&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;RESOLC FORMULAR:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;L&amp;apos;informe d&amp;apos;impacte ambiental&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;sobre el projecte bàsic de&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;deixalleria de Banyalbufar, en els termes següents: &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;1. Determinació de subjecció a avaluació ambiental i tramitació&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;D&amp;apos;acord amb l&amp;apos;article 13.2 del Decret legislatiu 1/2020, de 28 d&amp;apos;agost, pel qual s&amp;apos;aprova el Text Refós de la Llei d&amp;apos;Avaluació Ambiental de les Illes Balears, han de ser objecte d&amp;apos;avaluació d&amp;apos;impacte ambiental simplificada els projectes inclosos en l&amp;apos;annex II d&amp;apos;aquesta Llei. Entre els projectes inclosos en l&amp;apos;annex 2, el projecte de deixalleria de Banyalbufar s&amp;apos;inclou en els punts 3 i 4 del grup 6:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Instal·lacions d&amp;apos;emmagatzematge de residus perillosos fora del lloc de producció (incloses operacions prèvies al tractament) que facin operacions de la D13 a la D15 de l&amp;apos;annex 1 o operacions R12 i R13 de l&amp;apos;annex 2 de la Llei 22/2011, de 28 de juliol, de residus i sòls contaminats, que no es desenvolupin a l&amp;apos;interior d&amp;apos;una nau a polígon industrial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Instal·lacions d&amp;apos;emmagatzematge de residus no perillosos fora del lloc de producció (incloses operacions prèvies al tractament) que facin operacions de la D13 a la D15 de l&amp;apos;annex 1 i operacions R12 i R13 de l&amp;apos;annex 2 de la Llei 22/2011, de 28 de juliol, de residus i sòls contaminats, amb una capacitat superior a 100 t i que no es desenvolupin a l&amp;apos;interior d&amp;apos;una nau a polígon industrial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Les referències a la Llei 22/2011 s&amp;apos;han d&amp;apos;entendre fetes a la Llei 7/2022, de 8 d&amp;apos;abril.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Per tant, el projecte s&amp;apos;ha de tramitar com a una Avaluació d&amp;apos;Impacte Ambiental Simplificada i seguir el procediment establert a la secció 2a del Capítol II d&amp;apos;avaluació d&amp;apos;impacte ambiental de projectes del Títol II d&amp;apos;avaluació ambiental de la Llei 21/2013, de 9 de desembre, d&amp;apos;avaluació ambiental. S&amp;apos;han de complir també les prescripcions de l&amp;apos;article 21 i 22 del Decret legislatiu 1/2020, que li siguin d&amp;apos;aplicació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;2. Descripció i ubicació del projecte&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. El projecte pretén l&amp;apos;execució de la &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;nova&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; deixalleria &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;de &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Banyalbufar&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;, &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;la parcel·la 9009 del polígon 3 &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;(TN POLIGONO W 1)&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;i referència &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;cadastral &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;9436701DD5993N0001TJ&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;. &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;A&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ctualment,&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; la parcel·l&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;amb una superfície total de &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;8742 m&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;sup&gt;2&lt;/sup&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;, disposa d&amp;apos;un camp de futbol abandonat i un altre espai &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;d&amp;apos;uns 485 m&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;sup&gt;2&lt;/sup&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;utilitzat com a parc verd provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. La parcel·la està classificada com a sòl urbà amb la zonificació de Sistema d&amp;apos;Equipaments Públics, segons les Normes Subsidiàries de Banyalbufar, on es permet l&amp;apos;ús públic. L&amp;apos;accés a la deixalleria es fa directament des de la carretera Ma-10 que uneix Pollença a Andratx mitjançant una via d&amp;apos;accés de 5 m d&amp;apos;amplària i uns 80 m de recorregut. Per carretera, la deixalleria es troba a més de 2 km del nucli de Banyalbufar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;3. &lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;4. &lt;/span&gt;Cal destacar que tant el magatzem per a residus especials i perillosos com la zona coberta per l&amp;apos;emmagatzematge de diversos residus com RAEE o olis vegetals disposaran d&amp;apos;una superfície impermeable. &lt;span style="background-color: rgb(255, 255, 255)"&gt;T&lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;amb&lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;é es disposarà d&amp;apos;un sistema de recollida dels residus líquids en cas de fuita, vessament o ruptura de contenidors que consistirà en un sistema de drenatge interior de seguretat accessible mitjançant arquetes independent&lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;s&lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; que condueixi els residus vessats i/o les aigües de neteja a un dipòsit totalment estanc i resistent als residus que pugui contenir. &lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Aquest dipòsit s&amp;apos;haurà de buidar amb un gestor autoritzat en el cas de vessament de residus. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Així mateix, es disposarà de sepiolita o materials absorbents similars per a la contenció de possibles vessaments. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. &lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- 2 contenidors de voluminosos &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- 2 compactadores&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(206, 24, 30)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6.&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;El projecte preveu que la instal·lació &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;disposi d&amp;apos;una tanca perimetral i una pantalla vegetada per minimitzar l&amp;apos;impacte visual i impedir l&amp;apos;accés a la instal·lació fora del seu horari de servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(206, 24, 30)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;7. Segons el document ambiental, la parcel·la actualment ja disposa d&amp;apos;una escomesa d&amp;apos;&lt;strong&gt;aigua potable&lt;/strong&gt; que s&amp;apos;utilitzarà per al reg de zones verdes, neteja del recinte i per sufocar possibles incendis amb una pressió de servei de 2-3 bars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;8. Segons el document ambiental, la instal·lació disposarà d&amp;apos;una xarxa per &lt;strong&gt;aigües pluvials&lt;/strong&gt; que consistirà amb la canalització de l&amp;apos;aigua que recullin les teulades a un dipòsit per ser reutilitzada per reg o per neteja. Es realitzarà una xarxa de recollida d&amp;apos;aigües pluvials de la superfície destinada a contenidors i a maniobra de camions que s&amp;apos;evacuarà fora del recinte previ pas per un decantador de greixos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;9. Segons el projecte, La zona on s&amp;apos;ubiquen els banys disposarà de connexió a una fossa sèptica (depuradora d&amp;apos;oxidació total) a instal·lar. També es connectaran les aigües residuals del rentamans i renta ulls.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;10. Pel &lt;strong&gt;subministrament elèctric&lt;/strong&gt; de la deixalleria, s&amp;apos;instal·laran panells fotovoltaics. A més, al document ambiental s&amp;apos;indica que al carrer del solar hi passa &lt;/span&gt;una xarxa elèctrica que subministra energia al cementiri i que, per tant, es duran a terme les actuacions &lt;span style="color: rgb(0, 0, 0)"&gt;que siguin necessàries per connectar la instal·lació de la Deixalleria a la xarxa elèctrica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;11. Referent a la &lt;strong&gt;protecció contra incendis&lt;/strong&gt;, el document ambiental indica que es col·locaran extintors al magatzem de residus perillosos, al recinte d&amp;apos;aparells elèctrics RAEE i un extintor a l&amp;apos;oficina de recepció i que donades les característiques de la instal·lació no és necessària la posada en servei de la instal·lació contra inc&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;endis em&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;e&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;s&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;a&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; pe&lt;/span&gt;&lt;/span&gt;r la Direcció General de Política Industrial de la Conselleria de treball, Comerç i Indústria del Govern de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;12. Segons el document ambiental, la pantalla d&amp;apos;arbusts o arbres que enrevoltarà la instal·lació estarà constituïda per espècies vegetals adaptades al clima mediterrani que tenguin requeriments hídrics baixos i siguin de fulla perenne com el &lt;em&gt;Cupressus sempervirens &lt;/em&gt;(xiprer) o la &lt;em&gt;Pistacia lentiscus &lt;/em&gt;(mata).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;13. El Pressupost d&amp;apos;Execució Material (PEM) per la construcció de la nova deixalleria de Banyalbufar és de 412.585,10 € i el Pressupost Base de Licitació (PBL) és de 594.081,29 € IVA inclòs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;14. A la documentació ambiental es plantegen les alternatives següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Alternativa 0 (no execució): suposaria mantenir les condicions actuals de l&amp;apos;emplaçament (zona verda). D&amp;apos;acord amb el document ambiental, es descarta aquesta alternativa pels motius següents: la deixalleria de Banyalbufar actual no compta amb les infraestructures adequades per admetre aquest ús, amb la qual cosa, la no execució del projecte suposaria no poder dotar d&amp;apos;un servei necessari a la població del municipi amb el conseqüent no compliment de l&amp;apos;especificat a la normativa de residus.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Alternativa 1 (seleccionada): execució del projecte de la deixalleria tal com es preveu a la memòria d&amp;apos;explotació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Alternativa 2 (redistribució dels contenidors): Aquesta segona alternativa contempla la possibilitat de dur a terme una redistribució de la zona interior de la deixalleria modificant la ubicació de certs contenidors i per tant variant el recorregut dels vehicles que circulin per l&amp;apos;interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Alternativa 3 (Obertura de les dues portes d&amp;apos;accés al punt verd): De cara a facilitar els accessos als usuaris al Parc Verd, en aquesta tercera alternativa es proposa mantenir obertes les dues portes d&amp;apos;accés i disponibles per tots els usuaris, sense limitar el seu ús als serveis de recollida. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Al document ambiental es comenta que les alternatives presentades &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;no contemplen una reubicació de la deixalleria,&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; ja que, ja es va dur a terme una&lt;/span&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;anàlisi d&amp;apos;alternatives d&amp;apos;ubicació en el document ambiental relatiu a la modificació de les NNSS del municipi (Informe d&amp;apos;impacte ambiental publicat al BOIB nº 114 de 30 d&amp;apos;agost de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;3. Avaluació dels efectes previsibles&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;D&amp;apos;acord amb el document ambiental, durant la fase de construcció, es produirà l&amp;apos;emissió de pols, partícules en suspensió, gasos contaminants a l&amp;apos;atmosfera, i emissions acústiques, associat al trànsit de maquinària i vehicles i al moviment de terres, així com el possible abocament accidental de substàncies contaminants. No obstant això, atès que aquests impactes seran de caràcter temporal, no es consideren significatius. Com a impacte positiu, trobam la millora en l&amp;apos;economia local per compra de materials, contractació d&amp;apos;empreses del sector de la construcció i creació de llocs de treball. Durant la fase de funcionament de la instal·lació, a causa de les dimensions de la deixalleria projectada i l&amp;apos;entorn existent, es consideren impactes ambientals poc significatius, com el trànsit de vehicles, l&amp;apos;impacte paisatgístic, emissions contaminants a l&amp;apos;atmosfera i consum d&amp;apos;aigua. Com a impactes positius, destaca la disposició d&amp;apos;un millor servei de recepció i emmagatzematge de residus per als habitatges i petits productors del municipi, la millora de la gestió dels residus especials i perillosos generats al municipi, i la reducció dels punts d&amp;apos;abocament incontrolat de residus.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;4. Consultes a les administracions públiques afectades i persones interessades&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;L&amp;apos;òrgan ambiental ha realitzat consulta a les següents administracions previsiblement afectades:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(206, 24, 30)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Direcció General de Medi Natural i Gestió Forestal, de la Conselleria d&amp;apos;Agricultura, Pesca i Medi Natural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(206, 24, 30)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Servei de Canvi Climàtic i Atmosfera (DG d&amp;apos;Economia Circular, Transició Energètica i Canvi Climàtic), de la Conselleria d&amp;apos;Empresa, Ocupació i Energia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Servei d&amp;apos;Estudis i Planificació (DG de Recursos Hídrics), de la Conselleria de la Mar i del Cicle de l&amp;apos;Aigua.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(206, 24, 30)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- DG d&amp;apos;Emergències i Interior, de la Conselleria de Presidència i Administracions Públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(206, 24, 30)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- DG de Salut Pública, de la Conselleria de Salut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(206, 24, 30)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Amics de la Terra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- GOB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En el moment de redactar el present informe, s&amp;apos;han rebut els següents informes de les administracions consultades:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Informe del Servei d&amp;apos;Estudis i Planificació de la Direcció General de Recursos Hídrics:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Es conclou que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Informam favorablement, condicionat al compliment dels següents condicionants:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;1. Tota la deixalleria ha d&amp;apos;estar impermeabilitzada i amb un sistema de recollida de lixiviats que permeti assegurar que, en cap cas, les aigües pluvials puguin arrossegar part dels lixiviats fora de la deixalleria.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;2. La xarxa de recollida de les aigües pluvials de les superfícies de contenidors i de la zona de maniobra dels camions també s&amp;apos;ha de conduir al separador de greixos. Se&amp;apos;n recomana l&amp;apos;aprofitament posterior, envers de l&amp;apos;evacuació a la xarxa de pluvials municipal.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;3. S&amp;apos;ha d&amp;apos;eliminar la instal·lació denominada «dipòsit de fecals» i s&amp;apos;ha de connectar la instal·lació d&amp;apos;aigües residuals directament a la xarxa de sanejament municipal.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Informe del Servei de Canvi Climàtic i Atmosfera de la DG d&amp;apos;Economia Circular, Transició Energètica i Canvi Climàtic de la Conselleria d&amp;apos;Empresa, Ocupació i Energia:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Es conclou que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;1. El titular de la instal·lació ha de sol·licitar a la Direcció General d&amp;apos;Economia Circular, Transició Energètica i Canvi Climàtic la seva inscripció com activitat potencialment contaminadora de l&amp;apos;atmosfera (APCA) del grup C, o l&amp;apos;autorització administrativa com APCA del grup B, segons l&amp;apos;epígraf que li sigui d&amp;apos;aplicació. El titular haurà d&amp;apos;incloure una memòria sobre contaminació atmosfèrica on identifiqui tots els focus d&amp;apos;emissions, així com les mesures correctores i preventives a aplicar per minimitzar les emissions a l&amp;apos;atmosfera. S&amp;apos;ha d&amp;apos;utilitzar la maquinària energèticament més eficient i amb emissions específiques de contaminants mínimes.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;2. La resolució de condicionants APCA o, en el seu cas, d&amp;apos;autorització, fixarà la periodicitat de les comprovacions a realitzar per part d&amp;apos;un Organisme de control autoritzat per a l&amp;apos;atmosfera (OCA), tant les corresponents al manteniment i eficàcia de les mesures correctores i preventives implantades per disminuir les emissions de partícules, com de les mesures de gasos i partícules dels possibles equips de combustió existents, si s&amp;apos;escau.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;3. S&amp;apos;hauria d&amp;apos;haver presentat l&amp;apos;annex corresponent al consum energètic, emissions de gasos d&amp;apos;efecte hivernacle i avaluació de la vulnerabilitat front del canvi climàtic.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;4. Per altra part, es considera adequada la utilització d&amp;apos;energies renovables, en aquest cas energia fotovoltaica, ja que s&amp;apos;ajusta als objectius de la Llei de Canvi Climàtic i Transició Energètica, en la qual es descriu que les noves edificacions que es construeixin han de ser instal·lacions de consum energètic quasi nul i que s&amp;apos;ha d&amp;apos;implantar progressivament el consum d&amp;apos;energia renovable.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Informe de la Direcció General d&amp;apos;Emergències i Interior de la Conselleria de Presidència i Administracions Públiques:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Es conclou que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Una vegada examinada la documentació, i tot i que la Llei 21/2013 contempla l&amp;apos;opinió de les administracions afectades, l&amp;apos;enfocament de la Direcció general d&amp;apos;Emergències i Interior pot oferir és sobre la protecció de les persones i béns (art.1 de la Llei 17/2025 del Sistema Nacional de Protecció Civil).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Tot i així, la consideració que pot fer la Direcció General d&amp;apos;Emergències i Interior al projecte de la deixalleria de Banyalbufar és la mateixa que a l&amp;apos;informe anterior, atès que el projecte actual no ha variat del de data 24 de gener de 2024 i per tant la conclusió de l&amp;apos;informe de la modificació puntual de les NNSS del municipi on s&amp;apos;establia que «és necessari que al punt verd s&amp;apos;incorporin mesures adequades per a la prevenció dels incendis forestals d&amp;apos;acord amb el Departament de Medi Natural així com mesures d&amp;apos;autoprotecció per a l&amp;apos;activitat en cas d&amp;apos;incendi».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Informe del Servei de Salut Ambiental (DG de Salut Pública), de la Conselleria de Salut:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Es conclou que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;S&amp;apos;informa favorablement condicionat al compliment de la memòria ambiental i dels límits d&amp;apos;emissions a l&amp;apos;atmosfera (gasos, partícules i renous).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;5. Anàlisi dels criteris de l&amp;apos;annex III de la Llei 21/2013&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;S&amp;apos;han analitzat els criteris de l&amp;apos;annex III de la Llei 21/2013, de 9 de desembre, d&amp;apos;avaluació ambiental, i no es preveu que el projecte pugui tenir efectes significatius sobre el medi ambient, en concret:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="margin-bottom: 0.1cm; margin-top: 0.1cm"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;1. Característiques del projecte: El projecte pretén l&amp;apos;execució de la nova deixalleria del TM de Banyalbufar. Ubicació del projecte: La parcel·la seleccionada és la 9009 del polígon 3 (TN POLIGONO W 1) i referència cadastral 9436701DD5993N0001TJ. Actualment, la parcel·la amb una superfície total de 8742 m&lt;sup&gt;2&lt;/sup&gt;, disposa d&amp;apos;un camp de futbol abandonat i un altre espai d&amp;apos;uns 485 m&lt;sup&gt;2&lt;/sup&gt; utilitzat com a parc verd provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="margin-bottom: 0.1cm"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;La parcel·la està classificada com a sòl urbà amb la zonificació de Sistema d&amp;apos;Equipaments Públics, segons les Normes Subsidiàries de Banyalbufar, on es permet l&amp;apos;ús públic. L&amp;apos;accés a la deixalleria es fa directament des de la carretera Ma-10 que uneix Pollença a Andratx mitjançant una via d&amp;apos;accés de 5 m d&amp;apos;amplària i uns 80 m de recorregut. Per carretera, la deixalleria es troba a més de 2 km del nucli de Banyalbufar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;D&amp;apos;acord amb el visor del MUIB, la parcel·la objecte d&amp;apos;estudi es troba qualificada com a sòl urbà. Segons el document ambiental, es tracta d&amp;apos;un terreny urbà destinat a equipaments públics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Segons el visor de l&amp;apos;IDEIB, la parcel·la objecte d&amp;apos;estudi se situa sobre un espai natural protegit que és el Paratge natural de la Serra de Tramuntana, d&amp;apos;acord amb la zonificació del PORN que regula aquest espai natural, la parcel·la se situa en una Zona d&amp;apos;ús general.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La parcel·la estudiada se situa en una zona de risc moderat d&amp;apos;incendis, alhora envoltada d&amp;apos;una àrea boscosa més o menys densa catalogada com a zona de risc extremadament alt d&amp;apos;incendis:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La parcel·la estudiada se situa a sobre de la massa d&amp;apos;aigua subterrània&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; de Banyalbufar (1802M2), que es troba en bon estat i sense risc. En canvi, pel que fa a la vulnerabilitat, aquesta massa d&amp;apos;aigua subterrània està considerada com una massa amb una vulnerabilitat alta.&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;La parcel·la estudiada està afectada pels perímetres de restriccions moderades dels tres pous (fonts) de proveïment urbà següents (els pous es troben a menys de 1000 m de l&amp;apos;àmbit del projecte):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La parcel·la estudiada està situada a uns 30 m d&amp;apos;un petit torrent anomenat Torrent des Forcalls. El tàlveg d&amp;apos;aquest petit torrent es troba a uns 20 m per sota de l&amp;apos;alçada de la parcel·la i la capçalera del torrent se situa a uns 200 m del punt més pròxim del torrent a la parcel·la.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La parcel·la estudiada es troba envoltada i a pocs metres de dos espais catalogats com a sòl rústic protegit segons la&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; Llei 1/1991, de &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;30 de gene&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;r&lt;/span&gt;,&lt;span style="color: rgb(0, 0, 0)"&gt; d&amp;apos;espais naturals i de règim urbanístic de les àrees d&amp;apos;especial protecció de les &lt;/span&gt;&lt;a href="https://ca.wikipedia.org/wiki/Illes_Balears" style="color: rgb(0, 0, 128); text-decoration: underline"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Illes Balears&lt;/span&gt;&lt;/a&gt; (LEN&lt;span style="color: rgb(0, 0, 0)"&gt;) ; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;concretament per una &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Àrea Rural d&amp;apos;Interès Paisatgístic &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;(ARIP)&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;i &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;una Àrea Natural d&amp;apos;Especial Interès (ANEI).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Segons el visor de l&amp;apos;IDEIB, la parcel·la estudiada es troba a uns 130 m de la Zona d&amp;apos;Especial Conservació (ZEC) des Port des Canonge. Espai integrat dins la Xarxa Natura 2000.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;D&amp;apos;acord amb el visor de l&amp;apos;IDEIB, els Béns d&amp;apos;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;I&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;nterès &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;C&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ultural (BIC) &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;i&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; Béns Catalogats (BC) més pròxims &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a la parcel·la de referència es localitzen a més de 2 km de distància.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(206, 24, 30)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. Característiques del potencial impacte:&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;a&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;tesa la naturalesa de l&amp;apos;activitat a desenvolupar &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;i la ubicació proposada per a la deixalleria,&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; es preveu que els efectes sobre el medi ambient siguin mínims si s&amp;apos;apliquen les mesures &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;preventives i &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;correctores de&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;l document ambiental i les proposades en aquest informe.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. &lt;span style="background-color: rgb(255, 255, 255)"&gt;La xarxa de recollida de les aigües pluvials de les superfícies de contenidors i de la zona de maniobra dels camions s&amp;apos;ha de conduir al separador de greixos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;2. Tota la deixalleria ha d&amp;apos;estar impermeabilitzada i amb un sistema de recollida de lixiviats que permeti assegurar que, en cap cas, les aigües pluvials puguin arrossegar part dels lixiviats fora de la deixalleria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. Serà necessària la creació d&amp;apos;una franja de seguretat al voltant de la instal·lació d&amp;apos;uns 30 metres, exceptuant la zona sud i est, on el màxim que es podrà arribar és al propi límit de la parcel·la que es troba a uns 15 i 10 m respectivament de la instal·lació projectada. La franja de seguretat haurà de seguir els requisits establerts a la &lt;em&gt;Resolució del conseller de Medi Ambient i Territori, de 15 de febrer de 2021, d&amp;apos;aprovació de les instruccions per determinar les característiques específiques de les franges de seguretat i altres mesures d&amp;apos;autoprotecció en zones interfície urbano-forestal.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. Els efluents procedents de la depuradora d&amp;apos;oxidació total s&amp;apos;hauran de reutilitzar a la pròpia parcel·la. A aquest efecte s&amp;apos;ha de disposar de com a mínim, una zona verda d&amp;apos;evacuació de 25 m&lt;sup&gt;2&lt;/sup&gt; per habitant-equivalent (h.e) tal com estableix el punt 12 de l&amp;apos;article de 70 del PHIB 2022-2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Per altra banda, es recomana:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;- Reutilitzar l&amp;apos;aigua que passi pel separador de greixos a la pròpia parcel·la per regar les zones enjardinades, netejar els camions, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Finalment, es recorda que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;- S&amp;apos;haurà de complir amb el que s&amp;apos;indica al punt 4 de l&amp;apos;article 70 del Pla Hidrològic de les Illes Balears (2022-2027): &lt;/span&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;El titular del sistema autònom de depuració o dipòsit estanc haurà de presentar declaració responsable davant l&amp;apos;AH de la instal·lació d&amp;apos;aquest sistema, a la qual s&amp;apos;acompanyarà de document acreditatiu d&amp;apos;adquisició i instal·lació, característiques tècniques, rendiment en el primer cas, així com el pla de manteniment d&amp;apos;aquest. La direcció general competent en matèria de recursos hídrics facilitarà el model de declaració responsable.&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; La declaració responsable es troba disponible al següent enllaç:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 80px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;https://www.caib.es/seucaib/ca/200/persones/tramites/tramite/3471297&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;- S&amp;apos;haurà de complir amb el que s&amp;apos;indica al punt 12 de l&amp;apos;article 70 del Pla Hidrològic de les Illes Balears (2022-2027) sobre l&amp;apos;evacuació dels efluents dels sistemes autònoms de tractament d&amp;apos;aigües residuals: &lt;/span&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Com a norma general els efluents procedents dels sistemes autònoms de depuració s&amp;apos;hauran de reutilitzar a la pròpia parcel·la. A aquest efecte s&amp;apos;ha de disposar de com a mínim, una zona verda d&amp;apos;evacuació de 25 m&lt;/span&gt;&lt;/em&gt;&lt;sup&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;2&lt;/span&gt;&lt;/em&gt;&lt;/sup&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; per habitant-equivalent (h.e). En casos justificats es podrà evacuar l&amp;apos;efluent mitjançant infiltració per rasa drenant, sent necessari informe favorable de l&amp;apos;AH.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Durant l&amp;apos;execució de les obres caldrà complir el &lt;em&gt;D&lt;/em&gt;&lt;em&gt;ecret 125/2007, de 5 d&amp;apos;octubre, pel qual es dicten normes sobre l&amp;apos;ús del foc i es regula l&amp;apos;exercici de determinades activitats susceptibles d&amp;apos;increment el risc d&amp;apos;incendi forestal&lt;/em&gt;, especialment pel que fa a les mesures de prevenció durant l&amp;apos;època de perill d&amp;apos;incendi forestal i les accions conjunturals de prevenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Abans de l&amp;apos;inici de l&amp;apos;activitat, el titular de la instal·lació haurà de sol·licitar a la DG d&amp;apos;Energia i Canvi Climàtic la seva inscripció com activitat potencialment contaminadora de l&amp;apos;atmosfera (APCA) del grup C, o l&amp;apos;autorització administrativa com APCA del grup B, segons l&amp;apos;epígraf que li sigui d&amp;apos;aplicació. El titular haurà d&amp;apos;incloure una memòria sobre contaminació atmosfèrica on identifiqui tots els focus d&amp;apos;emissions, així com les mesures correctores i preventives a aplicar per minimitzar les emissions a l&amp;apos;atmosfera. S&amp;apos;ha d&amp;apos;utilitzar la maquinària energèticament més eficient i amb emissions específiques de contaminants mínimes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La resolució d&amp;apos;inscripció APCA o, si escau, d&amp;apos;autorització, fixarà la periodicitat de les comprovacions a realitzar per part d&amp;apos;un Organisme de control autoritzat per a l&amp;apos;atmosfera (OCA), tant les corresponents al manteniment i eficàcia de les mesures correctores i preventives implantades per disminuir les emissions de partícules, com de les mesures de gasos i partícules dels possibles equips de combustió existents, si s&amp;apos;escau.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Segon. &lt;/strong&gt;Es publicarà el present informe ambiental al Butlletí Oficial de les Illes Balears, d&amp;apos;acord amb el que disposa l&amp;apos;article 47.3 de la Llei 21/2013, de 9 de desembre, d&amp;apos;avaluació ambiental. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(26, 23, 24)"&gt;&lt;strong&gt;Tercer.&lt;/strong&gt; L&amp;apos;informe d&amp;apos;impacte ambiental perdrà la seva vigència i cessarà en la producció dels efectes que li són propis si, una vegada publicat en el BOIB, no s&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&amp;apos;hagués procedit a l&amp;apos;autorització del projecte en el termini màxim de sis anys des de la publicació, d&amp;apos;acord amb el que disposa l&amp;apos;article 21 bis del Text refós de la Llei d&amp;apos;avaluació ambiental de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Quart. &lt;/strong&gt;L&amp;apos;informe d&amp;apos;impacte ambiental no ha de ser objecte de cap recurs, sense perjudici dels que, si s&amp;apos;escau, siguin procedents en la via administrativa o judicial davant de l&amp;apos;acte, si s&amp;apos;escau, d&amp;apos;autorització del projecte, d&amp;apos;acord amb el que disposa l&amp;apos;article 47.5 de la Llei 21/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="margin-bottom: 0cm"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Cinquè.&lt;/strong&gt; Aquesta resolució s&amp;apos;emet sense perjudici de les competències urbanístiques, de gestió o territorials de les administracions competents i de les autoritzacions o informes necessaris per a l&amp;apos;aprovació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
