BDNS 784539]] 2024-11-21 790 762232 ca 2024-11-21 ![CDATA[<p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El dia 18 de novembre de 2024 he dictat, entre d&apos;altres, la següent resolució:</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>“Antecedents</strong></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">1.- El Consell Executiu, en la sessió ordinària de dia 4 de setembre de 2024, va aprovar la Convocatòria de subvencions per a l&apos;adquisició de terrenys on s&apos;ubiquin jaciments arqueològics a l&apos;illa de Mallorca, any 2024, que es publicà, per conducte de la BDNS, en el BOIB núm. 120 de 12 de setembre de 2024. L&apos;acord va autoritzar una despesa de 600.000,00€ a càrrec de l&apos;aplicació pressupostària 20 33620 76202, amb reserva de crèdit 220240017725 del pressupost de 2024.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">2. El Cap de Servei d&apos;Arqueologia, Etnologia i Patrimoni Històric Industrial ha emès amb data 5 de novembre de 2024 un informe on especifica que cada una de les parcel·les per adquirir formen part d&apos;un jaciment arqueològic.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">3. Els 5 de novembre de 2024, la Comissió Tècnica d&apos;Avaluació es va reunir per examinar els expedients i valorar-los. L&apos;acta fou signada el 6 de novembre de 2024.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">4. El 6 de novembre de 2024, s&apos;emet informe pel secretari tècnic de Cultura i Patrimoni en el qual fa constar que la fase d&apos;adjudicació compleix amb la normativa d&apos;aplicació i els beneficiaris proposats en l&apos;acta de la Comissió Tècnica d&apos;Avaluació compleixen amb tots els requisits necessaris per accedir a les subvencions i, específicament, estan al corrent del compliment de les obligacions tributàries i de la Seguretat Social davant l&apos;Administració de l&apos;Estat, així com de les obligacions tributàries davant el Consell Insular de Mallorca.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">5.&nbsp; El dia 6 de novembre de 2024, s&apos;emet l&apos;informe favorable sobre els aspectes jurídics de la concessió de les subvencions.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">6. El 15 de novembre de 2024, la Intervenció Delegada (Centre La Misericòrdia) va fiscalitzar de conformitat la concessió de les subvencions.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Fonaments de dret</strong></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Primer.</strong> L&apos;Ordenança general de subvencions del Consell Insular de Mallorca, aprovada per acord del Ple de 23 de desembre de 2016 (BOIB núm. 21, de 18/02/2017), modificada per acord del Ple de 14 de juny de 2018 (BOIB núm. 96, de 04/08/2018).</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Segon.</strong> La Llei 38/2003, de 17 de novembre, general de subvencions i el Reial decret 887/2006, de 21 de juliol, pel qual s&apos;aprova el reglament de la Llei 38/2003 general de subvencions.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Tercer.</strong> La Llei 4/2022, de 28 de juny, de consells insulars (BOIB núm. 88, de 07/07/2022).</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Quart. </strong>La Llei 39/2015, d&apos;1 d&apos;octubre, del procediment administratiu comú de les administracions públiques.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Cinquè.</strong> L&apos;òrgan competent per atorgar les subvencions és el/la conseller/a executiu/va del departament, conforme a l&apos;article 33.2 k) de la Llei 4/2022, de 28 de juny, de consells insulars.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong><span style="color: black">Sisè.</span></strong><span style="color: black"> D&apos;acord amb la base 18 d&apos;execució del pressupost 2024, la convocatòria compleix amb les exigències dels principis d&apos;estabilitat pressupostària i sostenibilitat financera.</span></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Per tot l&apos;exposat, la &nbsp;vicepresidenta primera i consellera executiva de Cultura i Patrimoni, dicta la següent</span></span></p> <p style="text-align: center"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>RESOLUCIÓ</strong></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>I.
