&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;BASES ESPECÍFIQUES DE LA CONVOCATÒRIA DEL PROCÉS SELECTIU PER COBRIR COM A PERSONAL FUNCIONARI DE CARRERA 1 PLAÇA VACANT DE LA CATEGORIA D'OFICIAL DE L'AJUNTAMENT DE CAPDEPERA PER PROMOCIÓ EXTERNA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;PRIMERA. Objecte de la convocatòria, procediment de selecció i normativa&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;La present convocatòria té per objecte regular el procés selectiu per a proveir, com a personal funcionari de carrera, 1 plaça d'Oficial de la policia local, vacant i dotada pressupostàriament, corresponent a l'Oferta d'Ocupació Pública de l'any 2022, pel sistema de promoció externa mitjançant concurs oposició. Aquesta plaça correspon a l'escala d'Administració Especial, subescala de Serveis Especials, classe Oficial de policia local, Subgrup de classificació C1, de l'Ajuntament de Capdepera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;S'aplicaran a aquestes proves selectives les presents bases; la Llei 4/2013,de 17 de juliol, de coordinació de les policies locals de les Illes Balears, amb la modificació efectuada per la Llei 11/2017, de 20 de desembre; el Decret llei 6/2021 i el Decret llei 6/2022; el Decret 40/2019, de 24 de maig, pel qual s'aprova el Reglament marc de coordinació de les policies locals de les Illes Balears i es modifica el Decret 55/2017, de 15 de desembre, del Fons de Seguretat Pública de les Illes Balears; Decret 11/2017,&lt;em&gt; &lt;/em&gt;de&lt;em&gt; &lt;/em&gt;24&lt;em&gt; &lt;/em&gt;de març,&lt;em&gt; &lt;/em&gt;d'exigència del coneixement de la llengua catalana en els procediments selectius d'accés a la funció pública i per ocupar llocs de treball de l'Administració de la Comunitat autònoma de les Illes Balears; el Reial decret legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el Text refós de la Llei de l'estatut bàsic de l'empleat públic, i la Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears, així com també la resta de disposicions legals aplicables a la policia local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Les bases d'aquesta convocatòria s'han de publicar en el &lt;em&gt;Butlletí Oficial de les Illes Balears.&lt;/em&gt; Així mateix, es publicarà al &lt;em&gt;Butlletí Oficial de l'Estat &lt;/em&gt;l'anunci de la convocatòria, amb la denominació de l'escala i la categoria de les places convocades, el nombre de places, l'ajuntament que les convoca, el sistema d'accés, el procediment selectiu, els mitjans d'impugnació i la data i número del &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; en què s'han publicat les bases. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;«Per tal d'aconseguir una composició equilibrada de la plantilla de la Policia Local de X places, d'acord amb la Disposició addicional 3a de la Llei 4/2013, de coordinació de les policies locals de les Illes Balears, modificada per la Llei 11/2017, es determina que el *25% de les places oferides en aquesta convocatòria ha de ser cobert per dones, en els termes establerts en aquestes Bases».&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;SEGONA. Requisits dels aspirants&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;A més del que preveu la legislació bàsica per accedir a la funció pública, en la data d'expiració del termini assenyalat per a la presentació de sol·licituds en el procés selectiu, els aspirants han de complir els requisits següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;a)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; Tenir la nacionalitat espanyola.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;b)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; Estar en possessió del títol de Batxillerat, Tècnic o equivalent, segons el que estableix la legislació bàsica estatal o estar en condicions d'obtenir-lo en la data en què finalitzi el termini de presentació de sol·licituds. En el cas de titulacions expedides a l'estranger, caldrà aportar l'homologació corresponent del Ministeri d'Educació, Cultura i Esport.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;c) &lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt;Tenir la condició de funcionari de carrera en algun dels cossos de policia local de les Illes Balears i l'antiguitat que s'especifica a continuació en la categoria d'origen:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;En el mateix cos de policia local: dos anys si es tracta d'una categoria immediatament superior i quatre anys si es tracta de dues categories superiors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;En la categoria immediatament superior d'un cos de policia local diferent d'aquell al qual pertany el funcionari o la funcionària de carrera: quatre anys.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Promoció externa dels policies dels ajuntaments que no tenen cos de policia local a la categoria d'oficial dels ajuntaments que tenen cossos de policia local: quatre anys.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;En cas de la promoció externa, a més, hauran de faltar més de cinc anys per passar a la situació de segona activitat per raó d'edat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;d)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; No patir cap malaltia o defecte físic o psicofísic que impedeixi o minvi el desenvolupament correcte de les &lt;/span&gt;&lt;span style="font-size:9.0pt"&gt;funcions. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;e)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; Presentar un certificat mèdic que acrediti l'aptitud per desenvolupar les funcions pròpies de la categoria a la qual s'accedeixi. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;f)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; No haver estat separat del servei de l'Administració local, autonòmica o estatal, ni estar inhabilitat per a l'exercici de la funció pública. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;g)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; No tenir antecedents penals per delictes dolosos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;h)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; Posseir els permisos de conducció de les classes A2 i B en vigor. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;i)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; Comprometre's a dur armes i, si escau, a utilitzar-les, mitjançant una declaració jurada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;j)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; Acreditar el coneixement de la llengua catalana de nivell B2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;k)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; Haver abonat la taxa per drets d'examen. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;TERCERA. Presentació de sol·licituds&lt;/span&gt;&lt;/strong&gt;&lt;span style="font-size:9.0pt"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;1. Les sol·licituds per prendre part en el procés selectiu s'han d'ajustar al model normalitzat de sol·licitud (annex IV), adreçades a la batlia, i es presentar-se al Registre de l'Ajuntament o en qualsevol altra de les formes que estableix l'article 16.4 de la Llei 39/2015. El model normalitzat de sol·licituds es trobarà a disposició de les persones interessades al Registre General d'aquest Ajuntament i a la pàgina web &lt;em&gt;www.ajcapdepera.net&lt;/em&gt; a partir de l'obertura del termini de presentació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;2. El termini general de presentació de sol·licituds és de vint dies hàbils a partir de l'endemà d'haver-se publicat la convocatòria en el &lt;em&gt;Butlletí Oficial de l'Estat&lt;/em&gt;. Quan el darrer dia del termini sigui inhàbil, s'entén prorrogat al primer dia hàbil següent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;3. Juntament amb la sol·licitud emplenada adequadament, les persones aspirants han d'adjuntar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;a)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; Una declaració responsable que la persona aspirant compleix els requisits exigits en les bases, amb referència sempre a la data d'expiració del termini assenyalat per presentar les sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;b)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; Acreditació d'haver abonat la taxa per drets d'examen. La manca de justificació del pagament de la taxa indicada determinarà l'exclusió de l'aspirant. Aquest pagament no substitueix, en cap cas, el tràmit de presentar la sol·licitud en el termini i en la forma prevista.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;L'Administració pot requerir de la persona sol·licitant l'aportació formal de la documentació substituïda per la declaració responsable en qualsevol fase del procediment selectiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Els drets d'examen per aquesta convocatòria es fixa en 15,00 euros, que s'han d'ingressar al compte municipal núm. ES10 0081 0604 56 0001182620. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;4. Amb la formalització i presentació de la sol·licitud l'aspirant presta el seu consentiment al tractament de les dades de caràcter personal que siguin necessàries per prendre part en la convocatòria i per a la resta de la tramitació del procés selectiu, d'acord amb la normativa vigent en matèria de protecció de Dades de Caràcter Personal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;5. Els aspirants quedaran vinculats a les dades que es facin constar en la seva sol·licitud. El domicili i telèfon que hi figurin es consideraran vàlids a l'efecte de notificacions, i seran responsabilitat exclusiva dels candidats tant els errors descriptius com la no comunicació durant el procés de selecció de qualsevol canvi en les dades de la sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;QUARTA. Admissió i exclusió de les persones aspirants&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;1. Finalitzat el termini de presentació de sol·licituds, en el termini màxim de 10 dies hàbils es publicarà en el tauler d'anuncis de l'Ajuntament i a la pàgina web &lt;em&gt;www.ajcapdepera.net&lt;/em&gt; una resolució per la qual s'aprovarà la llista provisional d'admesos i exclosos, amb indicació de la causa d'exclusió. En la resolució en què es publiqui la llista provisional de persones admeses i excloses de les proves selectives haurà de constar la data, l'hora i el lloc en què es duran a terme els exercicis de la fase d'oposició, amb indicació de si es duran a terme en una o més sessions, i amb l'interval mínim entre exercici i exercici. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;En tot cas, amb la finalitat d'evitar errors i, si se'n produïssin, possibilitar-ne l'esmena dins el termini establert i en la forma escaient, les persones interessades han de comprovar no només que no figuren en la relació de persones excloses sinó que, a més, els seus noms consten en la relació pertinent de persones admeses.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;2. Les persones aspirants excloses o omeses disposaran d'un termini de deu dies hàbils, comptadors des de l'endemà de la publicació esmentada, per esmenar el defecte o adjuntar el document que sigui preceptiu. En el cas que no s'esmenin, dins d'aquest termini, les deficiències que hagin motivat la seva exclusió, la sol·licitud es considerarà no presentada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;3. Una vegada finalitzat el termini a què fa referència el paràgraf anterior i esmenades, si escau, les sol·licituds, la batlessa dictarà una resolució, en el termini màxim de deu dies hàbils, d'aprovació de la llista definitiva de persones admeses i excloses. Aquesta resolució es farà pública en els mateixos llocs indicats per a la resolució provisional&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;El fet de figurar en la relació de persones admeses no prejutjarà que es reconegui a les persones aspirants estar en possessió dels requisits exigits per participar en el procés selectiu. Si de la documentació que han de presentar en superar-lo es desprèn que no posseeixen algun dels requisits, perdran tots els drets que es puguin derivar de la seva participació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;CINQUENA. El tribunal qualificador&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;1. L'òrgan de selecció és col·legiat i la composició s'ha d'ajustar als principis d'imparcialitat i professionalitat dels seus membres i s'ha de respectar el principi de representació equilibrada de dones i homes, excepte per raons fonamentades i objectivament motivades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;2. La composició dels Tribunals ha de ser predominantment tècnica; tots els membres han de tenir titulació igual o superior a l'exigida per a l'accés a la plaça convocada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;3. El personal d'elecció o de lliure designació política, el personal funcionari interí i el personal eventual no poden formar part dels òrgans de selecció. Tampoc no en poden formar part les persones representants dels empleats públics, sens perjudici de les funcions de vigilància i vetlla del bon desenvolupament del procediment selectiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Les persones representants sindicals que participin en el procediment selectiu amb aquestes funcions de vigilància i vetlla han de pertànyer a organitzacions sindicals que tinguin la consideració de més representatives i que comptin amb més del 10 % de representants en l'àmbit del municipi de la convocatòria, amb un màxim d'un representant per cada sindicat amb el límit de quatre membres per cada procediment selectiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;4. La pertinença als òrgans de selecció és sempre a títol individual; no es pot exercir aquesta representació per compte d'altri.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;5. El Tribunal Qualificador ha d'estar constituït per cinc membres i el mateix nombre de suplents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;c)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; Un secretari o secretària:&lt;em&gt; &lt;/em&gt;(persona designada per l'ajuntament convocant amb veu i vot, nom de la persona titular i suplent).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;El tribunal no pot constituir-se ni actuar sense l'assistència de més de la meitat dels seus membres, titulars o suplents indistintament, sense president o presidenta ni secretari o secretària. Les decisions s'han d'adoptar per majoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;6. El tribunal pot acordar la incorporació en les tasques de personal assessor o especialistes en totes o alguna de les proves, que poden actuar amb veu però sense vot. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;7. Els membres del Tribunal i els assessors s'han d'abstenir d'intervenir quan concorrin les circumstàncies que preveu l'article 23 de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic. Així mateix, han de notificar aquesta circumstància a l'autoritat que els va nomenar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;L'abstenció i la recusació dels membres del tribunal es regula pels articles 23 i 24 de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic, i pels articles 22 i 23 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;8. Les decisions adoptades pel tribunal poden ser recorregudes en les condicions que estableix l'article 121 de la Llei 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;SISENA. Fases del sistema de selecció&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;1. El sistema de selecció és el de concurs oposició.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;2. El concurs oposició consisteix en la realització successiva de les fases d'oposició i de concurs, per aquest ordre, les quals es descriuen a continuació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;3. La fase d'oposició del concurs oposició consisteix en la realització de les proves previstes en la convocatòria per tal de determinar la capacitat i l'aptitud de les persones aspirants. La fase d'oposició té caràcter eliminatori i és necessari superar-la per poder passar a la fase de concurs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;4. La fase de concurs consisteix en la valoració dels mèrits que al·leguin les persones aspirants. Aquesta fase no té caràcter eliminatori. Els mèrits que s'han de valorar són els de l'annex III.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;5. La puntuació total s'obté de la suma de les puntuacions en les dues fases. La puntuació de la fase d'oposició representarà un 60 % de la puntuació assolible en el procés selectiu. La fase de concurs representarà un 40 % del total de la puntuació assolible en el procés selectiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;SETENA. Proves de la fase d'oposició:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Totes les proves de l'oposició són de caràcter obligatori i eliminatori. És necessari superar la prova anterior per poder passar a la següent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;La fase d'oposició, de caràcter i superació obligatoris, constitueix un 60 % del procés selectiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;L'ordre d'actuació dels aspirants serà per ordre de crida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Les dones embarassades amb previsió de part, o en període de postpart, coincident amb les dates de realització de qualsevol dels exàmens o proves previstes en el procés selectiu, podran posar en coneixement del Tribunal aquesta situació, adjuntant el corresponent informe mèdic oficial pel qual es certifica aquesta circumstància.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;La comunicació s'ha de realitzar amb l'antelació suficient i el Tribunal ha de determinar sobre la base de la informació si és procedent o no atendre la sol·licitud, ajornar la prova o proves o realitzar-la en un lloc alternatiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;En cap cas les proves de reconeixement mèdic han d'estimar com a circumstància negativa als efectes del procés selectiu qualsevol derivada de la situació d'embaràs o lactància.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Les proves són les següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Les persones aspirants poden presentar per escrit al registre de l'Ajuntament en el termini de tres dies hàbils comptadors des de l'endemà de la publicació del resultat de cada exercici les observacions o al·legacions que considerin oportunes, que hauran de ser resoltes de forma motivada pel Tribunal en tot cas abans de les 48 hores prèvies a l'inici de l'exercici següent. Als efectes assenyalats, s'ha de facilitar la vista dels exercicis de les persones opositores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Finalitzats tots els exercicis de la fase d'oposició, el tribunal farà pública al tauler d'anuncis de l'Ajuntament i a la pàgina web &lt;em&gt;www.ajcapdepera.net&lt;/em&gt; la llista provisional de persones que l'hagin superat, amb indicació del DNI i de la puntuació obtinguda. La relació de persones que han superat la fase d'oposició serà determinada per la superació de tots els exercicis eliminatoris. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;La puntuació final de la fase d'oposició de cada aspirant serà el resultat de la suma de les puntuacions obtingudes en els exercicis eliminatoris. Les persones aspirants disposaran d'un termini de deu dies hàbils, comptadors des de la publicació de les llistes provisional, per fer reclamacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Dins el termini de deu dies naturals, comptadors a partir de l'endemà de la publicació de les llistes definitives de persones aprovades de la fase d'oposició, les persones aspirants que en formin part han d'al·legar i acreditar davant el Tribunal Qualificador, segons el model de l'annex IV, els mèrits que s'indiquin en l'annex III, mitjançant documents originals o fotocòpies compulsades en el registre de l'ajuntament o en qualsevol altra de les formes que estableix l'article 16.4 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. En cap cas no es valoraran mèrits que no hagin estat al·legats i presentats en la forma establerta durant aquest termini.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Els mèrits s'han d'acreditar i s'han de valorar sempre amb referència a la data de finalització del termini de presentació de sol·licituds. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;En cas que algun dels mèrits estigui en poder de l'ajuntament convocant, els aspirants poden sol·licitar que s'incorporin d'ofici, un extracte dels mèrits que figuren en l'expedient personal amb referència al darrer dia del termini per presentar la sol·licitud de participació. Els mèrits al·legats que no constin en l'expedient personal hauran de ser presentats mitjançant documents originals o còpies compulsades en el registre de l'ajuntament. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Les persones aspirants disposaran de cinc dies hàbils per fer reclamacions, comptadors des de la publicació de les llistes provisionals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Les reclamacions presentades seran resoltes pel tribunal en un termini de deu&lt;em&gt; &lt;/em&gt;dies hàbils.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;b)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; La puntuació del primer exercici de la segona prova. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;c)&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:9.0pt"&gt; De persistir l'empat, la puntuació total de la tercera prova.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;«Les vacants convocades s'adjudicaran seguint una única llista final d'aspirants atenent l'ordre de puntuació obtinguda en el concurs-oposició i els criteris de desempat anteriorment esmentats. Quan l'objectiu establert a la disposició addicional 3a de la Llei 4/2013, de coordinació de les policies locals de les Illes Balears, en relació amb el nombre de places que haurien de ser cobertes per candidates dones regulat a la clàusula primera d'aquestes Bases no s'aconsegueixi, es donarà preferència a les candidates dones sobre els candidats homes, fins a complir l'objectiu perseguit, sempre que:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;a) Hi hagi una equivalència de capacitació determinada per superar les proves i exercicis de la fase d'oposició del sistema selectiu.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;b) Cap de les candidates dones seleccionades aplicant aquesta preferència tingui un diferencial de puntuació en el concurs-oposició superior al 15% enfront dels candidats homes preterits.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;c) No concorrin en l'altre candidat motius legalment previstos que, sense ser discriminatoris per raó de sexe, justifiquin la no aplicació de la mesura, com la pertinença a altres col·lectius amb especials dificultats per accedir a l'ocupació.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;em&gt;&lt;span style="font-size:9.0pt"&gt;Les places no cobertes per dones en el percentatge establert aplicant aquests criteris seran cobertes per la resta d'aspirants que hagin superat les proves.»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;No requereixen presentació aquells documents que es trobin en poder de l'Ajuntament de Capdepera o dels quals es pugui comprovar la informació per tècniques telemàtiques segons es regula en l'article 28 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. En aquest darrer cas l'interessat ha d'indicar en quin moment i davant quin òrgan administratiu va presentar els documents esmentats, i les administracions públiques els han de sol·licitar electrònicament a través de les seves xarxes corporatives o d'una consulta a les plataformes d'intermediació de dades o altres sistemes electrònics habilitats a l'efecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;L'incompliment d'aquest termini, o si de l'examen de la documentació presentada es deduís que els aspirants no compleixen els requisits que s'exigeixen en la convocatòria, suposarà la pèrdua del dret a ser nomenats funcionaris en pràctiques i quedaran sense efecte totes les actuacions anteriors relatives al seu nomenament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Les persones aspirants que superin el concurs oposició i acreditin que compleixen els requisits que exigeix la convocatòria seran nomenades funcionaris en pràctiques pel batle/batlessa a l'inici d'aquest període. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;El nomenament tendrà efectes des de la data de començament del curs de capacitació o, en els supòsits en què la normativa d'aplicació excepcioni la realització d'aquest curs, des de la data de començament de les pràctiques en el municipi. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;En cap cas es pot nomenar personal funcionari en pràctiques un nombre d'aspirants superior al de places convocades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Aquesta situació s'ha de mantenir, si escau, fins que siguin nomenats personal funcionari de carrera o qualificats com a no aptes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;ONZENA. Personal funcionari en pràctiques&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;La fase d'oposició es completa amb la superació d'un període de pràctiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Aquest període està integrat per la superació tant del curs de capacitació corresponent a la categoria d'oficial com de la fase de pràctiques en el municipi, relacionades amb les funcions pròpies d'aquesta categoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Les persones aspirants que no superin el període de pràctiques d'acord amb el procediment de qualificació previst perdran el dret al seu nomenament com a personal funcionari de carrera, mitjançant una resolució motivada de la batlessa a proposta de l'òrgan responsable de l'avaluació del període de pràctiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Si algun aspirant és qualificat com a no apte en la fase de pràctiques, o bé si abandona les pràctiques abans de la seva qualificació o és expulsat, en la mateixa resolució es pot requerir les persones aspirants que hagin aprovat totes les proves, per ordre de puntuació obtinguda en les proves del concurs oposició, per ser nomenats personal funcionari en pràctiques. La incorporació d'aquestes persones aspirants en cap cas es pot realitzar en un curs ja iniciat i s'ha d'ajornar al començament del curs de capacitació immediatament posterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;La resolució esmentada, que exhaureix la via administrativa, pot ser recorreguda en els termes que estableix la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;DOTZENA. Contingut i retribucions de les pràctiques&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;Curs de capacitació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Les persones aspirants nomenades funcionaris en pràctiques hauran de realitzar i superar el curs de capacitació, impartit o homologat per l'Escola Balear d'Administració Pública, a què fa referència l'article 34 de la Llei 4/2013, de 17 de juliol, de Coordinació de les Policies Locals de les Illes Balears, excepte en els supòsits en què la normativa d'aplicació excepcioni de la realització d'aquest curs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Les persones que acreditin haver superat el curs de capacitació de la categoria d'oficial o superior abans de l'entrada en vigor de la Llei 11/2017 i el tenguin degudament actualitzat, resten exemptes de realitzar aquesta fase de les pràctiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;L'incompliment de les normes de règim intern establertes en la resolució corresponent de la persona titular de la Conselleria d'Hisenda i Administracions Públiques a la qual fa referència l'article 178.2 del Decret 40/2019, de 24 de maig, pel qual s'aprova el Reglament marc de coordinació dels policies locals dels Illes Balears i es modifica el Decret 55/2017, de 15 de desembre, del Fons de Seguretat Pública dels Illes Balears, pot donar lloc a la no superació del curs de capacitació en les condicions establertes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Les faltes d'assistència no justificades durant la realització del curs de capacitació comportarà la disminució proporcional dels drets econòmics, sense perjudici de la incidència sobre l'avaluació d'aquest.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Els aspirants que no superin el curs de capacitació perdran tots els drets al seu nomenament com a funcionari/a de carrera, la qual cosa serà així declarada mitjançant resolució motivada de l'òrgan municipal corresponent. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;Pràctiques en el municipi&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Aquest període de pràctiques per a la categoria d'Oficial es pot compaginar amb la realització del curs de capacitació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;La fase de pràctiques al municipi amb el contingut que determini l'Ajuntament tindrà una durada d'un any&lt;em&gt;. &lt;/em&gt;La metodologia d'execució i la supervisió s'ajustarà al que s'estableix en la Resolució de la consellera d'Administracions Públiques i Modernització de 23 d'octubre de 2020 per la qual es determina la metodologia d'execució, supervisió i avaluació de les pràctiques en el municipi per a les distintes categories de policia local (BOIB núm. 188, de 31 d'octubre de 2020).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;L'avaluació de les pràctiques es durà a terme segons el que estableixen els articles del 180 al 182 del Decret 40/2019 i la Resolució de la consellera d'Administracions Públiques i Modernització de 23 d'octubre de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Queden exemptes de la realització d'aquesta fase de pràctiques les persones aspirants que hagin ocupat en comissió de serveis o com a personal funcionari interí un lloc en el mateix ajuntament que convoca el procés selectiu d'accés, en una categoria igual o superior a la que es refereix la convocatòria del procés, sempre que hagi obtingut una avaluació favorable d'aquest període segons el que estableix l'apartat 12 de l'article 192 del Decret 40/2019 i que la durada de l'avaluació sigui igual o superior a la prevista per a la fase de pràctiques en les bases de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;L'exempció no serà aplicable si en els dotze mesos immediatament anteriors a l'inici de la fase de pràctiques del procés selectiu la persona aspirant deixa de prestar serveis en una categoria igual o superior a la que es refereix la convocatòria del procés.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;Retribució de les pràctiques&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;span style="font-size:9.0pt"&gt;Durant el període de pràctiques es reben les retribucions segons el que estableix l'article 34 bis de la Llei 4/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:10pt"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,serif"&gt;&lt;strong&gt;&lt;span style="font-size:9.0pt"&gt;TRETZENA. Finalització del procés selectiu&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
