    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per Resolució d'aquesta Batlia núm. 2024004135 de dia 22 de novembre de 2024, s'ha dictat el següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedents &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primer.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Vista la convocatòria del procés d'estabilització pel sistema concurs de mèrits per a la cobertura de cinc (5) places de personal laboral categoria Tècnic grau bàsic, classe auxiliar administratiu/iva, nivell VI del Conveni col·lectiu de l'Ajuntament de Llucmajor, les bases de la qual es varen publicar al BOIB núm. 154 de 26 de novembre de 2022 i l'anunci de la qual es va publicar al BOE núm. 307 de 23 de desembre de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segon.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Vist el Decret 2023004556 de dia 15 de novembre de 2023 en el qual s'estableix les persones aspirants que han superat el procés selectiu del concurs extraordinari de mèrits.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercer.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Atès que en el BOIB núm. 55 de 25 d'abril de 2024 es va publicar l'ordre de contractació de les persones aspirants Francesc Xavier Tomàs Terrasa, Maria de los Angeles Garrido Bibiloni, Maria Rafael Puigserver, Gloria Maria Ferrer Martínez i Rafael Ramírez Rosselló i que la Sra. Gloria Maria Ferrer Martínez no va signar contracte en el termini màxim de tres dies hàbils, comptadors a partir de l'endemà de la publicació de la Resolució en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quart.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Atès el que s'estableix a la base 15.3 «&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;...quan hi hagi renúncies d'aspirants seleccionats abans de la formalització del contracte, el tribunal ha d'elevar a l'òrgan convocant una relació complementària dels aspirants que estiguin situats a continuació de les persones proposades, per ordre de puntuació, per al seu possible contractació com a personal laboral fix en substitució de les que renunciïn a les places.»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cinquè.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Atès que les Sres. Eva Maria Crespi Bibiloni, Coloma Ramon Taberner, Marta Fernández Cabezas i Yurena Canals Salas (RGE: Núm. 16.239, 15.884, 15.704 i 15.742) respectivament, varen presentar la seva renuncia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sisè.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Vist l'anunci de la relació complementària de les persones aspirants que han superat el procés selectiu per ordre de prelació, realitzat pel Tribunal el dia 15 de novembre i publicat el mateix dia. Resulta, de conformitat amb el previst a la base 15.3, que la Sra. Maria del Mar Servera Munar, amb DNI **5407***, és l'aspirant situada a continuació de les persones proposades, per ordre de puntuació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En conseqüència,&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; RESOLC:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primer.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Acceptar la renuncia de les Sres. Eva Maria Crespi Bibiloni, Coloma Ramon Taberner, Marta Fernández Cabezas i Yurena Canals Salas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segon.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Ordenar la contractació de la Sra. Maria del Mar Servera Munar, amb DNI **5407***, com a personal laboral fix auxiliar administratiu/iva, categoria Tècnic grau bàsic, classe auxiliar administratiu/iva, nivell VI&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;del Conveni col·lectiu de l'Ajuntament de Llucmajor, derivada de l'Oferta d'Ocupació Pública Extraordinària de 2022 de l'Ajuntament de Llucmajor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercer.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Publicar aquesta Resolució en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quart.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Requerir a la Sra. Maria del Mar Servera Munar per a que signi contracte en el termini màxim de tres dies hàbils, comptadors a partir de l'endemà de la publicació d'aquesta Resolució en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cinquè.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Donar trasllat d'aquesta Resolució a l'Ajuntament Ple, així com a la Unitat de Recursos Humans pel seu coneixement i efectes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Contra aquesta resolució les persones interessades podran interposar un recurs potestatiu de reposició davant aquest Ajuntament, en el termini d'un mes a comptar de l'endemà de la publicació, de conformitat amb el que disposen els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;També podran interposar alternativament un recurs contenciós administratiu davant el Jutjat Contenciós Administratiu amb seu a Palma, en el termini de dos mesos, de conformitat amb el que estableixen els articles 30, 112.3 i 114.1.c) de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i 8, 10 i 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;En cas d'optar per interposar el recurs de reposició no es podrà interposar un recurs contenciós administratiu fins que s'hagi notificació la resolució expressa del recurs de reposició o hagi transcorregut un mes des de la seva interposició sense haver rebut la notificació, data en què es podrà entendre desestimat per silenci administratiu.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Tot això sense perjudici que hi puguin interposar qualsevol altre recurs que estimin oportú.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
