El 12 d'abril de 2024, el vicepresident en matèria agrària del FOGAIBA va dictar una Resolució de concessió d'ajudes per a inversions a les explotacions agràries, que es va publicar al Butlletí Oficial de les Illes Balears número 52, del 20 d'abril de 2024, en la qual hi figurava una concessió a favor dels interessats assenyalats a l'annex adjunt.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. El 9 de setembre de 2024, amb registre d'entrada núm. GOIBE569603/2024, l'interessat SON ARRET, SRM amb <span style="color:#000000">NIF E07712003, </span>va presentar el seu desistiment, la qual cosa suposa dur a terme la revocació total de l'ajuda concedida.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. El 25 de setembre de 2024, amb registre d'entrada núm. GOIBE618802/2024, l'interessat BINIGAFULL, S.R.M. amb <span style="color:#000000">NIF E07458359, </span>va presentar el seu desistiment, la qual cosa suposa dur a terme la revocació total de l'ajuda concedida.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. El 09 de setembre de 2024, amb registre d'entrada núm. GOIBE569603/2024, l'interessat MARIA DEL MAR RAMIS VICH amb <span style="color:#000000">NIF ***5889**, </span>va presentar el seu desistiment, la qual cosa suposa dur a terme la revocació total de l'ajuda concedida.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. L'article 21.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que «En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables».</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">7. L'article 43 del Text refós de la Llei de subvencions, aprovat per decret legislatiu 2/2005, de 28 de desembre, disposa que «Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament».</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">8. Atès tot això, es proposa fer la revocació a causa del desistiment de l'ajuda concedida pels beneficiaris que s'indiquen en l'annex d'aquesta resolució.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Fonaments de dret</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Proposta de resolució </span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Per tot això, s'informa favorablement i es proposa al vicepresident en matèria agrària del FOGAIBA que dicti una resolució en els termes següents:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1.Acceptar els desistiment presentats pels beneficiaris <span style="color:#000000"><em>assenyalats a l'annex adjunt</em></span>, a l'ajuda concedida per la Resolució del vicepresident del FOGAIBA de dia <span style="color:#000000"><em>17 d'abril de de 2023,</em></span> </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. Revocar l'ajuda concedida en la resolució del vicepresident del FOGAIBA de dia <span style="color:#000000"><em>17 d'abril de de 2023</em></span>, corresponent als interessats assenyalats a l'annex adjunt i per l'import indicat en l'annex d'aquesta resolució.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">3.
