Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per a l'any 2024, subvencions per a inversions en la prevenció dels danys causats als boscos per incendis forestals, desastres naturals i catàstrofes. BOIB núm. 48 de l'11 d'abril del 2024 la Resolució del president del FOGAIBA de 26 de març de 2024.</p> <p>2. Resolució del president del Fons de Garantia Agrària i Pesquera de les illes Balears (FOGAIBA) per la qual es modifica la Resolució del president del FOGAIBA de 26 de març de 2024, per la qual es convoquen, per a l'any 2024, subvencions per a inversions en la prevenció dels danys causats en els boscos per incendis forestals, desastres naturals i catàstrofes. BOIB núm. 69 de 25 de maig del 2024.</p> <p>3. De conformitat amb l'apartat sisè de l'esmentada Resolució, el termini de presentació de sol·licituds va acabar el dia 31/05/2024.</p> <p>4. Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.</p> <p>5. A data 8 de febrer de 2025 es va publicar al BOIB núm.18 un informe proposta provisional de denegació, de 31 de gener de 2025, per incompliment dels requisits de tenir la puntuació mínima, és a dir, que les sol·licituds han de tenir 37,5 punts, o dels requisits que han de ser propietaris o titulars de parcel·les forestals ubicades en una zona declarada de risc d'incendi forestal alt, molt alt o extremadament, d'acord amb el IV Pla de defensa contra incendis forestals de les Illes Balears, on s'emplaçava les persones interessades a presentar al·legacions el seu expedient en el termini de deu dies.</p> <p>6. Una vegada finalitzat el termini per al·legacions, els interessats relacionats en l'annex adjunt no compleixen amb algun dels requisits citats a l'apartat anterior.</p> <p>7. Correspon proposar per a denegar els expedients assenyalats a l'Annex I pels motius indicats a l'esmentat annex.</p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><span style="display:inline-block">Fonaments de dret</span></span></span></strong></p> <p>1. Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de desenvolupament rural de les Illes Balears 2014-2020, publicada en el Butlletí Oficial dels Illes Balears núm. 29, de 26 de febrer de 2015.</p> <p>2. BOIB núm. 69 de 25 de maig del 2024.</p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><span style="display:inline-block">Resolució </span></span></span></strong></p> <p>Per tot això, s'informa desfavorablement i proposo al vicepresident del FOGAIBA que dicti una resolució en els termes següents:</p> <p>1. Denegar l'ajuda sol·licitada pels interessats que figuren a l'Annex I , que són un total de 8 expedients i que comença amb CAN FARMBER SL i acaba amb MIGUEL ANGEL COLOMAR SERRA, relativa a la línia d'ajudes “Inversions en la prevenció dels danys causats en els boscos per incendis forestals, desastres naturals i catàstrofes”, per no complir requisits que s'estableixen en la convocatòria i que s'especifiquen a l'esmentat annex.</p> <p>2. Declarar conclòs el procediment i procedir a l'arxiu dels expedients detallats a l 'Annex adjunt.</p> <p>3.
