, és possible amb la condició de vedat de caça com també ho era amb la de refugi de fauna. Si bé la figura de vedat permet aplicar millors eines de gestió de la fauna cinegètica, així com també per a la conservació d'elements cinegètics de valor patrimonial en l'àmbit de la Serra de Tramuntana, i d'espècies cinegètiques rellevants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb la Disposició Addicional Quinta de la Llei 3/2013, de 17 de juliol, de modificació de la Llei 6/2006, de 12 d'abril, balear de caça i pesca fluvial , els vedats de titularitat pública estan exempts de pagament de taxa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLC&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
