Els interessats assenyalats en l'Annex I de la present Resolució varen presentar el desistiment de la sol·licitud de l'ajuda.&nbsp;</span></span></span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Fonaments de dret</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000">1. Acord pel qual s'aproven les Bases de la convocatòria, per a l'any 2024, d'ajudes al desenvolupament rural de l'illa de Mallorca, vinculades a projectes relacionats amb els àmbits agrari i/o ambiental i emmarcats en l'Estratègia de Desenvolupament Local Participatiu 2014-2020 de Mallorca</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000">2. Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000">3. Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les Administracions Públiques.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000">- L'article 21.1 de la Llei abans esmentada, estableix que «l'Administració està obligada a dictar una resolució expressa i notificar-la en tots els procediments sigui quina sigui la seva forma d'iniciació. En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com de desaparició sobrevinguda de l'objecte del procediment, la resolució consisteix en la declaració de la circumstància que concorri en cada cas, amb indicació dels fets produïts i les normes aplicables. S'exceptuen de l'obligació a què es refereix el paràgraf primer els supòsits de terminació del procediment per pacte o conveni, així com els procediments relatius a l'exercici de drets sotmesos únicament al deure de declaració responsable o comunicació a l'Administració».</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000">- Per altra banda, l'article 94.1 de la mateixa Llei determina que: «tot interessat podrà desistir de la seva sol·licitud o, quan això no estigui prohibit per l'ordenament jurídic, renunciar als seus drets».
