&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Mitjançant la&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;Resolució de la consellera de Presidència, Funció Pública i Igualtat de 16 de &lt;/span&gt;&lt;span style="color:#000000"&gt;setembre &lt;/span&gt;&lt;span style="color:#000000"&gt;de 20&lt;/span&gt;&lt;span style="color:#000000"&gt;22&lt;/span&gt;&lt;span style="color:#000000"&gt;, es varen aprovar les b&lt;/span&gt;&lt;span style="color:#000000"&gt;ase&lt;/span&gt;&lt;span style="color:#000000"&gt;s &lt;/span&gt;&lt;span style="color:#000000"&gt;ge&lt;/span&gt;&lt;span style="color:#000000"&gt;nerals que han de regir el procés excepcional d'estabilització per concurs extraordinari de mèrits per cobrir les places de personal funcionari de l'Administració general i especial de la Comunitat Autònoma de les Illes Balears &lt;/span&gt;&lt;span style="color:#000000"&gt;(BOIB núm. &lt;/span&gt;&lt;span style="color:#000000"&gt;122&lt;/span&gt;&lt;span style="color:#000000"&gt;, de 17 de setembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. En data 17 de desembre de 2024 es va publicar en el BOIB núm. 154, la Resolució de la consellera de Presidència i Administracions Públiques per la qual es varen aprovar les llistes d'aspirants que han superat el procés excepcional d'estabilització per concurs extraordinari de mèrits per als cos auxiliar facultatiu, escala professional d'infraestructures, especialitat auxiliar facultatiu per a l'illa d'Eivissa i s'ofereixen els llocs de feina.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Una vegada que les persones aspirants que han superat el procés selectiu han presentat la sol·licitud i s'ha comprovat el compliment dels requisits, han de ser nomenades personal funcionari de carrera d'aquest cos, escala, especialitat de l'Administració especial de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El Decret llei 6/2022, de 13 de juny, de noves mesures urgents per reduir la &lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;temporalitat en l'ocupació pública de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El Decret 27/1994, d'11 de març, pel qual s'aprova el Reglament d'ingrés del personal al servei de la Comunitat Autònoma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La Resolució de la consellera de Presidència, Funció Pública i Igualtat, per la qual s'aprova la convocatòria del procés excepcional d'estabilització per concurs extraordinari de mèrits per cobrir les places de personal funcionari de l'Administració general i especial de la Comunitat Autònoma de les Illes Balears (BOIB núm. 122, de 17 de setembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. El Decret 8/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual es determina la composició del Govern i s'estableix l'estructura de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. El Decret 9/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual es disposa el nomenament dels membres del Govern de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. El Decret 12/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;9. L'article 5.2 de l'annex del Decret 31/2012, de 13 d'abril, pel qual s'aproven els Estatuts de l'Escola Balear d'Administració Pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Nomenar personal funcionari de carre&lt;span style="color:#000000"&gt;ra del cos &lt;/span&gt;&lt;span style="color:#000000"&gt;auxiliar &lt;/span&gt;&lt;span style="color:#000000"&gt;facultatiu,&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;escala professional d'infraestructures,&lt;/span&gt;&lt;span style="color:#000000"&gt; especialitat auxiliar facultatiu &lt;/span&gt;&lt;span style="color:#000000"&gt;per a l'illa d'&lt;/span&gt;&lt;span style="color:#000000"&gt;Eivissa &lt;/span&gt;&lt;span style="color:#000000"&gt;de l'Administració &lt;/span&gt;&lt;span style="color:#000000"&gt;especial de la Comunitat Autònoma de les Illes Balears les persones següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Adjudicar els llocs de treball, d'acord amb el que s'indica en l'annex d'aquesta Resolució, a les persones aspirants que han superat el concurs extraordinari de mèrits d&lt;span style="color:#000000"&gt;el cos &lt;/span&gt;&lt;span style="color:#000000"&gt;auxiliar &lt;/span&gt;&lt;span style="color:#000000"&gt;facultatiu &lt;/span&gt;&lt;span style="color:#000000"&gt;de &lt;/span&gt;l'Administració &lt;span style="color:#000000"&gt;especial de&lt;/span&gt; la Comunitat Autònoma de les Illes Balears, després d'haver presentat la documentació pertinent, d'acord amb la seva petició efectuada i la puntuació obtinguda en el procés selectiu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La presa de possessió s'ha d'efectuar en la conselleria corresponent, en el termini de tres dies hàbils comptadors a partir de l'endemà de la publicació d'aquesta Resolució en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Abans de prendre possessió del lloc adjudicat, les persones interessades han de fer constar que no ocupen cap lloc de treball ni que fan cap activitat en el sector públic que es comprenen en l'article 1 de la Llei 53/1984, de 26 de desembre, d'incompatibilitats del personal al servei de les administracions públiques. Si du a terme cap activitat privada, incloses les de caràcter professional, ho ha de declarar en el termini de deu dies hàbils comptadors a partir de l'endemà de la presa de possessió, perquè l'òrgan competent acordi la declaració de compatibilitat o incompatibilitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Un cop publicat el nomenament, per adquirir la condició de funcionari de carrera s'ha d'efectuar el jurament o la promesa d'acatar la Constitució, l'Estatut d'Autonomia de la Comunitat Autònoma de les Illes Balears i l'ordenament vigent i prendre possessió en el termini reglamentari.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5. Declarar desistides de la seva sol·licitud per caducitat i excloses del procediment, a les persones que no han presentat l'escrit d'elecció dels llocs de treball oferts, per ordre de preferència, i la documentació acreditativa del compliment dels requisits, d'acord amb la base 12 de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra aquesta Resolució, que posa fi a la via administrativa, es pot interposar un recurs potestatiu de reposició davant la consellera de &lt;span style="color:#000000"&gt;Presidència&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;i Administracions Públiques&lt;/span&gt; en el termini d'un mes, comptador a partir del següent a la seva publicació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú, i l'article 57 de la Llei 3/2003, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;També es pot interposar un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears, en el termini de dos mesos comptador a partir del següent a la publicació de la resolució, d'acord amb els articles 8.2 i 46.1 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:block; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
