El 3 de juliol de 2021 es va publicar la convocatòria pública de subvencions &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;per a actuacions de suport a la mobilitat elèctrica (Programa MOVES III)&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;mitjançant la R&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;esoluci&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ó del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 28 de juny de 2021&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;, &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;modificada per &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 3 d&amp;apos;agost de 2022 (BOIB núm. 103, de 6 d&amp;apos;agost de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. En &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;data &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;7&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; de &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;març&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; de 202&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;, &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;la Sra. FRANCISCA FEBRER ALZAMORA&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;(Exp. MOVES III-&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3565&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;/2021)&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; va presentar &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;documentació per acollir-se a la convocatòria per &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ajut per a l&amp;apos;adquisició vehicle elèctric Citroën ë-Berlingo Batería 50 KWh Talla M amb repte demogràfic i desballestament, tant al tràmit telemàti&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;c com al document de sol·licitud signat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. Amb posterioritat, s&amp;apos;ha detectat un error &lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;manifest en l&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;a descripció del projecte&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; per &lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;la Sra.&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;FRANCISCA FEBRER ALZAMORA&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;(Exp. MOVES III-&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3565&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;/2021)&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;, que figura en l&amp;apos;annex de la resolució esmentada, &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ja que complint les bases de la convocatòria pública de referència &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;i, una vegada&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; revisada la resolució de concessió del dia &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;28&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; de &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;maig&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; de 2024, es comprova que &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;s&amp;apos;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;havia sol·licitat, tant al tràmit telemàtic com al document de sol·licitud signat, &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;un&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; vehicle elèctric N1 Citroën ë-Berlingo Van Batería 50 KWh Talla M amb repte demogràfic en lloc d&amp;apos;un un vehicle elèctric Citroën ë-Berlingo Batería 50 KWh Talla M amb repte demogràfic i desballestament, per &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;aquest motiu&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; es procedeix a rectificar-lo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. L&amp;apos;article 56 de la Llei 3/2003, de 26 de març, de règim jurídic de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears, disposa que la rectificació dels errors materials, aritmètics i de fet en actes i disposicions administratives correspon a l&amp;apos;òrgan que ha dictat l&amp;apos;acte o la disposició. Així mateix, la rectificació d&amp;apos;errors ha d&amp;apos;especificar, si escau, els efectes jurídics que se&amp;apos;n deriven i s&amp;apos;ha de notificar o publicar preceptivament quan faci referència a actes que han estat notificats o publicats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. L&amp;apos;article 109.2 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques, estableix que les administracions públiques poden rectificar en qualsevol moment, d&amp;apos;ofici o a instància dels interessats, els errors materials, de fet o aritmètics existents en els seus actes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d&amp;apos;Empresa, Ocupació i Energia en el termini d&amp;apos;un mes comptador des de l&amp;apos;endemà de la notificació, d&amp;apos;acord amb els articles 123 i 124 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques, i l&amp;apos;article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l&amp;apos;endemà de la notificació de la resolució, d&amp;apos;acord amb l&amp;apos;article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
