    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El Pla Estratègic de Subvencions (PES) del Pressupost general del Consell Insular de Menorca per a l'exercici 2025 propugna com a eix general engegar nous programes d'atenció, prestació i gestió dels serveis públics, especialment pel que fa a la sensibilització, comprensió i coneixement de les necessitats dels col·lectius més vulnerables, reforçant la protecció social. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;A més, pel que fa a les línies de subvenció o altres ajuts de caràcter assistencial corresponents al Departament de Benestar Social, entre els objectius generals hi consta establir premis i reconeixements per part del CIM a l'àmbit de l'acció social, amb la finalitat de fer valdre les bones iniciatives socials que es desenvolupen a l'illa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El PES per a l'exercici 2025 preveu la convocatòria per a la concessió de premis i reconeixement en l'àmbit de l'acció social, amb l'objectiu específic de premiar els projectes que promoguin l'acció social i la generació de valor públic per afrontar les necessitats i reptes socials, que siguin capaços d'activar processos d'apoderament de la ciutadania per a la construcció d'una societat més justa i inclusiva a l'illa de Menorca. Per això, en e&lt;/span&gt;&lt;span style="color:#111111"&gt;l pressupost del CIM per a l'exercici 2025, aprovat inicialment pel Ple de dia 20 de desembre de 2024,&lt;/span&gt;&lt;span style="color:#000000"&gt; el Departament de Benestar Social (3) preveu una partida específica, corresponent al programa de l'àrea de gestió administrativa departamental (23100) per complir aquests objectius de 4.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;S'ha revisat l'expedient i s'han vist els informes d'oportunitat de la directora insular de Gent Gran, Dependència i Diversitat Funcional i de legalitat de la tècnica assessora jurídica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Ateses les competències pròpies o concurrents que sobre aquestes matèries té el Consell Insular de Menorca i de conformitat amb la normativa bàsica aplicable en matèria de subvencions, en el marc del que estableixen les bases d'execució del pressupost general d'aquesta administració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Atesa la proposta de la consellera executiva del Departament de Benestar Social;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El Consell Executiu, per unanimitat i en votació ordinària, adopta els acords següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primer.&lt;/strong&gt; Aprovar les bases i, simultàniament, la convocatòria del concurs de curtmetratge i salut mental 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. Objecte i finalitat del premi&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;L'objecte d'aquesta convocatòria és mostrar la realitat de les persones amb problemes de salut mental, contribuir en la promoció i defensa dels seus drets, sensibilitzar contra l'estigma que les envolta i generar una visió més realista i positiva, allunyada d'estereotips i prejudicis, així com mostrar experiències positives en el tractament de la cura de la salut mental i actituds socials que contribueixin a millorar la qualitat de vida d'aquest col·lectiu. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La finalitat dels premis és promoure l'acció social i la generació de valor públic per afrontar les necessitats i els reptes socials, que siguin capaços d'activar processos d'apoderament de la ciutadania per a la construcció d'una societat més justa i inclusiva a l'illa de Menorca. En aquest sentit, amb els premis esmentats es dona compliment al Pla Estratègic de Subvencions (PES) del Consell Insular de Menorca per a l'any 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. Finançament&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Poden ser beneficiaris d'aquests premis els centres educatius que presentin curtmetratges elaborats per estudiants de tercer i quart de secundària (ESO), de primer i segon de batxillerat de Menorca, formació professional bàsica i cicles formatius de grau mitjà.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Només s'admet un curtmetratge per aula, el qual representarà tots els alumnes del curs en qüestió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. No poden optar als premis els centres en els quals concorri alguna de les prohibicions que estableixen l'article 13 de la Llei 38/2003, general de subvencions, i l'article 10 del Decret legislatiu 2/2005, pel qual s'aprova el Text refós de la Llei de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4. Tampoc hi poden optar les persones físiques o jurídiques que, en el moment de dictar-se la proposta de resolució definitiva de la convocatòria per part de l'òrgan instructor, no estiguin al corrent en el compliment de les seves obligacions tributàries i amb la Seguretat Social davant l'Administració General de l'Estat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4. Requisits dels curtmetratges que es presentin a concurs&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Els centres podran presentar curtmetratges elaborats pel grup-classe que cursin tercer i quart de secundària (ESO), de primer i segon de batxillerat de Menorca, formació professional bàsica i cicles formatius de grau mitjà. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Només s'admet un curtmetratge per grup-classe (aula), el qual representarà tots els alumnes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La duració màxima dels curtmetratges ha de ser de com a molt 5 minuts, crèdits inclosos, sense que hi hagi una duració mínima.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Els curtmetratges han de tractar el tema de com influeixen les xarxes socials a la salut mental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Els curtmetratges han d'oferir una imatge realista i natural de la salut mental, a més de tenir en compte i mostrar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;
	&lt;ol class="circle"&gt;
		&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La sensibilització contra l'estigma que envolta la salut mental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
		&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La promoció i defensa dels drets de les persones amb problemes de salut mental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
		&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La diversitat que caracteritza aquest col·lectiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
		&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Experiències positives del tractament i la cura de la salut de mental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
		&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Actituds socials positives.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;/ol&gt;
	&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El gènere artístic pot ser qualsevol i la tècnica mitjançant la qual es duguin a terme és lliure.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Les persones propietàries dels curtmetratges han de tenir signada l'autorització i cessió de drets d'imatge per tots els participants del curtmetratge. En cas de menors, les persones sotasignades han de ser els progenitors o representants legals. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Els curtmetratges s'han de presentar en versió original (català o castellà). Els subtítols no són obligatoris, encara que es valoraran les obres que sí que en tenguin, atès el caràcter inclusiu que suposen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;S'admeten els formats: MP4&lt;span style="color:#000000"&gt; &lt;/span&gt;(h.264)&lt;span style="color:#000000"&gt; &lt;/span&gt;o&lt;span style="color:#000000"&gt; &lt;/span&gt;AVI. I per a la projecció s'admeten suports en MP4 (h.264) o DVD.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Els curtmetratges que, per problemes tècnics o de format, no es puguin visionar no s'hi inscriuran.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;No es poden incorporar fotos o música subjectes a drets d'autor sense la deguda autorització; en cas contrari, serà eliminat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Es valorarà la presentació en dues versions: vertical i horitzontal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5. Presentació de les sol·licituds&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Les sol·licituds per participar en aquests premis s'han de presentar respectant estrictament les normes referents a l'anonimat dels autors dels curtmetratges i dels centres, per la qual cosa els documents i materials adjunts no hauran de contenir informació sobre el centre d'origen. El nom del centre serà identificable només en els documents de sol·licitud i de vistiplau del centre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La sol·licitud l'ha de presentar la persona que exerceix la direcció o el representant legal del centre amb l'acord previ, si escau, del consell escolar i amb la presentació del document acreditatiu de la condició de director o representant legal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Les sol·licituds, el curtmetratge i tots els annexos s'hauran de presentar en el termini establert a la convocatòria, s'han de presentar formalitzades mitjançant el model normalitzat que s'adjunta com a annex 1 d'aquestes bases, de forma electrònica mitjançant la Carpeta Ciutadana del Consell Insular de Menorca o en qualsevol altre registre electrònic, de conformitat amb el que estableix l'article 16.4 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. Documentació que cal presentar amb la sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;) Documentació administrativa general (bloc A):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Còpia del document d'identificació fiscal del centre educatiu i del representant legal del centre (NIF/DNI/NIE/CIF), tan sols si s'oposa la seva consulta per part del CIM.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Acreditació de la representació i acord del Consell Escolar, si escau.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Certificat del secretari del centre que acrediti el nomenament del director.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Declaració responsable del centre de no estar sotmès a cap de les circumstàncies que determinen la impossibilitat d'obtenir la condició de beneficiari o entitat col·laboradora de les subvencions públiques recollides a l'article 13.2 de la Llei de subvencions (annex 2 d'aquestes bases).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Declaració responsable sobre la disposició de totes les autoritzacions d'ús d'imatges, publicació de dades de caràcter personal i de material elaborat per al concurs. Annex 3 d'aquestes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Document de designació de compte bancari del centre que opta als premis, d'acord amb el model facilitat, llevat que ja constin a la Tresoreria General del CIM, cosa que s'ha de fer constar expressament (annex 5 d'aquestes bases) i només s'haurà d'entregar en cas d'haver escollit guanyador o finalista. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;S'eximeix de presentar la documentació a què fan referència els apartats I) i II), en el cas que aquesta ja consti en els arxius del CIM. En aquest cas, s'ha de fer constar expressament en la sol·licitud i indicar en quin expedient o registre d'entrada consta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;) Documentació específica requerida per a la concessió dels premis (bloc B – anonimitzat):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El curtmetratge identificat amb el pseudònim corresponent (nom de l'arxiu) establert a la sol·licitud (annex 1), que ha de complir els requisits establerts a la base 4.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4. Els centres interessats són responsables de la veracitat dels documents que presenten (article 28.7 de l'LPACAP). D'acord amb l'article 28.5 de l'LPACAP, excepcionalment, quan la rellevància d'un document de l'expedient aportat per l'interessat així ho exigeixi, o existeixin dubtes derivats de la qualitat de la còpia, el CIM pot sol·licitar de manera motivada la compulsa/autenticació de les còpies aportades per la persona interessada, per la qual cosa pot requerir l'exhibició del document o de la informació original.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;D'acord amb l'article 28.2 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú a les administracions públiques, amb la disposició addicional vuitena de la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades personals i garantia dels drets digitals, i amb l'article 95.1&amp;nbsp;&lt;em&gt;k&lt;/em&gt;, de la Llei 58/2003, de 17 de desembre, general tributària, el CIM podrà verificar l'exactitud de les dades declarades, així com consultar o requerir els documents elaborats per qualsevol Administració de forma electrònica mitjançant les seves xarxes corporatives o consulta a les plataformes d'intermediació de dades o altres sistemes electrònics habilitats a l'efecte, sempre que no consti en l'expedient l'oposició expressa a l'esmentada consulta o quan la llei especial que sigui aplicable al cas en requereixi el consentiment exprés, en aquest darrer cas serà obligatori que l'Administració el requereixi i que l'interessat el presenti.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5. Pel fet de presentar-se a aquests premis els centres presten al CIM els consentiments següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Per consultar i comprovar la veracitat de la documentació i de les dades presentades per l'interessat, principalment mitjançant les plataformes d'interoperabilitat, les xarxes corporatives o altres sistemes electrònics habilitats a aquests efectes i als quals el CIM tengui accés. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Per consultar l'existència i veracitat de la documentació i de les dades que eventualment l'interessat hagi considerat oportú no presentar acollint-se al dret de no fer-ho pel fet que hagin estat elaborades per les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Els consentiments esmentats només es consideraran atorgats quan no consti en l'expedient l'oposició expressa a l'esmentada consulta o quan la llei especial que sigui aplicable al cas en requereixi el consentiment exprés, en aquest darrer cas serà obligatori que l'Administració el requereixi i que l'interessat el presti.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6. Si la sol·licitud o la documentació fossin incorrectes o incompletes el CIM en requerirà la rectificació o el complement necessaris. Si en el termini de deus dies hàbils, comptats des de l'endemà d'haver rebut el requeriment d'esmena de la sol·licitud, la persona interessada no fa la rectificació reclamada o no presenta la documentació requerida, s'entendrà que ha desistit de la petició conformement amb l'article 68 de la Llei 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6. Criteris objectius que es tindran en compte per a la concessió dels premis&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Els criteris objectius que es tindran en compte per a la concessió dels premis són els que s'indiquen a continuació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Creativitat i originalitat en el disseny&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Qualitat en l'execució&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. El jurat seguirà el procediment de votacions successives fins que s'obtengui una majoria de vots a favor d'un curtmetratge. Se seguirà el mateix procediment per la selecció dels curtmetratges en els quals s'atorgui el segon i tercer premi. Amb tot, si el jurat creu que cap dels treballs presentats no assoleixen la qualitat mínima, el premi podrà no ser adjudicat. En cap cas l'import del premi pot ser fraccionat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. Procediment i òrgans competents per a la concessió dels premis&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Els premis es concediran, d'acord amb els principis d'objectivitat, transparència, igualtat, no discriminació i publicitat, per mitjà del procediment de concurrència competitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. L'inici de l'expedient s'efectuarà per mitjà de l'aprovació de la convocatòria corresponent. El text de la convocatòria i la resta de documentació que es requereixi es comunicarà a la Base de dades nacional de subvencions (BDNS) i es publicarà l'extracte de la convocatòria en el &lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;(BOIB), en compliment de l'article 20.8 de la Llei general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. Tots els treballs presentats dins el termini establert se sotmetran a l'examen de l'instructor, que serà un tècnic de gestió del Departament de Benestar Social que s'assenyali a la convocatòria, que haurà de dur a terme d'ofici totes les actuacions necessàries per a la determinació, el coneixement i la comprovació de les dades en virtut de les quals s'ha de dictar resolució sobre la concessió dels ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Correspon a l'instructor comprovar el compliment dels requisits exigits, si la sol·licitud no compleix els requisits establerts en la convocatòria o hi manca la documentació exigida, s'ha de requerir al sol·licitant, perquè en un termini de deu dies hàbils esmeni el defecte o aporti la documentació preceptiva, amb l'advertiment que, si no ho fa, se'l tindrà per desistit, farà arribar els curtmetratges admesos al jurat nomenat a aquest efecte, vetllant pel respecte d'un procés completament anonimitzat per a cada categoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4. La resolució del concurs la durà a terme el jurat, que emetrà el seu dictamen d'acord amb aquestes bases i estendrà una acta motivada en la qual constaran els curtmetratges i les obres seleccionades com a finalistes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5. Els premis es poden declarar deserts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6. La resolució del jurat tindrà lloc dins un termini que no podrà excedir dels sis mesos comptats a partir del dia en què la convocatòria surti publicada en el BOIB i al web del CIM, i es comunicarà a la BDNS en compliment de l'article 20.8 de la Llei general de subvencions. En el cas que no hi hagi resolució expressa, s'entendran per desestimades les sol·licituds presentades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8. Jurat dels premis&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Es crearà un jurat que determinarà els diferents guanyadors del concurs que es classificaran en primer, segon i tercer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El jurat estarà compost pels membres següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Un/a representant d'AFASME.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Un/a representant del Servei de Salut Mental del Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Un/a representant de la Fundació Hestia i Club Bàsquet Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Un/a representant de l'IBSalut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Un representant de la Fundació per a Persones amb Discapacitat de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Actuarà com a secretari el tècnic del Departament de Benestar del CIM que hagi instruït l'expedient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9. Abonament dels premis&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El pagament del premi per part del CIM es durà a terme en un termini màxim de seixanta dies des de la data del dictamen del jurat, sempre que la disponibilitat de tresoreria ho permeti. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La quantitat del premi és en concepte d'import brut i està subjecte a retenció d'acord amb la normativa que regula l'impost sobre la renda de les persones físiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10. Propietat dels premis&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La participació en aquest concurs comporta que els centres que presenten els curtmetratges guanyadors atorguen al CIM el dret a publicar-lo al web, amb independència de l'ús i les publicacions que pugui dur a terme el mateix centre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11. Drets i deures dels guanyadors&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Són obligacions dels guanyadors:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Comunicar al CIM l'acceptació del premi en els temes en què aquest es concedeixi. En qualsevol cas el premi s'entendrà acceptat tàcitament quan hagin transcorregut quinze dies hàbils d'ençà que s'hagi publicat la resolució del jurat en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Aportar el document de designació de compte bancari, tal com estipula el punt &lt;em&gt;a&lt;/em&gt;) IV de l'apartat 5 d'aquestes bases a través de l'annex 5.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Aportar els justificants necessaris per comprovar les dades incloses en la sol·licitud de participació en aquest concurs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Estar present a l'acte d'entrega dels premis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Autoritzar la presentació dels curtmetratges guanyadors a les plataformes de difusió que el CIM cregui convenient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12. Revocació i reintegrament dels premis, criteris de graduació dels possibles incompliments&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Pel que fa a la revocació i el reintegrament dels premis, s'ha d'aplicar el que disposa la Llei 38/2003, de 17 de novembre, general de &lt;/span&gt;subvencions i la resta de normativa que hi sigui aplicable. En cas d'incompliment del que estableixen aquestes bases s'haurà de reintegrar la quantia rebuda mitjançant l'aplicació d'un percentatge de minoració en funció de la naturalesa de l'incompliment. Aquest percentatge s'ha de fixar amb l'informe previ de l'instructor de la convocatòria i s'ha de notificar al beneficiari. Les causes de reintegrament i el procediment per a la seva exigència es regeixen pel que estableix l'article 44 del DLEG 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. En el cas que la causa del reintegrament determini la invalidesa de la resolució de concessió, aquesta resolució s'haurà de revisar en els termes establerts en l'article 25 del DLEG 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions, i en la resta de disposicions aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. Les quantitats que s'hagin de reintegrar tenen la consideració d'ingressos de dret públic i s'hi podrà aplicar la via de constrenyiment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4. L'obligació de reintegrament establerta en aquest article és independent de les sancions que, si escau, siguin exigibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;13. Infraccions i sancions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. El règim d'infraccions i sancions administratives aplicables és el que estableix el títol IV de la Llei 38/2003, de 17 de novembre, general de &lt;/span&gt;subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. &lt;span style="color:#000000"&gt;L'exercici de la potestat sancionadora &lt;/span&gt;correspon als òrgans insulars determinats legalment o reglamentàriament per raó de la matèria o, si no n'hi ha, al conseller executiu competent, d'acord amb l'article 69 de la Llei 4/2022, de 28 de juny, de consells insulars (BOIB núm. 88 de 7 de juliol de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;14. Altres disposicions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;En tot el que no estigui previst expressament en aquestes bases reguladores, regeixen les disposicions que siguin aplicables al CIM en matèria &lt;/span&gt;de subvencions, especialment les contingudes en la Llei 38/2003, d'acord amb la disposició final 1&lt;em&gt;a&lt;/em&gt;.2, i el Decret legislatiu 2/2005, de 28 de novembre, pel qual s'aprova el Text refós de la Llei de subvencions de les Illes Balears (BOIB núm. 196 de 31 de desembre de 2005), si es donen les &lt;span style="color:#000000"&gt;circumstàncies previstes en la disposició addicional segona del Text refós.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra aquest acord, que no exhaureix la via administrativa, es pot interposar un recurs d'alçada davant la Comissió de Govern, per delegació del Ple del Consell Insular de Menorca (Acord de 31 de juliol de 2023, BOIB núm. 109 de 5 d'agost de 2023), en el termini d'un mes comptador des de l'endemà que s'hagi publicat, d'acord amb l'article 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;L'esmentat recurs s'entendrà desestimat, si no es notifica la resolució corresponent, quan hagin transcorregut tres mesos des de la interposició. Contra la desestimació del recurs d'alçada per silenci administratiu, podreu interposar recurs contenciós administratiu davant el jutjat contenciós administratiu de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
