    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La convocatòria d'ajudes especifica que les comunicacions i les notificacions es realitzaran a les persones interessades mitjançant la seva publicació al &lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;d'acord amb els termes que preveu la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La cap del servei d'Ajudes al Desenvolupament Rural del FOGAIBA, amb data 4 de març de 2025, signa la següent, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;“&lt;strong&gt;PROPOSTA PROVISIONAL DE RESOLUCIÓ DE CONCESSIÓ&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#000000"&gt;1. En data de 28 de desembre de 2023, es va publicar en el Butlletí Oficial de les Illes Balears núm. 1&lt;span style="color:#000000"&gt;75&lt;/span&gt;, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, &lt;span style="color:#000000"&gt;mitjançant procediment anticipat de despesa&lt;/span&gt;, subvencions per a inversions a les explotacions agràries corresponent a l'any 2024, modificada mitjançant la resolució de data 26 de febrer de &lt;span style="color:#000000"&gt;2024&lt;/span&gt; (BOIB núm. 30)&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;2. De conformitat amb l'apartat sisè de la Resolució esmentada, el termini per presentar les sol·licituds va acabar el dia 11&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;de març de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;3. Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;4. Els interessats, assenyalats a l'Annex I adjunt, han presentat dins el termini establert i en la forma escaient, la documentació prevista a la convocatòria, i s'ha comprovat el compliment dels requisits exigits per poder ser beneficiaris d'aquesta ajuda i han acreditat el compliment dels criteris de selecció indicats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;5. Per a aquesta convocatòria s'han presentat un total de 314 sol·licituds d'ajuda, de les quals: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;7 s'han desistit perquè els interessats han presentat una sol·licitud de desistiment i 18 s'han desistit per no esmenar les deficiències comunicades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;24 es proposa la seva denegació per incompliment, per part dels interessats, dels requisits establerts a la convocatòria, segons l'Annex IV adjunt.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;6. Tenint en compte que el crèdit existent (6.000.000,00 €) no cobreix la totalitat de les peticions d'aquesta convocatòria, la selecció dels beneficiaris de les ajudes s'ha de realitzar mitjançant el procediment de concurrència competitiva, segons els criteris de prioritat i la puntuació obtinguda &lt;span style="color:#000000"&gt;d'acord amb&lt;/span&gt; la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, &lt;span style="color:#000000"&gt;mitjançant procediment anticipat de despesa&lt;/span&gt;, subvencions per a inversions a les explotacions agràries corresponent a l'any 2024, de dia 28 de desembre de 2023 i modificada mitjançant la resolució de data 26 de febrer de &lt;span style="color:#000000"&gt;2024&lt;/span&gt; (BOIB núm. 30).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;7. En data 25&lt;span style="color:#000000"&gt; de febrer de 2025&lt;/span&gt; la Comissió Avaluadora d'aquestes ajudes acorda informar favorablement la puntuació de l'Annex I adjunt.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En la relació de l'Annex I, figuren els 265 expedients que compleixen les condicions establertes i no tenen deficiències, dels quals:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;58 es proposa la concessió total.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;21 es proposa la concessió parcial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;186&lt;/span&gt;&lt;span style="color:#000000"&gt; queden denegades provisionalment.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;FONAMENTS DE DRET&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. O&lt;span style="color:#000000"&gt;rdre de 10/2023 de la consellera d'Agricultura, Pesca i Alimentació per la qual s'estableixen les bases reguladores per la concessió de subvencions en el marc de les intervencions per al desenvolupament rural de les Illes Balears 2023-2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. R&lt;span style="color:#000000"&gt;esolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, mitjançant procediment anticipat de despesa, subvencions per a inversions a les explotacions agràries corresponent a l'any 2024, de dia 28 de desembre de 2023 i modificada mitjançant la resolució de data 26 de febrer de 2024 (BOIB núm. 30).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. Llei 39/2015, d'1 d'octubre, de règim jurídic de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;PROPOSTA PROVISIONAL&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Atès l'Informe Tècnic de 19/02/25 i l'Informe de la Comissió Avaluadora de 25/02/2025, es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;1. Concedir l'ajuda sol·licitada als beneficiaris pels imports i amb els terminis detallats a l' Annex II amb els nombres d'ordre de l'1 al 79, ambdós inclosos, que són un total de 79 expedients i que comença amb PERE ANTONI COMPANY VIVES, i acaba amb AGROCANFELIU SL, que suma un import total de 6&lt;span style="color:#000000"&gt;.000.000,00&lt;/span&gt; euros, relativa a la línia d'ajuda “Inversions a les explotacions agràries &lt;span style="color:#000000"&gt;2024&lt;/span&gt;”, deduint, en el seu cas, les inversions/actuacions no elegibles especificades a l'Annex III.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;2. Denegar l'ajuda sol·licitada als beneficiaris detallats a l' Annex I amb els nombres d'ordre del 80 al 265, ambdós inclosos, que són un total de 186 expedients i que comença amb MIREIA OLIVER MULET, i acaba amb VINYES MORTITX, S.A.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;3. Denegar l'ajuda sol·licitada als beneficiaris detallats &lt;span style="color:#000000"&gt;a l' Annex IV, que són un total de 24 expedients, per incompliment, per part dels interessats, dels requisits establerts a la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;4. Comunicar aquesta proposta provisional als interessats que disposen d'un termini màxim de 10 dies hàbils, comptadors des de la publicació a la pàgina web del FOGAIBA d'aquesta proposta, per presentar al·legacions. En el cas de no fer ús del seu dret per al·legar, en el termini indicat, o si manifesta la seva decisió de no efectuar al·legacions ni aportar nous documents o justificacions, aquesta proposta tindrà caràcter definitiu, i s'elevarà al vicepresident del FOGAIBA per a què dicti la Resolució de concessió de l'ajuda que li correspon.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
