    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Es fa públic que&lt;span style="color:#000000"&gt; &lt;/span&gt;en data del 18/12/202&lt;/span&gt;&lt;span style="color:#000000"&gt;4 la Junta de Govern local de l'Ajuntament de Ciutadella de Menorca va acordar aprovar les bases reguladores de la convocatòria per a l'assignació de l'ús privatiu d'una parcel·la d'hort a l'hort urbà sa Vinyeta, de Ciutadella de Menorca, dirigida a persones a títol individual. Així mateix, es va aprovar la convocatòria corresponent a l'exercici de 2024 que es regeix per les bases assenyalades anteriorment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Se'n podran consultar aquestes i els annexos al web municipal de l'Ajuntament de Ciutadella de&lt;span style="color:#000000"&gt; &lt;/span&gt;Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. Normes generals&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1.1. En data 9 d'agost de 2018 i BOIB núm. 98 es publica l'aprovació definitiva de la&lt;span style="color:#000000"&gt; &lt;/span&gt;modificació del Reglament de règim d'ús dels horts urbans de Ciutadella de Menorca. Per tant,&lt;span style="color:#000000"&gt; &lt;/span&gt;les bases reguladores es presenten d'acord amb l'esmentat Reglament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1.2. L'objecte d'aquestes bases és regular l'atorgament mitjançant convocatòria pública de l'ús&lt;span style="color:#000000"&gt; &lt;/span&gt;temporal dels horts urbans de Sa Vinyeta destinats a persones que compleixin els requisits que&lt;span style="color:#000000"&gt; &lt;/span&gt;més endavant es detallen i vulguin disposar d'una parcel·la d'hort per un període de quatre&lt;span style="color:#000000"&gt; &lt;/span&gt;anys, sense possibilitat de pròrroga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1.3. En el cas que un hort quedi sense treballar més de 6 mesos per la persona adjudicatària&lt;span style="color:#000000"&gt; &lt;/span&gt;sense que hi hagi una comunicació expressa i motivada a l'Ajuntament de Ciutadella de&lt;span style="color:#000000"&gt; &lt;/span&gt;Menorca, aquest quedarà lliure i podrà ser adjudicat novament a una altra persona usuària en&lt;span style="color:#000000"&gt; &lt;/span&gt;una nova convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1.4. Les llicències municipals atorgades en virtut d'aquest reglament tindran la naturalesa&lt;span style="color:#000000"&gt; &lt;/span&gt;d'autoritzacions d'ús privatiu del domini públic, regulat en el Reglament de béns de les&lt;span style="color:#000000"&gt; &lt;/span&gt;corporacions locals, aprovat mitjançant reial decret 1372/1986, i en la Llei 33/2003 de patrimoni&lt;span style="color:#000000"&gt; &lt;/span&gt;de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1.5. Aquestes llicències s'atorguen salvant el dret de propietat i sense perjudici d'altre i, per&lt;span style="color:#000000"&gt; &lt;/span&gt;tant, no suposa, en cap cas, la transmissió del domini de la parcel·la d'hort utilitzada, que&lt;span style="color:#000000"&gt; &lt;/span&gt;continuarà essent propietat de l'Ajuntament de Ciutadella de Menorca, tant respecte al terreny&lt;span style="color:#000000"&gt; &lt;/span&gt;com respecte a totes les instal·lacions existents en el moment d'atorgament de la llicència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1.6. La persona adjudicatària solament tindrà la possessió de l'hort municipal que se li assigni,&lt;span style="color:#000000"&gt; &lt;/span&gt;pel termini que es determini i en els termes que preveu la llicència o el document de&lt;span style="color:#000000"&gt; &lt;/span&gt;formalització de l'adjudicació i la resta d'articles del reglament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1.7. Les llicències atorgades tenen caràcter personal, i, en cap cas, les persones titulars no&lt;span style="color:#000000"&gt; &lt;/span&gt;podran cedir, alienar, gravar o disposar, a títol onerós o gratuït, els drets que es derivin de&lt;span style="color:#000000"&gt; &lt;/span&gt;l'autorització d'ús, ni transmetre'l a tercers.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1.8. La ubicació dels horts està emplaçada a Sa Vinyeta, en el terme municipal de Ciutadella&lt;span style="color:#000000"&gt; &lt;/span&gt;de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1.9. Cada parcel·la d'hort consta d'uns 40 metres quadrats, aproximadament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. Persones destinatàries dels horts&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Els horts urbans van dirigits a persones a partir de 55 anys d'edat i pensionistes en el moment&lt;span style="color:#000000"&gt; &lt;/span&gt;de la sol·licitud. S'entén pensionista aquella persona que percep qualsevol tipologia de pensió,&lt;span style="color:#000000"&gt; &lt;/span&gt;en la modalitat de contributiva o no. A més, han d'estar empadronades en el municipi de&lt;span style="color:#000000"&gt; &lt;/span&gt;Ciutadella i no han de disposar, com a mínim des de la data de finalització del termini de&lt;span style="color:#000000"&gt; &lt;/span&gt;presentació de la sol·licitud d'adjudicació, d'un altre hort privat, i han d'estar al corrent pel que&lt;span style="color:#000000"&gt; &lt;/span&gt;fa al compliment de les obligacions tributàries, amb la Seguretat Social i amb la hisenda pública&lt;span style="color:#000000"&gt; &lt;/span&gt;municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. Parcel·les disponibles&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Hi ha disponibles en aquesta convocatòria 6 parcel·les per a persones a títol individual,&lt;span style="color:#000000"&gt; &lt;/span&gt;concretament les parcel·les número 1, número &lt;/span&gt;&lt;span style="color:#000000"&gt;3&lt;/span&gt;&lt;span style="color:#000000"&gt;, número &lt;/span&gt;&lt;span style="color:#000000"&gt;6&lt;/span&gt;&lt;span style="color:#000000"&gt;, número&lt;/span&gt;&lt;span style="color:#000000"&gt; 7&lt;/span&gt;&lt;span style="color:#000000"&gt;, número &lt;/span&gt;&lt;span style="color:#000000"&gt;15&lt;/span&gt;&lt;span style="color:#000000"&gt; i la&lt;/span&gt;&lt;span style="color:#000000"&gt; número 23.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4. Requisits i condicions de les persones aspirants&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4.1. Per poder optar a l'adjudicació d'una parcel·la, caldrà tenir les condicions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;a) Ser persona física igual o major de 55 anys i pensionista.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;b) En la data d'inici del procés de sol·licituds, estar empadronada al municipi de Ciutadella de&lt;span style="color:#000000"&gt; &lt;/span&gt;Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;c) Es podrà presentar una sol·licitud per nucli de convivència, entenent-se per &lt;em&gt;nucli&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;convivencial &lt;/em&gt;aquelles persones que conviuen en un mateix domicili i mantenen una relació&lt;span style="color:#000000"&gt; &lt;/span&gt;d'aliança o filiació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;d) No disposar, a títol de persona propietària, de cap altre hort ni terreny de conreu. Aquest&lt;span style="color:#000000"&gt; &lt;/span&gt;extrem s'acreditarà mitjançant la presentació d'una declaració responsable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;e) No haver-se adjudicat una altra parcel·la o cap altre hort a un membre del mateix nucli de&lt;span style="color:#000000"&gt; &lt;/span&gt;convivència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4.2. A l'efecte d'establir una puntuació amb les persones sol·licitants que tenen els requisits i&lt;span style="color:#000000"&gt; &lt;/span&gt;en cas d'haver-hi més sol·licitants que parcel·les disponibles, s'estableix el barem següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Es valorarà el còmput mensual d'ingressos econòmics del nucli de convivència, calculats a&lt;span style="color:#000000"&gt; &lt;/span&gt;partir del vigent IPREM. Es donarà una major puntuació en l'accés a una parcel·la de l'hort urbà&lt;span style="color:#000000"&gt; &lt;/span&gt;a les persones o als nuclis de convivència amb ingressos econòmics més baixos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-Ingressos econòmics del nucli de convivència igual o inferiors a 700.00 € mensuals (IPREM&lt;span style="color:#000000"&gt; &lt;/span&gt;anual 2024 14 pagues): 5 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-Ingressos superiors a 700.00 € i inferiors a 875.00 € (125% d'IPREM): 3 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;-Ingressos superiors a 875.00 € i inferiors a 1050.00 € (150% d'IPREM): 2 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;D'altra banda, es valorarà amb 5 punts en el cas de les persones que viuen soles en un&lt;span style="color:#000000"&gt; &lt;/span&gt;domicili, segons dades extretes del padró d'habitants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Per poder valorar la puntuació, les persones sol·licitants hauran de presentar els ingressos&lt;span style="color:#000000"&gt; &lt;/span&gt;econòmics dels membres del nucli convivencial: declaració de la renda o, en cas de no&lt;span style="color:#000000"&gt; &lt;/span&gt;presentar-ne, s'ha de presentar un certificat de la pensió o de les pensions concedides i de la&lt;span style="color:#000000"&gt; &lt;/span&gt;resta d'ingressos provinents de lloguers o d'altres percebuts. D'altra banda, l'Ajuntament de&lt;span style="color:#000000"&gt; &lt;/span&gt;Ciutadella comprovarà d'ofici la situació convivencial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5. Presentació de sol·licituds&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Es podrà presentar la sol·licitud, segons el model normalitzat, a l'Oficina d'Atenció al Ciutadà&lt;span style="color:#000000"&gt; &lt;/span&gt;per tal que en quedi registrada l'entrada així com de forma telemàtica, tal com ho preveu la&lt;span style="color:#000000"&gt; &lt;/span&gt;LPAC 39/2015. Haurà d'anar adreçada al Servei d'Atenció Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Les persones que sol·licitin una parcel·la hauran de presentar els documents acreditatius&lt;span style="color:#000000"&gt; &lt;/span&gt;següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;a) Sol·licitud de parcel·la d'hort urbà a Sa Vinyeta (annex I).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;b) Declaració responsable (annex II).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;c) Fotocòpia del DNI.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;d) Declaració de la renda o, si no en té, certificat de la pensió o de les pensions que percebi la&lt;span style="color:#000000"&gt; &lt;/span&gt;persona sol·licitant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6. Termini de presentació i esmena de les sol·licituds&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6.1. El termini de presentació de sol·licituds serà de 20 dies hàbils a partir de l'endemà d'haver-se publicat aquesta convocatòria en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6.2. Si de la revisió de la sol·licitud i de la documentació aportada es dedueix que aquesta és&lt;span style="color:#000000"&gt; &lt;/span&gt;incompleta o defectuosa, l'òrgan competent requerirà la persona sol·licitant perquè, en el&lt;span style="color:#000000"&gt; &lt;/span&gt;termini de deu dies, com expressa l'article 26 de la Llei de règim jurídic de les administracions&lt;span style="color:#000000"&gt; &lt;/span&gt;públiques i del procediment administratiu comú, aporti la documentació necessària o esmeni&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;els defectes observats. En aquest requeriment s'ha d'indicar que, si en el termini establert no&lt;span style="color:#000000"&gt; &lt;/span&gt;s'esmenen les deficiències, es desestimarà la sol·licitud, resolució prèvia que s'ha de dictar en&lt;span style="color:#000000"&gt; &lt;/span&gt;els termes que preveu l'article 42 del cos legal esmentat, i que l'expedient s'arxivarà d'acord&lt;span style="color:#000000"&gt; &lt;/span&gt;amb l'article 71 del mateix cos legal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. Procediment de concessió de parcel·les d'hort a Sa Vinyeta&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;7.1. El sistema d'adjudicació de les llicències d'ús privatiu del domini públic sobre parcel·les&lt;span style="color:#000000"&gt; &lt;/span&gt;municipals d'hort es farà en funció de la puntuació obtinguda, així com ve establert en el punt&lt;span style="color:#000000"&gt; &lt;/span&gt;4.2 de la present convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;7.2. El personal tècnic municipal de Serveis Socials i de Medi Ambient, juntament amb la&lt;span style="color:#000000"&gt; &lt;/span&gt;Secretaria municipal, valorarà l'admissió de les sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;7.3. En cas d'igualtat en la puntuació resultant i si existeix més sol·licituds que parcel·les d'hort&lt;span style="color:#000000"&gt; &lt;/span&gt;disponibles, l'ordre i per tant, l'adjudicació es determinarà per sorteig i la selecció de la&lt;span style="color:#000000"&gt; &lt;/span&gt;parcel·la també s'adjudicarà pel mateix procediment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;7.4. Una vegada acceptada la sol·licitud, en la data i en el lloc que es comuniqui oportunament&lt;span style="color:#000000"&gt; &lt;/span&gt;i en un acte públic, tindrà lloc el sorteig a partir del qual s'aprovaran les adjudicacions de les&lt;span style="color:#000000"&gt; &lt;/span&gt;llicències d'ús privatiu de parcel·les de l'hort municipal en cas d'empat de puntuació i d'excés&lt;span style="color:#000000"&gt; &lt;/span&gt;de sol·licituds enfront del nombre de parcel·les. D'igual forma se sortejaran l'assignació de les&lt;span style="color:#000000"&gt; &lt;/span&gt;parcel·les. Es traurà una butlleta amb un número i, a partir d'aquest, es comptaran els números&lt;span style="color:#000000"&gt; &lt;/span&gt;posteriors per tal d'adjudicar la totalitat dels horts urbans trets a concurs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8. Formalització de les adjudicacions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La persona que exerceix l'alcaldia o la regidoria delegada aprovarà les adjudicacions de les&lt;span style="color:#000000"&gt; &lt;/span&gt;diverses llicències d'ús privatiu del domini públic dels horts municipals, a la vista de l'informe&lt;span style="color:#000000"&gt; &lt;/span&gt;emès pel personal tècnic i de la Secretaria Municipal, una vegada efectuat, si escau, el sorteig&lt;span style="color:#000000"&gt; &lt;/span&gt;públic. Es notificarà a totes les persones participants la seva licitació. Així mateix es publicarà&lt;span style="color:#000000"&gt; &lt;/span&gt;la llista al tauler d'anuncis i al web municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El document administratiu que formalitzarà les adjudicacions de les llicències d'ús privatiu&lt;span style="color:#000000"&gt; &lt;/span&gt;(annex III) contindrà el següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- Dades de la persona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- Finalitat d'ús.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- Mesura, localització i número de la parcel·la.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- Drets i obligacions de la persona adjudicatària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- Durada de l'autorització.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La formalització d'aquest document que es signarà una vegada adjudicada la parcel·la d'hort,&lt;span style="color:#000000"&gt; &lt;/span&gt;suposa el reconeixement formal per part de les persones del dret de propietat de l'Ajuntament&lt;span style="color:#000000"&gt; &lt;/span&gt;de Ciutadella de la finca que se li assigna, així com totes les instal·lacions inseparables del&lt;span style="color:#000000"&gt; &lt;/span&gt;terreny i la total acceptació del règim jurídic que preveu aquest reglament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9. Lliurament d'autoritzacions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Les persones adjudicatàries hauran de recollir els títols acreditatius del seu dret atorgats per&lt;span style="color:#000000"&gt; &lt;/span&gt;l'Ajuntament de Ciutadella dins el termini de 30 dies a comptar des de la notificació de&lt;span style="color:#000000"&gt; &lt;/span&gt;l'adjudicació. Quan no es pugui formalitzar el document administratiu dins del termini indicat,&lt;span style="color:#000000"&gt; &lt;/span&gt;l'Ajuntament en podrà acordar la resolució, per entendre que es renuncia a aquesta&lt;span style="color:#000000"&gt; &lt;/span&gt;adjudicació, si no és que la persona adjudicatària pugui demostrar les causes que li han&lt;span style="color:#000000"&gt; &lt;/span&gt;impedit la formalització del document.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;b) No dispòs de l'ús de cap altre hort ni terreny de conreu privat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;c) Accept totes i cadascuna de les condicions establertes en el Reglament de règim d'ús dels&lt;span style="color:#000000"&gt; &lt;/span&gt;horts urbans de Ciutadella de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Informació sobre protecció de dades de caràcter personal, en compliment del Reglament UE 2016/679 del&lt;span style="color:#000000"&gt; &lt;/span&gt;Parlament Europeu i del Consell, de 27 d'abril de 2016 («RGPD») i la Llei Orgànica 3/2018, de 5 de desembre, de&lt;span style="color:#000000"&gt; &lt;/span&gt;Protecció de Dades i Garantia dels Drets Digitals («LOPDGDD»).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;Finalitats i legitimació: &lt;/strong&gt;(i) Tramitar i gestionar les sol·licituds per a l'obtenció d'una parcel·la d'hort urbà, sobre la&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;base del compliment d'una obligació legal (art. 6.1.c) RGPD).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;Termini de conservació&lt;/strong&gt;: Les dades seran conservades mentre no retiri el seu consentiment i, a la seva retirada,&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;durant el temps de prescripció de les possibles responsabilitats jurídiques.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;Destinataris&lt;/strong&gt;: No cedim dades a tercers excepte: (i) els necessaris conforme a llei; (ii) proveïdors de serveis en la&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;seva condició d'encarregats del tractament.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;Drets: &lt;/strong&gt;Accés, rectificació, oposició, supressió, limitació al tractament, dret a no veure's sotmès a decisions basades&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;únicament en tractaments automatitzats i a retirar el consentiment prestat, que podrà exercitar: (i) Telemàticament&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;mitjançant Registre d'entrada a través de la Carpeta ciutadana de l'Ajuntament de Ciutadella; (ii) Presencialment&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;mitjançant Registre d'entrada a l'Oficina d'Atenció al Ciutadà. A més, podrà, en qualsevol moment, formular una&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;reclamació davant l'autoritat de control competent.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;Transferències internacionals: &lt;/strong&gt;No es preveuen transferències internacionals de dades.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
