&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;La cap del Servei al Desenvolupament Rural del FOGAIBA, en data 12 de març de 2025,&lt;/span&gt; va signar la següent proposta provisional, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;1. En data 30&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;de gener de 2024 es va publicar, en el BOIB núm. 15, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 25 de gener de 2024, per la qual s'aprova la convocatòria per a l'any 2024 de les ajudes destinades al pagament compensatori per a zones amb limitacions específiques a les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;2. De conformitat amb l'apartat sisè de la resolució anterior, modificada per Resolució del president del FOGAIBA de 2 de juliol de 2024 i publicada al BOIB núm. 88 de 4 de juliol,&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;de determinats ajuts corresponents a les intervencions en forma de pagaments directes que preveu el Pla estratègic de la PAC (PEPAC) per a l'any 2024, el termini de presentació de sol·licituds de determinades intervencions al desenvolupament rural es va modificar. Aquest nou termini de presentació va acabar dia 15 de juny de 2024 i varen tenir entrada en el registre del FOGAIBA un total de 1298 sol·licituds d'ajuda de pagament compensatori per a zones amb limitacions específiques a les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;3. Una vegada avaluades les sol·licituds d'ajuda pels òrgans gestors, i d'acord amb els criteris d'elegibilitat establerts, l' interessat ANTONIO COLOMAR COLOMAR, amb nif ***3739**,no compleix els requisits prevists el punt 1.c i 3 de l'apartat Tercer de la convocatòria, ser titular d'una explotació agrària inscrita en el Registre Interinsular Agrari (RIA) durant tot l'any 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Fonaments de dret&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Resolució de la President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 25 de gener de 2024 per la qual s'aprova la convocatòria per a l'any 2024 de les ajudes destinades al pagament compensatori &lt;span style="background-color:#ffffff"&gt;per a zones amb limitacions específiques&lt;/span&gt;, publicada al BOIB núm. 15 de dia 30 de gener de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;2. Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Ordre 10/2023 de la consellera d'Agricultura, Pesca i Alimentació, de 5 d'abril de 2023, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc de les intervencions per al desenvolupament rural de les Illes Balears 2023-2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;4. La llei 3/2019, de 31 de gener, agrària de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;5. La llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;La resta de normativa de desenvolupament i aplicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Proposta de resolució de denegació&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Per tot això, s'informa desfavorablement i propòs al vicepresident en Matèria Agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Denegar la sol·licitud presentada per &lt;span style="background-color:#ffffff"&gt;ANTONIO COLOMAR COLOMAR, amb nif ***3739**&lt;/span&gt; , per incompliment dels requisits indicats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. La present proposta provisional de resolució s'ha de comunicar a la persona interessada informant-la que disposa d'un termini màxim de 10 dies hàbils, comptadors des de l'endemà de la notificació d'aquesta proposta per a presentar al·legacions i/o aportar documents. En el cas de no fer ús del seu dret a al·legar, en el termini indicat, o si manifesta la seva decisió de no efectuar al·legacions ni aportar nous documents o justificacions, aquesta proposta tendrà caràcter definitiu, i s'elevarà al vicepresident en matèria agrària del FOGAIBA perquè dicti la Resolució de denegació corresponent. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Notificar la resolució a la persona interessada&lt;strong&gt; &lt;/strong&gt;mitjançant la publicació en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;4. Informar a la persona interessada que el seu expedient es troba a la seva disposició i consulta al Servei d'Ajudes de Desenvolupament Rural del FOGAIBA (carrer de Reina Constança, núm. 4 de Palma).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
