    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per Decret de Batlia núm. 2025-0274, de 15 de gener de 2024, s'ha resolt el següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;«DECRET&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedents&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'Ajuntament de Manacor no compte amb cap borsa de feina de lletrats i lletrades per al departament d'Assessoria Jurídica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Atès que que la funció de l'Assessoria Jurídica no es limita a actuacions davant els tribunals en defensa de l'Ajuntament, sinó que inclou la de cuidar la remissió dels expedients, els emplaçaments de tercers interessats, donar compliment de documentals, diligències d'execució de sentència; sol·licitar factura o pressupost del Departament corresponent per a la personació i reclamació de danys en causes penals; l'emissió d'informes, com els de gènere per a subvencions; entre moltes altres funcions extrajudicials o administratives, és necessari constituir una borsa de feina per poder substituir el lletrat de l'Ajuntament en cas de ser necessari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Bases i convocatòria: art. 55.1 del TREBEP, el qual configura la publicitat com un dels principis rectors de les bases i les convocatòries públiques de l'oferta d'ocupació pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Art. 7 i 8 del RD 364/1995, de 10 de març, reglament general d'ingrés de personal de l'Administració i promoció de llocs, que regulen l'oferta d'ocupació pública determinant que les necessitats de recursos humans que no poden ser cobertes amb efectius de personal existents seran objecte d'oferta d'ocupació pública, sempre que existeixi crèdit pressupostari i es consideri convenient la seva cobertura durant l'exercici.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. RD legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el text refós de l'estatut bàsic de l'empleat públic, modificat per la Llei 20/2021, de 28 de desembre, de mesures urgents per a la reducció de la temporalitat en el treball públic, que regula en l'article 10 les circumstàncies per les quals es pot nomenar personal funcionari interí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Sistema selectiu: art. 61.1 del TREBEP el qual determina que els processos selectius tindran caràcter obert i garantiran la lliure concurrència. Els òrgans de selecció vetllaran pel compliment del principi d'igualtat d'oportunitats entre sexes. Els procediments selectius tindran cura especialment de la connexió entre el tipus de prova a superar i l'adequació al desenvolupament de les tasques del lloc de feina convocat, incloent, en el seu cas, les proves pràctiques que siguin precises. Els sistemes selectius seran el concurs o concurs oposició.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. RD 896/1991, de 10 de març, que aprova el reglament general d'ingrés del personal al servei de l'administració general de l'estat i de provisió de llocs de treball i promoció professional dels funcionaris civils de l'administració general de l'Estat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Bases generals de convocatòries de processos de selecció de personal no permanent de l'Ajuntament de Manacor, aprovades per Decret de Batlia de 19 de novembre de 2014.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Article 37 del RDLeg 5/2015, de 30 d'octubre, pel qual s'aprova el text refós de la Llei de l'estatut bàsic de l'empleat públic que en el seu apartat c) determina que són objecte de negociació “les normes que fixin els criteris generals en matèria d'accés, carrera, provisió, sistemes de classificació de llocs de feina, i plans i instruments de planificació de recursos humans”. Per tant, ja no queden incloses com a matèria de negociació les bases específiques sinó les que fixen les condicions generals. No obstant això, a efectes informatius és convenient remetre una còpia de les bases a la Junta de Personal / Comitè d'Empresa, de conformitat amb l'article 13 del pacte / conveni col·lectiu del personal de l'Ajuntament de Manacor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Aprovació de les bases i convocatòria: la Llei 7/1985, art. 21.1.g determina que a l'àmbit de l'Administració local és la Batlia Presidència de la Corporació qui té atribuïda la potestat d'aprovació de les bases i la consegüent publicació al BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per això,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLC&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Aprovar la convocatòria per a la selecció de personal funcionari interí per crear una borsa de feina extraordinària de lletrats i lletrades per a l'Assessoria Jurídica, mitjançant concurs oposició.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Aprovar les bases que han de regir aquesta convocatòria i que s'adjunten com a annex d'aquesta resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Designar els membres del tribunal qualificador d'aquesta convocatòria, que està constituït per les persones que s'indiquen a la clàusula sisena d'aquestes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Ordenar la publicació d'aquesta resolució en el Butlletí Oficial de les Illes Balears, a la premsa local i a la pàgina web de l'Ajuntament de Manacor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Comunicar la publicació de la convocatòria al servei d'ocupació de les Illes Balears perquè en faci la difusió oportuna i a la junta de personal per al seu coneixement.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la convocatòria i les presents bases, que exhaureixen la via administrativa, es podrà interposar per part de les persones interessades o bé recurs potestatiu de reposició, a interposar&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;davant aquesta Batlia, en el termini d'un mes des de la seva publicació al BOIB, d'acord amb l'establert als articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, de Procediment Administratiu Comú de les Administracions Públiques, o bé directament i de forma alternativa recurs contenciós administratiu, d'acord amb l'establert als articles esmentats i als articles 45 i següents de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, a interposar davant el Jutjat Contenciós Administratiu de Palma, en el termini de dos mesos a comptar de l'endemà de la publicació al BOIB de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primera. OBJECTE DE LA CONVOCATÒRIA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'objecte d'aquesta convocatòria és la selecció de personal funcionari interí, mitjançant concurs oposició, per crear una borsa de feina extraordinària de lletrats i lletrades per a l'Assessoria Jurídica, a l'efecte de substituir les possibles baixes, vacances, permisos, llicències, l'excés o acumulació de tasques o qualsevol supòsit de nomenament com a personal funcionari interí, d'acord amb l'article 10 de l'Estatut Bàsic de l'Empleat Públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Característiques del lloc de treball: escala d'Administració especial, subescala tècnica superior, grup A, subgrup A1, 100 % de jornada, nivell de destinació 28.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segona. NORMATIVA D'APLICACIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;Aquesta selecció es regirà per les prescripcions contingudes en aquesta convocatòria específica i, en allò que no s'hi prevegi, per les bases generals de convocatòries de processos de selecció de personal no permanent de l'Ajuntament de Manacor, aprovades per resolució de Batlia de 19 de novembre de 2014 i publicades al BOIB número 163, de 29 de novembre de 2014 i a la pàgina web www.manacor.org (seu electrònica, portal de transparència); pel Real Decret Legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el text refós de la Llei de l'estatut bàsic de l'empleat públic; la Llei 3/2007, de la funció pública de les Illes Balears; i supletòriament, per al no previst a l'anterior, pel Decret 30/2009, de 22 de maig, pel qual s'aprova el procediment de selecció de funcionaris interins de la comunitat autònoma de les Illes Balears, i per la demés normativa que li sigui d'aplicació.&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercera. REQUISITS DELS ASPIRANTS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els aspirants han de tenir, en la data d'expiració del termini assenyalat per a la presentació de sol·licituds, les condicions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Tenir la nacionalitat espanyola, sense perjudici del disposat a l'art. 57 del Real Decret Legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el text refós de la Llei de l'estatut bàsic de l'empleat públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Tenir complerts 16 anys d'edat a la data de la convocatòria i no excedir, en el seu cas, de l'edat màxima de jubilació forçosa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Estar en possessió de la llicenciatura o grau en Dret.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cas de titulacions obtingudes a l'estranger, la persona aspirant haurà d'estar en possessió de la credencial que n'acrediti l'homologació o de la credencial per a l'exercici de la professió corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Acreditar els coneixements de la llengua catalana corresponents al certificat de nivell B2, de conformitat amb l'Ordre del conseller d'Educació, Cultura i Universitats, de 21 de febrer de 2013, i la Llei 4/2016, de 6 d'abril, de mesures de capacitació lingüística per a la recuperació de l'ús del català en l'àmbit de la funció pública, mitjançant:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Certificat emès o reconegut com a equivalent per la Direcció General de Política Lingüística del Govern de les Illes Balears o per l'òrgan competent en l'àmbit de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Posseir la capacitat funcional per al desenvolupament de les funcions corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) No haver estat separats ni acomiadats, mitjançant expedient disciplinari, del servei de qualsevol de les administracions públiques o dels òrgans constitucionals o estatutaris de les comunitats autònomes, ni trobar-se en inhabilitació absoluta o especial per a l'exercici de funcions públiques per resolució judicial, per a l'accés al cos o escala de funcionari, o per exercir funcions similars a les que desenvolupava en el cas de personal laboral, en el qual haguessin estat separats o inhabilitats. En el cas de pertànyer a un altre estat, no trobar-se inhabilitats o en situació equivalent ni haver estat sotmesos a sanció disciplinària o equivalent que impedeixi, en el seu estat, en els mateixos termes, l'accés al servei públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;h) Abans de prendre possessió de la plaça, la persona interessada haurà de fer constar que no ocupa cap lloc de treball ni realitza cap activitat al sector públic delimitat per l'art. 1 de la Llei 53/1984, i que no percep pensió de jubilació, retir o orfandat. Si realitza alguna activitat privada, inclosa la de caràcter professional, ho haurà de declarar en el termini de deu dies naturals comptats a partir del dia de la presa de possessió, per tal que la corporació acordi la declaració de compatibilitat o incompatibilitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

SOL·LICITUDS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les sol·licituds s'han de presentar en el Registre General de forma presencial o electrònica o en qualsevol dels mitjans admesos a l'article 16.4 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les Administracions Públiques, dins el termini de 10 dies hàbils comptats a partir del següent al de la publicació de la convocatòria en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per presentar la sol·licitud electrònicament s'ha de fer a través de la seu electrònica de l'Ajuntament de Manacor, dins el «Catàleg de tràmits», seleccionar la matèria «recursos humans», i «Sol·licitud per a seleccions de Personal i Provisions de Llocs de treball» i seleccionar la convocatòria de què es tracti.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;També es publicarà l'anunci de la convocatòria, en extracte, a la premsa local i es comunicarà al Servei d'Ocupació de les Illes Balears perquè en faci la difusió oportuna. En tot cas, el termini de presentació de sol·licituds comptarà a partir de l'endemà de la publicació de la convocatòria en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si el darrer dia de presentació de sol·licituds s'escau en dia inhàbil, el termini s'entendrà ampliat fins al dia hàbil següent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

ADMISSIÓ DELS ASPIRANTS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Un cop finalitzat el termini de presentació de sol·licituds, la Presidència de la corporació dictarà resolució en el termini màxim de dos dies hàbils, amb la qual declararà aprovada la llista provisional de persones admeses i excloses. Aquesta resolució s'exposarà al tauler d'anuncis de la seu electrònica d'aquest Ajuntament. Es concedirà un termini de dos dies hàbils a comptar del dia següent a aquesta publicació per a rectificacions, esmenar errades i possibles reclamacions. Aquestes esmenes no seran aplicables respecte dels mèrits al·legats però no aportats, ni dels requisits establerts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

La pertinença als òrgans de selecció serà sempre a títol individual, i no es pot ostentar en representació o per compte de ningú. El Tribunal està format per cinc membres i els seus respectius suplents, per cobrir les absències que es puguin produir. &lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'abstenció i la recusació dels membres del tribunal s'han d'ajustar al que preveuen els articles 23 i 24 de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Tribunal queda facultat per resoldre els dubtes que es presentin i prendre els acords necessaris per al bon ordre de les proves en tot el que no preveuen aquestes bases. Tanmateix resoldrà les al·legacions que li siguin plantejades. Tots els membres del Tribunal Qualificador, tindran veu i vot. En el cas que es produeixi un empat en les decisions del Tribunal, la Presidència podrà fer ús del vot de qualitat per desfer-lo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El tribunal podrà disposar de la incorporació d'assessors especialistes, amb veu i sense vot, en cadascuna de les proves del procés. A l'efecte de comunicacions i altres incidències, el Tribunal té la seva seu a l'Ajuntament de Manacor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els membres del Tribunal podran percebre dieta segons el que preveu el RD 462/2002. El Tribunal qualificador es classifica en la categoria primera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Tribunal no podrà constituir-se ni actuar sense l'assistència de més de la meitat dels seus membres, titulars o suplents, indistintament, ni sense president/a ni sense secretari/ària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Al tribunal hi podrà assistir, sense que en formi part, un membre de la Junta de Personal, que actuarà com a observador, amb funcions de vigilància i vetlla del bon desenvolupament del procediment selectiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El procés selectiu s'iniciarà amb la fase d'oposició i continuarà amb la fase de concurs per als aspirants que hagin superat la fase d'oposició.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els aspirants seran convocats per a cada exercici en crida única i seran exclosos de les proves selectives els qui no hi compareguin, tret dels casos degudament justificats i lliurement apreciats pel Tribunal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vegada començades les proves selectives, els successius anuncis relatius a la realització de les proves restants es faran públics a la seu electrònica del tauler d'anuncis de l'Ajuntament de Manacor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La selecció constarà de les següents fases:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMERA FASE: FASE D'OPOSICIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La puntuació màxima és de 70 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primer exercici.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; De caràcter obligatori i eliminatori per a totes les persones aspirants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Consistirà en contestar un qüestionari de 60 preguntes (més quatre preguntes de reserva), amb quatre respostes alternatives, referents al contingut del temari que figura en l'annex I de les presents bases. El temps màxim per realitzar aquest exercici serà determinat pel tribunal, i no podrà ser superior en cap cas a les dues hores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La puntuació màxima serà de 35 punts. Quedaran eliminats els aspirants que no arribin a un mínim de 17,50 punts. Les preguntes no resoltes no es valoren. Les preguntes amb resposta errònia o en les quals figuri més d'una resposta es penalitzaran amb un terç del valor assignat a la resposta correcta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per efectuar la qualificació de l'exercici s'ha d'aplicar la fórmula següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A: nombre de respostes encertades&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;E: nombre de respostes errònies&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;P: nombre de preguntes de l'exercici&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segon exercici.&lt;/span&gt;&lt;/strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;De caràcter obligatori i eliminatori per a totes les persones aspirants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Consistirà en resoldre un o diversos supòsits pràctics, proposats pel tribunal, relacionats amb el programa indicat en l'Annex I d'aquestes bases, en un temps màxim de 2 hores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per a la realització dels exercicis els aspirants podran fer ús del material que estimin convenient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En la valoració de la prova s'atendrà principalment a la claredat de l'exposició del supòsit, a la capacitat de síntesi de la qüestió plantejada i, especialment, a la coherència dels raonaments jurídics desenvolupats per aconseguir la solució proposada del cas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquest exercici es valorarà de 0 a 35 punts i seran eliminades les persones aspirants que obtinguin una puntuació menor de 17,5 punts. Les puntuacions atorgades s'expressaran sempre amb dos decimals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les qualificacions dels exercicis es faran públiques el mateix dia que s'acordin i s'exposaran al tauler d'anuncis de la seu electrònica d'aquest Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tots els aspirants disposaran d'un termini de tres dies hàbils, des de l'endemà de la publicació de l'anunci amb els resultats provisionals al tauler d'anuncis de la seu electrònica de l'Ajuntament, per efectuar les reclamacions o observacions oportunes o sol·licitar la revisió dels seus exàmens davant el tribunal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRESENTACIÓ DE MÈRITS PER A LA FASE DE CONCURS:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vegada finalitzat aquest termini si no hi ha reclamacions, o una vegada resoltes les reclamacions si n'hi hagués, començarà el termini de 5 dies hàbils comptadors a partir de l'endemà de la publicació en el tauler d'anuncis de la seu electrònica de l'Ajuntament de la llista definitiva d'aspirants que han superat la fase d'oposició, perquè les persones que hi figurin puguin presentar els mèrits que s'hagin de valorar a la fase de concurs. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Només es valoraran els mèrits obtinguts fins al darrer dia del termini de presentació de sol·licituds per prendre part en la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Tribunal Qualificador no valorarà els mèrits al·legats però no justificats en la forma que indiquen aquestes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGONA FASE: FASE DE CONCURS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La puntuació màxima és de 30 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Es valoraran els següents mèrits:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1) Experiència professional&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;A.- Experiència professional en administracions i entitats publiques amb dependència funcionarial, laboral o contractual de serveis&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; (fins a un màxim de 10 punts):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per serveis en les administracions públiques exercint funcions pròpies de defensa davant jutjats i tribunals: 0,17 punts per mes sencer treballat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per serveis en entitats públiques dependents o vinculades a una Administració pública, exercint funcions pròpies de defensa davant jutjats i tribunals: 0,12 punts per mes sencer treballat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per serveis en les administracions públiques exercint funcions d'assistència lletrada o assessorament jurídic sense actuació davant jutjats i tribunals: 0,08 punts per mes sencer treballat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per serveis en entitats públiques dependents o vinculades a una Administració pública, exercint funcions d'assistència lletrada o assessorament jurídic sense actuació davant jutjats i tribunals: 0,04 punts per mes sencer treballat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Únicament als efectes de la present convocatòria, s'entendrà per entitats públiques:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;les autoritats administratives independents vinculades a una Administració pública&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;les societats mercantils el capital social de les quals sigui de titularitat pública&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;els consorcis, i,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;les fundacions del sector públic&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;totes elles dependents o vinculades a una Administració pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si es presten de forma solapada serveis d'assistència lletrada o assessorament jurídic amb serveis propis de defensa davant jutjats i Tribunal, en la mateixa Administració o entitat, els mesos en què tots dos serveis coincideixin, només serà valorat un dels dos serveis, que serà al qual se li atorgui major puntuació d'acord amb els apartats anteriors. Únicament es podran acumular els mesos d'assessorament jurídic amb els mesos de defensa davant jutjats i Tribunal, si cada servei es presta, encara que sigui simultàniament, en diferents administracions o entitats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'experiència professional en administracions públiques i en entitats públiques s'acreditarà mitjançant un certificat expedit per l'administració o entitat corresponent on consti la relació, el servei prestat i la data d'inici i la de finalització.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'experiència professional es computa per mesos complets.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;B.- Per experiència professional amb dependència laboral o contractual de serveis fora de la Administració pública &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;relacionada amb l'àmbit jurídic en entitats o empreses privades NO dependents o vinculades a una Administració pública (fins a un màxim de 5 punts).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;exercint funcions d'assistència lletrada o assessorament jurídic sense actuació davant jutjats i tribunals: 0,04 punts per mes sencer treballat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si es presten de forma solapada serveis d'assistència lletrada o assessorament jurídic amb serveis propis de defensa davant jutjats i Tribunal, en la mateixa entitat o empresa privada, els mesos en què tots dos serveis coincideixin, només serà valorat un dels dos serveis, que serà al qual se li atorgui major puntuació d'acord amb els apartats anteriors. Únicament es podran acumular els mesos d'assessorament jurídic amb els mesos de defensa davant jutjats i Tribunal, si cada servei es presta, encara que sigui simultàniament, en diferents entitats o empreses privades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'experiència professional en entitats o empreses privades s'acreditarà mitjançant un certificat expedit per l'entitat o empresa privada corresponent on consti la relació, el servei prestat i la data d'inici i la de finalització, acompanyat d'un informe de vida laboral.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'experiència professional es computa per mesos complets.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;​​​​​​​&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2) Formació:&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Accions formatives en l'àrea jurídica administrativa (fins a un màxim de 3'50 punts):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Accions formatives continuades quan el contingut estigui directament relacionat amb les funcions de la categoria corresponent a la borsa a la qual s'opta que no siguin un curs de postgrau, especialització o expert universitari, Màster ni Doctorat (els quals seran valorats a un altre apartat).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les accions formatives han d'haver estat impartides, organitzades, subvencionades o acreditades per alguna Administració pública, per un col·legi professional, per universitats, per qualssevol organismes públics i entitats de dret públic vinculats o dependents de les administracions públiques, per entitats de dret privat vinculades o dependents de les administracions públiques o per alguna entitat privada homologada per organitzar i impartir formació de caràcter oficial, la qual cosa ha d'acreditar-se en el certificat corresponent. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;[No es puntuarà el Màster universitari ni la formació per escoles de pràctica jurídica homologades, conduents a l'obtenció del títol professional per a l'exercici de la professió de l'advocacia, ja puntuats a un altre apartat].&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Es valoraran els cursos que compleixin els requisits anteriors amb el següent contingut:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cursos de l'àrea jurídica administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'acreditació de les accions formatives es farà mitjançant certificacions o documents oficials estesos per les administracions i/o organismes competents, i han d'incloure les hores de durada o els crèdits dels cursos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La valoració es realitzarà d'acord amb la següent escala:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a.- Cursos de 21 a 40 hores: 0'33 punts per curs &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b.- Cursos de 41 a 60 hores: 0'66 punts per curs&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c.- Cursos de més de 60 hores: 1 punt per curs&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3) Altres mèrits&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A) coneixements orals i escrits de llengua catalana (fins a un màxim d'1'50 punts):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En aquest apartat es valoraran els certificats expedits per la EBAP i els expedits o homologats per la Direcció General de Política Lingüística o equivalents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Nivell LA (abans E): 0,50 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Només es valorarà el certificat del nivell més alt que s'acrediti, a més del certificat de coneixements de llenguatge administratiu, la puntuació del qual s'acumularà a la de l'altre certificat que s'acrediti. En el cas que es presentin dubtes sobre la validesa d'algun certificat o sobre la puntuació que s'hi ha d'atorgar, es pot sol·licitar un informe a la Direcció General de Política Lingüística de la Conselleria d'Educació i Cultura.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els coneixements de llengua catalana únicament es puntuen dins aquest apartat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;B) Amb un màxim de 5 punts:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) la superació acreditada dels cursos de formació reglada i de caràcter oficial organitzats i impartits per universitats públiques o privades com a Màster universitari o per escoles de pràctica jurídica homologades, conduents a l'obtenció del títol professional per a l'exercici de la professió de l'advocacia: 1,66 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) la superació de la prova d'avaluació final acreditativa de la capacitació professional per a l'exercici de l'advocacia expedida per òrgan competent: 3,33 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) la col·legiació com a exercent en un col·legi d'advocats: 3,33 punts més 0,34 punts per cada any complet de col·legiació (amb un màxim de 5 punts).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Només es puntuarà per un dels tres apartats a), b) o c).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;C) Altres (amb un màxim de 5 punts):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Per estar en possessió d'un curs de postgrau, especialització o expert universitari de més de 60 hores i menys de 120 hores, que tingui relació directa amb la plaça: 0,66 punts per curs fins a un màxim de 2 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;(No es puntuarà el Màster universitari ni la formació per escoles de pràctica jurídica homologades, conduents a l'obtenció del títol professional per a l'exercici de la professió de l'advocacia)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Per estar en possessió d'un curs de postgrau, especialització o expert universitari de més de 120 hores, que tingui relació directa amb la plaça: 1 punt per curs fins a un màxim de 3 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;(No es puntuarà el Màster universitari ni la formació per escoles de pràctica jurídica homologades, conduents a l'obtenció del títol professional per a l'exercici de la professió de l'advocacia)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Per estar en possessió d'un màster que tingui relació directa amb la plaça: 2 punts per màster fins a un màxim de 4 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;(No es puntuarà el Màster universitari ni la formació per escoles de pràctica jurídica homologades, conduents a l'obtenció del títol professional per a l'exercici de la professió de l'advocacia)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Per estar en possessió del títol de Doctor en Dret: 5 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Vuitena. ORDRE DE CLASSIFICACIÓ DEFINITIVA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'ordre de classificació definitiva de les persones aspirants serà el resultat de sumar les puntuacions obtingudes en la fase d'oposició i en la fase de concurs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cas d'empat es donarà prioritat a la major puntuació obtinguda a la fase d'oposició. Si l'empat continua, es tindrà en compte la major puntuació obtinguda en la valoració del mèrit “serveis prestats a l'Administració Pública” i, si continua, en la valoració del mèrit “serveis prestats fora de l'Administració”. En el cas de persistir la igualtat, es resoldrà per sorteig.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Novena. LLISTA DE PERSONES APROVADES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Realitzades les corresponents proves selectives, i finalitzada la fase de concurs, el tribunal qualificador publicarà en el tauler d'anuncis de la seu electrònica de l'Ajuntament la llista provisional de la valoració dels mèrits dels aspirants i la llista provisional d'aprovats amb les puntuacions obtingudes per ordre de major a menor puntuació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els aspirants disposaran d'un termini de tres dies hàbils, des del dia següent a la publicació de l'anunci, per presentar al·legacions i sol·licitar la revisió dels mèrits. Dins aquest termini els aspirants que ho considerin poden sol·licitar acudir al departament de Recursos Humans a revisar la valoració dels mèrits i, si ho consideren pertinent, presentar al·legacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vegada revisades les puntuacions i resoltes les reclamacions, en el seu cas, el tribunal farà pública la llista definitiva de la valoració dels mèrits i elevarà la proposta definitiva d'aprovats, per ordre de puntuació, a la Presidència de la corporació amb l'objectiu de constituir la borsa de treball i procedir, en el seu cas, als nomenament que siguin convenients per cobrir vacants i necessitats urgents de nomenaments.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La resolució per la qual es constitueixi aquesta borsa s'ha de fer pública en el tauler d'anuncis de la seu electrònica de l'Ajuntament i en el BOIB, amb indicació de totes les persones integrants, l'ordre de prelació i la puntuació obtinguda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Desena. FUNCIONAMENT DE LA BORSA DE TREBALL&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les persones que formen part d'aquesta borsa a l'efecte d'oferir-los un lloc de treball, estan en situació de disponible o no disponible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estan en la situació de no disponible, aquells integrants de la borsa de treball que estiguin prestant serveis com a personal funcionari interí o personal laboral temporal a l'Ajuntament de Manacor corresponent al mateix lloc de feina objecte d'aquesta convocatòria, estiguin fent substitucions diverses (per IT, llicències per maternitat...), o cobrint acumulacions o excés de tasques, o que, per concórrer alguna de les causes previstes en els apartats a), b), c) d) i e) més avall indicats, no hagin acceptat el lloc ofert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Mentre la persona aspirant estigui en la situació de no disponible en la borsa, no se la cridarà per oferir-li un lloc de treball corresponent al mateix lloc de feina objecte d'aquesta convocatòria, excepte en el cas d'oferiment de vacant a la plantilla que s'hagi de cobrir amb caràcter d'interinitat fins que es cobreixi de forma definitiva, pel procediment reglamentari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estan en la situació de disponible la resta de persones aspirants de la borsa, amb la conseqüència que se les ha de cridar per oferir-los un lloc de treball d'acord amb la seva posició en la borsa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A aquest efecte, el departament de Recursos Humans es posarà en contacte telefònic amb un màxim de tres intents o per mitjans telemàtics (correu electrònic, WhatsApp o SMS), amb la persona que correspongui i li comunicarà el lloc a cobrir i el termini en el qual cal que s'incorpori al lloc de treball, el qual no serà inferior, si la persona interessada així ho demana, a 2 dies hàbils a comptar des de la comunicació. Quedarà constància a l'expedient, mitjançant una diligència, de què aquesta persona ha rebut la comunicació o dels intents realitzats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dins el termini màxim d'un dia hàbil a comptar des de la comunicació, o dos dies si la crida es fa en divendres, la persona integrant de la borsa ha de manifestar el seu interès amb el nomenament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si dins aquest termini no manifesta la conformitat, renuncia expressament al nomenament, no respon al telèfon de contacte que ha facilitat o altre circumstància que impedeixi la seva incorporació, passarà al darrer lloc de la borsa de feina, i s'avisarà al següent de la llista. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els aspirants que hi renunciïn de forma expressa o tàcita passaran al darrer lloc de la borsa de treball, llevat que al·leguin, dins del termini establert, la concurrència d'alguna de les circumstàncies següents, que s'han de justificar documentalment dins dels tres dies hàbils següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Estar en període d'embaràs, de maternitat o de paternitat, d'adopció o d'acolliment permanent o preadoptiu, incloent-hi el període en què sigui procedent la concessió d'excedència per a cura de fills i filles per qualsevol dels supòsits anteriors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Prestar serveis en un lloc de la relació de llocs de treball de l'Ajuntament de Manacor com a personal funcionari interí en una altra escala, subescala, classe o categoria, o com a personal laboral temporal o indefinit no fix.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Prestar serveis en un lloc de la relació de llocs de treball de l'Ajuntament de Manacor com a personal funcionari de carrera i no poder acollir-se, en aplicació de la normativa, a la situació d'excedència voluntària per incompatibilitat per prestació de serveis en el sector públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Patir malaltia o incapacitat temporal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Estar, en el moment de la crida, exercint funcions sindicals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquestes persones estan obligades a comunicar per escrit al Departament de Recursos Humans l'acabament de les situacions previstes anteriorment, excepte la de l'apartat b) i c), en un termini no superior a deu dies hàbils des que es produeixi, amb la justificació corresponent, i restaran en la situació de no disponible i no rebran cap més oferta mentre es mantingui la circumstància al·legada. La manca de comunicació en el termini establert determina l'exclusió de la borsa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Quan la persona seleccionada mitjançant aquest sistema de borsa cessi en el lloc de treball, llevat que sigui per renuncia voluntària, es reincorporarà novament a la borsa de treball amb el mateix ordre de prelació que tenia. També es mantindrà en el mateix ordre de prelació la persona que, essent citada per fer efectiva una contractació, ja estigui contractada per l'Ajuntament i es mantingui en el lloc de treball que desenvolupa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La posterior renuncia d'una persona funcionària/laboral interina al lloc de treball que ocupa, així com l'incompliment del deure de prendre possessió del lloc prèviament acceptat, suposa l'exclusió de la borsa de treball.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Vigència d'aquesta borsa&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquesta borsa extraordinària tindrà una vigència màxima de 3 anys des que es publiqui la resolució de constitució al BOIB, de conformitat amb l'article 12 del Decret 30/2009, de 22 de maig. Un cop hagi transcorregut aquest període de temps la borsa perd la vigència i no es pot reactivar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Onzena. PRESENTACIÓ DE DOCUMENTS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les persones aspirants que siguin cridades i donin la seva conformitat a un nomenament hauran de presentar, en el termini màxim de dos dies hàbils comptats a partir del dia en què manifestin la conformitat, els documents següents, referits sempre a la data d'expiració del termini de presentació de sol·licituds:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Certificat mèdic acreditatiu de posseir la capacitat funcional per al desenvolupament de les funcions corresponents. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Declaració jurada o promesa que no ha estat separat o separada, mitjançant expedient disciplinari, del servei de l'Estat, de les comunitats autònomes, ni entitats locals, ni està inhabilitat o inhabilitada per a l'exercici de funcions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No podran ser contractats o contractades els qui no presentin la documentació en el termini indicat, llevat dels casos de força major, o si se'n dedueix que manquen d'algun dels requisits. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
