El 25 de setembre de 2024, va tenir entrada en el Servei de Patrimoni d'aquesta Direcció General, un escrit de la Conselleria d'Agricultura, Pesca i Alimentació, en el qual comunicava que una motocicleta que es troba en bon estat ha deixat de ser necessària per el compliment de les finalitats que motivaren l'adscripció a la seva conselleria, per la qual cosa sol·licita, en conseqüència, la corresponent desadscripció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En aplicació de l'article 54 del Decret 127/2005, de 16 de desembre, pel qual s'aprova el Reglament de desenvolupament de la Llei 6/2001, d'11 d'abril, del&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Patrimoni de la Comunitat Autònoma de les Illes Balears, el Servei de Patrimoni va informar a la resta de conselleries d'aquesta circumstància per tal que, en cas que alguna de les conselleries notificades o alguna de les seves entitats dependents tinguessin interès en la utilització del vehicle esmentat, ho comuniquessin al Servei de Patrimoni , mitjançant un escrit justificatiu de la necessitat i sol·licitant l'adscripció del vehicle.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Les conselleries de Turisme, Cultura i Esports i la d'Habitatge, Territori i Mobilitat han manifestat el seu interès en el vehicle esmentat i han justificat la petició mitjançant escrits amb justificant d'entrada a la Direcció General del Tresor, Política Financera i Patrimoni en dates 30 de setembre i 3 d'octubre de 2024, respectivament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La Conselleria de Turisme, Cultura i Esports ha justificat la seva petició atès que la motocicleta es tracta d'un mitjà de transport que facilitaria el desplaçament urbà dels seus ordenances entre els diferents edificis que té aquesta Conselleria, molts d'aquests dins el casc antic de Palma, zona de difícil accés per a vehicles de quatre rodes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. La Conselleria d'Habitatge, Territori i Mobilitat ha justificat la seva petició atès que el personal de la Direcció General d'Habitatge i Arquitectura realitza freqüents sortides de feina, entre d'altres: visites d'obra setmanals com a membres de la direcció facultativa, visites a edificis per a realitzar informes tècnics, visites d'inspecció d'habitatges o assistència a reunions, per la qual cosa disposen d'un cotxe elèctric que comparteixen entre tots i veient que la majoria de sortides es realitzen al municipi de Palma, seria de gran profit disposar de la motocicleta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. El 23 d'octubre de 2024, el Servei de Patrimoni ha emès un informe favorable sobre l'expedient de referència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Correspon a la Direcció General del Tresor, Política Financera i Patrimoni la resolució de les adscripcions de béns d'acord amb les atribucions que s'estableixen a l'article 88 de la Llei 6/2001, d'11 d'abril, del patrimoni de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Atès els fets exposats, i vist que els arguments exposats per les dues conselleries sol·licitants tenen raons similars que justifiquen la seva necessitat, es considera raonable adoptar la decisió d'adscriure el vehicle a la conselleria la sol·licitud de la qual va tenir entrada en primer lloc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments jurídics&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Els articles 24 i 88 c de la Llei 6/2001, d'11 d'abril, del patrimoni de la Comunitat Autònoma de les Illes Balears (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;BOIB núm. 49, de 24 d'abril&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Els articles 28, 29 i 54 del Decret 127/2005, de 16 de desembre, pel qual s'aprova el Reglament de desenvolupament de la Llei 6/2001, d'11 d'abril, del patrimoni de la Comunitat Autònoma de les Illes Balears (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;BOIB núm. 192, de 24 de desembre&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El Decret 8/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual es determina la composició del Govern i s'estableix l'estructura de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El Decret 9/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual es disposa el nomenament dels membres del Govern de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Decret 16/2023, de 20 de juliol, de la presidenta de les Illes Balears, pel qual es modifica el Decret 12/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Decret 56/2023, de 21 de juliol, pel qual es disposa el nomenament d'alts càrrecs de la conselleria, d'Economia, Hisenda i Innovació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Autoritzar el canvi d'adscripció del vehicle que s'indica a continuació de la Conselleria d'Agricultura, Pesca i Alimentació a la Conselleria de Turisme, Cultura i Esports.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Establir que la Conselleria de Turisme, Cultura i Esports haurà de vetllar per l'adequada conservació i utilització del bé per la finalitat prevista. L'adscripció s'ha de formalitzat mitjançant un acta d'adscripció subscrita per la directora general competent en matèria de patrimoni i pel titular de la conselleria interessada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Notificar aquesta Resolució a les parts interessades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Publicar aquesta Resolució en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Anotar el contingut d'aquesta Resolució en &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;l'Inventari General de Béns i Drets de la Comunitat Autònoma de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquesta Resolució es pot interposar recurs d'alçada davant el conseller d'Economia, Hisenda i Innovació en el termini d'un mes comptador des de l'endemà d'haver-se notificat i publicat en &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;el Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
