En data de 21 de desembre de 2021 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 174, la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, mitjançant el procediment anticipat de despesa, subvencions per a inversions a les explotacions agràries per l'any 2021.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="display:inline-block"><span style="color:#000000">2. El 12 d'abril de 2024, el<em> </em> vicepresident en matèria agrària del FOGAIBA<em> </em>va dictar una Resolució de concessió d'ajudes per a inversions a les explotacions agràries, que es va publicar al <em>Butlletí Oficial de les Illes Balears</em> número 52, del 20 d'abril de 2024, en la qual hi figurava una concessió a favor dels interessats assenyalats a l'annex adjunt.</span></span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. El 17<span style="color:#000000"> </span>d'octubre de 2024, amb registre d'entrada núm. </span><span style="color:#000000">GOIBE</span><span style="color:#000000">678628</span><span style="color:#000000">, l'interessat RAIMON TORRES KORKEAMAKI </span><span style="color:#000000"> </span><span style="color:#000000">amb </span><span style="display:inline-block"><span style="color:#000000">NIF ***5148**, </span></span><span style="color:#000000">va presentar el seu desistiment, la qual cosa suposa dur a terme la revocació total de l'ajuda concedida.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4. </span>L'article 21.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la.En el seu paràgraf segon especifica que «En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables»</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. L'article 43 del Text refós de la Llei de subvencions, aprovat per decret legislatiu 2/2005, de 28 de desembre, disposa que «Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament».</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.
