    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vist l'informe tècnic amb proposta de resolució de dia 8 de novembre de 2024, i d'acord amb l'apartat 1 de l'article únic del Decret 5/2024, de 29 de maig, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears, i la disposició transitòria primera del Decret llei 3/2024, de 24 de maig &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLC FORMULAR&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;La declaració d'impacte ambiental sobre&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;el projecte d'ampliació d'una instal·lació de gestió de residus ubicada a l'Àrea Empresarial Ses Veles, parcel·les 49, 50, 51 i 52, 07193 T.M. Bunyola, en el termes següents:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El projecte &lt;/span&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«d'ampliació d'una instal·lació de gestió de residus ubicada a l'Àrea Empresarial Ses Veles,&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; 07193 T.M. Bunyola&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;»&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;, promogut per part de Adalmo SL a la parcel·la 49,50, 51 i 52, es considera una modificació d'un projecte actualment en funcionament i ha de ser objecte d'avaluació d'impacte ambiental ordinària, d'acord amb l'article 13, apartat 1, lletra b) del Decret legislatiu 1/2020, de 28 d'agost, pel qual s'aprova el Text refós de la Llei d'avaluació ambiental de les Illes Balears: &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«Els projectes que figurin en l'annex 1 d'aquesta llei»&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, en relació amb els projectes consignats al punt 1 del grup 9 de l'annex I: «&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Instal·lacions de tractament de residus perillosos que realitzin operacions d'eliminació de la D1 a la D12 de l'annex 1 o operacions de valorització de la R1 a la R11 de l'annex 2 de la Llei 22/2011, de 28 de juliol, de residus i sòls contaminats»&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El projecte i l'Estudi Impacte Ambiental es va exposar al públic el 6 de febrer de 2024 (BOIB núm. 18) i la tramitació a seguir és l'establerta a la llei 21/2013, de 9 de desembre, d'avaluació ambiental, i el Decret legislatiu 1/2020, de 28 d'agost, pel que s'aprova el Text Refós de la Llei d'avaluació ambiental de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per la qual cosa, després d'haver estat sotmesa a avaluació d'impacte ambiental ordinària, procedeix formular la seva declaració d'impacte ambiental d'acord amb l'article 41 de la Llei 21/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. Informació del projecte&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'empresa Adalmo S.L. actualment compta amb una planta de valorització i transferència de residus no perillosos a les parcel·les 49 i 50 del Polígon Industrial Ses Veles de Bunyola, a sòl urbà, ocupant una superfície de 3.965,18m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt;, que inclou una nau industrial amb planta baixa i altell. A la planta baixa es troben les oficines, l'office i la sala de bombes, entre d'altres, i a l'altell es troba el menjador, els vestuaris, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El projecte d'ampliació de l'activitat a les noves parcel·les 51 i 52 i la sol·licitud de canvi d'ús del sòl, compta amb una superfície ampliada de 3.933,41m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt; que inclou una nau industrial independent, a on s'afegeix un lavabo, i una àrea d'emmagatzematge exterior de residus no perillosos. Es realitza la recepció, selecció/classificació, emmagatzematge, re-envasat i expedició de residus.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'emmagatzematge de residus perillosos es farà a una zona tancada i sota coberta. La nova nau tendrà una fonamentació superficial a base de sabates aïllades de formigó armat amb pous de fonamentació i riostres de formigó armat. El paviment interior de formigó amb llosa armada de 20cm de gruix i armat per suportar càrregues elevades, prèvia compactació del terreny. L'estructura de la coberta serà de formigó armat amb coberta a dues aigües i una pendent del 10%.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A la zona exterior de 5.033,11m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt; els paviments seran totalment impermeables. Se li donarà una pendent adequada per a la correcta evacuació de les aigües pluvials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les coordenades UTM 31 ETRS 89 de la parcel·la son:&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;X: 473475, Y: 4389223&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La nau existent es situen a les parcel·les 49 i 50 amb referència cadastral&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3396544DD7839N0001WX.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;La referència cadastral&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;de la parcel·la 51 és: 3396524DD7839N0001FX i la de la parcel·la 52:&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3396522DD7839N0001LX.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Actualment es duen a terme activitats de classificació manual i compactació de residus de paper, cartró, plàstics i tèxtil, trituració de paper per a la gestió de documentació confidencial, premsat de metalls fèrrics o metalls lleugers, gestió de residus banals procedents d'empreses i classificació i emmagatzematge d'altres residus.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Amb l'ampliació s'augmentarà el volum de residus a gestionar de les operacions abans descrites i s'incorporaran noves operacions a la zona ampliada:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Zona de tractament de plàstics a la nau ampliada consistent amb una línia de producció per a la trituració, classificació, neteja, assecat i envasat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Premsat de plàstic no rígid mitjançant una nova premsa horitzontal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Descontaminació d'envasos que contenen restes de substàncies perilloses.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Classificació i emmagatzematge de residus d'Aparells Elèctrics i Electrònics (RAEES).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tractament de materials inadequats pel consum humà. Se separarà l'envàs valoritzable del líquid que es portarà a gestor autoritzat. Per aquesta operació es disposarà d'un desgarrador elevat amb alimentació manual, que mitjançant un sedàs separarà l'envàs del líquid.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Emmagatzematge de nous codis de residus no perillosos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Elements ambientals significatius de l'entorn del projecte&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb el Pla Territorial de Mallorca, els voltants de l'àmbit d'estudi es troben dins de la unitat de paisatge UP-4: Badia de Palma i Pla de Sant Jordi. Aquesta unitat inclou principalment àrees molt urbanitzades tant a la costa com a la perifèria de la capital i pertany al grup d'unitats paisatgístiques de menor grau de protecció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Segons el Pla director Sectorial de Residus Urbans de Mallorca el sòl urbà està qualificat com industrial àrea de gestió integral de residus (AGIR-1).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La parcel·la afectada pel projecte no es troba afectada per àrees de prevenció de riscos (APR), ni per àrees de protecció territorial (APT) de carreteres o de costes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La planta de Adalmo S.L. es localitza allunyada d'espais naturals protegits i d'espais definits per la Llei 1/1991, de 30 de gener, d'espais naturals i de règim urbanístic de les àrees d'especial protecció de les illes Balears. No hi ha afecció a hàbitats d'interès comunitari (HIC).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pel que fa a les aigües subterrànies, la zona d'estudi es troba sobre la massa subterrània 1814M4 «Son Reus», en bon estat quantitatiu i bon estat qualitatiu amb una vulnerabilitat moderada a la contaminació, i a la contaminació de nitrats, en concret.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Segons l'estudi d'impacte ambiental, no hi ha vegetació afectada a la parcel·la ja que es tracta d'un solar que pertany a una zona industrial urbanitzada. L'entorn del lloc d'estudi està format per altres instal·lacions industrials. Tampoc es preveu afecció a la fauna, ja que es tracta d'un solar situat en una zona industrial ja urbanitzada. Pel que fa a les aus, a la zona s'ha descrit la presència de dues espècies amenaçades presents en la quadrícula de 5x5km.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Resum del procés d'avaluació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fase d'informació pública i de consultes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el BOIB núm. 18 de data 6 de febrer de 2024 es publica l'anunci d'informació pública del projecte i l'Estudi d'Impacte Ambiental de l'ampliació d'una instal·lació de gestió de residus ubicada a l'Àrea Empreserial Ses Veles, parcel·les 49, 50, 51 i 52, 07193 T.M. Bunyola, promoguda per Adalmo S.L. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb l'article 37 de la Llei 21/2013, de 9 de desembre, d'avaluació ambiental, es varen dur a terme les consultes següents a les administracions públiques afectades i persones interessades:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Agencia Estatal de Seguredad Aéra del Ministerio de Transportes y Movilidad Sostenible (20/02/2024):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A l'informe de l'Agència Estatal de Seguretat Aèria es conclou que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«1. La Agencia Estatal de Seguridad Aérea no tiene comentarios respecto a los informes indicados dentro del ámbito de sus competencia, recogidas en su Estatuto, aprobado por Real Decreto 184/2008, de 8 de febrero.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. Así mismo, se recuerda que no se podrá llevar a cabo ninguna construcción, instalación o plantación ubicada en los espacios y zonas afectados por servidumbres aeronáuticas o que pueda construir un obstáculo, sin resolución favorable de AESA en zonas afectadas por servidumbres aeronáuticas civiles o del Ministerio de Defensa en zonas afectadas por servidumbres aeronáuticas militares»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;DG de Medi Natural i Gestió Forestal de la Conselleria d'Agricultura, Pesca i Medi Natural (Exp. núm. SPE 17/2024):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Servei de Protecció d'Espècies informa favorablement sobre el Projecte d'Ampliació d'activitat de valorització i transferència de residus i estudi d'impacte ambiental de l'Empresa Adalmo S.L.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Servei de Residus del Consell de Mallorca (Exp. 1013588M de 16/02/2024):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Servei de Residus informa favorablement al Projecte d'Ampliació d'activitat de valorització i transferència de residus amb els següents condicionants:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«Pels codis LER 020202, 020203, 200301, 200302 i 200307 només poden ser autoritzades les operacions de tractament R13/R1301 prèvies a la seva entrega al servei públic.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Pel codi LER 160103 només poden ser autoritzades les operacions de tractament R12/R1201 i R13/R1301 prèvies a la seva entrega al servei públic.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Pels codis LER 150102, 150103, 150104, 150106 i 150109 s'ha de fer distinció entre si els residus provenen o no de la recollida municipal. En el cas dels residus provinents de la recollida municipal només poden ser autoritzades les operacions de tractament R13/R1301 prèvies a la seva entrega al servei públic.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Pels codis LER 201010 i 150101 s'ha de fer distinció entre si els residus provenen o no de la recollida municipal de certs municipis. En el cas dels residus provinents de la recollida municipal de municipis diferents a Palma, Bunyola, Esporles, Valldemossa, Sóller, Deià, Fornalutx, Llucmajor, Estellencs, Banyalbufar, Marratxí o Puigpunyent només poden ser autoritzades les operacions de tractament R13/R1301 prèvies a la seva entrega al servei públic.»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Servei d'Estudis i Planificació de la DG de Recursos Hídrics (Exp. CRH/2024/0278 de 26/09/2024):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«Per tot l'anterior, des d'un punt de vista de suficiència hídrica, capacitat de sanejament i depuració i protecció del domini públic hidràulic subterrani, informam favorablement sobre el projecte de Valorització i Transferència de Residus al TM Bunyola, amb les següents condicions:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1. Les aigües utilitzades per minimitzar emissions de pols durant la fase d'obres seran preferentment regenerades. Durant l'execució de les obres, s'han d'adoptar les màximes precaucions per evitar l'abocament de substàncies contaminants, incloses les derivades del manteniment de les maquinàries.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. El projecte ha de preveure la instal·lació d'aixetes o aixeteries amb temporitzadors, o que l'obertura i tancament es realitzi mitjançant sensors de presencia o altres sistemes que permetin un estalvi equivalent d'aigua.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. El projecte ha de complir tots els requisits respecte als dipòsits estancs de buidatge periòdic.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;4. No es permet l'abocament d'aigües residuals sense tractar, independentment del tipus d'abocament, directe o indirecte, o del punt d'abocament.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;5. Assegurar el compliment de les mesures proposades a l'estudi d'impacte ambiental respecte al control de vessaments accidentals per evitar afeccions als recursos hídrics.»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Així mateix, també consten efectuades les consultes a les següents administracions i persones interessades, tot i que no se'n ha rebut resposta:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Al·legacions&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'empresa concessionària del servei públic insularitzat per a la gestió de residus Mac Insular, S.L., va presentar al·legacions en data 21 de març de 2024, fora del termini establert. En aquest escrit sol·licita:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«Que tengui per present aquest escrit i per formulades en temps i forma les anteriors al·legacions, als efectes de que l'autorització administrativa que en el seu cas s'atorgui no prevegi la possibilitat de gestionar els residus RAEES no perillosos (LER 20 01 36), els Residus voluminosos (LER 20 03 07) ni els Pneumàtics fora d'ús (LER 16 01 03); atès que el Projecte presentat a tal efecte no garanteix la disposició d'instal·lacions i equipaments adequats per a la seva gestió, que proposa una gestió mediambiental més desfavorable dels residus voluminosos al sol·licitar autorització per dur a terme operacions d'eliminació que es troben a la coa de la jerarquia de residus i que, en tot cas, en compliment de la normativa sectorial, ens trobam davant de residus, la gestió dels quals està reservada al servei públic obligatori insularitzat del que es concessionari MAC insular.»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No s'han realitzat consultes transfrontereres al no considerar-se necessari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Anàlisis tècnica de l'expedient&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.1. Alternatives&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Segons l'estudi d'impacte ambiental, les alternatives plantejades són les, següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Alternativa 0 (no execució): &lt;/strong&gt;no realitzar cap tipus de modificació i continuar l'activitat tal i com està autoritzada en l'actualitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;S'han plantejat les següents alternatives en termes de localització:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Realitzar l'activitat en les pròpies instal·lacions que ja té la empresa ADALMO: &lt;/strong&gt;S'ha descartat ja que no disposa d'espai lliure per a aquesta activitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Realitzar l'activitat en una parcel·la a una altra ciutat de l'illa: &lt;/strong&gt;S'ha descartat perquè és més eficaç situar la planta el més pròxim possible dels centres productors, i l'activitat econòmica a Mallorca es concentra principalment als municipis de Palma i Marratxí, on, a més a més, es concentren les plantes de valorització de residus del sistema públic de gestió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Realitzar l'activitat en la zona AGIR Ses Veles: &lt;/strong&gt;Amb aquesta opció es poden aprofitar les sinèrgies que ofereix aquesta zona de gestió, la proximitat de les plantes de tractament de residus, l'adequació de les vies de comunicació, les infraestructures existents en termes de xarxa d'aigües residuals, d'aigües pluvials, d'aigües regenerades, galeries subterrànies de serveis elèctrics, comunicacions, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De l'anàlisi d'alternatives, s'ha considerat com a millor opció l'adquisició i la unió de dues parcel·les veïnes a les actuals al polígon industrial de Ses Veles, i construcció d'una nau on desenvolupar les activitats que requereixen estar sota coberta gestió de residus perillosos, línia de plàstics, RAEES, i una zona exterior per emmagatzemament manipulació de residus no perillosos, dotades ambdues zones dels serveis necessaris i de les mesures de protecció ambiental adequades. La unió de totes elles permet racionalitzar les entrades i sortides amb accés des del carrer tant al pati exterior com a l'interior de la nau.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.2. Principals impactes de l'alternativa escollida i la seva correcció&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Segons l'EIA la fase que generarà majors impactes negatius en conjunt és la de obres, però tots els impactes es valoren com compatibles. En la fase d'obres, l'únic impacte positiu és l'associat a la generació de llocs de treball.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En la fase d'explotació hi ha impactes negatius associats a la pròpia activitat industrial (renous, generació de residus i aigües residuals, consum energètic) però tots ells es qualifiquen com compatibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Segons l'EIA es produeixen impactes molt positius en la fase d'explotació. A més de generar-se llocs de treball estables, l'activitat permet classificar els residus i fer una preparació per al reciclatge de manera que es poden tenir residus classificats i embalats amb una major densitat i així, reduir en proporció la necessitat de transport i de consum de combustibles. Això és positiu per a la qualitat de l'aire, la mobilitat i el consum energètic. Per altra banda la classificació i preparació per al reciclatge dels materials convertint residus en matèries primeres evita el consum d'altres matèries primeres com arbres o petroli per obtenir els mateixos materials (paper i plàstic, que són els principals) la qual cosa es valora positivament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En la clausura, el desmuntatge i retirada dels equips impliquen un impacte negatiu sobre l'atmosfera, la mobilitat, i la generació de residus. L'impacte positiu és la generació de llocs de treball.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si analitzem per factors ambientals, els principals impactes negatius seran sobre l'atmosfera ja sigui per possibles emissions de pols o emissions de renous. Es concentren sobre tot en la fase d'obres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'aparició d'un nou edifici de tipologia industrial i la seva incidència al paisatge es valora com compatible tenint en compte que es tracta d'una zona industrial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els principals impactes positius es donen en el factor socioeconòmic per la generació de llocs de treball en totes les fases del projecte, però molt més durant l'explotació. També per la reducció en les necessitats de transport respecte de la situació actual que afecta positivament a la mobilitat i al consum de combustibles per transport. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La generació de residus es produeix a totes les fases però en quantitats limitades i destinats a la reutilització i al reciclatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.3. Seguiment ambiental&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'estudi d'impacte ambiental, aportat pel promotor, presenta un Pla de Vigilància Ambiental (PVA) per a dur a terme el seguiment del compliment de les mesures preventives previstes, a la fase d'obra, a la fase de funcionament i a la fase de clausura.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.4. Consideracions tècniques&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb l'article 11.3g de la Llei 8/2019, de 19 de febrer, de residus i sòls contaminants de les Illes Balears, les competències dels consells insulars són el tractament, si escau, de la resta de residus no perillosos en la forma que estableixin els plans directors sectorials de prevenció i gestió de residus no perillosos. D'acord amb l'article 2 del PDSRNPMA:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. L'àmbit territorial d'aplicació del present PDSRNPM és l'illa de Mallorca&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. L'àmbit material són els residus no perillosos. D'acord amb la Llei 2/2001, de 7 de març, d'atribució de competències als consells insulars en matèria d'ordenació del territori, queden exclosos d'aquest pla sectorial els residus perillosos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Són residus no perillosos de tractament obligatori dins el servei públic insularitzat de gestió de residus urbans, sempre i quan el servei disposi de les instal·lacions de tractament adequades amb la capacitat necessària; els següents: 200301/200302/20303/200108/200201/150102/150103/150104/150105/150106/150109/190805/180104/180203/180208/020102/020202/020203/191210/191212.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Són residus no perillosos d'entrega obligatòria al servei públic insularitzat de gestió de residus urbans: 150101/200101/150107&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Són residus no perillosos de tractament obligatori al servei public insularitzat de gestió de residus de construcció i demolició, d'equips elèctrics i electrònics i voluminosos sempre i quan el servei disposi de les instal·lacions de tractament adequades amb la capacitat necessària, els següents: Família 17 Residus de construcció i demolició exceptuant els de codi 1705/200136/200307.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Conclusions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primer. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Per tot l'anterior, es formula la declaració d'impacte ambiental &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;favorable&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; a la realització del projecte&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; «ampliació d'una instal·lació de gestió de residus ubicada a l'Àrea Empresarial Ses Veles&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;»&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;de data 28/11/2023, redactat per Bellavista Enginyeria S.L.P. i signat per l'enginyer industrial el Sr. Josep Bellavista Ariman, promogut per part de Adalmo S.L. a la parcel·la 49, 50, 51 i 52 T.M. Bunyola, en concloure's que previsiblement no es produiran impactes adversos significatius, sempre que es complexin totes les mesures preventives, correctores proposades i acceptades pel promotor a l'estudi d'impacte ambiental de l&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;'Activitat de valorització i transferència de residus,&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; de data 28-11-2023, signat per Maria Teresa Oms Molla i Juan Alba Vidal, i a més es complexin els condicionants següents, d'acord amb l'informe del Servei d'Estudis i Planificació de la DG de Recursos Hídrics de data 26/09/2024:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les aigües utilitzades per minimitzar emissions de pols durant la fase d'obres seran preferentment regenerades. Durant l'execució de les obres, s'han d'adoptar les màximes precaucions per evitar l'abocament de substàncies contaminants, incloses les derivades del manteniment de les maquinàries.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El projecte ha de preveure la instal·lació d'aixetes o aixeteries amb temporitzadors, o que l'obertura i tancament es realitzi mitjançant sensors de presencia o altres sistemes que permetin un estalvi equivalent d'aigua.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El projecte ha de complir tots els requisits respecte als dipòsits estancs de buidatge periòdic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No es permet l'abocament d'aigües residuals sense tractar, independentment del tipus d'abocament, directe o indirecte, o del punt d'abocament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Assegurar el compliment de les mesures proposades a l'estudi d'impacte ambiental respecte al control de vessaments accidentals per evitar afeccions als recursos hídrics. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A més a recorda que, segons indica l'informe del Servei de Residus del Consell (Exp. 1013588M de 16/02/2024):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pels codis LER 020202, 020203, 200301, 200302 i 200307 només poden ser autoritzades les operacions de tractament R13/R1301 prèvies a la seva entrega al servei públic. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pel codi LER 160103 només poden ser autoritzades les operacions de tractament R12/R1201 i R13/R1301 prèvies a la seva entrega al servei públic. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pels codis LER 150102, 150103, 150104, 150106 i 150109 s'ha de fer distinció entre si els residus provenen o no de la recollida municipal. En el cas dels residus provinents de la recollida municipal només poden ser autoritzades les operacions de tractament R13/R1301 prèvies a la seva entrega al servei públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pels codis LER 201010 i 150101 s'ha de fer distinció entre si els residus provenen o no de la recollida municipal de certs municipis. En el cas dels residus provinents de la recollida municipal de municipis diferents a Palma, Bunyola, Esporles, Valldemossa, Sóller, Deià, Fornalutx, Llucmajor, Estellencs, Banyalbufar, Marratxí o Puigpunyent només poden ser autoritzades les operacions de tractament R13/R1301 prèvies a la seva entrega al servei públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segon. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Es publicarà la present declaració d'impacte ambiental al Butlletí Oficial de les Illes Balears, d'acord amb el que disposa l'article 41.3 de la Llei 21/2013, de 9 de desembre, d'Avaluació Ambiental. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercer.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; La declaració d'impacte ambiental perdrà la seva vigència i cessarà en la producció dels efectes que li són propis si, una vegada publicat en el BOIB, no s'hagués procedit a l'autorització del projecte en el termini màxim de sis anys des de la publicació, d'acord amb el que disposa l'article 21 bis del Text refós de la Llei d'avaluació ambiental de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quart. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;La declaració d'impacte ambiental no serà objecte de cap recurs, sense perjudici del que, si és el cas, escaigui en via administrativa o judicial davant de l'acte d'autorització del projecte , d'acord amb el que disposa l'article 41.4 de la Llei 21/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cinquè. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Aquesta resolució s'emet sense perjudici de les competències urbanístiques, de gestió o territorials de les administracions competents i de les autoritzacions o informes necessaris per a l'aprovació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sisè.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Segons la disposició transitòria primera del Decret llei 3/2024, de 24 de maig, de mesures urgents de simplificació i racionalització administratives de les administracions públiques de les Illes Balears, els efectes de la supressió de la comissió de Medi Ambient de les Illes Balears es produiran a partir del dia 29 de maig de 2024 i els procediments d'avaluació que s'hagin iniciat abans de la data esmentada s'han de resoldre per la direcció general competent, sense que sigui necessari el dictamen dels comitès tècnics. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
