    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Antecedents&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Scirtothrips aurantii&lt;/em&gt; és una espècie de trips probablement nativa del sud d'Àfrica (EFSA PLH, 2018). Encara que no es troba al nord-oest del continent africà, s'ha detectat a Angola, Cap Verd, Egipte, Etiòpia, Ghana, Kenya, Malawi, Maurici, Nigèria, Reunió, Eswatini, Sud-àfrica, el Sudan, Tanzània, Uganda i Zimbàbue (EPPO, 2020). Aquesta espècie també és present al Iemen i a Austràlia (Mound &lt;em&gt;et al&lt;/em&gt;., 2019; EFSA PLH, 2018; EPPO, 2020).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aquesta plaga va ser detectada per primera vegada a Espanya el novembre de 2020 a diversos municipis de la província de Huelva (Andalusia), detecció que també va ser la primera a l'àmbit europeu. Durant els anys 2020 a 2022, es van produir noves deteccions de la plaga a les províncies andaluses de Huelva i Sevilla, i el 2024 se'n va notificar la presència a la Comunitat Valenciana i a les províncies de Còrdova i Màlaga. El 2022 va ser detectada per primera vegada a Portugal (EUROPHYT, 2024).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Scirtothrips aurantii&lt;/em&gt; és una plaga molt polífaga que ha estat citada sobre més de setanta&amp;nbsp;espècies vegetals pertanyents a diferents famílies botàniques (EFSA PLH, 2018). La seva importància es deu als danys ocasionats en els fruits, que fan que perdin el valor comercial, deixant-los només aptes per al processament (EFSA PLH, 2018; Gilbert &amp;amp; Samways, 2018).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Durant el mes d'octubre de 2024 el Servei d'Agricultura va rebre un avís d'un tècnic d'una plantació de cítrics del terme municipal de Sóller sobre l'aparició de símptomes compatibles amb danys produïts per aquests trips en fulles de taronger. Posteriorment, els serveis tècnics de Sanitat Vegetal i el tècnic de la Cooperativa de Sóller es desplaçaren a les parcel·les afectades per recollir mostres i avaluar-ne els símptomes. El Laboratori Oficial de Sanitat Vegetal de les Illes Balears (LOSVIB) va confirmar la presència d'aquest fitòfag i va enviar mostres dels exemplars adults capturats al Laboratori Nacional de Referència per a la Identificació de Nematodes i Artròpodes d'Interès Agrícola i Forestal, el qual, el 14 d'octubre de 2024, informà que l'anàlisi molecular del material, mitjançant la seqüenciació de part del gen mitocondrial citocrom oxidasa I (COI), àmpliament utilitzat per a la identificació específica d'artròpodes, indica que els insectes pertanyen a l'espècie &lt;em&gt;Scirtothrips aurantii&lt;/em&gt; Faure, 1929 (espècie de l'ordre dels tisanòpters, de la família &lt;em&gt;Thripidae&lt;/em&gt;).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Scirtothrips aurantii&lt;/em&gt; Faure és un insecte inclòs en l'annex 2, part &lt;em&gt;A&lt;/em&gt;, punt &lt;em&gt;c&lt;/em&gt;) núm. 62, del Reglament d'execució (UE) 2019/2072 de la Comissió, de 28 de novembre de 2019, pel qual s'estableixen condicions uniformes per a l'execució del Reglament (UE) 2016/2031 del Parlament Europeu i del Consell pel que fa a les mesures de protecció contra les plagues dels vegetals, es deroga el Reglament (CE) núm. 690/2008 de la Comissió i es modifica el Reglament d'execució (UE) 2018/2019 de la Comissió. Per tant, es considera un organisme de quarantena i, consegüentment, està sotmès a regulació de la Unió Europea, per la qual cosa s'han d'adoptar mesures per erradicar-lo i controlar-lo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Així mateix, aquest insecte està inclòs en la llista A1 de l'Organització Europea i Mediterrània per a la Protecció de les Plantes (EPPO, per les seves sigles en anglès), llista que recull els organismes de quarantena absents als països membres de l'EPPO.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Decret 12/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears, disposa que la Conselleria d'Agricultura, Pesca i Medi Natural, exerceix, entre d'altres, la competència en matèria de sanitat vegetal.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Reglament d'execució (UE) 2019/2072 de la Comissió, de 28 de novembre de 2019, pel qual s'estableixen condicions uniformes per a l'execució del Reglament (UE) 2016/2031 del Parlament Europeu i del Consell pel que fa a les mesures de protecció contra les plagues dels vegetals, es deroga el Reglament (CE) 690/2008 de la Comissió i es modifica el Reglament d'execució (UE) 2018/2019 de la Comissió, recull en l'annex 2 la llista de plagues de quarantena de la Unió, entre les quals figura &lt;em&gt;Scirtothrips aurantii&lt;/em&gt;.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'article 14 de la Llei 43/2002, de 20 de novembre, de sanitat vegetal, habilita la Comunitat Autònoma de les Illes Balears a adoptar alguna de les mesures fitosanitàries que estableix l‘article 18, la qual cosa implica la facultat de desinsectar, desinfectar, immobilitzar, destruir, transformar o sotmetre a qualsevol altra mesura profilàctica els vegetals i els seus productes, i també el material que s'hi relaciona, que sigui o pugui ser vehicle de plagues.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'article 13 de la Llei 43/2002, de 20 de novembre, de sanitat vegetal, estableix que les mesures fitosanitàries necessàries per a l'erradicació de les plagues, les ha d'executar la persona interessada. Es considera que són obligacions dels particulars:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a) &lt;/em&gt;Mantenir els seus cultius, plantacions i collites, i també masses forestals i medi natural, en bon estat fitosanitari per a la defensa de les produccions pròpies i alienes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b) &lt;/em&gt;Aplicar les mesures fitosanitàries obligatòries que s'estableixin a conseqüència de la declaració de l'existència d'una plaga.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'incompliment d'aquestes mesures pot ser considerat una infracció administrativa, la qual cosa pot obligar l'òrgan competent de l'Administració pública a iniciar l'expedient sancionador corresponent sobre la base de les obligacions dels particulars en la prevenció i lluita contra plagues, d'acord amb els articles 53 i següents de la Llei 43/2002, de 20 de novembre, de sanitat vegetal.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot això, i atesa l'atribució competencial que preveu l'article 20 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, dict la següent&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article 1&lt;/strong&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Declaració de la presència de la plaga &lt;em&gt;Scirtothrips aurantii&lt;/em&gt; Faure a les Illes Balears&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es declara la presència de la plaga &lt;em&gt;Scirtothrips aurantii&lt;/em&gt; Faure a les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article 2&lt;/strong&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Establiment de zones demarcades&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Es considera zona demarcada l'àrea resultant de sumar la zona infestada i la zona tampó.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Es declaren infestades per &lt;em&gt;Scirtothrips aurantii&lt;/em&gt; Faure les parcel·les que es detallen en l'annex 2 d'aquesta Resolució.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Es considera zona tampó l'àrea de tots els recintes SIGPAC que es troben totalment o parcialment a menys de 100&amp;nbsp;m de la zona infestada.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. L'actualització de la informació referent als recintes que conformen la zona demarcada estarà disponible en la pàgina web de la Conselleria d'Agricultura, Pesca i Medi Natural https://sanitatvegetal.caib.es.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article 3&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Establiment de mesures fitosanitàries obligatòries a les zones infestades&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;S'estableixen les mesures fitosanitàries obligatòries següents a les zones infestades:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a) &lt;/em&gt;Mesures obligatòries d'erradicació en plantacions, parcs i jardins:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;― &lt;/em&gt;Aplicar tractaments fitosanitaris contra la plaga sobre la totalitat dels vegetals hostes amb els productes adequats autoritzats per al seu control, segons el Registre oficial de productes fitosanitaris del Ministeri d'Agricultura, Pesca i Alimentació (https://servicio.mapa.gob.es/regfiweb). S'han d'aplicar dos tractaments consecutius com a mínim, amb un interval de dues a tres setmanes, alternant les substàncies actives de modes d'acció diferents. En l'aplicació dels tractaments s'ha de tenir en compte la fenologia del cultiu, adequar els productes seleccionats per a la lluita contra l'organisme nociu i respectar en tot moment els condicionaments i les restriccions que estableix la legislació vigent.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;― &lt;/em&gt;Instal·lar paranys cromotròpics adhesius.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;― &lt;/em&gt;Inspeccionar i netejar les eines, la maquinària i els vehicles, tant si s'utilitzen en terrenys amb espècies hostes infestades com per transportar fruits, per evitar el moviment accidental de l'organisme.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b) &lt;/em&gt;Mesures obligatòries d'erradicació a magatzems, centres de distribució, vivers i centres de jardineria:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;― &lt;/em&gt;Aplicar tractaments fitosanitaris que asseguren la correcta eliminació de la plaga de tots els lots de branques i flors tallades amb fulles i vegetals hostes contaminats, amb els productes autoritzats per al seu control, segons el Registre oficial de productes fitosanitaris del Ministeri d'Agricultura, Pesca i Alimentació (https://servicio.mapa.gob.es/regfiweb), o destruir els lots si no és possible aplicar-los aquests productes fitosanitaris. S'han d'aplicar dos tractaments consecutius com a mínim, amb un interval de dues a tres setmanes, alternant les substàncies actives de modes d'acció diferents. En l'aplicació dels tractaments s'ha de tenir en compte la fenologia del cultiu, adequar els productes seleccionats per a la lluita contra l'organisme nociu i respectar en tot moment els condicionaments i les restriccions que estableix la legislació vigent.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;― &lt;/em&gt;Inspeccionar el material vegetal de viver, les branques i les flors tallades amb fulles dels magatzems o centres d'empaquetatge i distribució. S'ha d'inspeccionar el material vegetal, les branques i les flors tallades amb fulles hoste dels lots corresponents a la recerca de símptomes d'infestació.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;― &lt;/em&gt;Efectuar, els operadors professionals responsables de les instal·lacions o parcel·les de producció o comercialització d'espècies hostes, un control exhaustiu de detecció i erradicació de &lt;em&gt;Scirtothrips aurantii&lt;/em&gt; per garantir que el material vegetal que surti de les instal·lacions estigui lliure d'aquest organisme nociu; per això, han d'aplicar els tractaments fitosanitaris en el moment més pròxim a la possible comercialització.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;― &lt;/em&gt;Instal·lar paranys cromotròpics adhesius.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article 4&lt;/strong&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Establiment de mesures fitosanitàries obligatòries a les zones tampó&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;S'estableixen les mesures fitosanitàries obligatòries següents a les zones tampó:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;― &lt;/em&gt;Vigilància intensiva dels hostes en plantacions (aire lliure o hivernacle), vivers, parcs i jardins.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;― &lt;/em&gt;Instal·lació de paranys cromotròpics adhesius per a la detecció d'adults i també dins les instal·lacions d'emmagatzematge i centres d'empaquetatge i distribució de material vegetal o abocadors de residus.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;― &lt;/em&gt;Inspecció i neteja d'eines, maquinària i vehicles utilitzats en terrenys amb espècies hostes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article 5&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Establiment de mesures fitosanitàries obligatòries fora de les zones demarcades&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per a la resta del territori de les Illes Balears, no afectat per la zona demarcada de la plaga, s'estableixen les obligacions següents, tant per als titulars de les parcel·les com per als operadors professionals de vegetals amb espècies hostes, especialment les que figuren en l'annex 1:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a) &lt;/em&gt;Efectuar prospeccions a fi de determinar la presència de l'organisme nociu &lt;em&gt;Scirtothrips aurantii&lt;/em&gt;.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b) &lt;/em&gt;Comunicar a la Direcció General d'Agricultura, Ramaderia i Desenvolupament Rural l'existència d'indicis que puguin representar la presència de la plaga o l'aparició dels símptomes de la plaga en els vegetals de la seva propietat.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article 6&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Inspeccions oficials&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Tal com estableixen la Llei 43/2002, de 20 de novembre, de sanitat vegetal, i la legislació europea en matèria de fitosanitat, el personal del Servei d'Agricultura pot dur a terme inspeccions oficials en els llocs on es cultiven, produeixen, emmagatzemen o posen a la venda vegetals, productes vegetals i altres objectes.&lt;/span&gt;&lt;/p&gt;
