&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Sobre FUNCION PUBLICA&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En este órgano judicial se tramita PROCEDIMIENTO ORDINARIO 353/2021 seguido a instancias de SINDICAT DE TREBALLADORS I TREBALLADORES INTERSINDICAL DE LES ILLES BALEARS (STEI) contra CONSEJO DE GOBIERNO, por resolución de fecha 30/09/2024 y conforme al art. 107.2 de la LJCA se ha acordado remitir a Vd. el presente por el cual se interesa disponga lo necesario a fin de que se publique en ese EL FALLO DE LA SENTENCIA Nº 477/2022 de fecha 27/06/2024, debiendo comunicar a este órgano judicial la fecha y número del ejemplar donde quede publicado. Todo ello de conformidad con el art. 107.2 LJCA. Se adjunta fallo de la Sentencia y resolución que acuerda su publicación:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;“FALLAMOS:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;PRIMERO&lt;/strong&gt;.- Estimamos parcialmente el recurso.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SEGUNDO&lt;/strong&gt;.- Declaramos no ser conforme a Derecho y anulamos, según a continuación se señala, el Acuerdo del Consell de Govern de 24/05/2021, mediante el que se aprobaba el incremento retributivo para el año 2021, previsto en la Ley 11/2020, de presupuestos generales del Estado, de determinadas retribuciones del personal al servicio de la Administración de la CAIB:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.- El apartado primero en cuanto se limita a incrementar un 0,9% las retribuciones básicas de los funcionarios de la CAIB sin revertir el decrecimiento compensatorio aplicado en el ejercicio 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.- El apartado segundo en cuanto se limita a incrementar un 0,9% las retribuciones en concepto de sueldo base y antigüedad del personal laboral de la CAIB sin revertir la congelación salarial aplicada en el ejercicio 2020&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.- El apartado tercero en cuanto que la recuperación retributiva que fija para el mes de enero de 2023 no comprende&amp;nbsp;la de los incrementos retributivos del 2% y del 0,9 % previstos por el Real Decreto-Ley 3/2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;TERCERO&lt;/strong&gt;.- Declaramos el Derecho de los funcionarios de la CAIB a los que es de aplicación el artículo 76 EBEP:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.- A percibir todas sus retribuciones complementarias en la misma cuantía que fueron percibidas en 2019, con efectos desde el 01/01/2021, más los intereses legales correspondientes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.- A recuperar desde el 01/01/2023 los incrementos del 2% y del 0'9% de las retribuciones complementarias.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CUARTO&lt;/strong&gt;.- Declaramos el Derecho del personal laboral de la CAIB a percibir, con efectos del 01/01/2021, el incremento retributivo del 2% del sueldo y de la antigüedad previsto en el Acuerdo de 09/03/2018, más los intereses legales correspondientes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;QUINTO&lt;/strong&gt;.- Desestimamos las restantes pretensiones de la demanda.&lt;/span&gt;&lt;/p&gt;
