    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;L'apartat 8.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 12 d'abril de 2023, per la qual es convoquen subvencions Foment de l'Agricultura Ecològica, especifica que la resolució es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, de l'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;L'expedient ha estat tramitat pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 8 de juliol de 2024, va signar la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;1. En data 6 d'abril de 2023, es publica en el BOIB núm. 43, l'Ordre de la consellera d'Agricultura, Pesca i Alimentació per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc de les intervencions per al desenvolupament rural de les Illes Balears 2023-2027.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;2. En data 15 d'abril de 2023, es publica en el BOIB núm. 48, la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria, per a l'any 2023, de les ajudes destinades per al foment de l'agricultura ecològica.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;3. En data 30 de maig de 2023, es publica en el BOIB núm. 71, la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es modifica la Resolució de la presidenta del FOGAIBA de 27 de febrer de 2023, de convocatòria, per a l'any 2023, dels ajuts corresponents a les intervencions en forma de pagaments directes que preveu el Pla estratègic de la PAC (PEPAC), així com altres resolucions de convocatòria d'ajuts que preveuen les intervencions al desenvolupament rural.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;4. En data 30 de juny de 2023, s'han rebut 551 sol·licituds per l'ajuda destinada per al foment de l'agricultura ecològica.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;5. Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han duit a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;6. En data 20 de febrer de 2024, es publica en el BOIB núm. 25 la Resolució de denegació als beneficiaris de les ajudes, Rd1conjunta de la Secció II, per l'incompliment del requisit previst a l'apartat 7 del punt tercer de la convocatòria d'estar al corrent de les obligacions tributàries.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;7. En data 6 d'abril de 2024, es publica en el BOIB núm. 46 la Resolució de revocació parcial de la denegació al sol·licitant Finca Savantry CB amb número d'expedient 04003976 i NIF E57990400, en data 4 de maig de 2024 es publica en el BOIB núm. 59 la Resolució de revocació parcial de la denegació al sol·licitant AOVE Artà SL, amb número d'expedient 04004999 i NIF B57770125, respectivament. &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;8. En data 25 de maig de 2024, es publica en el BOIB núm. 69 la Resolució de concessió de les ajudes destinades al foment de l'agricultura ecològica.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;9. En data 17 de juny de 2024 es notifica, mitjançant publicació a la pàgina web del FOGAIBA, la proposta provisional de resolució de revocació i es concedeix un termini de 10 dies hàbils per presentar al·legacions. Els expedients que així ho han fet apareixen a l'annex I d'aquesta resolució, on s'indica l'estimació favorable o no d'aquestes al·legacions.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;10. En data 4 de juliol de 2024, es publica en el BOIB núm. 88 la Resolució de modificació de concessió de les ajudes destinades al foment de l'agricultura ecològica.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;11. Per altra banda, es comprova d'ofici una errada detectada per part de l'Administració, en referència als expedients 0236, 0244, 0318, 0402, 0472 i 0542. En aquests casos concrets, corregits a l'annex&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;d'aquesta resolució, l'import a revocar és menor ja que s'havia establert erròniament la penalització a aplicar.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;12. Per últim, es comprova també d'ofici, una errada detectada per part de l'Administrtació, pel que fa a l'expedient 0367, per l'incumpliment de monitoratge i que no es va tenir en compte a l'hora de publicar l'Informe/Proposta provisional de resolució, de 17 de juny. Concretament, per aquest expedient es redueix un 1% l'import proposat a la notificació de resolució de modificació de concessió publicat en el BOIB núm. 88 en data 4 de juliol de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;13. S'ha considerat l'informe proposta provisional de resolució, de 17 de juny de revocació parcial de la resolució de concessió dels expedients assenyalats a l'annex II, ja que no compleixen amb algun dels requisit de la convocatòria, amb les incidències i motius corresponents que s'assenyalen a l'annex III, i per tant l'import a percebre per l'anualitat 2023 és inferior.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:0.18cm"&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;1. Resolució de la Presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 12 d'abril de 2023 per la qual s'aprova la convocatòria per a l'any 2023 de les ajudes destinades per al foment de l'agricultura ecològica, publicada al BOIB núm. 48 de dia 15 d'abril de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;3. Punt tercer de la convocatòria referent als requisits de les persones beneficiàries i de les explotacions, apartat 1 lletra a) pel que fa a seguir les pràctiques i mètodes que defineix el Reglament (UE) 2018/848 del Parlament Europeu i del Consell, de 30 de maig de 2018, sobre producció ecològica i etiquetatge dels productes ecològics.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;4. Article 13 del Reial decret 147/2023, de 28 de febrer, pel qual s'estableixen les normes per a l'aplicació de penalitzacions en les intervencions contemplades en el PEPAC, i es modifiquin diferents reials decrets pels quals es regulen diferents aspectes relacionats amb l'aplicació a Espanya de la PAC per al període 2023-2027, referent a l'omissió de parcel·les.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;5. Article 18 de l'RD 147/2023, de 28 de febrer.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;6. Article 31 de l'RD 147/2023, de 28 de febrer.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;7. Article 23 del Reial decret 1047/2022, de 27 de desembre, pel qual es regula el sistema de gestió i control de les intervencions del PEPAC i altres ajudes de l a PAC.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;8. Article 48 de l'RD 1047/2022, de 27 de desembre.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;9. Article 63 de l'RD 1047/2022, de 27 de desembre.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;10. Article 105.7 del Reial decret 1048/2022, de 27 de desembre, sobre l'aplicació, a partir de 2023, de les intervencions en forma de pagaments directes i l'establiment de requisists comuns en el marc del Pla Estratègic de la Política Agrària Comú, i la regulació de la sol·licitud única dels sistema integrat de gestió i control.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;11. Article 111 de l'RD 1048/2022, de 27 de desembre.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;12. &lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:0.18cm"&gt;&lt;span style="background-color:null"&gt;Informe y proposta de resolució &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;Per tot això, s'informa i es proposa al vicepresident en Matèria agrària del FOGAIBA que dicti una resolució en els termes següents: &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;1. Revocar parcialment la Resolució de concessió publicada en el BOIB núm. 69 del 25 de maig de 2024, tal i com es detalla en l'annex II d'aquesta resolució per l'anualitat 2023.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;2. Notificar la resolució als interessats en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant la consellera d' Agricultura, Pesca i Medi Natural, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb els articles 121 i 122 de la Llei 39/2015, d' 1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
