En data 20 d'abril de 2023, es va publicar el BOIB núm. 50 la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova, per l'any 2023, la convocatòria d'ajudes destinades al foment i la protecció de varietats autòctones en risc d'erosió genètica.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. En data 27 de juny de 2023, es va publicar el BOIB núm. 87 la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual modifica la Resolució de la presidenta del FOGAIBA, de 18 d'abril de 2023, per la qual s'aprova, per a l'any 2023, la convocatòria dels ajuts destinats al foment i a la protecció de varietats autòctones en risc d'erosió genètica.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. En data 25 de gener de 2024, es va publicar el BOIB núm. 12 la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es modifiquen diverses convocatòries de subvencions del FOGAIBA, corresponents a les intervencions que preveu el Pla estratègic de la PAC 2023-2027 d'Espanya (PEPAC), per a l'ajuda de la Unió finançada el FEAGA i pel FEADER.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">4. En data 27 d'abril de 2024, es va publicar al BOIB núm. 56 la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'incrementa el crèdit de la Resolució de la presidenta del FOGAIBA per la qual s'aprova la convocatòria, per a l'any 2023, dels ajuts destinats al foment i a la protecció de varietats autòctones amb risc d'erosió genètica.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">5. En data 18 de maig de 2024, es va publicar al BOIB núm 66 la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'incrementa el crèdit de la Resolució de la presidenta del FOGAIBA per la qual s'aprova la convocatòria, per a l'any 2023, dels ajuts destinats al foment i a la protecció de varietats autòctones en risc d'erosió genètica.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">6. De conformitat amb l'apartat sisè de l'esmenada Resolució, el termini de presentació de sol·licituds de la convocatòria va acabar dia 30 de juny de 2023. Es varen registrar un total de 186 sol·licituds d'ajuda per la convocatòria de 2023.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">7. El 20 de febrer de 2024 es publica al BOIB núm 25 la Resolució de denegació als beneficiaris de les ajudes, Rd1 conjunta de la secció II, per l'incompliment del requisit previst a l'apartat 7 del punt tercer de la convocatòria d'estar al corrent de les obligacions tributàries. En aquesta resolució hi ha 5 expedient de la línia d'ajudes destinades al foment i la protecció de varietats autòctones en risc d'erosió genètica.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">8. El 20 d'abril de 2024 es publica al BOIB núm. 52 la Resolució de denegació de beneficiaris de les ajudes, Rd1 de data 9 d'abril de 2024, per l'incompliment del requisit previst a l'apartat tercer del punt 1.b de la convocatòria d'inscripció a alguna associació o agrupació d'agricultors i/o productors que tingui com a objectiu la conservació o el manteniment dels cultius en perill d'erosió genètica i compleixin les obligacions que se'n derivin. En aquesta resolució de denegació hi ha 15 expedients de de la línia d'ajudes destinades al foment i la protecció de varietats autòctones en risc d'erosió genètica.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">9. El </span><span style="color:#000000">20</span><span style="color:#000000"> de juny es va publicar al BOIB núm. </span><span style="color:#000000">82</span><span style="color:#000000"> la Resolució de concessió i denegació d'ajudes pel f</span><span style="color:#000000">oment i la protecció de varietats autòctones en risc d'erosió genètica</span><span style="color:#000000"> de data </span><span style="color:#000000">7</span><span style="color:#000000"> de juny, en la qual es concedien 163 expedients i es deneguen 2.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">10. Una vegada avaluades les sol·licituds d'ajuda pels òrgans gestors, i d'acord amb els criteris d'elegibilitat establerts, els interessats que figuren a l'annex I es va comprovar que a data </span><span style="color:#000000">11</span><span style="color:#000000"> de juny de 2024 </span><span style="color:#000000">no complien</span><span style="color:#000000"> amb algun dels requisit de la convocatòria, amb les incidències</span><span style="color:#000000"> i motius corresponents que s'assenyalen a l'esmentat annex.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">11. En data <span style="color:#000000"> </span>1 de juliol de 2024 es va notificar la proposta provisional de revocació corresponent, atorgant un termini de 10 dies per presentar al·legacions. Transcorregut l'esmentat termini cap interessat ha presentat al·legacions, per la qual cosa es procedeix a la resolució corresponent.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:0.18cm">Fonaments de dret</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="background-color:#ffffff">1.
