font-size:12px"><strong>Segon.- </strong>Establir el següent sistema de funcionament del borsí: </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- Quan es doni algun dels supòsits prevists a la normativa per el nomenament d'un funcionari interí, s'haurà d'oferir el lloc a les persones del borsí que estiguin en situació de disponible, d'acord amb l'ordre de prelació, sempre que compleixin els requisits que exigeix la relació de llocs de feina per ocupar-lo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- S'ha de comunicar a l'aspirant a qui correspongui, el lloc i el termini en el qual s'ha de presentar. La persona interessada ha de manifestar la seva conformitat en el termini d'un dia hàbil, i la seva disposició a incorporar-se en el termini indicat pel servei de personal de l'Ajuntament. Aquest termini ha de ser, com a mínim, de tres dies hàbils i, com a màxim de deu dies hàbils.&nbsp;&nbsp; </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- Si la persona interessada no manifesta la seva conformitat amb la proposta de nomenament en el termini d'un dia hàbil i la seva disposició a incorporar-se en el termini indicat pel servei de personal de l'Ajuntament, s'entén que renuncia a ocupar el lloc de feina.&nbsp; </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- A les persones aspirants que renunciïn de manera expressa o tàcita, se'ls ha d'excloure del borsí de feina, a no ser que al·leguin, en el termini establert per manifestar la seva conformitat , la concurrència d'alguna de les circumstàncies següents, que han de justificar documentalment en els tres dies següents:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a.- Estar en un període d'embaràs, de maternitat o paternitat, adopció o acolliment permanent o preadoptiu, i s'ha d'incloure el període en què sigui procedent la concessió d'excedència per cura de filles i/o fills.&nbsp;&nbsp; </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b.- Prestar servei com a funcionari en un altre municipi. </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c.- Patir malaltia o incapacitat temporal. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.- En relació a la reincorporació al borsí, les persones interessades estan obligades a comunicar per escrit a l'Ajuntament la finalització de les situacions anteriors, en un termini no superior a deu dies hàbils des de que es produeixi, amb la justificació corresponent. D'aquesta manera tornaran a la situació de disponibles. La falta de comunicació en el termini establert determinarà l'exclusió del borsí.&nbsp; </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.- El personal funcionari que cessi en el seu lloc de feina o no prengui possessió com a conseqüència del procés d'estabilització, s'incorpora automàticament al borsí del qual pren part en el lloc que li correspongui, d'acord amb la puntuació obtinguda en el moment en què es va forma el mateix.”</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra el present acord que esgota la via administrativa es pot interposar alternativament recurs potestatiu de reposició en el termini d'un mes a contar des del dia següent al de la publicació&nbsp; del present anunci, davant la Batlia d'aquest Ajuntament, de conformitat amb els articles 123 i 124 de la Llei 39/2015, de 1 d'octubre, del procediment administratiu comú de les Administracions Públiques, o recurs contenciós-administratiu, davant el jutjat Contenciós-Administratiu de Palma, en el termini de dos mesos, a partir del dia següent al de la publicació del present anunci, de conformitat amb l'art. 46 de la Llei 29/1998, de 13 de juliol, de la Jurisdicció Contenciosa Administrativa.
