font-size:12px"><span style="line-height:100%"><span style="color:#000000">L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, subvencions per a inversions a les explotacions agràries, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al <em>Butlletí Oficial de les Illes Balears </em>d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:0.18cm"><span style="color:#000000"><em>1.En data de 16 de juliol de 2015 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 106, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019,<em> </em>subvencions per a inversions a les explotacions agràries, modificada mitjançant les resolucions de data 17 de desembre de 2015 (BOIB núm. 185), en data 22 de juny de 2016, (BOIB núm. 81) i en data 26 de juny de 2018 (BOIB núm. 80). </em></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:0.18cm"><span style="color:#000000"><span style="color:#000000"><em>2.El 17 d'abril de de 2023, el vicepresident en matèria agrària del FOGAIBA va dictar una Resolució de concessió d'ajudes per a inversions a les explotacions agràries, que es va publicar al Butlletí Oficial de les Illes Balears número 50, del 20 d'abril de 2023, en la qual hi figurava una concessió a favor de l'interessat assenyalat a l'annex adjunt.</em></span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:0.18cm"><span style="color:#000000"><em>3. El 31 de juliol de 2024, amb registre d'entrada núm. GOIBE480647/2024, l'interesat JAVIER BENÍTEZ CAPITÁN a</em><span style="color:#000000"><em><span style="background-color:#ffffff">mb NIF ***0676**, </span></em></span><em>va presentar el seu desistiment, la qual cosa suposa dur a terme la revocació total de l'ajuda concedida.&nbsp;</em></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>4.L'article 21.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que «En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància<em> </em>que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables».</em></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>5.L'article 43 del Text refós de la Llei de subvencions, aprovat per decret legislatiu 2/2005, de 28 de desembre, disposa que «Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció.
