CAIB 2025-02-18 ca ![CDATA[<p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: black">El conseller executiu d&apos;Hisenda i Funció Pública del Consell Insular de Mallorca, en data 10 de febrer de 2025, ha adoptat la següent Resolució:</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: black">“Atès que per resolució del conseller executiu d&apos;Hisenda i Funció Pública de 13 de maig de 2024 es varen aprovar les bases i la convocatòria del procés de promoció interna de l&apos;àrea operativa del Servei de Bombers del Consell de Mallorca, pel sistema de concurs oposició, de les categories de bomber –a conductor –a i caporal –a, derivat del procés de reclassificació (BOIB núm. 64, de 16 de maig de 2024).</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: black">El punt 9 d&apos;aquestes bases estableix que:</span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: black"><em>9.1. D&apos;acord amb l&apos;article 41.8 del Decret 33/1994, de 28 de març, pel qual s&apos;aprova el Reglament de proveïment de llocs de treball i promoció professional dels funcionaris al servei de l&apos;Administració de la Comunitat autònoma de les Illes Balears, en relació amb l&apos;article 22.1 de la Llei 30/1984, de 2 d&apos;agost, de mesures per a la reforma de la Funció Pública i amb el TREBEP, les persones que superin el procés de promoció interna es mantindran en el mateix lloc de treball al subgrup immediatament superior (C1). </em></span></span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: black"><em>9.2. Els nomenaments del personal funcionari es publiquen en el Butlletí Oficial de les Illes Balears (BOIB). Un cop publicat el nomenament, les persones disposen d&apos;un termini de tres dies hàbils per al jurament o promesa i per a la presa de possessió. En els casos en què la persona seleccionada així ho sol·licita i, a més, ho justifica degudament, el conseller o la consellera competent en matèria de funció pública del Consell de Mallorca pot concedir una pròrroga del termini possessori</em>.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: black">Vista la resolució del conseller executiu d&apos;Hisenda i Funció Pública de data 8 de gener de 2024, mitjançant la qual s&apos;aprova la llista de les persones seleccionades per promocionar del subgrup C2 al subgrup C1 del procés de promoció interna de l&apos;àrea operativa del Servei de Bombers del Consell de Mallorca, pel sistema de concurs oposició, de les categories de bomber –a conductor –a i caporal-a (BOIB núm. 6 d&apos;11 de gener de 2025).</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: black">Per tot això, en virtut de les atribucions que m&apos;han estat conferides</span></span></span></p> <p style="text-align: center"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="color: black">RESOLC</span></strong></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: black"><strong>Primer.- </strong>Integrar dins el subgrup C1 el personal del Servei de Bombers de Mallorca, que pertany a les categories de caporal –a de bombers i bomber –a conductor –a que han superat el procediment selectiu convocat a l&apos;efecte i que figuren a l&apos;annex d&apos;aquesta resolució, els quals mantindran l&apos;adscripció actual al lloc de treball.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: black"><strong>Segon.- </strong>Ordenar<strong> </strong>la publicació de la present Resolució en el Butlletí Oficial de les Illes Balears, als efectes oportuns. Les persones que&nbsp; han superat aquest procediment selectiu disposaran d&apos;un termini de 3 dies hàbils, comptat a partir del dia següent a la publicació, per al jurament o promesa i la presa de possessió.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: black"><strong>Tercer.-</strong> La integració dins el subgrup C1del personal que figura a l&apos;annex d&apos;aquesta resolució es durà a terme amb resolucions individualitzades del conseller executiu d&apos;Hisenda i Funció Pública una vegada fiscalitzada de conformitat per la Intervenció General aquesta proposta de Resolució.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: black"><strong>Interposició de recursos</strong></span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: black">Contra aquesta resolució, que no posa fi a la via administrativa, podeu interposar el recurs d&apos;alçada davant la Comissió de Govern del Consell Insular de Mallorca, en el termini d&apos;un mes, comptador a partir de l&apos;endemà de la seva publicació.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: black">Contra la desestimació expressa d&apos;aquest recurs d&apos;alçada podeu interposar el recurs contenciós administratiu davant el Jutjat contenciós Administratiu de Palma que correspongui en el termini de dos mesos, comptadors a partir de l&apos;endemà de rebre la notificació de la desestimació del dit recurs d&apos;alçada.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: black">Si han transcorregut tres mesos des de la interposició del recurs d&apos;alçada i no n&apos;heu rebut la notificació de resolució expressa, s&apos;entén desestimat per silenci i podeu interposar el recurs contenciós administratiu davant el Jutjat contenciós Administratiu de Palma que correspongui, sense limitació de temps.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: black">No obstant l&apos;anterior, podeu interposar, si escau, qualsevol altre recurs que considereu oportú.
