En el BOIB núm. 174, de 26 de desembre de 2023, es va publicar la Resolució del conseller d'Empresa, Ocupació i Energia de 22 de desembre de 2023 </span>per la qual s'aprova, mitjançant el procediment de despesa anticipada, la convocatòria pública de subvencions per a l'any 2024 per al foment d'instal·lacions d'energia solar fotovoltaica i microeòlica adreçada a persones físiques dins el Programa FEDER 2021-2027.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En el BOIB núm. 6, de 11 de gener de 2025, es va publicar la Resolució del conseller d'Empresa, Ocupació i Energia de 9 de gener de 2025, per la qual es revoquen les subvencions en el marc de la convocatòria pública de subvencions per al foment d'instal·lacions d'energia solar fotovoltaica i microeòlica adreçada a persones físiques i comunitats de propietaris dins el Programa Operatiu FEDER 2021-2027 (FOTOPAR2024). La causa de la revocació va ser no haver presentat, en el termini establert, la justificació requerida pel pagament de la subvenció aprovada.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Tant a <span style="color:black">l'encapçalament com al punt 1 de la part dispositiva de la Resolució esmentada en el fet anterior, es diu erròniament que </span>les subvencions per al foment d'instal·lacions d'energia solar fotovoltaica i microeòlica estan adreçades a persones físiques i comunitats de propietaris dins el Programa Operatiu FEDER 2021-2027 quan, d'acord amb la convocatòria, només estan adreçades a les persones físiques. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Al fet 1 de la mateixa Resolució es diu que la Resolució</span><strong><em> </em></strong>del conseller d'Empresa, Ocupació i Energia per la qual s'aprova, mitjançant el procediment de despesa anticipada, la convocatòria pública de subvencions per a l'any 2024 per al foment d'instal·lacions d'energia solar fotovoltaica i microeòlica adreçada a persones físiques dins el Programa FEDER 2021-2027, es va publicar en el BOIB núm. 164 quan es va fer en el BOIB núm. 174 i, al fonament de dret 5, es diu que es va publicar en el BOIB núm. 174, de 26 de desembre de 2022, quan es va fer en el de 26 de desembre de 2023.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Per últim, a</span> <span style="color:black">l'annex «Llista</span><strong> </strong><span style="color:black">de beneficiaris als quals se'ls revoca la subvenci</span><span style="color:black">ó per no justificar</span><span style="color:black">» de la mateixa </span><span style="color:black">Resolució, es varen incloure erròniament persones beneficiàries que sí havien presentat la justificació requerida dins el termini establert, per la qual cosa procedeix rectificar</span> <span style="color:black">aquest annex per tal d'excloure de la llista a aquestes persones. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonaments de dret</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. L'article 109.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix que les administracions públiques poden rectificar en qualsevol moment, d'ofici o a instància dels interessats, els errors materials, de fet o aritmètics existents en els seus actes.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. L'article 56 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, disposa que la rectificació dels errors materials, aritmètics i de fet en actes i disposicions administratives correspon a l'òrgan que ha dictat l'acte o la disposició. Així mateix, la rectificació d'errors ha d'especificar, si escau, els efectes jurídics que se'n deriven i s'ha de notificar o publicar preceptivament quan faci referència a actes que han estat notificats o publicats.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per tot això, dict la següent</span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolució</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1.
