    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PROJECTE CONVOCATÒRIA AJUDES PER A LA PREVENCIÓ D'INCENDIS PER ACTUACIONS REALITZADES L'ANY 2024 (EXP. 553/2025)&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. OBJECTE, FINALITAT I ÀMBIT D'APLICACIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'objectiu d'aquesta convocatòria és donar suport econòmic a les actuacions, les iniciatives i els projectes de les societats i associacions que gestionin vedats de caça del municipi de Sant Josep de sa Talaia i les Associacions de propietaris de terrenys forestals o rústics que tinguin com a objectiu la preservació de l'entorn, la conservació del paisatge i la prevenció dels incendis forestals dels terrenys que gestionin en el municipi de Sant Josep de sa Talaia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Llei de Bases de Règim Local (Llei 7/85) estableix en el seu article 25 que és competència dels municipis la prevenció i extinció d'incendis. En aquest sentit, el Decret 125/2007 d'incendis forestals de les Illes Balears defineix com actuacions de prevenció d'incendis forestals totes aquelles activitats dirigides a evitar l'inici de l'incendi forestal cal crear les condicions per a minimitzar la propagació i limitar a màxim als efectes perjudicials que puguin ocasionar a persones, béns, patrimoni rural i medi ambient en general.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Així mateix, la Llei de Forests (Llei 43/2003) estableix en el seu article 43 que correspon a les administracions públiques competents la responsabilitat de l'organització de la defensa contra incendis forestals i que han d'adoptar, de manera coordinada, mesures que condueixin a la prevenció, detecció i extinció dels incendis, independentment de la titularitat de les muntanyes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'altra banda, la Llei de Patrimoni Natural i Biodiversitat (Llei 42/2007) estableix, en el seu article 5, que les administracions públiques han de promoure la participació i les activitats que contribueixin a assolir els objectius de la llei, entre els quals s'inclou la gestió sostenible dels recursos naturals, la preservació de la varietat, singularitat i bellesa dels ecosistemes naturals i del paisatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el mateix sentit, l'Estatut d'Autonomia de les Illes Balears estableix en el seu article 23 que els poders públics han de vetllar per la defensa i la protecció de la naturalesa, del territori, del medi ambient i del paisatge i establiran polítiques de gestió, ordenació i millora de la seva qualitat harmonitzant-les amb les transformacions que es produeixen per l'evolució social, econòmica i ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Així doncs, el marc normatiu actual estableix de forma clara la responsabilitat de les administracions locals per dur a terme actuacions de prevenció dels incendis forestals i de forma més general la responsabilitat per prendre mesures de gestió sostenible dels recursos naturals i de protecció del paisatge .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El desenvolupament rural (mitjançant la conservació de cultius i neteja de masses forestals) és un element clau en el manteniment del paisatge i en la prevenció dels incendis forestals, i cal destacar que gran part dels terrenys forestals i rurals del municipi de Sant Josep de sa Talaia es troben inclosos en vedats de caça gestionats per societats de caçadors i associacions de veïns o estan inclosos en associacions de propietaris de terrenys forestals o rurals. Aquestes entitats duen a terme actuacions de manteniment de cultius, recuperació d'espais agrícoles degradats que d'altra banda seguirien en estat d'abandonament, neteja de boscos, així com actuacions de millora i protecció de l'entorn on realitzen la seva activitat, afavorint així la conservació del medi ambient, la recuperació d'usos tradicionals i col·laborant en la prevenció d'incendis forestals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De la mateixa manera, el pla Especial de protecció civil d'Emergències per Incendis Forestals de les Illes Balears (INFOBAL), aprovat mitjançant Decret 9/2023 (BOIB 26 de 2023), estableix en el seu punt 11 i a l'Annex 6 la necessitat d'elaboració i execució de plans d'autoprotecció per risc d'incendis forestals per aquelles urbanitzacions i residencials que es trobin en interfície urbano-forestal. Aquesta obligació es troba reforçada pel que determina l'apartat 3.6 del Real decret 893/2013 de Directriu bàsica de planificació de protecció civil d'emergència per incendis forestals (BOE 293 de 2013), així com l'article 77 de la Llei 3/2019, Agrària de les Illes Balears (BOIB 18 de 9 de febrer de 2019). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Regidoria de Medi Ambient de l'Ajuntament de Sant Josep de sa Talaia pretén impulsar les actuacions que permetin la preservació del paisatge i del patrimoni natural del municipi, alhora que es fomenten les actuacions orientades a la prevenció dels incendis forestals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. RÈGIM JURÍDIC&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.1. La present convocatòria se sotmet a la Llei 38/2003, de 17 de novembre, general de subvencions, el Reial Decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions, a l'Ordenança general de les bases reguladores de les subvencions que concedeix l'Ajuntament de Sant Josep de sa Talaia (BOIB núm. 66 de 30 de maig de 2017) i en el Pla estratègic de subvencions de l'Ajuntament de Sant Josep de sa Talaia per els anys 2024-2026 (BOIB núm. 36, de 14 de març de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquesta convocatòria s'exposarà al tauler d'anuncis de la seu electrònica de l'Ajuntament i es publicarà a la BDNS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. CONSIGNACIÓ PRESSUPOSTÀRIA I QUANTIA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquesta convocatòria està dotada amb un màxim de 25.000,00€ a càrrec del pressupost municipal de 2025 (partida 136-48022). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. REQUISITS GENERALS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Podran acollir-se a aquesta convocatòria aquelles societats de caçadors, comunitats de propietaris d'urbanitzacions o residencials, associacions de veïns que gestionin vedats de caça al municipi de Sant Josep de sa Talaia i les associacions d'agricultors o de propietaris de terrenys forestals o rústics, i que compleixin els següents requisits:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Gestionar terrenys del municipi de Sant Josep de sa Talaia o representar comunitats de propietaris d'urbanitzacions o residencials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Tenir personalitat jurídica i estar legalment constituïda&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Tenir caràcter no lucratiu&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Trobar-se el beneficiari al corrent de les obligacions tributàries, amb la seguretat social i amb el mateix Ajuntament de Sant Josep.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) No trobar-se el beneficiari incurs en cap de les causes d'incompatibilitat i complir els requisits que fixa l'article 13 de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) Acreditació del compliment d'obligacions per reintegrament de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;g) Estar inscrit en el Registre d'Associacions de l'Ajuntament (si s'escau).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. ACTIVITATS SUBVENCIONABLES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Només es consideraran &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;activitats&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; subvencionables aquelles que es realitzin en el municipi de Sant Josep de sa Talaia, que es puguin justificar amb factures i &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;que hagin estat realitzades i pagades entre l'1 de gener i el 31 de desembre de l'any 2024&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Les activitats objecte de la subvenció són les següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Sembra i recuperació de cultius: Sembres o recuperacions de cultius de parcel·les identificades cadastralment dins el municipi de Sant Josep de sa Talaia. S'inclouen en aquest apartat les despeses de personal, maquinària, tractament de residus, compra de llavors o altres productes complementaris i altres despeses relacionades. Amb la sol·licitud es lliurarà la següent documentació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;i. La relació de parcel·les identificades cadastralment&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;ii. Plànol d'ubicació de les mateixes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Prevenció d'incendis forestals: Seran subvencionables les actuacions de prevenció d'incendis forestals com ara l'execució o manteniment de faixes contra-incendis, dipòsits contra-incendis (per a mitjans d'extinció aeris i terrestres), activitats i materials de difusió/educació i actuacions similars, realitzades sempre d'acord amb les instruccions i permisos corresponents per part de les administracions públiques. S'inclouen en aquest apartat les despeses de personal, obres, maquinària i altres despeses relacionades. Amb la sol·licitud es lliurarà la següent documentació (si s'escau):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;i. Plànol que assenyali les parcel·les o camins on s'ha realitzat l'actuació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;ii. Imatge dels materials per als quals es demana la subvenció (dipòsit contra-incendis, materials de difusió, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Redacció de plans d'autoprotecció d'incendis forestals: Redacció, per part d'un expert, del pla d'autoprotecció d'incendis forestals de la urbanització o residencial o agrupació d'habitatges. Amb la sol·licitud es lliurarà la següent documentació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;i. Còpia del registre d'entrada del pla d'autoprotecció a la Direcció General d'Emergències del Govern de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;ii. Còpia del projecte d'autoprotecció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Totes les activitats per a les quals se sol·liciti la subvenció han de disposar dels corresponents permisos, autoritzacions i / o llicències necessàries per a la seva realització.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. RÈGIM DE LES AJUDES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.1. La concessió de la subvenció es durà a terme mitjançant el règim de concurrència competitiva. Només podran obtenir subvenció aquells sol·licitants que reuneixin els requisits exigits en aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;6.2. &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;S'estableix com a únic mitjà de notificació de tots els actes de tràmit del present procediment, el tauler d'anuncis de la seu electrònica de l'Ajuntament (www.santjosep.org).&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.3. Esmenes de defectes de les sol·licituds&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si la sol·licitud no compleix els requisits establerts a la normativa de la convocatòria, l'òrgan instructor ha de requerir, segons estableix la base 6.2, a l'entitat interessada que l'esmeni en el termini màxim i improrrogable de 10 dies i li ha d'indicar que, si no ho fa, es considerarà que ha desistit de la sol·licitud, amb la resolució prèvia que s'ha de dictar en els termes que preveu l'art. 68 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Un cop passat el termini per a l'esmena de documentació o presentació d'al·legacions i un cop resoltes aquestes per l'òrgan col·legiat, l'òrgan instructor publicarà la llista provisional d'admesos i exclosos per a participar en el procediment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vegada passat el termini per a l'esmena de documentació o presentació d'al·legacions a la publicació de la llista provisional, i una vegada resoltes per l'òrgan col·legiat, l'òrgan instructor publicarà la llista definitiva de concessió de l'ajuda, i en cas de no haver al·legacions a la llista provisional s'entendrà elevada a definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.4. Només podran obtenir subvenció aquells sol·licitants que, reunint els requisits exigits, compleixin les condicions assenyalades a la base 4.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.5. Els ajuts objecte d'aquesta convocatòria són compatibles amb altres ajuts per part de qualsevol altre organisme, administració o institució pública o privada. La suma total dels ajuts percebuts per a la mateixa activitat no podrà ser, en cap cas, superior al cost total de l'activitat subvencionada. El beneficiari està obligat a comunicar a l'Ajuntament l'obtenció d'altres subvencions o ajudes per a la mateixa finalitat, procedents de qualsevol administració o ens públic, nacional o internacional, així com de tota entitat o institució privada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.6. Les ajudes no podran ser superiors a les despeses originades per l'activitat objecte d'aquesta convocatòria, sense perjudici de les limitacions pressupostàries. Si el total d'ajuts a concedir superés la consignació pressupostària d'aquesta línia de subvencions, aquestes es distribuiran de forma proporcional, garantint un mínim per a tots els sol·licitants amb actuacions subvencionables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquestes subvencions no generen cap dret a l'obtenció d'altres ajuts en exercicis posteriors i, per tant, tampoc es poden al·legar com a precedent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. SOL·LICITUD, DOCUMENTACIÓ I TERMINI DE PRESENTACIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;7.1. Les sol·licituds de subvenció es formalitzaran mitjançant el model normalitzat que es pot trobar a la pàgina web de l'Ajuntament. Les instàncies s'han de registrar a la seu electrònica de l'Ajuntament de Sant Josep de sa Talaia o en la forma establerta en l'art. 16 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. En aquest cas s'haurà de passar avís per correu electrònic a l'adreça: mediambient@santjosep.org.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.2. Els sol·licitants, juntament amb el model de sol·licitud han de presentar la següent documentació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;a)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Còpia del CIF / NIF de l'entitat sol·licitant i còpia del DNI / NIF del representant de l'entitat (en cas de no haver estat presentades en convocatòries anteriors).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;b)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Còpia dels Estatuts de l'entitat (en cas de no haver estat presentada en convocatòries anteriors).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;c)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Compte justificatiu, el qual haurà que contenir una memòria d'actuació i una memòria econòmica amb el detall previst a l'article 72 del RLGS i amb la informació requerida al punt 5 de la present convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;d)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Factures que justifiquin les despeses realitzades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;e)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Justificant de pagament de les factures (certificat de l'empresa proveïdora, extracte bancari).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;f)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Model de sol·licitud de transferència bancària per a pagaments de l'Ajuntament de Sant Josep de sa Talaia, disponible a les oficines municipals o bé certificat de titularitat bancària. (En cas de no haver estat presentat amb anterioritat).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;g)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Declaració responsable, de no trobar-se en cap de les causes d'incompatibilitat i complir els requisits que fixa l'article 13 de la Llei 38/2003, de 17 de novembre, general de subvencions (veure &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;annex II&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;h&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;) Declaració responsable del compliment de obligacions per reintegrament de subvencions (&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;annex II).&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;i)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Declaració de les subvencions rebudes o sol·licitades per a la mateixa finalitat i compromís de comunicar a l'entitat local, les que s'obtinguin en el futur (&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;annex III&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;j)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Declaració responsable de trobar-se al corrent de les obligacions tributaries, amb la Seguretat Social i amb el mateix Ajuntament de Sant Josep i autorització a l'Ajuntament per sol·licitar a la Agència Tributària i a la Seguretat Social les dades fiscals del sol·licitant, que siguin necessàries (&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;annex IV&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;k)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Declaració responsable sobre la situació relativa al IVA del sol·licitant (&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;annex V&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si els documents exigits en la sol·licitud ja s'haguessin presentat a l'Ajuntament en una altra ocasió, la persona sol·licitant podrà acollir-se al que estableix l'article 53.d) de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, sempre que es faci constar la data i l'òrgan o dependència on es presentaren o emesos. La presentació de la sol·licitud suposa l'acceptació, per part de la persona interessada, de les prescripcions contingudes en la convocatòria corresponent. L'Ajuntament de Sant Josep de sa Talaia, en qualsevol moment, pot sol·licitar als interessats la documentació i la informació complementària que consideri necessària per resoldre l'expedient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.3. Termini de presentació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;El termini de presentació de sol·licituds serà de 15 dies comptats a partir del dia següent a la publicació de l'extracte de la convocatòria en el BOIB.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. QUANTIA DE LES AJUDES I CRITERIS DE VALORACIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8.1. Quantia de les ajudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La quantia de les subvencions podrà ser del 100% del cost de l'activitat, sempre que l'import de l'ajut, aïlladament o en concurrència amb altres subvencions o ajudes, no superi el cost de l'activitat per a la qual se sol·licita la subvenció. En cap cas serà subvencionable el pagament d'impostos, taxes o tributs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En qualsevol cas, l'import màxim de la subvenció per a cada entitat serà de 15.000,00€. Específicament, l'ajuda màxima per a la redacció del projectes d'autoprotecció (d'acord amb l'apartat 5) serà de 4.000,00 €, tot i&amp;nbsp;que serà compatible amb altres activitats fins l'import màxim de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cas que les sol·licituds formulades que compleixin els requisits superin la quantitat disponible, es distribuirà el fons de manera proporcional a la puntuació obtinguda segons els criteris de valoració establerts en aquestes bases, garantint un mínim per a tots els sol·licitants amb actuacions subvencionables. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8.2) Criteris de valoració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els criteris per a la valoració de les sol·licituds serà el següent (màxim de 60 punts):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Sembres i recuperació de cultius: 10 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Prevenció d'incendis forestals: 20 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Redacció de projectes d'autoprotecció: 30 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. ÒRGAN COL·LEGIAT&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.1. L'òrgan col·legiat realitzarà la valoració tècnica de les sol·licituds, a partir d'un informe del tècnic de l'Àrea de Medi Ambient, i elevarà l'informe a l'òrgan instructor, el qual formularà proposta de resolució, que, quan sigui definitiva, elevarà a l'òrgan resolutori per a les oportunes concessions de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.2. Estarà format pels següents membres:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Presidència: la regidora de Medi Ambient o persona en qui delegui.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vocals: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Un/a tècnic/a del Departament de Medi Ambient o d'altre departament de l'Àrea de Ciutadania. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Un/a tècnic/a del Departament de Platges o del Departament de Benestar Animal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Un membre del personal administratiu del Departament de Medi Ambient &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Secretari/ària: la de la corporació o persona en qui delegui.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'òrgan col·legiat té atribuïdes les següents funcions: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Analitzar i valorar les sol·licituds d'acord amb els requisits establerts a la base 4 i dels criteris establerts al punt 9.1. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Resoldre qualsevol dubte que es presenti en la interpretació i aplicació d'aquesta convocatòria.&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

INSTRUCCIÓ I RESOLUCIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10.1 L'òrgan instructor del procediment serà personal administratiu del Departament de Medi Ambient, que té atribuïdes les funcions establertes a l'article 24 de la Llei general de subvencions i l'article 12 de l'Ordenança general de les bases reguladores de les subvencions que concedeix l'Ajuntament de Sant Josep. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'òrgan instructor, a la vista de l'expedient i l'informe de l'òrgan col·legiat, formularà la proposta de resolució provisional degudament motivada, que haurà de notificar-se a les persones interessades concedint-los un termini de 10 dies, comptats a partir del dia següent de la publicació de la proposta, per presentar al·legacions i, si escau, requerir-los perquè presentin la documentació que acrediti la realitat de les dades afirmades en la declaració. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10.2 Finalitzat aquest termini i examinades les al·legacions que, si és el cas, haguessin presentat els interessats, l'òrgan instructor, amb l'informe previ de l'òrgan col·legiat, formularà la proposta de resolució definitiva, que haurà d'expressar la relació de persones sol·licitants per a les quals es proposa la concessió de l'ajuda. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La proposta de resolució definitiva s'elevarà a l'òrgan competent per resoldre, que dictarà resolució definitiva amb la llista dels sol·licitants que hagin obtengut ajudes i la quantia de les ajudes concedides, la qual es notificarà de conformitat amb el que exposa la base 6.2. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10.3 La resolució de concessió, d'acord amb l'article 14a de l'Ordenança general de les bases reguladores de les subvencions que concedeix l'Ajuntament de Sant Josep, haurà de contenir la relació de persones beneficiàries a les quals s'atorga l'ajuda, amb les quanties individualitzades, així com la desestimació i la no concessió, per desistiment, renúncia al dret o impossibilitat material sobrevenguda de les sol·licituds no ateses. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La resolució inclourà el requeriment de la justificació de les mesures de publicitat establertes al punt 11 de les presents bases, sense les quals no es podrà efectuar el pagament de l'ajuda, d'acord amb el punt 13 d'aquestes bases&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La resolució serà pública de conformitat amb el que preveu l'article 18.2 de la Llei 38/2003 general de subvencions i l'article 17 de l'Ordenança general de les bases reguladores de les subvencions que concedeix l'Ajuntament de Sant Josep.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El termini màxim per a la resolució i notificació del procediment és de 6 mesos des de la data de finalització del termini per a presentació de les sol·licituds a què es refereix aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11. PUBLICITAT DELS PROJECTES SUBVENCIONATS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cada entitat beneficiària d'una subvenció reflectirà, en les activitats que realitzi, la col·laboració de la corporació i s'expressarà que ha estat subvencionada per l'Ajuntament de Sant Josep de sa Talaia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La persona o entitat beneficiària haurà de donar adequada publicitat al caràcter públic del finançament del programa, activitat, inversió o actuació objecte de subvenció. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les mesures de difusió poden consistir en la inclusió de la imatge institucional de l'entitat concedent, així com en llegendes relatives al finançament públic en cartells, plaques commemoratives, materials impresos, mitjans electrònics o audiovisuals, o bé, en mencions realitzades en mitjans de comunicació o altres que resultin adequades a l'objecte subvencionat i d'eficàcia equivalent a les esmentades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12. FACTURA JUSTIFICATIVA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12.1. Les factures hauran de ser emeses a nom de l'entitat que sol·licita la subvenció i amb anterioritat a la finalització del termini de sol·licitud de la subvenció que estableix el punt 7.3 de la present convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12.2. S'haurà d'acreditar el pagament de la factura justificativa amb anterioritat a la finalització del període de sol·licitud de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12.3. L'acreditació de l'abonament de la despesa del projecte es durà a terme a través de la documentació que a continuació s'indica, depenent dels mitjans de pagament que s'hagin utilitzat:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Pagament en efectiu: factura, signada i segellada pel proveïdor, en la qual s'especificarà la despesa a la qual correspon el pagament, la data i l'expressió «rebut en metàl·lic», «pagat en metàl·lic», «pagat» o similar. Sota la signatura ha de figurar el nom, cognoms i número de document d'identitat de la persona que signa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Pagament amb targeta de crèdit:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tiquet de compra en el qual figuri el pagament amb targeta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tiquet de compra i resguard del pagament amb targeta en cas que no figuri en el tiquet de compra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Extracte del compte en què figuri el càrrec de pagament amb targeta. L'extracte del compte pot substituir per un certificat o títol similar de l'entitat bancària en la qual, com a mínim, hi consti el titular i el número de compte corrent en què es carrega el pagament de la targeta, la persona beneficiària, el concepte pel qual es fa la transferència i l'import i la data de l'operació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Pagament mitjançant transferència bancària o ingressos en un compte bancari:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Còpia del justificant de l'ordre de transferència bancària o del document bancari acreditatiu del pagament en què figuren el concepte de la transferència o l'ingrés, la data del document, l'import, la identificació del concepte, a fi que quedi identificat el pagament de la factura, i les dades de l'ordenant i del destinatari, que han de coincidir amb la persona beneficiària i amb l'emissor de la factura, respectivament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Extracte del compte bancari de la persona beneficiària de l'ajuda en el qual figuri el càrrec d'aquesta transferència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d. Pagament mitjançant xec nominatiu:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Còpia del xec nominatiu o pagaré nominatiu emès a nom del proveïdor que expedeix la factura o document equivalent, sempre que estigui vençut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Extracte del compte corrent de la persona beneficiària de l'ajuda en el qual figuri el càrrec d'aquest xec o pagaré.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e. Pagament mitjançant pagarés, lletres de canvi o similars:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. PAGAMENT DE L'AJUDA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El pagament de la subvenció aprovada només es podrà fer efectiu una vegada dictada la resolució corresponent i una vegada justificada la publicitat de la subvenció, d'acord amb l'article 11 de la present convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14. RÈGIM DE RECURSOS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la resolució que recaigui en aquest procediment, la qual posarà fi a la via administrativa, es podran interposar, alternativament, els recursos següents: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— El recurs potestatiu de reposició davant l'òrgan que dictarà la resolució, en el termini d'un mes, comptador a partir del dia següent de la notificació d'aquesta resolució. Contra la desestimació expressa del recurs de reposició, es podrà interposar el recurs contenciós administratiu, en el termini de dos mesos, comptadors a partir del dia següent de la notificació de la desestimació del recurs de reposició. Contra la desestimació per silenci del recurs de reposició, es podrà interposar el recurs contenciós administratiu, en el termini de sis mesos, comptadors a partir del dia següent a la desestimació presumpta. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— O, directament, el recurs contenciós administratiu davant la jurisdicció contenciosa administrativa, en el termini de dos mesos, comptadors a partir del dia següent de la notificació de l'acord. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
