font-size:12px"><span style="color:#000000"><span style="line-height:100%">El Reial decret 364/1995, de 10 de març, pel qual s'aprova el Reglament general d'ingrés del personal al servei de l'Administració General de l'Estat i de provisió de llocs de treball i promoció professional dels funcionaris civils de l'Administració General de l'Estat, establí a l'article 71 els intervals dels nivells de llocs de treball que corresponen a les escales d'acord amb el grup en el qual figuren classificats.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#00000a">Aquest canvi entrà en vigor l'endemà de la publicació al BOE, que fou</span> 20 de desembre de 2023.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#00000a">Per establir les conseqüències d'aquest canvi,</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#00000a"><strong>INFORM:</strong></span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#00000a"><strong>PRIMER: </strong>La disposició addicional sisena no estableix l'àmbit d'aplicació, en tot cas és clar que aquesta nova escala de nivells és d'aplicació a l'Administració de l'Estat.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#00000a">D'acord amb l'article 3 del Reial decret 861/1986</span><span style="color:#00000a">,</span><span style="color:#00000a"> de 25 d'abril, modificat pel Reial </span><span style="color:#00000a">d</span><span style="color:#00000a">ecret 158/1996</span><span style="color:#00000a">,</span><span style="color:#00000a"> del 2 de febrer, estableix: "Los intervalos de los niveles de la Administración Local serán los que en cada momento sean los establecidos por los funcionarios de la Administración del Estado" , per la qual cosa no sembla que hi hagi dubte que aquesta modificació afecta </span><span style="color:#00000a">e</span><span style="color:#00000a">l personal de l'Administració local.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#00000a"><strong>SEGON:</strong> La diferència entre la situació actual i l'aplicació d'aquesta pujada del complement de destinació</span><span style="color:#00000a"> seria aproximadament de 273.000 €</span><span style="color:#00000a">, a la qual podríem aplicar un cost augmentat de Seguretat Social de 81.900 €, és a dir, l'augment total seria d'uns 350.900 €, això suposa un augment d'un 1,4 % de la massa salarial total de la partida de personal del Consell Insular de Menorca.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000"><span style="line-height:100%">La cap del Servei de Gestió de Persones»</span></span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">La Mesa General de Negociació acordà, en data 5 de juliol de 2024, aprovar la modificació dels nivells de complement de destinació amb els canvis següents: incorporar el grup AP amb un nivell mínim de 12 i un màxim de 16, i modificar l'Acord marc dels funcionaris del Consell Insular de Menorca per eliminar la referència a l'increment per serveis prestats.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">La cap del Servei de Gestió de Persones emeté nota d'ampliació, en data 26 d'agost de 2024, en relació amb la modificació del complement de destinació.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Atesa la proposta de la consellera executiva del Departament d'Economia i Serveis Generals i en exercici de les competències atribuïdes a l'article 33 de la Llei 4/2022, de 28 de juny, de consells insulars;</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">El Consell Executiu, per unanimitat i en votació ordinària, adopta els acords següents:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><strong>Segon.</strong> Iniciar els tràmits per a la modificació de l'article 65 bis de l'acord marc del personal funcionari i del conveni col·lectiu del personal laboral del Consell Insular perquè s'elimini la referència a l'increment per prestació de serveis, mantenint l'increment per superació de cursos. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">L'actualització d'aquest article es farà ajustant-se a la normativa vigent.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><strong>Tercer.</strong> Publicar aquest acord en el <em>Butlletí Oficial de les Illes Balears</em> tenint en compte que els efectes de l'acord adoptat seran des del 20 de desembre de 2023 i suposaran que aquells funcionaris que tenen el nivell de complement de destí per davall dels nous mínims establerts, es veuran incrementats aquests complements des de la data esmentada.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Contra aquest acord – que no exhaureix la via administrativa – es pot interposar un recurs d'alçada davant la Comissió de Govern, per delegació del Ple del Consell Insular de Menorca (Acord de 31-7-2023, BOIB núm. 109 de 5-8-2023), en el termini d'un mes comptador des de l'endemà que s'hagi publicat, d'acord amb l'article 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">L'esmentat recurs s'entendrà desestimat, si no es notifica la resolució corresponent, quan hagin transcorregut tres mesos des de la seva interposició.
