    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Per Resolució d&amp;apos;aquesta Batlia núm. 2024004154 de dia&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;25 de novembre de 2024&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;, s&amp;apos;ha &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;dictat&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; el següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;ANTECEDENTS &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En relació amb el procés &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;d&amp;apos;estabilització pel sistema de concurs-oposició per a la cobertura d&amp;apos;una (1) plaça de personal funcionari de carrera de l&amp;apos;Escala administració &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;especial, subescala Serveis especials, classe comesses especials, especialitat zelador d&amp;apos;obres, del grup C, subgrup C1&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;, de l&amp;apos;Ajuntament de Llucmajor les bases de la qual es varen publicar al BOIB núm. 154 de 26 de novembre de 2022 i l&amp;apos;anunci de la qual es va publicar al BOE núm. 307 de 23 de desembre de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Atès que en el BOIB núm. 153 de 23 de novembre de 2024 es va publicar la Resolució de Batlía núm. 2024004111, relativa &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;al n&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;omenament d&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&amp;apos;un (1) Zelador d&amp;apos;obres funcionari de carrera de l&amp;apos;Escala administració especial, subescala Serveis especials, del grup C, subgrup C1, de l&amp;apos;Ajuntament de Llucmajor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Una vegada publicada la &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Resolució de Batlía núm. 2024004111 a&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;l BOIB abans esmentat, s&amp;apos;ha detectat una errada material.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;FONAMENTS DE DRET &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Primer.-&lt;/strong&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; Normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Article 109.2 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, de Procediment Administració Comú de les Administracions Públiques estableix que “&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Las Administraciones Públicas podrán, asimismo, rectificar en cualquier momento, de oficio o a instancia de los interesados, los errores materiales, de hecho o aritméticos existentes en sus actos&lt;/em&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En conseqüència, &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;RESOLC:&lt;/strong&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;PRIMER.- &lt;/strong&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Rectificar l&amp;apos;error detectat a la publicació del &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;n&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;omenament d&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&amp;apos;un (1) Zelador d&amp;apos;obres funcionari de carrera de l&amp;apos;Escala administració especial, subescala Serveis especials, del grup C, subgrup C1, de l&amp;apos;Ajuntament de Llucmajor&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; publicat en el Butlletí Oficial de les Illes Balears núm. &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;153 de 23 de novembre de 2024&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;. Concretament en el punt tercer dels antecedents.&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;On diu: &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;“&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Tercer.- &lt;/strong&gt;Amb data 8 de novembre de 2024 es va publicar la Resolució del regidor delegat de recursos humans i funció publica núm. 2024003973 de dia 8 de novembre de 2024 en el qual s&amp;apos;estableix que el Sr. Ramon Molina Sarmiento ha superat el procés selectiu de concurs-oposició.&amp;quot;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Ha de dir: &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Contra aquesta Resolució els interessats podran interposar un recurs potestatiu de reposició davant aquest Ajuntament, en el termini d&amp;apos;un mes a comptar de l&amp;apos;endemà de la publicació, de conformitat amb el que disposen els articles 123 i 124 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;També podran interposar alternativament un recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, amb seu a Palma, en el termini de dos mesos, de conformitat amb el que estableixen els articles 30, 112.3 i 114.1 c) de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques, i 8, 10 i 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;En cas d&amp;apos;optar per la interposició del recurs de reposició no es podrà interposar un recurs contenciós administratiu fins que s&amp;apos;hagi notificat la resolució expressa del recurs de reposició o hagi transcorregut un mes des de la seva interposició sense haver rebut la notificació, data en què es podrà entendre desestimat per silenci administratiu.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Tot això sense perjudici que puguin interposar qualsevol altre recurs que estimin oportú.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
