&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En la data 16 d'octubre de 2024, la directora general d'Atenció a la Dependència ha formulat la proposta de resolució següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fets&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En data 6 de juliol de 2024, es va publicar la Resolució de 21 de juny de 2024 de la consellera de Famílies i Afers Socials per la qual s'aprova la convocatòria de subvencions destinades a entitats privades titulars de serveis residencials per a gent gran per finançar inversions dirigides a la reforma i la rehabilitació d'espais residencials per reconvertir places per a persones autònomes en places per a persones grans en situació de dependència (BOIB núm. 89 de 6 de juliol).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquesta convocatòria té per objecte l'establiment de subvencions destinades a entitats privades titulars de serveis residencials per a gent gran per finançar inversions dirigides a la reforma i la rehabilitació d'espais residencials per reconvertir places per a persones autònomes en places per a persones en situació de dependència. Concretament, s'han de destinar a serveis residencials del tipus «residència», entès com un servei de caràcter social que ofereix allotjament, convivència i atenció integral a les persones grans amb necessitat de suport per a les activitats bàsiques de la vida diària, per la qual cosa els presta una atenció integral i continuada; substitueix la llar familiar de manera temporal o permanent i presta una atenció especialitzada segons les necessitats específiques de les persones usuàries.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Una vegada publicada la Resolució esmentada, arran d'una sèrie de consultes realitzades per diferents entitats que poden estar interessades en sol·licitar les subvencions que regula la Resolució així com una vegada l'òrgan competent ha valorat la necessitat de clarificar i millorar una sèrie d'aspectes de la convocatòria, s'ha considerat adient modificar la resolució de 21 de juny de 2024 de la consellera de Famílies i Afers Socials. Les modificacions principals que s'introdueixen són:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.1 L'ampliació del termini per a la presentació de la justificació parcial del 60% corresponent a la línia 1) de la subvenció que s'amplia fins dia 15 de novembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.2 La previsió de què, en cas que hi hagi un romanent de crèdit a una de les línies, de subvencions es pugui passar a l'altra línia sempre dins el mateix exercici pressupostari mitjançant resolució de la consellera sense que impliqui una modificació de la resolució d'aprovació de la convocatòria&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.3 La possibilitat de què també aquelles entitats interessades que si bé no son titulars del solar, terreny o immoble en el qual s'efectuarà la reforma o rehabilitació puguin optar a les subvencions que regula la convocatòria sempre que disposin d'un contracte de lloguer o de cessió del solar, terreny o immoble on està ubicat el servei residencial del qual és titular si reuneixen els requisits que s'estableixen per aquest supòsit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.4 Establir un període mínim de 10 anys envers dels 20 anys que preveu inicialment la convocatòria del destí dels ajuts atorgats a la finalitat per a la qual se sol·liciten.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Atès que el termini de presentació de sol·licituds, que acaba el 6 de novembre de 2024, no ha finalitzat, la modificació de la convocatòria no té efectes en la concurrència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Llei 1/2019, de 31 de gener, del Govern de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Llei 3/2003, de 26 de novembre, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Llei 14/2014, de 29 de desembre, de finances de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El Decret 12/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears, modificat pel Decret 16/2023, de 20 de juliol, de la presidenta de les Illes Balears i el Decret 5/2024, de 29 de maig de la presidenta de les Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Proposta de resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Propòs a la consellera de Famílies i Afers Socials que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Modificar el punt 2.1 a) de la convocatòria aprovada per la Resolució de 21 de juny de 2024 , que queda redactat de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;«&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a) Respecte a la línia descrita en el punt 1.5.a) d'aquesta convocatòria, les obres es poden haver iniciat dins l'any 2022 i han d'haver finalitzat, com a màxim, abans del dia 30 de setembre de 2025, d'acord amb el calendari d'execució següent:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;- L'entitat beneficiària, abans del dia 15 novembre de 2024, ha d'haver justificat, com a mínim, el 60 % de l'obra executada entre el dia 1 de gener de 2022, o si escau, en data posterior, i el dia 30 de setembre de 2024, d'acord amb el projecte presentat.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;- L'entitat beneficiària ha de justificar la resta del projecte executat al llarg de l'any 2025, i en tot cas, abans del dia 15 d'octubre de 2025&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Modificar el punt 2.2 de la convocatòria, que queda redactat de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;«&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. Les entitats han de disposar del certificat de final d'obra o, en el cas de que aquest no sigui obligatori, del certificat del professional del final de l'obra, abans de presentar la justificació final del projecte i han de disposar de la corresponent autorització i acreditació administrativa de les places subvencionades en el termini màxim d'un any des de la finalització de l'obra. L'entitat beneficiària haurà de presentar la sol·licitud d'autorització o acreditació degudament registrada en el moment de presentar la justificació final del projecte subvencionat&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Afegir un apartat 7 al punt 3 de la convocatòria amb la redacció següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;«&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;7. En cas que hi hagi un romanent a una línia es pot passar a l'altra línia sempre dins el mateix exercici pressupostari mitjançant resolució de la consellera sense que impliqui una modificació de la resolució d'aprovació de la convocatòria»&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Modificar la lletra g) del punt 4 de la convocatòria, que queda redactada de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;«&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g) Ser titular del solar, terreny o immoble en el qual s'efectuarà la reforma o rehabilitació o, disposar d'un contracte de lloguer o de cessió del solar, terreny o immoble on està ubicat el servei residencial del qual és titular sempre que es compleixin dos requisits:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;I. Que el temps de la vigència del contracte que resta pendent sigui igual o superior a 10 anys comptadors del de la data prevista de finalització de les obres subvencionables. En el cas que la vigència del contracte de lloguer sigui inferior a aquest període, declaració responsable signada per l'entitat interessada i el propietari de l'edifici en la què s'indicarà expressament que es comprometen a destinar el centre objecte de la convocatòria a la finalitat prevista durant un període de 10 anys i a mantenir durant aquest període la corresponent autorització i acreditació del servei. En cas contrari, l'entitat subvencionada haurà de retornar l'import subvencionat de conformitat amb el què disposa el punt 17 d'aquesta convocatòria.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;II. Que l'entitat beneficiària compti amb l'autorització expressa del titular del solar, terreny o immoble per dur a terme les obres projectades».&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Modificar lel punt 5.1 e) de la convocatòria, que queda redactada de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;«&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e) Destinar els ajuts atorgats a la finalitat per a la qual se sol·liciten, per un període mínim de 10 anys&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Modificar el punt 7.2. k) de la convocatòria, que queda redactat de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;«&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;k) Un document acreditatiu de la titularitat de l'edifici en el qual s'ha de dur a terme el projecte per al qual se sol·licita finançament. En el cas que l'edifici estigui en règim de lloguer, s'ha d'aportar còpia del contracte de lloguer vigent i l'autorització expressa de la propietat de l'edifici que manifesti la seva conformitat de les obres. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;En el cas que la vigència del contracte de lloguer sigui inferior a aquest període, s'ha de presentar una declaració responsable signada per l'entitat interessada i el propietari de l'edifici en la què s'indicarà expressament que es comprometen a destinar el centre objecte de la convocatòria a la finalitat prevista durant un període de 10 anys així com a mantenir durant aquest període la corresponent autorització i acreditació del servei&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Modificar els punts 8.2 i 8.3 de la convocatòria, que queden redactats de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;«&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. Cada sol·licitud de subvenció que es presenti ha de correspondre a un únic projecte tècnic.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. No es pot presentar el mateix projecte tècnic per a les dues línies de subvenció&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Modificar el punt 12.6.de la convocatòria, que queda redactat de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;«&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;6. La Comissió Avaluadora aplicarà el següent procediment de valoració i determinació de l'import de la subvenció:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;b) Per determinar l'import de la subvenció en relació amb les despeses d'inversió, s'ha de valorar cada sol·licitud d'acord amb els criteris que estableix la taula anterior.&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c) La puntuació mínima necessària perquè una sol·licitud pugui accedir a la subvenció és de 40 punts.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d) Una vegada valorades les sol·licituds d'acord amb els criteris de valoració i la limitació establerta en la lletra f), s'ordenaran tots els projectes segons la puntuació obtinguda. Per determinar l'import concedit, es tindran en compte les consideracions següents:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;En el cas que la suma dels imports sol·licitats sigui inferior a l'import total de la convocatòria, s'atribuirà a les entitats beneficiàries tota la subvenció sol·licitada, amb els límits establerts en els diferents apartats d'aquesta convocatòria.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;En el cas que la suma dels imports sol·licitats sigui superior a l'import total de la convocatòria, es concedirà el 100% dels imports sol·licitats, per ordre de puntuació obtinguda, fins exhaurir el crèdit amb els límits establerts en els diferents apartats d'aquesta convocatòria. En aquest supòsit, a l'hora d'establir la quantia de la subvenció per a cada sol·licitud, s'ha de tenir en compte que l'import màxim que es pot concedir a una mateixa entitat és del 60 % sobre l'import total de la línia corresponent de la convocatòria&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e) El darrer projecte subvencionable segons el que disposa l'apartat anterior es pot finançar per un import inferior al 100% de la quantia sol·licitada, per poder executar tot el pressupost de la convocatòria. En aquest cas, es notificarà la proposta de resolució a l'entitat interessada perquè accepti o rebutgi la subvenció proposada i se li concedirà un tràmit d'audiència perquè pugui presentar-hi al·legacions en el termini de deu dies hàbils, comptadors des de l'endemà de la notificació de la proposta de resolució. En cas que la rebutgi, es notificarà successivament a les entitats següents per ordre de prelació de la llista, fins que alguna l'accepti.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f) D'altra banda, un cop notificades les propostes de resolució, les entitats interessades disposen d'un termini de deu dies hàbils per acceptar o rebutjar la subvenció. Es considera que l'accepten si no manifesten la renúncia dins el termini atorgat. Si alguna entitat rebutja la subvenció, es podrà repartir l'import romanent entre la resta, seguint les mateixes regles descrites en els apartats anteriors.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g) En el cas que, un cop es reparteixin tots els imports sol·licitats, quedi un romanent de crèdit en la convocatòria, es podrà repartir entre les entitats que no hagin arribat als 40 punts però n'hagin assolit un mínim de 25. El repartiment del romanent es farà seguint les mateixes regles descrites en els apartats anteriors.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;h) En cas d'empat entre les puntuacions de projectes subvencionables, es donarà prioritat a la sol·licitud que tengui una puntuació més alta segons el criteri següent:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Nombre de places reformades o rehabilitades per a persones en situació de dependència.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Si persisteix l'empat, cal atenir-se a la puntuació obtinguda en la resta de criteris, segons l'ordre successiu següent:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;i) En cas que, així i tot, persisteixi l'empat, es donarà prioritat a l'ordre d'entrada de la sol·licitud en el registre de la Conselleria de Famílies i Afers Socials.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;j) Si una vegada atorgats els ajuts a les entitats beneficiàries queda romanent en alguna línia, aquesta quantitat es pot passar a una altra línia, a proposta de l'òrgan instructor i amb la resolució prèvia de la consellera de Famílies i Afers Socials».&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Modificar el punt 13.1 a), 13.2 i 13.3 de la convocatòria, que queda redactada de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;«&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1. L'abonament de les anualitats es farà d'acord amb la planificació següent i segons cada línia de subvenció:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a) Línia 1:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;- Anualitat de 2024: s'ordenarà el pagament del 60 % de la subvenció concedida una vegada s'hagi justificat, abans del 15 de novembre de 2024, que s'ha executat el 60 % del projecte que hagi servit per concedir la subvenció, de tots els projectes en execució en el període 2022-2025. En el cas que l'entitat beneficiària de la subvenció presenti una justificació per un import inferior al 60 % del projecte, s'abonarà com a màxim el percentatge del projecte justificat en aquesta anualitat, sense perjudici que l'entitat pugui sol·licitar una ampliació del termini d'execució de les actuacions en les condicions marcades en l'article 15.3 de l'Ordre de la consellera d'Afers Socials i Esports de 5 de març de 2021 per la qual s'estableixen les bases reguladores de les subvencions en matèria de serveis socials i de joventut i amb la prèvia resolució a la què fa referència el punt 3.3 d'aquesta convocatòria.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;- Anualitat de 2025: s'ordenarà el pagament del 40 % de la subvenció concedida una vegada s'hagi justificat, abans del 15 d'octubre de 2025, la totalitat del projecte que hagi servit per concedir la subvenció. En el cas que l'entitat beneficiària de la subvenció no justifiqui la totalitat del projecte es reajustarà el segon pagament proporcionalment d'acord amb el projecte finalment justificat i sempre tenint en compte a l'hora de fer el pagament proporcional el reajustament previ, que si escau, s'hagi fet en el primer pagament.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. Per justificar la subvenció, les entitats beneficiàries han de presentar la documentació següent:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b) Una memòria econòmica, en la qual han de constar un compte justificatiu, degudament emplenat i signat pel representant de l'entitat, que ha d'incloure la relació de certificats parcials d'obra, a més del certificat final d'obra o, en el cas de que aquest no sigui obligatori, del certificat del professional del final de l'obra, amb la data d'emissió i de pagament i el percentatge d'imputació al projecte subvencionat.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;En el cas que s'hagi presentat un projecte tècnic que formi part o que es correspongui a una part d'un projecte d'execució distribuït per fases, la memòria econòmica ha d'incloure la relació de certificats parcials d'obra i un certificat del professional que dirigeix l'obra on consti que s'han finalitzat les obres previstes en el projecte tècnic.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. Les entitats han de disposar del certificat de final d'obra o, en el cas de que aquest no sigui obligatori, del certificat del professional del final de l'obra, abans de presentar la justificació final del projecte. No obstant, en el cas que s'hagi presentat un projecte tècnic que formi part o que es correspongui a una part d'un projecte d'execució distribuït per fases, les entitats han de disposar d'un certificat del professional que dirigeix l'obra on consti que s'han finalitzat les obres previstes en el projecte tècnic.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Igualment, les entitats han de disposar de la corresponent autorització i acreditació administrativa de les places subvencionades en el termini màxim d'un any des de la finalització de l'obra. L'entitat beneficiària haurà de presentar la sol·licitud d'autorització o acreditació degudament registrada en el moment de presentar la justificació final del projecte subvencionat. Si en el termini indicat l'entitat no hagués obtingut la corresponent autorització i acreditació de les places subvencionades, s'iniciarà el corresponent procediment de reintegrament de la subvenció atorgada».&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. Modificar el punt 17.3 primer paràgraf de la convocatòria, que queda redactada de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;«&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. D'acord amb el que preveu l'article 8.4 de l'Ordre l'Ordre de la consellera d'Afers Socials i Esports de 5 de març de 2021 per la qual s'estableixen les bases reguladores de les subvencions en matèria de serveis socials i de joventut i l'article 40.4 del Text refós de la Llei de subvencions, és causa de reintegrament l'incompliment de l'obligació de destinació dels ajuts atorgats a la finalitat per a la qual se sol·liciten, per a un període mínim de deu anys. Aquest incompliment es produeix en tot cas amb l'alienació o el gravamen del bé, i el bé queda afecte al pagament del reintegrament sigui qui sigui el posseïdor, llevat que sigui un tercer protegit per la fe pública registral o es justifiqui l'adquisició dels béns amb bona fe i títol just en un establiment mercantil o industrial en cas de béns mobles no inscriptibles&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. Publicar aquesta resolució en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquesta Resolució —que exhaureix la via administrativa— es pot interposar un recurs potestatiu de reposició davant la consellera de Famílies i Afers Socials en el termini d'un mes comptador des de l'endemà que s'hagi publicat, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la notificació, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
