&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En data 15 de juny de 2024, es va publicar en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;(BOIB núm. 80), la Resolució del conseller de Turisme, Cultura i Esports per la qual es convoquen subvencions per fomentar l'organització de festivals i certàmens cinematogràfics a les Illes Balears durant l'any 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Dins el termini d'inscripció que s'estableix en l'apartat 6.1 de la convocatòria es va rebre un total de sis sol·licituds. Les sis candidatures són correctes i no hi ha cap exclusió ni denegació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. D'acord amb l'apartat 10&lt;em&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/em&gt;de les bases reguladores, un cop finalitzat el termini de presentació de sol·licituds, la Comissió Avaluadora ha de valorar els projectes presentats segons els criteris de valoració que es fixen en el punt 10.2. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. De conformitat amb l'apartat 10.1 de la convocatòria, l'òrgan competent ha de prorratejar l'import global màxim destinat a la convocatòria entre els sol·licitants que compleixen els requisits per ser beneficiaris en funció dels punts de valoració obtinguts per cada projecte, d'acord amb l'article 18 del Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre. La quantia màxima disponible s'ha de dividir entre el total de punts de valoració obtinguts per tots els projectes que compleixen els requisits; el resultat d'aquesta divisió determinarà una quantitat d'euros per punt que es multiplicarà per la valoració de cada projecte. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. De conformitat amb l'apartat 11.2 de les bases de la convocatòria, la Comissió Avaluadora es va reunir el dia 10 de juliol de 2024 per examinar les sol·licituds presentades i, posteriorment, va estendre l'acta de la sessió, a la qual s'adjuntà l'informe que va servir de base per dictar la Proposta de resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El dia 23 de juliol es va publicar en la Seu Electrònica de la CAIB i en la pàgina web de la Direcció General de Cultura la Proposta de resolució de la directora general de Cultura sobre la concessió i denegació de subvencions per fomentar l'organització de festivals i certàmens cinematogràfics a les Illes Balears durant l'any 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. D'acord amb l'apartat 13.3 de la convocatòria, els beneficiaris han de comunicar a l'òrgan instructor l'acceptació o la renúncia respecte de la subvenció proposada en el termini de cinc dies hàbils comptadors des de la publicació de la Proposta de resolució en la Seu Electrònica de la CAIB. En qualsevol cas, l'acceptació s'entén produïda automàticament si no es fa constar el contrari en el tràmit telemàtic habilitat a aquest efecte. Durant el termini esmentat les persones proposades com a beneficiaris no van presentar cap renúncia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. D'acord amb l'apartat 13.2 de la convocatòria, una vegada publicada la Proposta de resolució, els sol·licitants disposaven d'un termini de cinc dies hàbils per formular-hi al·legacions. Dins el termini esmentat no es van presentar al·legacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Durant la tramitació d'aquest procediment es va detectar la participació de diversos sol·licitants a una altra convocatòria de subvencions per a la mateixa finalitat, concretament la convocada per l'Institut d'Estudis Baleàrics (en endavant, IEB) per donar suport a fires, festivals, cicles de concerts, trobades, jornades i premis del món de la cultura que fomentin la projecció exterior i es duguin a terme en el territori de les Illes Balears per a l'any 2024 (BOIB núm. 29, de 27 de febrer de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. Si bé les dues convocatòries permeten la compatibilitat amb altres subvencions per a la mateixa finalitat, la base 21.1 de l'esmentada convocatòria de l'IEB estableix que els beneficiaris no poden obtenir ajudes pels mateixos conceptes que es derivin d'altres convocatòries d'ajudes de la Conselleria de Turisme, Cultura i Esports, l'IEB mateix, l'Institut d'Indústries Culturals de les Illes Balears o l'Institut Ramon Llull.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. Atès l'anterior, es va requerir els beneficiaris sol·licitants de les dues subvencions que en el termini de deu dies hàbils comptadors des de l'endemà de la notificació del requeriment corresponent, especificassin quins dels conceptes s' havien d'imputar als projectes presentats a cada una de les convocatòries.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12. Transcorregut el termini atorgat a aquest efecte, totes les persones requerides han presentat, en temps i forma, documentació en què s'identifiquen els conceptes que s'han d'imputar a cada una de les convocatòries.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13. Així mateix, a la Proposta de resolució s'hi han detectat una sèrie d'errors materials referents a les quanties que és procedent corregir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Consideracions jurídiques&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Llei 38/2003, de 17 de novembre, general de subvencions (BOE núm. 276, de 18 de novembre de 2003).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre (BOIB núm. 196, de 31 de desembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. L'Ordre de la consellera d'Educació i Cultura d'1 de juliol de 2009 per la qual s'estableixen les bases reguladores de les subvencions en matèria d'educació i cultura (BOIB núm. 100, d'11 de juliol de 2009).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Resolució del conseller de Turisme, Cultura i Esports per la qual es convoquen subvencions per fomentar l'organització de festivals i certàmens cinematogràfics a les Illes Balears durant l'any 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La Proposta de resolució de la directora general de Cultura per la qual es concedeixen subvencions per fomentar l'organització de festivals i certàmens cinematogràfics a les Illes Balears durant l'any 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Aprovar i concedir subvencions per l'import total de 500.000 € a favor dels beneficiaris que s'inclouen en l'annex 1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Autoritzar i disposar la despesa indicada per a cadascun dels beneficiaris amb càrrec al capítol IV del pressupost de la Direcció General de Cultura, amb els imports que es detallen en l'annex 1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Acceptar les despeses amb persones o entitats vinculades de l'entitat FILMIN MALLORCA, SL, i denegar la sol·licitud de Mèdit, Associació Cultural pel fet que es tracta d'honoraris dels beneficiaris de la subvenció, considerats com a despesa no subvencionable a l'apartat 5.2.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Informar els beneficiaris que la subvenció s'ha de justificar en els termes establerts en la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Publicar aquesta Resolució en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller de Turisme, Cultura i Esports en el termini d'un mes comptador a partir de l'endemà de la publicació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 de octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;També es pot interposar un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia en el termini de dos mesos comptadors a partir de l'endemà d'haver-se publicat, d'acord amb l'article 46.1 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
