    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Atès que al punt 4t de l'acord del Consell Executiu del Consell de Mallorca, relatiu a d'aprovació del conveni de col·laboració entre l'Ajuntament de Palma i el Consell de Mallorca pel que fa a les instal·lacions de regulació i control de trànsit en el terme municipal de Palma a les vies competència del Consell de Mallorca, s'ordena la publicació al &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; als efectes del seu general coneixement.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tal de donar compliment a aquesta previsió, i atès que es va formalitzar el conveni mitjançant les signatures del representant Consell de Mallorca i de l'Ajuntament de Palma, es procedeix a la seva publicació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;«CONVENI DE COL·LABORACIÓ ENTRE L'AJUNTAMENT DE PALMA I EL CONSELL DE MALLORCA EN RELACIÓ A LES INSTAL·LACIONS DE REGULACIÓ I CONTROL DEL TRÀNSIT EN EL TERME MUNICIPAL DE PALMA A LES VIES COMPETÈNCIA DEL CONSELL &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Al lloc i a la data de les signatures electròniques&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;REUNITS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'una banda, el Sr. Jaime Martínez Llabrés, batle de Palma, per l'acord del Ple adoptat en la sessió extraordinària de 17 de juny de 2023, en virtut de les facultats que li atribueix l'article 21 de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases de Règim Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;I per l'altra, l'Hble. Sr. Fernando Rubio Aguiló, conseller executiu de Territori, Mobilitat i Infraestructures, d'acord amb el Decret de la Presidència del Consell Insular de Mallorca de dia 10 de juliol de 2023, pel qual es nomenen els membres del Consell Executiu (BOIB núm. 95, de 11 de juliol de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les parts ens reconeixem mútuament la capacitat legal necessària per a formalitzar aquest conveni i exposem els següents&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ANTECEDENTS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;I.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En el terme municipal de Palma existeixen vies competència del Consell de Mallorca que es troben integrades dins la xarxa viària del municipi. Compartir els fluxos de vehicles implica que la regulació semafòrica en aquestes vies té una vinculació i dependència directa que obliga a establir una coordinació necessària sota un mateix criteri d'actuació per al millor funcionament i gestió dels recursos públics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;II.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En aplicació de l'article 5 apartat k) del RDL 6/2015 de 30 d'octubre és competència del Ministeri de l'Interior la regulació, ordenació i gestió del trànsit en vies interurbanes i a travesseres, establint per a aquestes darreres fórmules de cooperació o delegació amb les Entitats Locals. No obstant això, l'Administració competent en matèria de Carreteres històricament ha col·laborat en la implantació d'aquests sistemes, en particular en les instal·lacions semafòriques que són l'objecte del present conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;III.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Des de l'any 1990 l'Ajuntament de Palma mitjançant diversos projectes de la DGT i de l'Ajuntament, va procedir a la implantació de la Sala de Control de Trànsit i a la centralització de gran part de les instal·lacions de regulació i control del trànsit de l'Ajuntament de Palma. En aquella època les instal·lacions de regulació i control del trànsit titularitat de la Administració competent en matèria de Carreteres va quedar integrada a la xarxa centralitzada municipal per raons d'eficàcia en la gestió. La qual cosa es va produir sense l'existència d'un instrument jurídic que ho regulés i que amb el present conveni quedarà esmenat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;IV&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. El creixement urbanístic de la ciutat ha propiciat la creació d'infraestructures viàries i que vies de competència de Carreteres que han esdevingut urbanes o de caràcter local s'hagin transferit al municipi a través de diferents convenis. Essent des d'aquest moment la conservació i explotació de les vies cedides, que inclouen les instal·lacions, a càrrec dels recursos municipals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;V.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; A data d'avui encara estan pendent de transferir altres vies de la xarxa del Consell a l'Ajuntament de Palma, i mentre no es transfereixen aquestes competències, les instal·lacions de regulació semafòrica a les vies competència del Consell de Mallorca es mantenen a càrrec de l'Ajuntament de Palma, per unificar criteris i optimitzar els recursos públics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;VI.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; L'entrada en vigor de la Llei de règim jurídic del sector públic (LRJSP) 40/2015 fa necessària la regulació de les actuacions relacionades amb les instal·lacions de regulació i control del trànsit en les vies del Consell. Que els articles 27 i 57 de la Llei Reguladora de les Bases de Règim Local (Llei 7/1985, de 2 d'abril) i els articles 65, 66 i 70 del Text Refós aprovat per Reial decret 781/1986, de 18 d'abril, així com el Capítol VI del Títol Preliminar de la Llei 40/2015, d'1 d'octubre, de Règim Jurídic del Sector Públic, permeten l'establiment del present conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tant, en aquest conveni s'ha de contemplar els compromisos entre les parts i establir les contraprestacions corresponents a les següents,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CLÀUSULES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMERA. Objecte del conveni&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'objecte del conveni és regular i establir els compromisos a assumir per les parts signants, sobre la gestió i conservació de les instal·lacions de regulació i control del trànsit que actualment és a càrrec de l'Ajuntament de Palma i que estan ubicades en vies de titularitat del Consell de Mallorca, i determinar el procediment a seguir per a les noves instal·lacions de regulació i control del trànsit que estiguin ubicades a les vies competència del Consell de Mallorca i que siguin susceptibles d'incorporar a la gestió centralitzada i de conservar-se a càrrec del Departament de Mobilitat de l'Ajuntament de Palma. Així mateix establir de comú acord els ajusts precisos per poder disposar d'un conveni adaptat a la LRJSP 40/2015, i altres disposicions que siguin d'aplicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGONA. Àmbit d'actuació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'àmbit d'actuació són les vies que a data d'avui són competència del Consell dins el terme municipal de Palma. La relació de vies competència del Consell dins el terme municipal de Palma, a data d'aquest Conveni, consta a l'Annex 1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Quan una via del Consell sigui cedida a l'Ajuntament de Palma, les instal·lacions ubicades en aquesta i referides en aquest document, deixaran de formar part d'aquest Conveni. En aquest sentit, es procedirà al reajustament de l'import que s'estableix a la clàusula SETENA, apartat 7.2.c), amb efectes des del dia de la signatura de l'acta de lliurament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TERCERA. Definició d'instal·lacions de regulació i control del trànsit incloses dins aquest conveni&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Instal·lacions de regulació semafòrica en encreuaments de carrers, per a passos de vianants o passos tramviaris. Inclou equips de regulació, suports, cablejat, presa de terra, semàfors, detectors de trànsit, espires, armaris, equips especials tramviaris, sistemes de radars i de foto en vermell.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Instal·lacions de càmeres de televisió per al control del trànsit. Inclou suport, càmera de TV, cablejat i escomesa elèctrica. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Instal·lacions de càmeres de televisió IP per al visionat de l'estat del trànsit en web municipal MobiPalma. Inclou suport, càmera de TV, cablejat i escomesa elèctrica. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cablejat de comunicació de fibra òptica i armaris i equips per a nodes de comunicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Panels d'informació a l'usuari. Inclou suport, panells, cablejat i escomesa elèctrica, i els seus armaris i equips de comunicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Senyals d'informació variable. Inclou suport, senyal, cablejat i escomesa elèctrica, i els seus armaris i equips de comunicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No s'inclouen les instal·lacions corresponents a panells d'informació als conductors, càmeres de control i resta d'equips, així com altres instal·lacions de regulació, el manteniment i gestió dels quals es regula des del centre de control de carreteres (ccc) del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;QUARTA. Definició de l'obra civil inherent a la instal·lació de regulació i control del trànsit&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Canalitzacions subterrànies amb cablejat nu de coure per a presa de terra&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

Definició de la gestió inherent a la instal·lació de regulació i control del trànsit&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SISENA. Definició de les tasques de manteniment i conservació de les instal·lacions de regulació i control del trànsit i identificació d'aquestes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Es corresponen amb les tasques especificades per a totes les instal·lacions al terme municipal de Palma incloses en el contracte de manteniment i conservació de les instal·lacions de regulació i control del trànsit del Departament de Mobilitat de l'Ajuntament de Palma. Inclou les corresponents al manteniment funcional operatiu, manteniment preventiu, manteniment correctiu i les corresponents a la vigilància del funcionament d'aquestes instal·lacions des de la sala de control del trànsit de l'Ajuntament de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A l'Annex 2 s'inclou la relació d'instal·lacions de regulació i control del trànsit a les vies competència del Consell de Mallorca, les quals s'han identificat segons la propietat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SETENA. Compromisos que assumeixen les parts.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7.1 Compromís de l'Ajuntament de Palma&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) L'Ajuntament assumeix el manteniment i conservació de les instal·lacions de regulació i control del trànsit actuals en les vies del Consell de Mallorca, a excepció de les instal·lacions, panels d'informació als conductors, càmeres de televisió, detectors i altres, la gestió dels quals es fa des del centre de control del Consell. També assumeix l'Ajuntament de Palma la gestió d'explotació del servei inherent amb la instal·lació de regulació i control del trànsit, així com el manteniment de la xarxa de comunicacions per fibra òptica que enllaça els centres de control de l'Ajuntament de Palma i el centre de control del Consell de Mallorca i altre cablejat de fibra òptica dins les conduccions subterrànies a les seves vies. El Consell sempre podrà participar en la part corresponent a l'enginyeria de trànsit d'encreuament semafòrics en les seves vies a fi de coordinar les afeccions per retencions que poguessin afectar a altres vies de la xarxa del Consell. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Per a noves instal·lacions de regulació i control del trànsit, una vegada autoritzada per ambdues parts, l'Ajuntament assumeix la part corresponent a les instal·lacions, la gestió inherent amb la instal·lació de regulació i control del trànsit, la conservació de les instal·lacions i l'obra civil a l'àmbit de la seva competència (habitualment les voravies). Els tècnics responsables municipals facilitaran els documents tècnics necessaris per a la realització de l'obra civil a càrrec del Consell de Mallorca, i coordinaran les tasques de replanteig i direcció dels treballs així com les corresponents a la seguretat i salut amb els tècnics del Consell. Les noves instal·lacions seran propietat de l'Ajuntament i així quedaran consignades a l'actualització de l'Annex 2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7.2 Compromisos del Consell de Mallorca&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) El Consell de Mallorca assumeix dins els seus pressuposts la conservació de la calçada afectada per les instal·lacions actuals incloent la senyalització horitzontal i la vertical complementària, així com l'obra civil inherent a la instal·lació, necessària per al seu manteniment i explotació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Per a noves instal·lacions de regulació i control del trànsit, una vegada autoritzada per ambdues parts, el Consell assumeix la part corresponent a l'obra civil a l'àmbit de la seva competència (habitualment la calçada). Els tècnics responsables del Consell coordinaran les tasques de replanteig i direcció dels treballs així com les corresponents a la seguretat i salut amb els tècnics municipals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) El Consell de Mallorca s'obliga a transferir anualment, per anys vençuts, a l'ajuntament de Palma, durant la vigència del conveni en concepte de restitució dels elements avariats o danyats i de comprovació de l'estat de les instal·lacions propietat del Consell de Mallorca que es relacionen a l'Annex 3, la quantitat de 27.971,50€ (B.I. 23.116,94€ + IVA 21% 4.854,56€), corresponent a un període de 12 mesos, o en el seu cas, la part proporcional si la anualitat no es completa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;VUITENA. Altres consideracions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el cas de què una de les dues administracions vulgui dur a terme una nova instal·lació, i que no compti amb el suport de l'altra, l'executarà pel seu compte i fora de l'àmbit d'aquest conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Durant la vigència del present Conveni, el Consell de Mallorca, prèvia sol·licitud d'autorització corresponent, facilitarà a l'Ajuntament de Palma la utilització de les infraestructures de canalitzacions subterrànies, que tècnicament sigui possible i sempre que en tingui a disposició, per al pas de cablejat de comunicacions de la xarxa de fibra òptica per a la regulació i control del trànsit així com la disponibilitat dels terrenys i infraestructures per les instal·lacions de regulació i control del trànsit objecte d'aquest Conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En obres de reforma que realitzi el Consell de Mallorca en vies que disposin d'instal·lacions de regulació i control del trànsit o que vagin a disposar-se, el Consell haurà d'executar tota l'obra civil necessària per a adaptar la instal·lació semafòrica al nou disseny viari. Els treballs corresponents a la instal·lació serà a càrrec de l'Ajuntament així com el seu manteniment. Per part del Consell es facilitarà tota la informació i plànols "as Built" necessaris per poder realitzar la instal·lació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'Ajuntament de Palma, dins el primer trimestre de l'any, sol·licitarà al Consell de Mallorca l'abonament de l'import corresponent a la gestió i conservació de les instal·lacions de regulació i control del trànsit, i que s'ha dut a terme en l'exercici anterior, perquè aquest pugui fer efectiu el compromís assumit en la clàusula SETENA, punt 7.2.c).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;NOVENA. Comissió de Seguiment&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les parts constituiran una Comissió mixta de seguiment que coordinarà el desenvolupament d'aquest Conveni i que estarà integrat per dos membres de cada una de les parts, designats pel Batle de l'Ajuntament i pel Conseller de Territori, Mobilitat i Infraestructures del Consell de Mallorca, amb veu i vot.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La comissió estarà presidida per un dels representants del Consell de Mallorca i el secretari serà un dels representants de l'Ajuntament de Palma. En la primera sessió constitutiva es procedirà al nomenament del president i secretari per unanimitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La comissió resoldrà els problemes d'interpretació i vetllarà pel compliment del conveni. Els acords s'adoptaran per unanimitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Podran incorporar-se a la Comissió de seguiment, a petició de les parts, les persones que es requereixin per temes específics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La comissió realitzarà reunions periòdiques pel seguiment i desenvolupament del conveni, establint un mínim d'una (1) reunió anual. Tindrà les següents tasques i funcions:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Realització del control i seguiment del Conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Coordinació entre els Departaments corresponents relacionades amb l'objecte del conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Proposar les modificacions necessàries a aquest Conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Resolució de qualque qüestió o discrepància que pogués sorgir entre les parts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Verificar el compliment de les clàusules del Conveni per poder arribar a complir la finalitat del mateix, i actuar en conseqüència en el cas d'incompliment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Valoració econòmica de les contraprestacions fetes per cada una de les parts i seguiment del balanç econòmic per mantenir l'equilibri econòmic entre ambdues parts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Proposar l'extinció del conveni, si es donen els motius establerts en el Capítol VI del Títol Preliminar de la LRJSP 40/2015, en especial a l'article 52 en relació amb l'extinció del Conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Planificació anual de les despeses i inversions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;DESENA. Aprovació i entrada en vigor del Conveni&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El conveni quedarà perfeccionat per la prestació del consentiment de les parts amb les corresponents assignatures, i entrarà en vigor una vegada s'hagi publicat en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ONZENA. Vigència i duració del Conveni&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El conveni tindrà una durada màxima de quatre (4) anys, d'acord a l'article 49 h) de la LRJSP 40/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La durada es comptabilitzarà a partir de l'entrada en vigor del Conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Quant a possibles ampliacions o pròrrogues del Conveni que es puguin acordar, s'estarà en tot cas al procediment disposat a l'article 49 apartat h) de la LRJSP 40/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;DOTZENA. Modificacions del Conveni&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La modificació del Conveni s'atendrà al procediment i requisits establerts per a la LRJSP 40/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les modificacions es tractaran prèviament a la Comissió de Seguiment, la qual elevarà la proposta a les parts per a la seva aprovació si escau.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les modificacions hauran de ser acordades de forma unànime per les parts intervinents en el Conveni, atenent a l'article 49 g) de la LRJSP 40/2015, i per a la seva tramitació s'haurà incloure el contingut mínim que estableix l'article 49.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TRETZENA. Extinció i resolució del Conveni &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El conveni es resoldrà una vegada finalitzat el seu termini de vigència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Seran causes de resolució les contemplades a l'article 51.2 de la Llei 40/2015 (LRJSP); és a dir, l'incompliment de les obligacions i compromisos per alguna de les parts, l'acord unànime entre aquestes, la decisió judicial que declari nul el conveni, per la finalització del període de vigència del conveni sense que s'hagi acordat la seva pròrroga o per qualsevol altra causa prevista en el conveni o a les lleis corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Quant als efectes d'una resolució anticipada, s'haurà de tenir en compte el indicat a l'article 52 de la Llei 40/2015 LRJSP i procedir a la corresponent liquidació de l'aportació d'ambdues parts en funció de les tasques i funcions que s'hagin desenvolupat. En aquest supòsit serà imprescindible la proposta, amb el seu informe adjunt, de la Comissió de Seguiment definida a la clàusula desena.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CATORZENA. Règim jurídic&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La naturalesa d'aquest conveni és l'administrativa, i, en cas de litigi entre les parts, les qüestions en controvèrsia seran sotmeses a la jurisdicció contenciosa administrativa, de conformitat amb el que es preveu a l'article 44 de la Llei 29/1998, de 13 de juliol, de la Jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstant l'anterior, les controvèrsies que puguin plantejar-se sobre la interpretació, execució o desenvolupament d'aquest conveni es dirimiran, amb caràcter previ, a la Comissió de Seguiment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
