&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;PRIMER &lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt;.- Aprovar l'annex que s'adjunta, segons les qualificacions definitives del primer exercici efectuat pel tribunal qualificador de les proves del procés selectiu de la convocatòria per concurs oposició pel torn lliure de 2 places d'Enginyer /a Tècnic /a Industrial , vacants a la plantilla de funcionaris /es d'aquest Ajuntament pertanyents a l'Escala l'Administració Especial, Subescala Tècnica , Classe Tècnics Mitjans , grup A, subgrup A2 , dotats pressupostàriament , d'elles 1 plaça corresponent a la taxa de reposició de l'Oferta d'Ocupació Pública de l'any 2020 (BOIB núm. 200, de 26 de novembre de 2020), i 1 plaça corresponent a la taxa de reposició de l'Oferta d'Ocupació Pública de l'any 2021 (BOIB núm. 180 de 31 de desembre de 2021), per formar part del borsí per a posteriors nomenaments com a personal funcionari interí de la Subescala tècnica , grup A, subgrup A2, de lAdministració especial de lAjuntament de Palma .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Aquest borsí té caràcter provisional, d'acord amb el que estableix l'article 4.10 del Decret 30/2009 de 22 de maig, pel qual s'aprova el procediment de selecció de personal funcionari interí al servei de l'administració de la comunitat autònoma Illes Balears, “ &lt;em&gt;esgotada la possibilitat de l'apartat anterior, abans d'aplicar el procediment extraordinari i només fins a la constitució definitiva de la borsa de treball que tindrà lloc quan acabi el procés selectiu de personal funcionari de un determinat cos, escala o especialitat, es pot utilitzar, per nomenar personal funcionari interí d'aquest mateix cos, escala o especialitat, la relació de les persones aspirants que hagin aprovat alguna de les proves o exercicis realitzats fins aquell moment, d'acord amb l'ordre de prelació recollit a l'article 3.4 d'aquest Decret. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;em&gt;Les persones funcionàries interines que comencin a prestar serveis com a conseqüència d'aquest supòsit, estaran en la situació de no disponible a la borsa que es constitueixi en finalitzar el procés selectiu esmentat. En el moment del cessament s'incorporen automàticament a la borsa ordinària constituïda, en l'ordre de prelació que els correspongui d'acord amb l'apartat 3 d'aquest article &lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;SEGON &lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt;.- Publicar aquesta Resolució al Butlletí Oficial de les Illes Balears i a la web de l'Ajuntament de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Contra aquesta resolució, que esgota la via administrativa, es pot interposar per part de les persones interessades recurs potestatiu de reposició en el termini d'un mes davant del mateix òrgan que les hagi aprovat, d'acord amb l'article 123 de la Llei 39/ 2015, de 1 doctubre, de procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;En cas de no interposar el recurs potestatiu de reposició es podrà interposar directament recurs contenciós administratiu, segons larticle abans esmentat i 45 i següents de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, davant del Jutjat contenciós Administratiu, en el termini de dos mesos a comptar de l'endemà de la publicació al BOIB .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
