El vicepresident del Consorci Serra de Tramuntana Patrimoni Mundial ha dictat, el dia 20 de març de 2024, va resoldre aprovar convocatòria de subvencions destinades a ajuntaments, per a l'any 2024, per a la recuperació d'elements etnològics i arquitectònics amb valors patrimonials, per a la recuperació del paisatge agrícola i el seu entorn i dels espais agrícoles i forestals, de titularitat municipal, per al manteniment, la neteja i la conservació d'espais públics que per les seves característiques necessitin d'una especial cura, i per a la redacció i/o actualització de catàlegs municipals de camins públics, que estiguin situats dins l'àmbit territorial de la serra de tramuntana (SV 2/2024)</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. L'extracte de la convocatòria de subvencions, així com la mateixa convocatòria, es varen publicar al BOIB núm. 40, de dia 23 de març de 2024.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.Durant el període d'un mes per presentar sol·licituds, fins dia 23 d'abril de 2024, es varen presentar 32 sol·licituds de subvencions per a ajuntaments.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Les sol·licituds s'han revisat pel centre gestor i el personal del Servei de Gestió de Paratges Culturals del Departament de Presidència; servei que té encomanada la funció de gestionar el Consorci Serra de Tramuntana. Arran d'aquesta revisió, en diverses dates, el sr. Gabriel Ordinas Marcè, tècnic de Patrimoni Etnològic i la sra. Carolina de Pablos Puig, enginyera agrònoma del Consorci Serra de Tramuntana, han emès els informes tècnics, dels quals es fonamenta la viabilitat tècnica dels projectes sol·licitats.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Revisada la documentació administrativa i tècnica presentada, en data 19 de novembre de 2024, la cap de servei jurídic del Servei de Gestió de Paratges Culturals del Departament de Presidència, en les seves funcions d'instructora de l'expedient, va emetre l'informe sobre el compliment dels requisits de la convocatòria per part de les entitats beneficiàries i ha emès informe jurídic favorable sobre els aspectes jurídics de la proposta de resolució de concessió de les subvencions que ens ocupa.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. En data 4 de desembre de 2024 Intervenció Delegada va fiscalitzar de conformitat la Proposta de resolució de concessió de data 3 de desembre de 2024.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonaments de dret</strong></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El procediment de concessió de les subvencions regulades per la present convocatòria pública s'ha dut a terme, mitjançant règim de concurrència no competitiva, d'acord amb l'article 17,2 de l'Ordenança General de Subvencions, per ordre d'entrada en el registre del Consorci Serra de Tramuntana, en els termes de la base cinquena de la convocatòria. D'aquesta manera seran subvencionades fins exhaurir el total del crèdit assignat per a la convocatòria totes aquelles sol·licituds completes que compleixin els requisits que s'hi estableixen, i, per tant, no és necessària la comparació entre les sol·licituds.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Al cas que ens ocupa, atenent l'ordre de prioritat d'entrada per registre de les sol·licituds presentades, s'ha previst el crèdit adequat i suficient per fer front a les despeses que es deriven de la línia de subvencions i queda crèdit suficient per poder dur a terme la concessió de totes les subvencions que aquí es proposaran. Concretament el crèdit total disponible és de 300.000 €, dels quals segons el perfil de beneficiari és el següent:</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Dos-cents cinquanta mil euros (250.000,00 €) aniran destinats als ajuntaments en les línies corresponents a subvencions per a la recuperació d'elements etnològics i arquitectònics amb valor patrimonial i per a la recuperació dels espais agrícoles i/o forestals de titularitat municipal. Aquesta quantia s'imputa a l'aplicació pressupostària 00 33615 76200 (documents comptables RC 220240000028 i A220240000468). Aquesta quantia es podria veure incrementada fins a un import total màxim de 400.000 € condicionat a l'existència de crèdit adequat i suficient en el moment de la concessió de les subvencions i amb la distribució que es preveu a la convocatòria.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cinquanta mil euros (50.000,00 €) aniran destinats als ajuntaments en la línia corresponent als espais públics que per les seves característiques especials necessitin d'una especial cura en el seu manteniment, neteja i conservació i a la línia de redacció i/o actualització de catàlegs municipals de camins públics. Aquesta quantia s'imputa a l'aplicació pressupostària 00 33615 46200 (documents comptables RC 220240000029 i A 220240000469). Aquesta quantia no pot ser objecte d'ampliació segons la convocatòria.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Per determinar l'import que es proposa concedir s'ha valorat la sol·licitud, la documentació aportada i la comprovació de la realitat física en la que es pretén actuar, d'acord amb les regles previstes a la base setena i els límits regulats a la base tercera de la convocatòria.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A cada expedient consta crèdit adequat i suficient per dur a terme la despesa de les concessions de subvenció que es tramiten.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. La base onzena de la convocatòria estableix les funcions de l'instructor de l'expedient, que diu que; “La instrucció correspon al cap de servei jurídic del Servei de Gestió de Paratges Culturals del Departament de Presidència, que ha de dur a terme totes les actuacions o els actes de tràmit necessaris per vetllar pel compliment dels requisits de la convocatòria, a més d'exercir les facultats previstes en l'article 16 del Decret Legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions, i les que s'esmenten en l'Ordenança General de Subvencions del Consell de Mallorca. L'òrgan instructor pot requerir a les entitats sol·licitants els informes o els aclariments que consideri convenients. L'instructor de l'expedient podrà assessorar-se per qualsevol tècnic del Consell de Mallorca que consideri adequat.”. Sent el Consorci Serra de Tramuntana el centre gestor responsable del seguiment de les subvencions.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Amb aquesta finalitat, la instructora de l'expedient amb la col·laboració del personal del Consorci des d'un punt de vista administratiu i jurídic, i dels tècnics del Consell de Mallorca, des d'un punt de vista tècnic, han dut a terme tota aquesta tasca. </span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. La base segona regula la condició de beneficiari d'aquestes subvencions, i estableix, entre d'altres, que no poden ser beneficiaris els que, en el moment que l'òrgan instructor de la convocatòria ha de fer la proposta d'acord definitiva, no estan al corrent en el compliment de les obligacions tributàries i amb la Seguretat Social davant l'Administració de l'Estat i amb les obligacions tributàries amb el Consell de Mallorca. Igualment, la base segona estableix que les esmentades circumstàncies s'han d'acreditar abans de la proposta de resolució de concessió i en el moment de pagament de la subvenció.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Revisat aquest requisit, s'ha constatat que els sol·licitants no incompleixen amb les obligacions tributàries i amb la Seguretat Social davant l'Administració de l'Estat i amb les obligacions tributàries amb el Consell de Mallorca i el Consorci Serra de Tramuntana.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. La proposta de resolució de concessió serà redactada per la instructora de l'expedient d'acord amb l'apartat 1 de la base onzena de la convocatòria, i s'ajusta al que estableix l'article 16.4 del Decret Legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de Subvencions, en el sentit que ha d'incloure la relació d'entitats beneficiàries, atès que inclou la relació de persones beneficiàries, amb indicació del beneficiari, el NIF parcial, el concepte, el pressupost, la quantia sol·licitada i l'import concedit, a més de la resta de sol·licituds desestimades o excloses.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. La competència per aprovar la resolució de concessió recau en la vicepresidència del Consorci Serra de Tramuntana d'acord amb l'article 11 e) dels Estatuts del Consorci Serra de Tramuntana i d'acord amb la base onzena de la convocatòria.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per tot el que s'ha exposat i d'acord amb la base onzena de la convocatòria, dicto la següent</span></span></p> <p style="text-align:center"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolució</strong></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Concedir als sol·licitants que es detallen als Annexes 1.A i 1.B adjunts, la quantitat total de tres cents mil euros (300.000,00 €) i disposar-ne la despesa a favor seu.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">D'aquesta quantitat total, dos cents cinquanta mil euros (250.000,00 €) va destinada a ajuntaments per a la recuperació d'elements etnològics i arquitectònics amb valor patrimonial, per a la recuperació dels espais agrícoles i/o forestals de titularitat municipal que estiguin situats dins l'àmbit territorial de la Serra de Tramuntana, i s'ha d'imputar a l'aplicació pressupostària 00.33615.76200 del pressupost de despeses del Consorci Serra de Tramuntana per a l'any 2024 i al projecte amb finançament afectat 2024/2/33615/1/1 (A 220240000468). A l'annex 1.A consta l'import que es concedeix i la operació comptable D provisional que va associada a cada expedient.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">I cinquanta mil euros (50.000,00 €) van destinats als ajuntaments per al manteniment, la neteja i la conservació d'espais públics que per les seves característiques especials necessitin d'una cura, i per a la redacció i/o actualització de catàlegs municipals de camins públics que estiguin situats dins l'àmbit territorial de la Serra de Tramuntana, i s'ha d'imputar a l'aplicació pressupostària 00.33615.46200 del pressupost de despeses del Consorci Serra de Tramuntana per a l'any 2024 (A 220240000469). A l'annex 1.B consta l'import que es concedeix i&nbsp; l'operació comptable D provisional que va associada a cada expedient.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Requerir als beneficiaris prevists a l'annex 1.A i 1.B perquè compleixin amb les obligacions previstes a la base quinzena de la convocatòria, i també executin i justifiquin la subvenció rebuda d'acord amb els terminis prevists a la base catorzena. És a dir, les beneficiàries o els beneficiaris, hauran d'haver executat i justificat les actuacions fins dia 20 de desembre de 2024. Aquest termini ha estat objecte d'ampliació per Resolució del vicepresident del Consorci Serra de Tramuntana de dia 14 d'octubre de 2024 ( BOIB núm. 149 de 14 de novembre de 2024)&nbsp; segons la qual s'amplia fins dia 31 de març de 2025 la justificació dels projectes de subvenció concedits als Ajuntaments i l'execució i justificació dels&nbsp; projectes de subvenció amb bestreta sol·licitada concedits als Ajuntaments.</span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.
