&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Mitjançant la Resolució del Conseller d'Educació i Cultura de 4 de juny de 2007 (BOIB núm. 89, de 16 de juny) es va autoritzar la modificació de la configuració del Col·legi Privat Concertat Nuestra Señora de la Consolación, de Palma. Com a conseqüència d'aquesta modificació el centre quedà configurat de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Educació infantil de segon cicle: 3 unitats i 75 places escolars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Educació primària: 7 unitats i 175 places escolars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Educació secundària obligatòria: 4 unitats i 120 places escolars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En data 13 de novembre de 2023, (GOIBE711769/2023), la titular del centre sol·licità la modificació de la configuració del CC Nuestra Señora de la Consolación, de Palma, amb la implantació de 2 unitats del primer cicle d'educació infantil. Amb aquesta sol·licitud presentà els plànols i la memòria gràfica de creació de l'escoleta. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En data 18 de desembre de 2023, (GOIBE790701/2023, GOIBE790710/2023 i GOIBE790714/2023), el centre aportà documentació complementària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El 27 de febrer de 2024, l'arquitecte de l'IEPI va emetre un informe desfavorable, atès que la documentació presentada no acreditava que les instal·lacions del centre complissin els requisits establerts per la normativa vigent per a la modificació de configuració sol·licitada, d'acord amb el Decret 23/2020 de 31 de juliol. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El 7 de març de 2024, la cap de la Secció d'Autoritzacions i Registre de Centres va comunicar les conclusions de l'informe de l'IEPI al centre. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El 9 d'abril de 2024, (GOIBE218267/2024), el centre presentà una nova documentació, que modificava la sol·licitud de 13 de novembre de 2023, (GOIBE711769/2023), en què sol·licitava la modificació de la configuració del CC Nuestra Señora de la Consolación de Palma amb la implantació de 3 unitats de primer cicle d'educació infanti. Amb aquest sol·licitud, el director del centre, adjuntà el compromís de presentar les titulacions del professorat que impartiria el primer cicle d'educació infantil una vegada finalitzades les obres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;També s'adjuntava a la documentació el nou projecte per a l'escoleta amb el plànols corresponents, en els quals es corregien les deficiències detectades en l'informe anterior i es reflectia l'ampliació d'aules.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. L'11 d'abril de 2024, (GOIBE225280/2024), el director del centre demanà que la sol·licitud presentada el 13 de novembre de 2023, (GOIBE711769/2023), fos substituïda per la presentada el 9 d'abril de 2024, (GOIBE218267/2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. El 9 de juliol de 2024, l'arquitecte de l'IEPI va emetre un informe favorable, condicionat a la presentació de la documentació que esmenàs determinats apartats que s'assenyalaven en l'informe. A part d'aquestes esmenes, es determinava que les instal·lacions del centre complien els requisits establerts per la normativa vigent per a la modificació de configuració sol·licitada, d'acord amb el Decret 23/2020 de 31 de juliol.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. L'11 de juliol de 2024 la cap de la Secció d'Autoritzacions i Registre de Centres va comunicar les conclusions de l'informe anterior al centre. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. Posteriorment, en dada 16 d'agost de 2024, (GOIBE505064/2024), i en data 23 d'agost de 2024, (GOIBE517413/2024), el centre presentà la documentació que esmenava els apartats assenyalats en l'informe.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. El 27 d'agost de 2024, (GOIBE521496/2024), el centre presentà la certificació de finalització de les obres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12. Finalment, en data 27 d'agost de 2024, l'arquitecte de l'IEPI va emetre un informe favorable de la visita realitzada en data 27 d'agost de 2024. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13. El 29 d'agost de 2024, la cap de Departament de Planificació i Centres va emetre un informe favorable sobre l'autorització de la implantació de 3 unitats de primer cicle d'educació infantil del centre&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;privat CC Nuestra Señora de la Consolación, de Palma. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;14. El 29 d'agost 2024, la directora general de Planificació i Gestió Educatives, va proposar l'autorització de la implantació de 3 unitats de primer cicle d'educació infantil del centre&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;privat CC Nuestra Señora de la Consolación, de Palma. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Llei orgànica 8/1985, de 3 de juliol, reguladora del dret a l'educació (BOE núm. 159, de 4 de juliol).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La Llei orgànica 2/2006, de 3 de maig, d'educació, modificada per la Llei orgànica 3/2020, de 29 de desembre, (BOE núm.106, de 4 de maig de 2006).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El Decret llei 5/2023, de 28 d'agost, de mesures urgents en l'àmbit educatiu i en el sanitari (BOIB núm. 120, de 29 d'agost).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 44, de 3 d'abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La Llei 1/2022, de 8 de març, d'educació de les Illes Balears, (BOIB núm. 38 de 17 de març), la qual estableix a l'article 102, punt 2, de creació de centres que la creació, la supressió i la transformació de centres privats s'ha de sotmetre a l'autorització administrativa corresponent (BOIB núm. 38, de 17 de març).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El Reial decret 332/1992, de 3 d'abril, sobre autoritzacions de centres docents privats, per impartir ensenyaments de règim general no universitaris (BOE núm. 86, de 9 d'abril), modificat pel Reial decret 131/2010, de 12 de febrer (BOE núm. 62, de 12 de març), el qual estableix a l'article 13.1.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; que l'ampliació o la reducció del nombre d'unitats o places escolars es consideren circumstàncies que donen lloc a la modificació de l'autorització.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. El Decret 23/2020 de 31 de juliol, pel qual s'aprova el Text consolidat del Decret pel qual s'estableixen els requisits mínims dels centres de primer cicle d'educació infantil (BOIB núm. 135, d'1 d'agost).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. L'Ordre del conseller d'Educació i Universitat de 8 de març de 2018 per la qual es fixen les titulacions que cal tenir per fer classes de i en llengua catalana, pròpia de les Illes Balears, a l'ensenyament reglat no universitari, se n'estableixen les equivalències, es defineix el Pla de Formació Lingüística i Cultural (FOLC), es regulen les condicions de l'exempció de l'avaluació de la llengua catalana i literatura en ensenyaments no universitaris i es determinen les funcions i la composició de la Comissió Tècnica d'Assessorament per a l'Ensenyament de i en Llengua Catalana (BOIB núm. 38, de 27 de març).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. La Resolució del conseller d'Educació i Universitat de dia 28 de maig de 2018 per la qual s'aproven les instruccions que estableixen les condicions per obtenir l'equivalència del certificat de capacitació per a l'ensenyament en llengua catalana al primer cicle de l'educació infantil (CCI) amb la titulació de tècnic superior en Educació Infantil (BOIB núm. 68, de 2 de juny).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. L'Estatut d'autonomia de les Illes Balears, aprovat per la Llei orgànica 1/2007, de 28 de febrer (BOE núm. 52, de 1 de març), el qual estableix a l'article 36.2 que, en matèria d'ensenyament, correspon a la Comunitat Autònoma de les Illes Balears la competència de desenvolupament legislatiu i d'execució de l'ensenyament en tota la seva extensió, nivells i graus, modalitats i especialitats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. El Decret 5/2024, de 29 de maig, de la presidenta de les Illes Balears, pel qual es modifica el Decret 12/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears, modificat pel Decret 16/2023, de 20 de juliol; pel Decret 17/2023, de 23 d'agost; pel Decret 1/2024, de 4 de gener, i pel Decret 4/2024, de 17 de maig (BOIB núm. 73, de 31 de maig).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot això, i d'acord amb la proposta formulada per la Direcció General de Planificació i Gestió Educatives amb data 29 d'agost de 2024, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Autoritzar, amb efectes des de l' inici del curs escolar 2024-2025, la modificació de la configuració del centre CC Nuestra Señora de la Consolación, de Palma, amb l'ampliació de tres unitats d'educació infantil de primer cicle. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Determinar que, com a conseqüència d'aquesta autorització, el centre queda configurat de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Inscriure aquesta autorització en el Registre estatal de centres docents (RCD) del Ministeri d'Educació, Formació Professional i Esports i en el Registre Autonòmic de la Conselleria d'Educació i Universitats (Repositori).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Fer avinent al centre esmentat que resta obligat a complir la legislació vigent i a sol·licitar la revisió oportuna de la seva configuració quan s'hagi de modificar qualsevol de les dades que figuren en aquesta Resolució. En cas contrari, es revocarà l'autorització atorgada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Publicar aquesta Resolució al Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Educació i Universitats en el termini d'un mes comptador des de l'endemà del dia en què es publiqui en el BOIB, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;També s'hi pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació en el BOIB, d'acord amb els articles 10 i 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
