ca 24819 2328 510 ![CDATA[Resolució del conseller d’Educació i Universitats per la qual s'aproven les noves tarifes de serveis per a l'execució dels encàrrecs a mitjans propis que l'Administració de la Comunitat Autònoma de les Illes Balears i la resta de poders adjudicadors facin a la Fundació Universitat-Empresa de les Illes Balears MP durant l’any 2025]] 695795 2025-01-16 2025-01-15 CAIB ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fets</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Mitjançant Acord de Consell de Govern de 7 de febrer de 2022 es va atorgar a la declaració exigida en el punt primer de l'apartat d) de l'article 32.2 de la Llei 9/2017, de 8 de novembre, de contractes del sector públic, perquè la Fundació Universitat-Empresa de les Illes Balears MP (FUEIB) tingui la condició de mitjà propi de <span style="color:black">l'Administració de la Comunitat Autònoma de les Illes Balears</span> (BOIB núm. 20, de 8 de febrer).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Mitjançant el mateix Acord es va autoritzar el conseller competent en matèria d'universitat perquè aprovés les tarifes que ha de percebre la FUEIB com a contraprestació per raó dels encàrrecs de gestió que rebés de la Comunitat Autònoma de les Illes Balears com a mitjà propi, les quals s'han de calcular en funció dels costs reals imputables a l'execució dels projectes, tot tenint en compte especialment la informació que, a aquest efecte, aporti la Fundació.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. En data 8 de gener de 2025 la FUEIB va presentar davant la Conselleria d'Educació i Universitats la documentació justificativa de les noves tarifes que es proposen per a l'execució dels encàrrecs a mitjans propis que l'Administració de la Comunitat Autònoma de les Illes Balears i la resta de poders adjudicadors facin a la FUEIB (GOIBE8262/2025).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Dins d'aquestes tarifes, s'inclou el cost dels serveis prestats pel Personal Docent i Investigador de la UIB (PDI), per la realització de treballs de caràcter científic, tècnic o artístic, així com pel desenvolupament d'ensenyaments d'especialització o activitats específiques de formació, a l'empara del que disposen l'article 60 de la Llei orgànica 2/2023, del Sistema Universitari; l'article 17.2 de la Llei 14/2011, de la ciència, la tecnologia i la innovació i l'article 114 dels Estatuts de la UIB.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">També s'inclou el cost dels serveis prestats pel Personal Tècnic, de Gestió, d'Administració i Serveis de la UIB (PTGAS) derivat de la col·laboració en la realització d'encàrrecs, de conformitat amb el que estableix l'Acord Normatiu 7017/2014, de 10 de novembre de la UIB.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Així mateix s'inclouen les tarifes per a encàrrec específics dins de les quals es troben les tarifes per la prestació dels serveis de la Residència d'Estudiants, les del Servei d'anàlisi morfocomposicional aplicat a l'estudi de càlculs renals i les del servei de gestió, suport i coordinació per a la impartició de cursos de formació i l'avaluació i acreditació de les persones formades.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;<strong>Fonaments de dret</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Llei 9/2017, de 8 de novembre, de contractes del sector públic.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Decret 14/2016, d'11 de març, pel qual s'aprova el Text consolidat del Decret sobre contractació de la Comunitat Autònoma de les Illes Balears.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Els Estatuts de la Fundació Universitat-Empresa de les Illes Balears MP.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. L'Acord del Consell de Govern de 7 de febrer de 2022 pel qual es declara la Fundació Universitat-Empresa de les Illes Balears MP (FUEIB) com a mitjà propi de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per tot això, dict la següent</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolució</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Aprovar les tarifes, que s'estableixen en l'annex adjunt, aplicables als serveis dels nous encàrrecs que l'Administració de la Comunitat Autònoma de les Illes Balears i la resta de poders adjudicadors facin a la Fundació Universitat-Empresa de les Illes Balears MP durant l'any 2025, d'acord amb el que s'indica als punts següents:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Les tarifes, que inclouen tots els costos directes imputables als encàrrecs a mitjans propis pels serveis de què es tractin, i a les quals caldrà afegir, si escau, l'impost sobre el valor afegit vigent, s'han d'aplicar en funció del tipus de servei i de les unitats contractades que s'assignin a l'execució dels encàrrecs en els termes que s'indiquen a l'annex d'aquesta resolució i, si escau el costs indirectes, d'acord amb el que s'estableix als punts següents.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Els pressupostos de cada encàrrec poden incloure altres despeses que la FUEIB pot contractar amb tercers. L'import de les prestacions parcials que la FUEIB pot contractar amb tercers no pot excedir del 50 per cent de la quantia de l'encàrrec. Tot i això, no es consideraran prestacions parcials aquelles que la FUEIB adquireixi a altres empreses quan es tracti de subministraments o serveis auxiliars o instrumentals que no constitueixen una part autònoma i diferenciable de la prestació principal, encara que siguin part del procés necessari per a produir aquesta prestació.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Les despeses contractades amb tercers s'imputaran a l'encàrrec incloent els impostos no deduïbles degut a la no subjecció dels encàrrecs a l'impost sobre el valor afegit.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) El percentatge de despeses indirectes queda establert en el 20 % del total de cada epígraf del pressupost dels encàrrecs a la FUEIB, excepte per a les tarifes horàries de personal propi FUEIB, PDI i PTGAS en les quals les despeses indirectes s'han incorporat al càlcul de les tarifes horàries.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) Sense perjudici d'aquestes tarifes d'aplicació general, es poden incorporar als encàrrecs altres preus públics d'aquest pressupost, així com aprovar tarifes específiques per als encàrrecs que ho requereixen per consideració a les seves particularitats, per mitjà d'una altra resolució del conseller de la conselleria d'adscripció.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Deixar sense efectes les tarifes anteriors per l'execució dels nous encàrrecs a mitjans propis que l'Administració de la Comunitat Autònoma de les Illes Balears i la resta de poders adjudicadors facin a la Fundació Universitat-Empresa de les Illes Balears MP a partir de l'1 de gener de 2025.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.
