    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'apartat 8.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 12 d' abril de 2023 per la qual s'aprova la convocatòria de les ajudes, per al foment de l'agricultura ecològica, per als anys 2023, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques . &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 14 de juliol de 2024, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.En data 30 de maig de 2023, es publica en el Butlletí Oficial de les Illes Balears núm. 71, la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es modifica la Resolució de la presidenta del FOGAIBA de 27 de febrer de 2023, de convocatòria, per a l'any 2023, dels ajuts corresponents a les intervencions en forma de pagaments directes que preveu el Pla estratègic de la PAC (PEPAC), així com altres resolucions de convocatòria d'ajuts que preveuen les intervencions al desenvolupament rural. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3.En data 10 de maig de 2024, el vicepresident en matèria agrària del FOGAIBA, va dictar Resolució de concessió d'ajudes per al foment de l'agricultura ecològica per a l'any 2023, que es va publicar en el Butlletí Oficial de les Illes Balears núm. 69, de 25 de maig de 2024, en el qual hi figura una concessió a favor dels beneficiaris que apareixen a l'annex I adjunt, que són dos, i que comença amb ANDREU LLUÍS BIBILONI MUNAR amb NIF***2498** i número d'expedient AECU04001896/2023 i acaba amb ANA GARRIGOS SISTARE amb NIF***4275** i número d'expedient AECU04004299/2023.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4.En data 11 de juny de 2024, el beneficiari ANDREU LLUÍS BIBILONI MUNAR amb NIF***2498** va presentar la renúncia de l'ajuda concedida amb número de registre d'entrada GOIBE371720/2024 la qual cosa suposa dur a terme la revocació total de l'ajuda concedida.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;En data 9 de juliol de 2024, la beneficiària ANA GARRIGOS SISTARE amb NIF***4275** va presentar la renúncia de l'ajuda concedida amb número de registre d'entrada GOIBE433204/2024 la qual cosa suposa dur a terme la revocació total de l'ajuda concedida.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;6.&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Atès tot això, es proposa fer la revocació total dels imports concedits i pendents de pagament i el reintegrament de l'anualitat 2023 pagada amb anterioritat, a causa de &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;la renúncia&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt; de l'ajuda concedida pel&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;s&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt; beneficiari&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;s&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;i els imports &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;que s'indi&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;ca&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt; en l'annex&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;I adjunt &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;en &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;aquesta resolució.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1.Resolució de la Presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 12 d'abril de 2023 per la qual s'aprova la convocatòria per a l'any 2023 de les ajudes destinades per al foment de l'agricultura ecològica, publicada al BOIB núm. 48 de dia 15 d'abril de 2023.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.Ordre de la consellera d'Agricultura, Pesca i Alimentació de data 6 d'abril de 2023 per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc de les intervencions per al desenvolupament rural de les Illes Balears 2023-2027.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3.Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:10px"&gt;L'article 21.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que «En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables».&lt;/span&gt;&lt;/em&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4.Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'article 43 del Text refós de la Llei de subvencions, aprovat per decret legislatiu 2/2005, de 28 de desembre, disposa que «Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. A conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament». &lt;/span&gt;&lt;/em&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Proposta de resolució&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Per tot això, s'informa favorablement i &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;es &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;prop&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;o&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;s&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; al vicepresident en &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;m&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;atèria &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1.Acceptar les renúncies a les ajudes concedides per Resolució del vicepresident en matèria agrària del FOGAIBA de dia 10 de maig de 2024, publicada al BOIB núm. 69, de 25 de maig de 2024, presentada pels beneficiaris detallats en l'Annex I adjunt, que són dos, i que comença amb &lt;/em&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;ANDREU LLUÍS BIBILONI MUNAR &lt;/span&gt;i acaba amb ANA GARRIGOS SISTARE.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.Revocar les ajudes concedides en la resolució&lt;span style="background-color:#ffffff"&gt; d&lt;/span&gt;el vicepresident en matèria agrària del FOGAIBA &lt;span style="background-color:#ffffff"&gt;de 20 de maig de 2024,&lt;/span&gt; corresponent a les persones interessades&lt;span style="background-color:#ffffff"&gt; assenyalades&lt;/span&gt; i pels imports indicats en l'Annex I d'aquesta resolució.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Declarar conclòs el procediment i arxivar&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;l'&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;expedient&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Notificar aquesta Resolució a &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;les persones interessades&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant la consellera de Agricultura, Pesca i Medi Natural, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i els articles 121 i 122, de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
