En tractar-se d&amp;apos;un lloc de treball catalogat, la provisió del qual és inajornable per desenvolupar les funcions que té encomanades el Consell Insular, és recomanable convocar l&amp;apos;esmentat lloc pel procediment de comissió de serveis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 10)"&gt;D&amp;apos;acord amb el que estableix l&amp;apos;article 82 de la Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears, modificat pel Decret llei 2/2013, de 14 de juny, que regula la comissió de serveis ordinària voluntària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Atesa la proposta de la consellera executiva del Departament d&amp;apos;Economia i Serveis Generals;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El Consell Executiu, per unanimitat i en votació ordinària, adopta l&amp;apos;acord següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Aprovar la convocatòria i les bases per a la cobertura del lloc de treball de cap insular de bombers, mitjançant el sistema de comissió de serveis ordinària voluntària, que consten com annex.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El requisit de coneixement de la llengua catalana corresponent al nivell exigit per al lloc de feina establert s&amp;apos;ha d&amp;apos;acreditar mitjançant la presentació del certificat oficial de coneixements de català que prevegi el Catàleg o Relació de llocs de treball del Consell Insular de Menorca d&amp;apos;acord amb el Reglament d&amp;apos;usos lingüístics del Consell Insular de Menorca, aprovat definitivament pel Ple en sessió de caràcter ordinari de 15 de febrer de 2021 i publicada en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; núm. 39 de 20 de març.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Els estudis de llengua catalana de l&amp;apos;ESO i del batxillerat es poden homologar amb els certificats oficials de coneixements de llengua catalana A2, B1, B2 i C1 de la Direcció General de Política Lingüística.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;S&amp;apos;acceptarà l&amp;apos;homologació del certificat de català sempre que la sol·licitud d&amp;apos;aquesta s&amp;apos;hagi realitzat abans de finalitzar el termini de presentació de sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Contra aquest acord, que no posa fi a la via administrativa, es pot interposar recurs d&amp;apos;alçada en el termini d&amp;apos;un mes a partir de l&amp;apos;endemà d&amp;apos;haver-se publicat. El recurs es pot interposar formalment davant el mateix Consell Executiu o davant la Comissió de Govern, que és l&amp;apos;òrgan competent per resoldre&amp;apos;l.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Contra la desestimació expressa d&amp;apos;aquest recurs d&amp;apos;alçada es pot interposar un recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma que correspongui en el termini de dos mesos comptadors a partir de l&amp;apos;endemà de rebre la notificació de la desestimació d&amp;apos;aquest recurs d&amp;apos;alçada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Si han transcorregut tres mesos des de la interposició del recurs d&amp;apos;alçada i no s&amp;apos;ha rebut la notificació expressa, s&amp;apos;entén desestimat per silenci i es pot interposar el recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma que correspongui, sense limitació de temps.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;No obstant això, si escau, es pot interposar qualsevol altre recurs que consideri oportú. Tot això, de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, i de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
