    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Antecedents&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Mitjançant la Resolució del director gerent de Serveis Ferroviaris de Mallorca de 16 de desembre de 2024 s'aprova la convocatòria pel sistema de concurs oposició per cobrir les places de personal laboral pel torn lliure de Serveis Ferroviaris de Mallorca de les ofertes públiques d'ocupació dels anys 2021, 2022 i 2023 (BOIB núm. 165, de 17 de desembre de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. D'acord amb la base 11.1.1, els tribunals s'han d'ajustar, pel que fa a la constitució i la composició, al que estableixen els capítols V i VI del Reglament d'ingrés del personal al servei de la Comunitat Autònoma de les Illes Balears, aprovat mitjançant el Decret 27/1994, d'11 de març.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. D'acord amb la base 11.2. de la convocatòria sobre nomenament dels membres dels tribunals, els tribunals encarregats de la selecció han de ser nomenats pel director gerent d'SFM i tenen la consideració d'òrgans dependents de la seva autoritat. De conformitat amb l'apartat 1 de l'article 13 del Decret 27/1994, el nomenament dels membres dels tribunals s'ha de publicar en el &lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;un cop finalitzat el període de presentació d'instàncies.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. A més, d'acord amb la base 11.1.2, els tribunals han d'estar constituïts, com a mínim, per tres membres titulars, amb el mateix nombre de suplents. S'ha de constituir un tribunal per cada categoria professional o lloc de feina. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Tots els membres dels tribunals han de tenir una titulació acadèmica de nivell igual o superior que l'exigit als aspirants per a l'ingrés.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Com a mínim, un dels membres dels tribunals ha de tenir una titulació corresponent a la mateixa àrea de coneixements que l'exigida per a l'ingrés, si aquesta titulació és específica. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En la designació dels tribunals s'ha de procurar garantir, en tot cas, el compliment del principi d'especialitat i d'idoneïtat per enjudiciar els coneixements i les aptituds requerides als aspirants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La base 11.1.3 disposa que la determinació de la composició dels tribunals s'ha de dur a terme d'acord amb les normes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Tribunal està constituït per un president o una presidenta i dos vocals designats pel Consell d'Administració d'SFM, dos entre el personal funcionari de la conselleria d'adscripció de l'entitat, i un elegit per sorteig d'entre els treballadors fixos d'SFM. Tots els membres han de tenir una titulació acadèmica de nivell igual o superior que l'exigit a les persones aspirants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El nomenament dels membres correspon al director gerent d'SFM. La pertinença als òrgans de selecció és a títol individual i no es pot actuar en representació o per compte de ningú, motiu pel qual els membres són personalment responsables de complir estrictament les bases de la convocatòria i de subjectar-se als terminis establerts per a la realització i la valoració dels exercicis del procés selectiu, com també de complir el deure de secret professional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La composició dels òrgans de selecció s'ha d'ajustar, llevat de raons fonamentades i objectives, motivades degudament, al criteri de paritat entre homes i dones, amb capacitació, competència i preparació adequades. S'entén per representació equilibrada la presència de dones i homes de manera que cap sexe no superi el 60&amp;nbsp;% del conjunt de persones al qual es refereix ni sigui inferior al 40&amp;nbsp;%.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Així mateix, en la sessió del dia 14 de març de 2025 del Comitè d'Empresa de SFM es va elaborar, per sorteig, una llista de reserva de treballadors de l'entitat pels tribunals qualificadors per al cas que no puguin intervenir ni el titular ni el suplent designat. De la mateixa manera, el dia 19 de març la cap del Servei de Recursos Humans de la conselleria d'adscripció va trametre una relació de funcionaris per crear la llista de reserva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Finalment, la base 11.3 preveu que el Tribunal pugui sol·licitar a l'òrgan gestor del procés la intervenció de personal assessor especialista que consideri necessari per a les proves. Aquests assessors s'han de limitar a prestar col·laboració en les seves especialitats tècniques i tenen veu, però no vot. A aquest efecte, són aplicables les mateixes prohibicions de participació i les causes d'abstenció i recusació que tenen els membres dels òrgans de selecció. Per això, es publica en l'annex 3 la llista d'assessors per cada un dels tribunals qualificadors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Resolució del director gerent de Serveis Ferroviaris de Mallorca de 16 de desembre de 2024 per la qual s'aprova la convocatòria pel sistema de concurs oposició per cobrir les places de personal laboral pel torn lliure de Serveis Ferroviaris de Mallorca de les ofertes públiques d'ocupació dels anys 2021, 2022 i 2023 (BOIB núm. 165, de 17 de desembre de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El Decret 27/1994, d'11 de març, pel qual s'aprova el Reglament d'ingrés del personal al servei de la Comunitat Autònoma de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El VII Conveni Col·lectiu de Serveis Ferroviaris de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot això, dict la següent &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Nomenar els membres de cada un dels tribunals qualificadors, per a cada lloc de feina, de la convocatòria derivada de l'oferta d'ocupació pública per als anys 2021, 2022 i 2023, convocada per la Resolució del director gerent de Serveis Ferroviaris de Mallorca de 16 de desembre de 2024 (BOIB núm. 165, de 17 de desembre de 2024), en els termes que figuren en l'annex 1 d'aquesta Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Publicar la llista de reserva treballadors de l'entitat pels tribunals qualificadors a l'annex 2 d'aquesta Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Publicar la llista de reserva de funcionaris de la conselleria d'adscripció de Serveis Ferroviaris de Mallorca en l'annex 3 d'aquesta Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Nomenar els assessors especialistes per cada un dels tribunals qualificadors en els termes que figuren en l'annex 4 d'aquesta Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Informar les persones nomenades de l'obligació d'abstenir-se d'intervenir en el procés selectiu si concorre alguna de les circumstàncies previstes en l'article 23 de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic, i en el punt 11.5 de les bases específiques de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; i en el portal de Convoca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra aquesta Resolució, que posa fi a la via administrativa, es pot interposar una demanda davant el Jutjat Social en el termini de dos mesos, comptadors des de l'endemà de la publicació, d'acord amb l'article 69 de la Llei 36/2011, de 10 d'octubre, reguladora de la jurisdicció social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
