Bases Reguladores&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquestes subvencions es regiran pel que s'estableix en la present convocatòria, en aquestes bases reguladores i en les bases d'execució del pressupost general de l'Ajuntament per a l'exercici 2024 aprovat definitivament i publicat en el Butlletí Oficial de les illes Balears núm.175, en data 23 de desembre del 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El procediment per a la concessió d'aquestes subvencions serà en règim de concurrència competitiva, mitjançant la comparació de les sol·licituds presentades, a fi d'establir una prelació entre les mateixes d'acord amb els criteris de valoració establerts en aquesta convocatòria, adjudicant, amb el límit fixat en la clàusula quarta, aquelles que hagin obtingut major valoració en aplicació dels citats criteris.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Objecte de la convocatòria&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'objecte d'aquestes bases i convocatòria és regular les condicions i el procediment per a la concessió per part de l'Ajuntament d'Andratx d'ajudes per a l'adquisició del primer habitatge, construïda o en construcció, de segona mà o de nova construcció, per a afavorir l'accés a l'habitatge dels residents del municipi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les presents ajudes s'ajusten a la línia de subvencions del Pla Estratègic de Subvencions per als exercicis 2023-2025 en el seu Compromís 8 de generar un nou model de polítiques locals d'habitatge des d'una lògica social, incrementant les opcions d'accés a l'habitatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La concessió de les ajudes contemplades en la present convocatòria se subjectarà als principis de publicitat, transparència, concurrència, objectivitat, igualtat i no discriminació, així com l'eficàcia en el compliment d'objectius i eficiència en l'assignació i utilització dels recursos públics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Règim jurídic&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per a tot el no previst en aquesta convocatòria serà aplicable:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Reial decret 887/2006, pel qual s'aprova el reglament que desenvolupa la Llei General de Subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Llei 39/2015, de dia 1 d'octubre del Procediment Administratiu Comú de les Administracions Públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Reial decret 130/2019, de 8 de març, pel qual es regula la Base de dades Nacional de Subvencions i la publicitat de les subvencions i altres ajudes públiques&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Llei 7/1985, de 2 d'abril, Reguladora de les Bases del Règim Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Llei 20/2006, de 15 de desembre, municipal i de règim local de les illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ordenança general de subvencions de l'Ajuntament d'Andratx (BOIB núm. 47 de 20 d'abril de 2017).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Bases d'execució del Pressupost Municipal per a l'exercici 2024. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Dotació econòmica&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.1.- Per a les ajudes objecte d'aquesta convocatòria es destinarà la quantitat de 45.000- €, amb càrrec a la partida 150.78001 de l'exercici pressupostari de l'any 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.2.- L'import màxim de les subvencions concedides serà de 3.000,-€ per habitatge adquirit pels sol·licitants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Beneficiaris&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Es poden acollir a aquesta convocatòria les persones que compleixin els requisits següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.1.a) Ser persona física, resident legal en el municipi i amb una antiguitat mínima en el padró municipal de dos anys.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.1.b) Adquirir un habitatge mitjançant escriptura pública per títol onerós en solitari o conjuntament amb altres propietaris. La quantitat subvencionada és per habitatge adquirit i es prorratejarà entre els copropietaris que sol·licitin l'ajuda sempre que resideixin en la mateixa de manera habitual com a primer habitatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.1.c) Que l'habitatge adquirit estigui situada en territori municipal d'Andratx i es tracti del domicili habitual del beneficiari o de les persones al seu càrrec, entenent per tal aquella en la qual resideixin durant un termini continuat de tres anys. L'habitatge ha de passar a constituir el domicili habitual del beneficiari o les persones al seu càrrec com a màxim en el període de dotze mesos següents a la data d'adquisició o terminació de les obres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstant això, s'entendrà que l'habitatge va tenir aquell caràcter quan, malgrat no haver transcorregut aquest termini, concorrin circumstàncies que necessàriament exigeixin el canvi d'habitatge, com ara celebració de matrimoni, separació matrimonial, trasllat laboral, obtenció de primera ocupació o d'ocupació més avantatjosa o altres anàlogues.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Quan l'habitatge hagués estat habitada de manera efectiva i permanent pel beneficiari en el termini de dotze mesos, comptats a partir de la data d'adquisició o terminació de les obres, el termini de tres anys previst en el paràgraf anterior es computarà des d'aquesta última data.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.1.d) No es podran concedir les ajudes de primer habitatge quan el titular/és que tingui la residència habitual i permanent en l'habitatge sigui propietari/a o usufructuari/a d'algun altre habitatge a Espanya. A aquest efecte es considerarà que és propietari/a o usufructuari/a d'un habitatge únicament si el dret recau sobre més d'un 50% d'aquesta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;S'exceptuen d'aquest requisit aquelles persones que siguin propietàries o usufructuàries d'un habitatge i acreditin que no disposen de l'ús i gaudi d'aquesta per alguna de les següents causes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Separació o divorci.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Qualsevol altra causa aliena a la seva voluntat, degudament acreditada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Quan l'habitatge no sigui accessible per raó de discapacitat de la persona titular o d'algun membre de la unitat de convivència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.1.e) Que la superfície útil màxima de l'habitatge sigui de 150m2, en el cas que el sol·licitant acrediti ser família nombrosa aquest requisit serà que l'habitatge no superi la superfície útil màxima de 180m2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.1.f) Que el preu d'adquisició de l'habitatge, sense les despeses i tributs inherents a l'adquisició, sigui igual o inferior a 300.000,- €. Si la compravenda inclogués annexos com a garatge o traster, el preu de cadascun d'ells haurà d'estar desglossat figurant el preu de cadascun dels elements per separat. Si en el preu total s'incloguessin annexos com a garatge i traster, i el preu de cadascun d'ells no estigués desglossat figurant únicament l'import global, a l'efecte de la comprovació de l'import màxim del preu anterior, es valorarà l'import de l'habitatge com el 80 per 100 del preu total del contracte quan aquest inclogui habitatge i garatge; 95 per 100 quan el contracte inclogui habitatge i traster i 75 per 100 quan el contracte inclogui habitatge, garatge i traster.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.1.g) L'habitatge haurà d'haver-se adquirit en el termini entre el 5 d'agost 2023 i la data de publicació de l'extracte de la convocatòria en el BOIB en escriptura pública o com a mínim en contracte privat de compravenda, promesa de venda o en opció de compra, acabada o en construcció; en qualsevol cas, l'escriptura pública haurà d'atorgar-se necessàriament en el termini que s'estableixi en l'acord de concessió, sense que pugui superar el de dos anys des d'aquesta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.1.h) Que els ingressos íntegres (base imposable general de la declaració IRPF) dels membres de la unitat de convivència, no excedeixin de 42.000,- € (5 IPREM) en el cas d'una sola persona sol·licitant, i de 84.000,- € (10 IPREM) en el cas de dos o més persones sol·licitants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.1.i) No trobar-se curso/a en cap dels supòsits de prohibició per a ser beneficiari/a de subvencions establerts en l'article 13 de la Llei 38/2003, de 17 de novembre, general de subvencions. De conformitat amb el que s'estableix en l'article 26 del Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions, s'acreditarà no estar culpable en cap de les prohibicions previstes en l'article 13 de la LGS, mitjançant la presentació de declaració responsable davant l'òrgan que concedeix la subvenció, segons el model de declaració responsable de l'Annex II, aprovat per a aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.1.j) No tenir deutes amb l'Ajuntament d'Andratx a data de publicació de la resolució provisional de l'ajuda. No obstant això, aquest requisit es podrà esmenar durant el període d'al·legacions a la Resolució Provisional de l'ajuda, mitjançant el pagament del deute.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.2. Només s'admetrà una sol·licitud per persona física, atorgant-se una sola subvenció per habitatge adquirit pel que en cas de diversos copropietaris podran presentar la sol·licitud conjuntament, prorratejant-se en aquest cas l'ajuda en funció de la seva quota de copropietat sobre l'habitatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.3. Incompatibilitats Les ajudes objecte d'aquesta convocatòria són compatibles amb altres subvencions, ajudes, ingressos o recursos per a la mateixa finalitat, efectuats per qualsevol altra administració pública, ens públic, institucions privades o altres recursos. L'import de subvenció en cap cas podrà ser de tal quantia que, aïlladament o en concurrència amb altres subvencions, ajudes, ingressos o recursos, superi el cost de l'activitat subvencionada, d'acord amb el que preveu l'article 19 de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.4.- Simplificació de l'acreditació del compliment d'obligacions tributàries i amb la Seguretat Social Complint amb el que s'estableix en l'article 24 del reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions, a l'ésser aquestes ajudes de quantia a atorgar a cada beneficiari/a no superior a l'import de 3.000 euros, l'acreditació d'estar al corrent d'obligacions tributàries i amb la Seguretat Social s'acreditarà mitjançant la presentació per la persona de la declaració responsable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El model de declaració responsable aprovat per a aquesta convocatòria és l'Annex II&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. Termini i lloc de presentació de les sol·licituds&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.1. El termini per a la presentació de les sol·licituds serà de 20 dies hàbils a partir del següent de la data de publicació en el Butlletí Oficial de les illes Balears (BOIB) de l'extracte de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.2. Les sol·licituds es presentaran en la seu electrònica del propi Ajuntament (www.ajuntamentandratx.es) o en el Registre General Municipal de l'Ajuntament d'Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les sol·licituds es podran presentar-se acord amb el que estableix l'article 16.4 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A les sol·licituds dels interessats s'acompanyaran els documents i informacions determinats en la norma o convocatòria, tret que els documents exigits ja estiguessin en poder de qualsevol òrgan de l'Administració actuant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si la sol·licitud no reuneix els requisits establerts en la norma de convocatòria, l'òrgan competent requerirà a l'interessat perquè l'esmeni en el termini màxim i improrrogable de 10 dies, indicant-li que si no ho fes se li tindrà per desistit de la seva sol·licitud. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Sol·licitud i documentació necessària.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les sol·licituds es formularan mitjançant un model d'instància degudament emplenat que serà facilitat per l'Ajuntament (Model Annex I) i hauran de presentar la següent documentació al costat de la sol·licitud segons la situació del sol·licitant:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.1 Fotocòpia del DNI/NIE del sol·licitant o sol·licitants, adquirents de l'habitatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.2 Fotocòpia de l'escriptura de compravenda, del document privat de compravenda, d'opció de compra o de promesa de venda degudament signat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.3 Fotocòpia de l'última declaració de l'impost sobre la renda presentada per la persona sol·licitant i de tots els membres de la unitat de convivència majors de 18 anys o ben certificat negatiu de Renda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.4 En el supòsit que el sol·licitant es trobi en els supòsits de: Titular o convivent en l'habitatge amb Discapacitat, Família nombrosa o monoparental, persona que hagi sofert una execució hipotecària prèvia del seu habitatge habitual, que hagi donat el seu habitatge habitual en paga del deute o unitat de convivència en les quals hi hagi alguna víctima acreditada de violència de gènere, haurà d'acompanyar, si és el cas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Documentació acreditativa del reconeixement de la situació de discapacitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Còpia del carnet vigent de família nombrosa o monoparental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Còpia de la sentència judicial ferma o escriptura pública que acrediti l'execució hipotecària o la dació en paga de l'habitatge habitual anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Còpia de la sentència ferma o acte judicial ferm de mesures cautelars que declari la condició de víctima de violència de gènere.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.5 Annex II. Model declaració responsable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.6 Nota simple, expedida pel Registre de la Propietat, a nom del sol·licitant de l'ajuda o del venedor si és el cas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.7 Certificació de titularitat del compte bancari per a la transferència de l'ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'Ajuntament d'Andratx podrà requerir en qualsevol moment de la tramitació de la sol·licitud els documents que consideri necessaris a fi de garantir la correcta adjudicació de l'ajuda segons els criteris d'avaluació establerts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. La Comissió de Valoració.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La valoració de les sol·licituds correspon a un òrgan col·legiat en la composició del qual s'haurà de promoure la presència equilibrada d'homes i dones d'acord amb l'article 51 de la Llei orgànica 3/207, de 22 de març, per a la igualtat efectiva de dones i homes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La comissió de Valoració estarà composta per:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;President: regidor de l'àrea: Hisenda i Economia. Substitut: regidor de l'àrea de Serveis Socials&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Secretari: TAG de l'àrea d'Hisenda. Substitut: tècnic del Departament de Servei Socials&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3 vocals: 2 tècnics d'Urbanisme i 1 tècnic de Serveis Socials. Substitut: 1 tècnic d'una altra àrea municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'òrgan col·legiat, després de la valoració de les sol·licituds que es presentin, d'acord amb els criteris fixats en la convocatòria, emetrà un informe motivat en el qual es concretarà el resultat d'aquesta, i si és el cas, una prelació de les sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'informe servirà de base perquè s'elabori la proposta de resolució per l'òrgan instructor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La comissió estarà autoritzada per a resoldre els dubtes que es presentin i per a adoptar els acords necessaris per al bon ordre del procés previst en aquestes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. Criteris per a la concessió de les ajudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.1.- Les ajudes es concediran d'acord amb els criteris següents, a qualificar per la comissió avaluadora:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.1.1. Antiguitat d'algun dels sol·licitants adquirents del mateix habitatge com empadronat en el municipi d'Andratx, per cada període de:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10 anys o més de residència legal en el municipi 10 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De 6 a 9 anys de residència legal en el municipi 6 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De 3 a 5 anys de residència legal en el municipi 2 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Es prendrà el període del sol·licitant cotitular si és el cas que al·legui major antiguitat, sent excloents els períodes. La puntuació màxima possible serà de 35 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.1.2. Es concediran 5 punts per cadascuna de les següents situacions, amb un màxim de 15 punts. Les situacions hauran de mantenir-se com a mínim el mateix període de temps en què resideixi en l'habitatge el beneficiari, assenyalat en la Base 5.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;(No es podrà concedir més de 5 punts per cadascuna de les situacions):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Titular, cotitular o convivent en l'habitatge amb discapacitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Família nombrosa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Família monoparental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Titular o cotitular que hagi sofert una execució hipotecària prèvia del seu habitatge habitual, o que hagi donat el seu habitatge habitual en paga del deute.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Unitats de convivència en les quals hi hagi alguna víctima acreditada de violència de gènere.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.1.3. Ingressos de la Unitat de convivència durant l'últim exercici la declaració del qual per IRPF s'hagués presentat:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per cada tram complet de 2% de reducció sobre les quantitats d'ingressos íntegres (base imposable general de la declaració IRPF) dels membres de la unitat de convivència a què es refereix la Base 5.1 h): 0,5 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.2.- La comissió estudiarà totes les sol·licituds presentades, completes i que compleixin amb els requisits per a ser beneficiari de les ajudes, establint una puntuació per a cada sol·licitud. Es concediran 3.000,- euros a les sol·licituds amb més puntuació fins a esgotar el crèdit disponible per a aquesta convocatòria d'ajudes segons la base 4 d'aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.3.- En cas d'empat en la puntuació entre diversos sol·licitants, es desempatarà segons els següents criteris: 1r Sol·licitants que es trobin en les situacions establertes en l'apartat 9.1.2. 2n Sol·licitants amb major antiguitat d'empadronament. 3r Ordre de registre d'entrada de la sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10. Òrgan per a la instrucció i resolució.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'àrea d'Hisenda de l'Ajuntament d'Andratx és la designada per a la instrucció del procediment de concessió de la subvenció. Una vegada comprovada la documentació presentada obrant en l'expedient i l'informe de l'òrgan col·legiat (Comissió avaluadora), l'òrgan instructor ha de formular la proposta de resolució provisional, degudament motivada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'òrgan concedent serà la Junta de Govern Local&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11. Proposta de resolució provisional, resolució definitiva, terminis i notificació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;S'estableix com a mitjà de notificació de tots els actes de tràmit del present procediment d'atorgament de les subvencions, el tauler d'anuncis de l'Ajuntament, així com la pàgina web. (www.ajuntamentandratx.es)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vegada avaluades les sol·licituds, per l'òrgan instructor es formularà la proposta de resolució provisional, degudament motivada, que serà notificada als interessats mitjançant publicació en el tauler d'anuncis i en la pàgina web, concedint un termini de 10 dies per a presentar al·legacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Es podrà prescindir del tràmit d'audiència quan no figurin en procediment ni siguin tinguts en compte altres fets ni altres al·legacions i proves que les adduïdes pels interessats. En aquest cas, la proposta de resolució formulada tindrà el caràcter de definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Després d'examinar les al·legacions si n'hi hagués, i en el termini màxim de 6 mesos des de la publicació de la convocatòria, es formularà la proposta de resolució definitiva, que haurà d'expressar el sol·licitant o la relació de sol·licitants per als quals es proposa la concessió de la subvenció, i la seva quantia, especificant la seva avaluació i els criteris de valoració seguits per a efectuar-la perquè se sotmeti la seva aprovació a la Junta de Govern Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La resolució, a més de contenir el sol·licitant o relació de sol·licitants als quals es concedeix la subvenció, farà constar, si és el cas, de manera expressa, la desestimació de la resta de les sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La llista definitiva serà publicada en el Butlletí Oficial dels Illes Balears (BOIB), de conformitat amb l'article 34 de l'Ordenança Municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12. Fi de la Via Administrativa&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'acte de resolució de la subvenció esgota la via administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb el que disposen els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques, contra aquesta resolució podrà interposar-se recurs potestatiu de reposició davant l'Alcalde d'aquest Ajuntament, en el terme d'un mes a comptar des de l'endemà de la recepció de la notificació, o bé directament recurs contenciós administratiu davant el Jutjat contenciós administratiu de Palma, en el termini de dos mesos, a comptar des de l'endemà de la recepció de la notificació, de conformitat amb l'article 46 de la Llei 29/1998, de 13 de juliol, de la Jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. Mètode de pagament&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La liquidació i pagament de les ajudes es realitzarà una vegada comprovada la documentació aportada. El pagament s'efectuarà mitjançant transferència al compte bancari designat pel beneficiari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cas que els interessats així ho sol·licitin, es pot recordar un acompte de fins al 80% de l'import sol·licitat una vegada concedida la subvenció d'acord amb la Base 45 del pressupost general de l'Ajuntament d'Andratx per a 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14. Justificació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per ser una subvenció en atenció a la concurrència d'una determinada situació, el perceptor no haurà de presentar una altra justificació que l'acreditació d'aquesta situació amb caràcter previ a la concessió, sense perjudici dels controls que poguessin establir-se per a verificar la seva existència&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstant això, en cas que la concessió ho hagi estat sobre la base d'un contracte privat de compravenda, promesa de venda o en opció de compra, el beneficiari haurà d'aportar còpia de l'escriptura de compravenda així com passar a residir en l'habitatge en els terminis que assenyali l'acord de la concessió. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15. Incompliment de les condicions de concessió. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.1 Tota alteració de les condicions tingudes en compte per a concedir la subvenció així com l'incompliment de l'obligació d'aportar còpia de l'escriptura de compravenda assenyalada en la base anterior podran donar lloc a la modificació de la resolució de la concessió, a proposta de la Comissió avaluadora, que haurà d'atendre el principi de proporcionalitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.2 En cas de falsedat en les dades o en la documentació aportada o d'ocultació d'informació, dels quals es pugui deduir intenció d'engany en benefici propi o aliè, se'ls podrà excloure d'aquest procediment i podran ser objecte de sanció; i, si és el cas, els fets es posaran en coneixement del ministeri fiscal per si poguessin ser constitutius d'il·lícit penal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.3 S'aplicarà l'Ordenança municipal respecte al reintegrament de la subvenció i al règim d'infraccions i sancions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16. Publicació &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La present convocatòria es publicarà en la web de la Base de dades Nacional de Subvencions (BDNS) i el seu extracte es publicarà, per conducte de la BDNS, en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
