    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En data de la signatura digital&lt;span style="color:black"&gt;, el director general d'Economia circular, Transició Energètica i Canvi Climàtic ha formulat la proposta definitiva següent:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fets&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. El 26&lt;/span&gt; de desembre de 2023 &lt;span style="color:black"&gt;es va publicar la convocatòria pública de subvencions per al foment d'instal·lacions d'autoconsum amb o sense emmagatzematge elèctric amb fonts d'energia renovable, així com a de renovables tèrmiques, promogudes per a persones físiques dins les actuacions previstes en el Pla d'Inversions per a la Transició Energètica de les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència finançat per la Unió Europea (NextGenerationEU) &lt;/span&gt;(BOIB núm. 174, de 26 de desembre de 2023).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Les persones que figuren en l'annex d'aquesta proposta varen presentar una sol·licitud de subvenció en el marc de la convocatòria de referència.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Els tècnics de la Direcció General d'Economia Circular, Transició Energètica i Canvi Climàtic, en aplicació del procediment de concessió que estableix l'apartat desè de la Resolució esmentada, han informat desfavorablement sobre la concessió de les subvencions descrites en l'annex, amb la motivació que també hi figura.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El 15 d'octubre de 2024, es va emetre la &lt;span style="color:black"&gt;Proposta de resoluci&lt;/span&gt;ó provisional del director general d'Economia Circular, Transició Energètica i Canvi Climàtic per la qual es deneguen &lt;span style="color:black"&gt;les subvencions &lt;/span&gt;&amp;nbsp;&lt;span style="color:black"&gt;per al foment d'instal·lacions d'autoconsum amb o sense emmagatzematge elèctric amb fonts d'energia renovable, així com a de renovables tèrmiques, promogudes per a persones físiques dins les actuacions previstes en el Pla d'Inversions per a la Transició Energètica de les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència finançat per la Unió Europea (PITEIB PF)&lt;/span&gt; (BOIB núm.136, de 17 d'octubre de 2024).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El 22 d'octubre de 2024 el Sr. Eugenio Jesús Rodríguez Cano, titular de l'expedient PF PITEIB2869/2024, va presentar un escrit d'al·legacions contra la proposta de resolució esmentada en el punt anterior.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En la proposta de resolució es denega la subvenció a Eugenio Jesús Rodríguez Cano pel motiu següent: «&lt;span style="color:black"&gt;El beneficiari ja té concedida una subvenció pel mateix concepte , per import de 2.376 euros. Publicada la resolució de concessió al BOIB núm.67, de 20 de maig de 2024 (expedient NEXTG45 2666/2021)».&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En l'escrit d'al·legacions el Sr &lt;/span&gt;Eugenio Jesús Rodríguez Cano&lt;span style="color:black"&gt; sol·licita que es reactivi l'expedient de PITEIB PF2869/2024.ja que ha sol·licitat la renúncia a l'expedient NEXTG45 2666/2021 i en canviar d'empresa instal·ladora, no tenia coneixement de l'ajuda concedida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6. El 23 d'octubre de 2024, es va emetre un informe tècnic en que s'informa desfavorablement a les al·legacions presentades per &lt;/span&gt;Eugenio Jesús Rodríguez Cano&lt;span style="color:black"&gt; per l'existència d'una altra ajuda concedida per la mateixa actuació en el moment de la presentació de la sol·licitud. Comprovat que ha presentat renúncia a l'expedient NEXTG45-2666/2021 en data 18/10/2024 es tramitarà a partir d'ara i, una vegada publicada, podrà sol·licitar un nou expedient PITEIB PF.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions (BOIB núm. 196, de 31 de desembre de 2005).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El Decret 75/2004, de 27 d'agost, pel qual es despleguen determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears (BOIB núm. 122, de 2 de setembre de 2004).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. L'Ordre de la consellera de Comerç, Indústria i Energia de 15 de maig de 2008 per la qual s'estableixen les bases reguladores per a la concessió de subvencions en matèria d'energia (BOIB núm. 72, de 24 de maig de 2008).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. L'Ordre HFP/1030/2021, de 29 de setembre, per la qual es configura el sistema de gestió del Pla de Recuperació, Transformació i Resiliència, així com per l'Ordre HFP/1031/2021, de 29 de setembre, per la qual s'estableix el procediment i format de la informació a proporcionar per les entitats del sector públic per al seguiment del compliment de les fites i objectius i d'execució pressupostària i comptable de les mesures dels components del Pla de Recuperació, Transformació i Resiliència.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. El Reial decret 451/2022, de 14 de juny, pel qual es regula la concessió directa d'ajudes destinades al finançament d'estratègies d'energia sostenible per a les Illes Balears i Canàries, en el marc del Pla de Recuperació, Transformació i Resiliència, s'emmarca en el Pla de Recuperació, presentat pel Govern espanyol el 21 d'abril de 2021 i aprovat per la Decisió d'Execució del Consell relativa a l'aprovació de l'avaluació del Pla de Recuperació i Resiliència d'Espanya (Council Implementing Decision-CID), de 13 de juliol de 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. El Reial decret 244/2019, de 5 d'abril, pel qual es regulen les condicions administratives, tècniques i econòmiques de l'autoconsum d'energia elèctrica.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. La Resolució del conseller d'Empresa, Ocupació i Energia per la qual s'aprova, mitjançant el procediment de despesa anticipada, la convocatòria pública de subvencions per al foment d'instal·lacions d'autoconsum amb o sense emmagatzematge elèctric amb fonts d'energia renovable, així com a de renovables tèrmiques, promogudes per a persones físiques dins les actuacions previstes en el Pla d'Inversions per a la Transició Energètica de les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència finançat per la Unió Europea (NextGenerationEU) (BOIB núm. 174, de 26 de desembre de 2023).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Proposta de resolució definitiva&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Propòs al conseller d'Empresa, Ocupació i Energia que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Denegar la concessió d'una subvenció &lt;span style="color:black"&gt;per al foment d'instal·lacions d'autoconsum amb o sense emmagatzematge elèctric amb fonts d'energia renovable, així com a de renovables tèrmiques, promogudes per a persones físiques dins les actuacions previstes en el Pla d'Inversions per a la Transició Energètica de les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència finançat per la Unió Europea (PITEIB PF)&lt;/span&gt; &amp;nbsp;als beneficiaris que figuren en l'annex, d'acord amb la motivació que també hi figura.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Empresa, Ocupació i Energia en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació de la resolució, d'acord amb l'article 46 de la Llei &lt;span style="color:black"&gt;29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
