En data 8 de febrer de 2025 es va publicar en el BOIB núm. 18 la Resolució de la consellera de Presidència i Administracions públiques per la qual es va constituir la borsa preferent de personal funcionari interí del cos facultatiu superior, escala d'enginyeria, especialitat enginyeria industrial per a l'illa de Mallorca de l'Administració especial de la Comunitat Autònoma de les Illes Balears, corresponent al procés d'estabilització per concurs oposició convocat per la Resolució de 16 de setembre de 2022 (BOIB núm. 122, de 17 de setembre).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. S'ha advertit un error aritmètic en la composició de la borsa preferent esmentada en el punt anterior, en relació a la suma de les puntuacions obtingudes en la fase d'oposició i la puntuació obtinguda en la llista definitiva dels mèrits referits en el punt<span style="color:#000000"> </span>2 de la base 21 de l'annex 2 de la convocatòria procés d'estabilització per concurs oposició convocat per la Resolució de 16 de setembre de 2022 publicada el 5 de febrer de 2025. Aquest error afecta l'ordre de prelació de la borsa, per la qual cosa s'ha de corregir.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonaments de dret</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. L'article 109.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix que aquestes poden rectificar en qualsevol moment, d'ofici o a instància de les persones interessades, els errors materials, de fet o aritmètics que hi hagi en els seus actes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. D'altra banda, l'article 56 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, disposa que la rectificació dels errors materials, aritmètics i de fet en actes i disposicions administratius correspon a l'òrgan que hagi dictat l'acte o la disposició.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Decret 12/2023, de 10 de juliol, de la presidenta de les Illes Balears i posteriors modificacions, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per tot això, dict la següent</span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolució</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Rectificar en els termes que estableix l'annex d'aquesta Resolució l'error aritmètic advertit en la suma de les <span style="color:#000000">puntuacions obtingudes en la fase d'oposició i la puntuació obtinguda en la llista definitiva dels mèrits publicada el 5 de febrer de 2025, i en conseqüència publicar l'ordre de prelació de la borsa preferent de personal funcionari interí del cos facultatiu superior, escala d'enginyeria, especialitat enginyeria industrial per a l'illa de Mallorca de l'Administració especial de la Comunitat Autònoma de les Illes Balears, corresponent al procés d'estabilització per concurs oposició convocat per la Resolució de 16 de setembre de 2022.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Publicar aquesta Resolució en el <em>Butlletí Oficial de les Illes Balears,</em> a la Seu Electrònica de la CAIB (www.caib.es) i en el Portal de l'Opositor (http://oposicions.caib.es).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposició de recursos</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra aquesta Resolució, que posa fi a la via administrativa, es pot interposar un recurs potestatiu de reposició davant la consellera de Presidència i Administracions Públiques en el termini d'un mes, comptador des de l'endemà de la publicació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
