Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per a l&apos;any 2021, subvencions per a inversions en la transformació i comercialització de productes agrícoles .</span> </span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">2. De conformitat amb l&apos;apartat sisè de l&apos;esmentada Resolució, el termini de presentació de sol·licituds va acabar el di a 15/07/2021 , i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de 54 sol·licituds d&apos;ajuda. </span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">3. Els òrgans gestors del Servei d&apos;Ajudes al Desenvolupament Rural varen dur a terme el control administratiu de les sol·licituds i de la documentació aportada d&apos;acord amb les normes reguladores d&apos;aquesta ajuda.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">4. Una vegada avaluada la sol·licitud d&apos;ajuda pels òrgans gestors, i d&apos;acord amb els criteris d&apos;elegibilitat establerts, l&apos;interessat no complia amb algun dels requisits prevists a la convocatòria per poder ser beneficiaris de l&apos;ajuda.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">5. En data 01/09/2023 es signa la proposta provisional de denegació i es notifica a l&apos;interessat, concedint-li un termini de 10 dies per presentar les al·legacions escaients.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">6. En data 11 de setembre l&apos;interessat presenta al·legacions esmenant algunes de les deficiències notificades a la proposta, però no la totalitat d&apos;algunes deficiències que es consideren elementals<em>. </em></span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">7. En data 27 de setembre de 2023, el vicepresident en matèria agrària del FOGAIBA dicta la Resolució de denegació als beneficiaris de les ajudes (publicada al BOIB núm. 134 de 30 de setembre de 2023) perquè, després de revisar la documentació presentada en fases d&apos;al·legacions, PRODUCTOS MARTIN S.A., no va aportar tota la documentació requerida.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">8. En data 27/10/2023 la Sra. JUANA MARIA VERGER MARTÍN, en nom i representació de l&apos;entitat PRODUCTOS MARTÍN S.A. amb CIF A07101850 interposa un recurs d&apos;alçada contra la Resolució de denegació de data 27 de setembre de 2023 davant el conseller d&apos;Agricultura, Pesca i Medi Natural.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">9. En data 30/05/2024 es notifica a l&apos;interessat la proposta i resolució relativa al recurs d&apos;alçada interposat per la representació de l&apos;entitat Productos Martin S.A. contra la resolució de denegació de la Presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 9 de juny de 2021, per la qual es convoquen, per a l&apos;any 2021, subvencions per a inversions en la transformació i la comercialització de productes agrícoles.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">10. D&apos;acord amb la resolució s&apos;ordena la retroacció del procediment al moment previ de dictar l&apos;Informe Proposta provisional de resolució de denegació de data 1 de setembre de 2023, atorgant un nou termini per presentar al·legacions. Aquest acord es notifica en data 26/06/2024.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">11. En data 4/07/2024 el beneficiari presenta la documentació sol·licitada.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">12. En data 12/11/2024 el Servei d&apos;Ajudes al Desenvolupament Rural ha emès informe favorable i proposta provisional de concessió, concedint un termini de 10 dies per presentar les al·legacions escaients. A dia d&apos;avui no s&apos;han presentat al·legacions.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="color: rgb(0, 0, 0)">Fonaments de dret </span></strong></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)"><span style="color: rgb(0, 0, 0)">1 </span>. Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l&apos;Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears BOIB núm. 082 de 2007; en virtut de l&apos;Ordre de la consellera d&apos;Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l&apos;assumpció de l&apos;execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l&apos;article 1 que el FOGAIBA assumeix l&apos;execució de la política de la Conselleria d&apos;Agricultura i Pesca referent a l&apos;aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l&apos;1 de gener de 2006.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><span style="color: rgb(0, 0, 0)">16 .
