    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En la data de la signatura electrònica, la directora general de Medi Natural i Gestió Forestal ha formulat la proposta de resolució següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fets&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La mèrlera vermella (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Monticola saxatilis&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) és una espècie típica de penya-segats i roquissars de l'alta muntanya mallorquina, amb escassa vegetació, que s'ha vist greument afectada pel canvi climàtic i la pressió humana. Aquesta espècie ha patit una forta davallada en els darrers anys, en què ha passat de sis o set territoris el 2013 a només quatre el 2020 (una baixada del 33,3&amp;nbsp;%). L'any 2023 no s'ha trobat com a reproductora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La coablanca (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Oenanthe oenanthe&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) és una espècie típica d'hàbitats desarborats i carritxars de l'alta muntanya mallorquina, amb escassa presència com a reproductora a Eivissa al nivell de la mar. És una espècie que també es veu afectada pel canvi climàtic i les molèsties ocasionades per la presència humana en època de reproducció. La seva població reproductora ha patit una forta davallada en els darrers deu anys, en què ha passat de trenta territoris coneguts el 2013 a només deu el 2023 (una baixada del 67&amp;nbsp;%).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Atesa la greu davallada que han sofert les dues espècies, i una vegada coneguts els factors d'amenaça que les afecten, la Direcció General de Medi Natural i Gestió Forestal va considerar convenient atendre la sol·licitud presentada pel Grup Balear d'Ornitologia i Defensa de la Naturalesa (GOB) i presentar al Consell Assessor de Fauna i Flora de les Illes Balears (CAFFIB) una proposta d'inclusió d'aquestes espècies en el Catàleg balear d'espècies amenaçades i d'especial protecció, en la categoria de «Vulnerable».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En la sessió del Consell Assessor de Fauna i Flora de les Illes Balears de 15 d'octubre de 2024 es van presentar els informes redactats pel Servei de Protecció d'Espècies de la Direcció General de Medi Natural i Gestió Forestal per a les espècies mèrlera vermella (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Monticola saxatilis&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) i coablanca (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Oenanthe oenanthe&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;). El Consell Assessor de Fauna i Flora de les Illes Balears va informar favorablement sobre la inclusió d'aquestes espècies en el Catàleg balear d'espècies amenaçades i d'especial protecció, en la categoria de «vulnerable».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. L'article 2.1 del Decret 75/2005, de 8 de juliol, pel qual es crea el Catàleg balear d'espècies amenaçades i d'especial protecció, les àrees biològiques crítiques i el Consell Assessor de Fauna i Flora de les Illes Balears, que determina que el Catàleg és un registre públic de caràcter administratiu de les espècies silvestres de les Illes Balears que requereixen mesures de conservació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. L'article 4.1 del Decret 75/2005, que defineix les categories de catalogació de les espècies del Catàleg, entre les quals la d'espècie «Vulnerable». &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. L'article 5 del Decret 75/2005, que determina que el procediment d'inclusió, canvi de categoria o exclusió d'una espècie en el Catàleg s'ha de dur a terme mitjançant una resolució del conseller competent en matèria de medi ambient, amb la tramitació prèvia del procediment oportú, que ha d'incloure, com a mínim, informació tècnica sobre la situació de conservació de l'espècie o grup d'espècies catalogat, amb la millor informació disponible de la distribució, els efectius, les tendències demogràfiques i les amenaces que l'afecten; l'informe preceptiu del Consell Assessor de Fauna i Flora de les Illes Balears, i la proposta del director general competent en matèria de protecció d'espècies.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Els informes del Servei de Protecció d'Espècies de la Direcció General de Medi Natural i Gestió Forestal relatius a cadascuna de les dues espècies ―mèrlera vermella (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Monticola saxatilis&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) i coablanca (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Oenanthe oenanthe&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;)―, sobre els quals va informar favorablement per unanimitat el Consell Assessor de Fauna i Flora de les Illes Balears en la sessió del 15 d'octubre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. L'article 2.10.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) del Decret 16/2023, de 20 de juliol, que modifica el Decret 12/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears, que estableix, entre les competències de la Direcció General de Medi Natural i Gestió Forestal, la «conservació i gestió d'espècies silvestres protegides», entre d'altres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Proposta de resolució &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Propòs al conseller d'Agricultura, Pesca i Medi Natural que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Incloure les espècies mèrlera vermella (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Monticola saxatilis&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) i coablanca (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Oenanthe oenanthe&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) en el Catàleg balear d'espècies amenaçades i d'especial protecció, en la categoria de «Vulnerable», segons el que preveu el Decret 75/2005, de 8 de juliol, pel qual es crea el Catàleg balear d'espècies amenaçades i d'especial protecció, les àrees biològiques crítiques i el Consell Assessor de Fauna i Flora de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Publicar aquesta Resolució en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Agricultura, Pesca i Medi Natural en el termini d'un mes comptador des de l'endemà de la publicació de la Resolució, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
