El Ple del Consell Insular de Menorca, en sessió de 21 de desembre de 2023, va rebutjar el Projecte de Pressupost 2024 presentat per l'equip de Govern; consegüentment, es va prorrogar el pressupost general CIM 2023 mitjançant el Decret de presidència 2024/PRE/000003, de data 4 de gener de 2024.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. El Pla Estratègic de Subvencions vigent, aprovat pel Consell Executiu de la corporació en data 4 de desembre de 2023, preveu la convocatòria d'ajuts al teixit empresarial i associatiu de Menorca mitjançant la dotació de fons propis (corrents i d'inversió).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. La cooperació en el foment del desenvolupament econòmic i social és una de les competències pròpies del Consell Insular de Menorca; a més, als poders públics els correspon fomentar la participació en l'empresa, estimular l'economia social i incentivar el cooperativisme.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. En matèria de promoció econòmica, els propòsits del Consell Insular de Menorca són promocionar els productes agroalimentaris autòctons, estimular el petit comerç local i les cooperatives agràries i de consum, donar suport al sector industrial i avivar l'artesania de l'illa.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. Tota actuació administrativa de foment per mitjà de la concessió de subvencions ha de subjectar-se als principis de publicitat, concurrència i objectivitat. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. L'interès públic d'aquesta convocatòria rau en la millora del nivell competitiu del teixit productiu i comercial de Menorca i en la potenciació de la visibilitat del seu producte. Per aquesta raó, l'objecte d'aquests ajuts de minimis és donar suport a les empreses productives, a les cooperatives, al petit comerç i a les associacions empresarials de Menorca en la promoció i comercialització dels seus productes i en l'adaptació o transformació dels seus negocis mitjançant la incorporació de tecnologies avançades, sistemes innovadors, de qualitat o sostenibles i noves inversions. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">7. La convocatòria d'ajuts al teixit productiu, cooperatiu i comercial de l'any 2024 preveu les quatre línies, amb les respectives accions susceptibles de subvenció, que es relacionen a continuació:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Línia 1. Les ajudes que s'atorguin en el marc d'aquestes bases es podran distribuir mitjançant quatre línies: la dirigida a les empreses de caràcter productiu (L1), la reservada a les associacions empresarials (L2), la de cooperatives agràries i de consum (L3) i la dedicada al petit comerç (L4). </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. La convocatòria establirà els imports màxims i les partides a les quals s'aplicaran els ajuts.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. En funció del tipus de beneficiari (empresa o associació), els ajuts es comptabilitzaran, per vinculació, a l'aplicació pressupostària adient. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>4. ACTIVITATS SUBVENCIONABLES: REQUISITS I CONDICIONS</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Únicament són subvencionables les despeses que s'imputin al desenvolupament del projecte de naturalesa subvencionable o que recaiguin, inequívocament, sobre alguna de les activitats referides als epígrafs de l'IAE considerats subvencionables. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. Les actuacions a subvencionar s'han de realitzar durant el període comprés entre el dia 1 de setembre de l'any anterior a la convocatòria i el dia 31 d'agost de l'any en què es convoquin els ajuts. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. Són susceptibles de subvenció, sempre que respectin els criteris d'elegibilitat previstos a la base 8, les activitats relacionades a continuació:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>L1. Ajuts a empreses productives:</em></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a)</em> Assistència a fires professionals o sectorials fora de Menorca en què l'empresa hi hagi assistit o exposat, i prospecció de mercats exteriors que poden ser viatges comercials o gestions d'intermediaris especialitzats. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em> Formació per a la millora de les competències professionals, presencial o virtual, sempre que tingui una relació directa amb l'ocupació.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>c)</em> Assessorament per a la captació de fons europeus sobre projectes pels quals s'hagi sol·licitat una subvenció dins del termini subvencionable.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>d)</em> Incorporació de personal qualificat, indefinida o temporal, referida a personal amb formació d'enginyeria, cicle formatiu de grau superior (CFGS) o equivalent i enquadrament en els grups de cotització 1, 2 o 3.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>e) </em>Implantació de projectes d'innovació, qualitat o sostenibilitat exclusivament vinculats al procés productiu; obtenció de patents i models d'utilitat; certificacions o homologacions prèvies a les millores o novetats en el procés productiu (s'exclouen els estudis de viabilitat o de mercat).</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>f)</em> Inversió en actius fixos exclusivament vinculats al procés productiu (amb un mínim de 600 € per a cada element o actiu): materials (maquinària, equipament, utillatge o instrumental) o immaterials (adquisicions de drets de patents, llicències, <em>know-how</em> o coneixements tècnics no patentats) de naturalesa amortitzable (excloses les adquisicions de segona mà).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>L2. Ajuts a associacions empresarials:</em></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a)</em> Accions promocionals i campanyes publicitàries, convencionals o digitals. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em> Formació per a la millora de les competències professionals: accions formatives, presencials o virtuals, relacionades directament amb les ocupacions sectorials de l'associació.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>L3. Ajuts a cooperatives agràries i de consum:</em></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a)</em> Assistència a fires fora de Menorca, prospecció de mercats exteriors i promoció de producte local.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em> Inversió en actius fixos materials (amb un mínim de 600 € per a cada element o actiu): obres i reformes, maquinària, equipament, utillatge o instrumental de naturalesa amortitzable, excloses les adquisicions de segona mà. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>c)</em> Despeses indirectes, necessàries i imprescindibles, per a l'execució de la promoció de producte local.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>L4. Ajuts al petit comerç:</em></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a) </em>Assessorament comercial i vendes, aparadorisme i espais, estudis de viabilitat o de mercat.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em> Inversió en actius fixos materials (amb un mínim de 600 € per a cada element o actiu): obres i reformes, maquinària, equipament, utillatge o instrumental de naturalesa amortitzable, excloses les adquisicions de segona mà. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. L'impost sobre el valor afegit (IVA) constitueix part d'una despesa subvencionable només si el beneficiari el sufraga en part o íntegrament i no pot recuperar-lo. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>5. RÈGIM DE COMPATIBILITAT AMB ALTRES AJUTS. NATURALESA DE L'AJUT DE MINIMIS</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Les subvencions que es regeixen per aquestes bases són de caràcter voluntari i eventual; en tot moment es poden anul·lar, revocar i reintegrar per les causes que preveuen la llei i aquestes bases; no generen cap dret a obtenir-ne en anys posteriors; tampoc no es poden al·legar com a precedent.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. Les subvencions que es concedeixin són compatibles amb altres ajudes, subvencions, ingressos o recursos, per dur a terme les mateixes actuacions, i que provenguin d'altres administracions o entitats, sens perjudici de l'obligació dels beneficiaris de comunicar-ho al CIM de la forma establerta en aquestes bases.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. De manera aïllada o amb la concurrència d'altres subvencions, en cap cas, l'import dels ajuts concedits no pot superar el cost de l'activitat subvencionada. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. Per a l'L1, L3 i L4, aquests ajuts seran incompatibles amb els que el CIM concedeixi per a la mateixa finalitat durant l'any de la convocatòria; i pel que fa a l'L2, seran incompatibles amb els que el CIM concedeixi durant l'any de la convocatòria tot i ser un nou projecte. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. Exceptuant la línia dedicada a entitats sense afany de guany (L2), les línies restants (L1, L3 i L4) contenen ajuts amb la consideració de minimis segons la normativa europea. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. En funció del sector econòmic en què operi l'empresa sol·licitant de les esmentades L1, L3 i L4, resultarà d'aplicació un dels següents reglaments de minimis: </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a)</em> Reglament (UE) núm. 1408/2013 (modificat pel Reglament (UE) núm. 2019/316 de 21 de febrer de 2019), de la Comissió, de 18 de desembre de 2013, relatiu a l'aplicació dels art. 107 i 108 del Tractat de funcionament de la Unió Europea de les ajudes de minimis en el sector agrícola. En aquest grup, comptant els tres darrers exercicis fiscals, els beneficiaris no poden rebre ajuts públics o d'ens privats finançats a càrrec de pressuposts públics, per un import que sobrepassi els 20.000 €; així mateix, s'haurà de respectar el topall nacional indicat a l'annex de l'esmentat reglament.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em> Reglament (UE) núm. 2023/2831 de la Comissió, de 183 de desembre de 2023, relatiu a l'aplicació dels art. 107 i 108 del Tractat de funcionament de la Unió Europea a les ajudes de minimis a tots els sectors. En aquest cas, comptant els tres darrers exercicis fiscals i tot tenint en compte les possibles acumulacions previstes en l'article 5, els beneficiaris no poden rebre ajuts públics o d'ens privats finançats a càrrec de pressuposts públics, per un import que superi els 300.000 €. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>6. REQUISITS DELS BENEFICIARIS</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Poden accedir als ajuts que els correspongui:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a)</em> Per a l'L1, les persones físiques o jurídiques o agrupacions de persones físiques o jurídiques, les comunitats de béns o qualsevol altre tipus d'unitat econòmica o patrimoni separat sense personalitat jurídica que tenguin el domicili fiscal i un establiment operatiu a Menorca de naturalesa productiva (fabricant, productor o artesà), el qual, sota la figura de micro, petita o mitjana empresa, consti d'alta de l'impost d'activitats econòmiques en les divisions 0 (sempre que l'explotació estigui donada d'alta en el Registre insular d'explotacions agràries en data de finalització del termini de presentació de sol·licituds, com a activitat complementària de venda directa i de transformació, si n'és el cas), 1, 2, 3 o 4 de la secció primera o l'agrupació 86 de la secció segona del Reial decret legislatiu 1175/1990, de 28 de setembre, pel qual s'aproven les tarifes i la instrucció de l'impost sobre activitats econòmiques. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em> Per a l'L2, les associacions empresarials amb un àmbit d'actuació circumscrit, totalment i en exclusiva, a l'illa de Menorca.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>c)</em> Per a l'L3, les cooperatives agràries o les cooperatives de consumidors i usuaris que constin inscrites en el Registre de cooperatives de les Illes Balears en el moment de la sol·licitud.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>d)</em> Per a l'L4, les persones físiques o jurídiques o agrupacions de persones físiques o jurídiques, les comunitats de béns o qualsevol altre tipus d'unitat econòmica o patrimoni separat sense personalitat jurídica que tenguin el domicili fiscal i un establiment comercial ubicat a qualsevol terme municipal de Menorca (excepte urbanitzacions i polígons industrials), el qual, sota la figura de comerç al detall, consti d'alta de l'impost d'activitats econòmiques (IAE) en algun dels epígrafs relacionats a l'annex I (extret de les agrupacions 64 i 65 de la primera secció del Reial decret legislatiu 1175/1990, de 28 de setembre, pel qual s'aproven les tarifes i la instrucció de l'IAE). Només serà subvencionable un establiment comercial per empresa.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. Les línies 1, 2, 3 i 4 són incompatibles entre si; per això, qualsevol persona física o jurídica podrà ser beneficiària només dels ajuts previstos en una de les quatre.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. Per a les línies 1 i 4, en cas que un establiment tengui més d'un titular, només es podrà dur a terme una única sol·licitud per establiment; també s'ha de presentar una única sol·licitud per beneficiari en el supòsit que aquest sigui titular de més d'un establiment.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. En qualsevol dels casos, no poden ser-ne beneficiàries:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a)</em> Les persones físiques o jurídiques en les quals concorri alguna de les prohibicions establertes en l'article 13 de la Llei 38/2003, de 17 de novembre, general de subvencions (LGS) i en l'article 10 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions de les Illes Balears (TRLSIB).</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b) </em>Aquelles<em> </em>associacions sotmeses a alguna de les causes de prohibició recollides en l'article 4, apartats 5 i 6, de la Llei orgànica 1/2002, de 22 de març, que regula el dret d'associació o que es trobin en un procediment de suspensió del procediment d'inscripció per indicis racionals d'il·licitud penal en aplicació de l'article 30.4 de l'esmentada llei. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>c) </em>De conformitat amb el que disposa l'article 11 de la Llei 11/2016, de 28 de juliol, d'igualtat de dones i homes, tampoc no poden ser beneficiàries de les subvencions previstes en aquestes bases, les persones físiques o jurídiques sancionades o condemnades per resolució administrativa o sentència judicial fermes per exercir o tolerar pràctiques laborals considerades discriminatòries per raó de sexe o gènere. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>d)</em> Aquelles persones físiques o jurídiques que, en el moment de dictar-se la proposta de resolució definitiva de la convocatòria, per part de l'òrgan instructor, no estiguin al corrent en el compliment de les seves obligacions tributàries i amb la Seguretat Social davant de l'Administració General de l'Estat i amb les obligacions tributàries davant del CIM.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>e)</em> Les empreses que en els tres darrers exercicis fiscals hagin rebut ajuts públics o d'ens privats finançats a càrrec de pressuposts públics en concepte de minimis, per un import superior a 20.000 € o 300.000 €, segons els sigui d'aplicació l'apartat <em>a)</em> o <em>b</em>) de la base 5.6.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">A tal efecte, el CIM prendrà en consideració la informació pública que consta al <em>Sistema Nacional de Publicidad de Subvenciones y Ayudas Públicas</em>; si d'aquesta consulta es desprèn que l'empresa supera el llindar, serà requerida en els termes establerts en la base 7.9 perquè pugui presentar les al·legacions que consideri oportunes.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>f)</em> Segons l'article 13.3 bis de la Llei 38/2003, de 17 de novembre, general de subvencions, per a subvencions d'un import superior a 30.000 €, les persones físiques i jurídiques, diferents de les entitats de dret públic, amb ànim de lucre hauran d'acreditar que compleixen els terminis de pagament establerts a la Llei 3/2004, de 29 de desembre, per la qual s'estableixen mesures de lluita contra la morositat en les operacions comercials, de la forma que s'estableix a l'article 13.3 <em>bis </em>de l'LGS i que es reprodueix textualment al punt <em>k</em> de l'apartat D de la base 7.4. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>7. PRESENTACIÓ DE LES SOL·LICITUDS</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. El termini per a la presentació de sol·licituds i justificacions s'iniciarà l'endemà d'haver-se publicat la convocatòria en el <em>Butlletí Oficial de les Illes Balears</em> (BOIB) i finalitzarà el dia que la mateixa convocatòria assenyali.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. Tenen la consideració de declaració responsable els següents documents, en versió L1, L2, L3 o L4, a presentar: sol·licitud, model normalitzat de memòria justificativa, declaració responsable i declaració de compte bancari. De conformitat amb l'article 11.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques (LPACAP), és obligatori l'ús de la signatura en tots ells.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. Tota la informació requerida als documents esmentats al punt anterior és essencial; per aquesta raó, qualsevol inexactitud, falsedat o omissió continguda en ells determina la impossibilitat de continuar amb l'exercici del dret o activitat afectada des del moment en què es tingui constància d'aquests fets, sense perjudici de les responsabilitats penals, civils o administratives que pertoquin de conformitat amb l'article 69.4 de l'LPACAP.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. La sol·licitud s'ha de presentar formalitzada electrònicament mitjançant el model normalitzat adjunt a aquestes bases i que hi ha a la seu electrònica <em>www.cime.es</em>. Facultativament, les persones físiques poden presentar-la presencialment d'acord amb el que s'estableix a l'apartat <em>b</em> del punt 8 d'aquesta base.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. A la sol·licitud, s'hi ha d'adjuntar la següent documentació:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>A) Documentació administrativa general</strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a)</em> Si el sol·licitant és persona física, DNI/NIE en vigor.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em> Si el sol·licitant és persona jurídica, escriptura de constitució o modificació, estatuts o reglament intern de funcionament inscrits en el registre corresponent. font-size:12px"><span style="line-height:100%"><span style="color:#000000">S'eximeix de presentar la documentació a què fan referència les lletres <em>a), b), c), d) </em>i<em> h)</em> en el cas que aquesta ja consti en els arxius del CIM; en aquest cas, s'haurà de fer constar expressament en la sol·licitud indicant el núm. de l'expedient. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. D'acord amb els art. 28.3 i 53 <em>c)</em> de l'LPACAP, les persones interessades no tenen l'obligació de presentar documents originals, llevat que, amb caràcter excepcional, la normativa reguladora aplicable exigeixi el contrari. En qualsevol cas, les persones interessades són responsables de la veracitat dels documents que presentin (art. 28.7 de l'LPACAP).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Excepcionalment, quan la rellevància d'un document de l'expedient aportat per la persona interessada ho exigeixi, o existeixin dubtes derivats de la qualitat de la còpia, el CIM pot sol·licitar de manera motivada l'autenticació de les còpies aportades, per la qual cosa pot requerir l'exhibició del document o de la informació original (art. 28.5 de l'LPACAP).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">7. Pel fet de presentar-se a la convocatòria, la persona interessada presta al CIM els següents consentiments:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a)</em> A consultar i comprovar la veracitat de la documentació i de les dades presentades per la persona interessada que tenguin en el seu poder altres administracions públiques, principalment mitjançant les plataformes d'interoperabilitat, les xarxes corporatives o altres sistemes electrònics habilitats a aquest efecte i als quals el CIM tengui accés.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em> A consultar l'existència i la veracitat de la documentació i de les dades que eventualment la persona interessada hagi considerat oportú no presentar acollint-se al dret de no fer-ho pel fet que hagin estat elaborades per les administracions públiques.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Els esmentats consentiments només es consideraran atorgats quan no consti en l'expedient l'oposició expressa a l'esmentada consulta o quan la llei especial que sigui aplicable al cas en requereixi el consentiment exprés; en aquest darrer cas, serà obligatori que l'Administració el requereixi i que la persona interessada el presti. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">8. Dins del termini establert al punt 1 d'aquesta base, les sol·licituds i tota la documentació (general i específica) relacionada al punt 5, també d'aquesta base, s'han de presentar d'acord amb les indicacions següents:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a)</em> Per mitjans electrònics d'acord amb el que estableix l'article 14.2 de l'LPACAP, al registre electrònic del CIM (<em>www.cime.es</em>) o a qualsevol altre registre electrònic dels establerts en l'article 16.4 de la llei adés esmentada. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em> Facultativament, poden fer-ho presencialment, d'acord amb el que estableix l'article 14.1 de l'LPACAP, les persones físiques adreçant-se a la seu del CIM de Maó, a les oficines administratives de Ciutadella o a qualsevol altre registre i lloc dels establerts en l'article 16.4 de l'esmentada LPACAP. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Si algun subjecte obligat a fer la sol·licitud per mitjans electrònics presenta la sol·licitud presencialment, se'l requerirà per tal que l'esmeni mitjançant la seva presentació electrònica. A aquests efectes, i d'acord amb el que estableix l'article 68.4 de la mateixa llei, es considerarà com a data de presentació de la sol·licitud aquella en què hagi tingut lloc l'esmena.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">9. Si la sol·licitud o la documentació fossin incorrectes o incompletes, es requerirà la rectificació o el complement necessaris. Si en el termini de 10 dies hàbils, comptats des de l'endemà del dia que es rebi el requeriment d'esmena de la sol·licitud, la persona interessada no fa la rectificació reclamada o no presenta la documentació requerida, s'entendrà que ha desistit de la seva petició de conformitat amb l'article 68 de l'LPACAP.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>8. DESPESES ELEGIBLES I INTENSITAT DE LES SUBVENCIONS</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Es considera subvencionable aquella despesa que respon, de manera indubtable, a la naturalesa de l'activitat subvencionada, és estrictament necessària per a la seva execució i es realitza dins dels terminis establerts en la convocatòria i en aquestes bases (art. 31 LGS).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. Tota despesa realitzada serà subvencionable quan s'hagi pagat abans d'acabar el termini de sol·licitud i justificació i d'acord amb les condicions considerades a la base 13.2. Les empreses hauran d'haver abonat les despeses en els terminis de pagament previstos a la normativa sectorial que li sigui aplicable o bé als establerts a la Llei 3/2004, de 29 de desembre, per la qual s'estableixen mesures de lluita contra la morositat en les operacions comercials.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. Pel que fa a les actuacions susceptibles de subvenció per a l'L1, les despeses únicament considerades elegibles són:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a)</em> Assistència a fires professionals o sectorials fora de Menorca, en què l'empresa hi hagi assistit o exposat: el 100&nbsp;% dels bitllets aeris o marítims (trasllats i aparcaments exclosos); el 100&nbsp;% de l'allotjament sense manutenció; el 50&nbsp;% del cost del disseny, muntatge i ús de l'espai expositiu i el 100&nbsp;% dels serveis externs d'assessorament o suport.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Prospecció de mercats exteriors que poden ser viatges comercials o gestions d'intermediaris: el 100 % dels bitllets aeris o marítims fora de Menorca (trasllats i aparcaments exclosos) i el 100&nbsp;% dels serveis externs d'assessorament.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Es considera subvencionable l'assistència a una fira iniciada abans del període subvencionable sempre que finalitzi dins el mateix; per tant, s'acceptaran factures i pagaments fets amb anterioritat al període subvencionable si corresponen a fires o accions prospectives efectivament realitzades en el període delimitat per la convocatòria. Altrament, no és subvencionable una fira o acció prospectiva iniciada dins del període subvencionable però que finalitzi més enllà d'aquest. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em> Formació per a la millora de les competències professionals, presencial o virtual, sempre que tingui una relació directa amb l'ocupació: 100&nbsp;% de les despeses de matrícula o inscripció, desplaçaments, allotjament i material pedagògic.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>c)</em> Assessorament per a la captació de fons europeus sobre projectes pels quals s'hagi sol·licitat una subvenció dins del termini subvencionable: 50&nbsp;% de les factures corresponents a serveis externs de consultoria.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>d)</em> Incorporació de personal qualificat, indefinida o temporal, referida a personal amb formació d'enginyeria, cicle formatiu de grau superior (CFGS) o equivalent i enquadrament en els grups de cotització 1, 2 o 3: 50&nbsp;% dels sous i salaris més les quotes a la Seguretat Social a càrrec de l'empresa.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>e) </em>Implantació de projectes d'innovació, qualitat o sostenibilitat exclusivament vinculats al procés productiu: 50&nbsp;% de les factures corresponents a serveis externs de recerca, assessorament, consultoria o de projectes tècnics (incloses certificacions o homologacions prèvies a les millores o novetats en el procés productiu i exclosos els estudis de viabilitat o de mercat); despeses relacionades amb els serveis de diagnòstic previ de la propietat intel·lectual; la sol·licitud de marques, dibuixos o models; i també les relatives als tràmits necessaris fins a la resolució definitiva de concessió. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>f)</em> Inversió en actius fixos exclusivament vinculats al procés productiu (amb un mínim de 600 € per a cada element o actiu): 50&nbsp;% dels actius materials (maquinària, equipament, utillatge o instrumental) o immaterials (adquisicions de drets de patents, llicències, <em>know-how</em> o coneixements tècnics no patentats) de naturalesa amortitzable (excloses les adquisicions de segona mà i les despeses de transport i instal·lació de maquinària).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. Altrament, una fira o acció prospectiva iniciada dins del període subvencionable però que finalitzi més enllà d'aquest no és subvencionable. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em> Inversió en actius fixos materials (amb un mínim de 600 € per a cada element o actiu): 75&nbsp;% de les obres i reparacions, maquinària, equipament, utillatge o instrumental de naturalesa amortitzable, excloses les adquisicions de segona mà i les despeses de transport i instal·lació de maquinària. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>c)</em> Despeses indirectes, necessàries i imprescindibles, per a l'execució de la promoció de producte local: un 25&nbsp;% de les despeses escomeses a l'apartat <em>a</em> justificable en lloguers, subministraments, serveis externs, despeses de personal, directament o indirectament, involucrat.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. Pel que fa a les actuacions susceptibles de subvenció per a l'L4, les despeses únicament considerades elegibles són:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a) </em>Assessorament comercial i vendes, aparadorisme i espais, estudis de viabilitat o de mercat: un 75% de les factures corresponents a serveis externs de consultoria especialitzada en màrqueting, publicitat o interiorisme.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em> Inversió en actius fixos materials (amb un mínim de 600 € per a cada element o actiu): un 75% de les obres i reformes, maquinària, equipament, utillatge o instrumental de naturalesa amortitzable, excloses les adquisicions de segona mà i les despeses de transport i instal·lació de maquinària. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">7. En qualsevol dels casos, no formen part del pressupost subvencionable, les següents despeses:</span></span></span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">aquelles que no s'ajustin a l'objecte i a la finalitat de la convocatòria (bases 1 i 2);</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">les relatives als conceptes exclosos per a cada activitat subvencionable;</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">les relatives a factures emeses per algun dels socis d'una societat, agrupació de persones físiques o jurídiques, comunitat de béns o una altra agrupació econòmica sense personalitat jurídica;</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">les resultants d'imports superiors als preus de mercat;</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">les comissions i despeses financeres;</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">els impostos sobre la renda i els indirectes susceptibles de recuperació o compensació;</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">les assegurances;</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">els costos d'allotjament web de servidors; i,</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">les relatives a menjars, refrigeris, serveis de menjars o similars.</span></span></span></li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">8. L'IVA no es pot subvencionar, llevat de quan no sigui recuperable pel beneficiari (art. 4.3 RD 81/2015).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>9. CRITERIS OBJECTIUS PER A LA CONCESSIÓ DELS AJUTS I DETERMINACIÓ DE L'IMPORT DE LA SUBVENCIÓ</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Quant al sistema de selecció dels beneficiaris, s'atorgaran tots els ajuts sol·licitats que compleixin els requisits i els límits fixats en les presents bases i segons el crèdit posat a disposició en la convocatòria. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. Quan s'hagi d'atendre el nombre de treballadors, només valdrà la xifra de l'informe de mitjana anual treballadors d'alta durant l'any anterior al de la convocatòria que emeti la Tresoreria General de la Seguretat Social.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Les agrupacions de persones físiques, comunitat de béns o societat civil s'equiparen a l'empresari individual; això és, computen com un sol autònom.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">No totes les empreses disposen de comptes de cotització separats (producció i venda directa, per exemple); per tant, les empreses amb comptes de cotització separats poden esgrimir la suma total de treballadors. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. El pressupost que prevegi la convocatòria per a despeses corrents, ho serà per a totes les línies (aquestes a títol individual no tindran una assignació màxima); si la suma total d'aquests ajuts sol·licitats per a despeses corrents supera el crèdit disponible, la distribució es farà proporcionalment. Idènticament, el pressupost que prevegi la convocatòria per a despeses d'inversió, ho serà per a totes les línies (també sense una assignació màxima a títol individual); si la suma total d'aquests ajuts sol·licitats per a despeses d'inversió supera el crèdit disponible, la distribució es farà proporcionalment.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. style="line-height:100%"><span style="color:#000000">Els trimestres d'activitat seran considerats en funció de les declaracions trimestrals IRPF (model 130 o 131 de l'AEAT) referits als períodes d'activitat corresponents a l'any anterior al de la convocatòria aportades pels autònoms; o bé, en el cas de societats mercantils, informe de vida laboral de l'empresa expedit per la TGSS i referit a l'any sencer anterior al de la convocatòria.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>10. PROCEDIMENT I ÒRGANS COMPETENTS PER A LA CONCESSIÓ DELS AJUTS</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Per mitjà del procediment de concurrència competitiva, els ajuts es concediran d'acord amb els principis d'objectivitat, transparència, igualtat, no discriminació i publicitat. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. L'inici de l'expedient s'efectuarà per mitjà de l'aprovació de la convocatòria corresponent. El text de la convocatòria i la resta de documentació que es requereixi s'ha de comunicar a la Base de dades nacional de subvencions<em> </em>(BDNS) i l'extracte de la convocatòria s'ha de publicar al <em>Butlletí</em> <em>Oficial de les Illes Balears </em>(BOIB), en compliment de l'article 20.8 de l'LGS. La informació a la BDNS se li remetrà de tal manera que pugui anunciar tantes convocatòries com diferents règims jurídics de la UE s'hi hagin previst. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. La instrucció, que correspon als funcionaris del CIM que determini la convocatòria, haurà de realitzar d'ofici totes les actuacions necessàries per a la determinació, el coneixement i la comprovació de les dades en virtut de les quals s'ha de dictar resolució sobre la concessió dels ajuts.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. Totes les sol·licituds presentades dins el termini establert en la convocatòria se sotmetran a l'examen de la comissió avaluadora.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Si la sol·licitud no compleix els requisits establerts en la convocatòria o hi manca la documentació exigida, s'ha de requerir al sol·licitant, perquè en un termini de deu dies hàbils esmeni el defecte o aporti la documentació preceptiva, amb l'advertiment que, si no ho fa, se'l tindrà per desistit. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. Una vegada examinades les sol·licituds per la Comissió Avaluadora, i després que aquesta hagi emès el seu informe, la consellera executiva competent dictarà resolució sobre la concessió o denegació dels ajuts.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. La resolució de l'expedient d'atorgament de les subvencions ha de ser expressa i motivada, i ha de fixar, amb caràcter definitiu, la quantia específica de cada una de les subvencions concedides.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">7. El termini màxim per dictar i notificar la resolució expressa de concessió de subvenció serà de sis mesos comptats des del dia que acabi el termini de presentació de sol·licituds. No obstant l'anterior, aquest termini es podrà reduir si s'estableix expressament en la convocatòria dels ajuts. El silenci administratiu tindrà caràcter desestimatori.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">8. La notificació de la resolució de les ajudes s'efectuarà mitjançant publicació en el BOIB.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">9. La resolució de l'expedient de concessió o denegació dels ajuts es remetrà a la BDNS en compliment de l'article 20.8 de l'LGS. La informació es remetrà de tal manera que la BDNS pugui publicar les dades segons els diferents règims jurídics de la UE prevists. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">10. A efectes de notificació, el CIM publicarà la resolució de concessió o denegació dels ajuts adés esmentada al BOIB (art. 45.1 <em>b)</em> de l'LPACAP).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>11. COMISSIÓ AVALUADORA DELS AJUTS</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. La Comissió avaluadora és l'òrgan col·legiat encarregat d'examinar les sol·licituds presentades i emetre'n l'informe que ha de servir de base a l'òrgan competent per elaborar la proposta de resolució definitiva.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. Aquest òrgan estarà integrat pels membres següents:</span></span></span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Presidenta: la consellera executiva del Departament d'Econòmica i Serveis Generals. </span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Secretari/ària: un/a funcionari/ària de l'esmentat departament.</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">No menys de tres vocals designats en la convocatòria.</span></span></span></li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. Perquè la Comissió Avaluadora s'entengui vàlidament constituïda es requerirà la presència del president i del secretari i de la meitat, almenys, dels seus membres. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>12. ABONAMENT DELS AJUTS</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Els ajuts s'han d'abonar un cop se n'hagi acordat la concessió.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. No es pot pagar la subvenció mentre el beneficiari no es trobi al corrent en el compliment de les seves obligacions tributàries amb l'Estat, el CIM i davant de la Seguretat Social. Respecte d'això, l'entitat beneficiària pot substituir les certificacions per una declaració responsable d'estar al corrent en el compliment de les obligacions esmentades quan l'import de la subvenció concedida a la convocatòria no superi els 3.000 € (art. 11 <em>f</em> TRLSIB).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. Les subvencions que es paguen a persones físiques resten subjectes a retenció d'acord amb la normativa que regula l'impost sobre la renda de les persones físiques.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. Les subvencions es faran efectives en el termini màxim de 60 dies a comptar des de la data de la resolució de concessió i pagament i sempre que la disponibilitat de tresoreria del CIM ho permeti.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>13. JUSTIFICACIÓ DE LES DESPESES</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Les despeses objecte de subvenció s'han de justificar en el moment de la sol·licitud mitjançant un compte justificatiu; per tant, el termini per fer-ho finalitza el dia assenyalat en la convocatòria. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. D'acord amb l'article 72 del Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de l'LGS, el compte justificatiu consisteix en:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a) </em>El model normalitzat de memòria justificativa en què consti la següent informació: descripció de les activitats realitzades per a les quals se sol·licita la subvenció; imatges relacionades (fires, publicitat, inversions); relació nominativa de despeses (núm. d'ordre, identificació del creditor, document, import, data d'emissió i de pagament; declaració d'altres ingressos o subvencions que hagin finançat les activitats subvencionades i que les despeses que es justifiquen no superen els valors de mercat.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em> La relació de factures/despeses amb els corresponents justificants de pagament; aquests poden ser: </span></span></span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">L'extracte bancari en què quedi identificat el pagament fet mitjançant indicació de l'import, identificació del pagador i destinatari.</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Factura que incorpori l'acreditació del cobrament per part del seu emissor o persona responsable de l'empresa, amb capacitat de cobrament. A l'efecte, han de quedar consignats en la factura les dades següents: data de cobrament, identificació (nombre, NIF i firma del declarant del cobrament de la factura) i segell de l'empresa (facultatiu en cas que l'emissor sigui persona física).</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Comprovant de transferència bancària en el qual quedi identificat el pagament fet, mitjançant indicació de l'import, identificació del pagador i del destinatari.</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Qualsevol altre document de valor probatori equivalent, vàlid en dret, mitjançant el qual s'acrediti la realització efectiva del pagament.</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">S'admetran pagaments en efectiu fins a 300 € sempre que a la factura hi consti: data de cobrament, identificació del declarant del cobrament (nom, DNI i signatura) i segell de l'empresa (facultatiu en el cas que l'emissor sigui persona física).</span></span></span></li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. El CIM podrà inspeccionar les activitats subvencionades, sense perjudici de les competències que puguin correspondre, per normativa legal o reglamentària, a altres organismes o institucions.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>14. OBLIGACIONS DELS BENEFICIARIS</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Els beneficiaris han de complir les obligacions següents:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a)</em> Comunicar al CIM l'acceptació de la subvenció en els termes en què aquesta es concedeixi. En qualsevol cas, la subvenció s'entendrà acceptada tàcitament un cop transcorreguts 15 dies hàbils des de la publicació de la concessió dels ajuts al BOIB.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em> Comunicar al CIM la sol·licitud i l'obtenció de subvencions i ajudes per a la mateixa finalitat.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>c) </em>Acreditar, quan el CIM els ho sol·liciti, que es troben al corrent de les obligacions tributàries i amb la Seguretat Social. L'acreditació no serà necessària en el cas que s'hagi autoritzat expressament el CIM a consultar-ho.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>d)</em> Proporcionar la informació sobre l'activitat subvencionada que li requereixi el CIM.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>e)</em> Sotmetre's a les actuacions de comprovació que efectuïn el CIM i la resta d'organismes competents per a la fiscalització dels comptes públics.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>f)</em> Conservar els documents justificatius de l'aplicació dels fons percebuts, inclosos els documents electrònics, mentre puguin ser objecte d'actuacions de comprovació i control.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>g)</em> Reintegrar els fons percebuts en els supòsits prevists en l'article 37 de l'LGS.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>h)</em> Les entitats beneficiàries d'aquestes ajudes han de mantenir l'activitat durant el termini mínim d'un any des de la presentació de la sol·licitud; en cas contrari, se'ls podrà exigir la devolució, total o parcial, de la subvenció abonada més els interessos de demora, sens perjudici de la sanció que pugui correspondre per alteració de la finalitat per a la qual la subvenció va ser concedida.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>i)</em> Deixar constància de la percepció i l'aplicació de la subvenció en la seva comptabilitat o en els llibres de registre que hagi de portar l'entitat beneficiària d'acord amb la normativa vigent i, en cas de no tenir aquesta obligació, en la documentació que la substitueixi.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>15. REVOCACIÓ I REINTEGRAMENT DELS AJUTS</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Pel que fa a la revocació i reintegrament de les subvencions, s'ha d'aplicar el que disposa la Llei 38/2003, de 17 de novembre, general de subvencions i la resta de normativa aplicable. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>16. INFRACCIONS I SANCIONS</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. El règim d'infraccions i sancions administratives aplicables serà l'establert en el títol V del TRLSIB i en el títol IV de l'LGS.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. L'òrgan competent per imposar les sancions que es derivin de les infraccions lleus i greus de l'establert en aquestes bases i de la normativa aplicable en matèria de subvencions, és el conseller executiu competent per raó de la matèria i, en el cas de les molt greus, el Consell Executiu, de conformitat amb l'establert en l'article 69 de la Llei 4/2022, de 28 de juny, de consells insulars.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>17. TRACTAMENT PERSONAL DE LES DADES</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. La finalitat del tractament de les dades és gestionar la convocatòria d'ajuts de minimis del CIM per al teixit productiu de Menorca. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. Les dades que es tracten emanen de la informació identificativa, bancària, fiscal i de contacte facilitada per les persones interessades.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. El temps d'ús de les dades és el termini de vigència d'aquest expedient de subvencions, i es conservaran segons la política de gestió documental o per motiu estadístic, sempre de forma descriptiva i agregada.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. El CIM té legitimació per al tractament de les dades en l'exercici d'una missió d'interès públic i per consentiment exprés de les persones interessades. Les dades no se cedeixen a tercer aliens al CIM, llevat que siguin sol·licitades per les Forces i Cossos de Seguretat i organismes judicials o hagin de ser comunicades a altres entitats públiques per imperatiu legal.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. Es poden exercir els drets d'accés, rectificació, supressió, oposició, limitació del tractament i portabilitat davant el CIM (Pl. Biosfera, 5 - 07703 Maó) o a través de la Seu electrònica (seulectronica.cime.es).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">7.
