&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En data 24/05/2023 el Departament de Gestió Urbanística va sol·licitar informe a la Comissió de Medi Ambient de les Illes Balears (CMAIB), amb caràcter excepcional, per tal que manifestés el seu parer respecte de si l&amp;apos;Ajuntament podia continuar amb la tramitació dels Projectes d&amp;apos;Urbanització de les UE 73/05, UE 04-J i UE 46/02, o si, vista la Declaració Ambiental Estratègica de 23 de març de 2023, la CMAIB considerava que les noves obres d&amp;apos;urbanització s&amp;apos;havien de condicionar a l&amp;apos;entrada en funcionament de l&amp;apos;ampliació de l&amp;apos;EDAR II de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En data 12/06/2023 la CMAIB va emetre informe sobre la petició efectuada (doc. núm. 148622123), en el qual conclou:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;«1. D&amp;apos;acord amb l&amp;apos;informe d&amp;apos;impacte ambiental de 19 de desembre de 2022, es considera que la connexió a l&amp;apos;estació depuradora de les noves obres d&amp;apos;urbanització de la UE 73/05 PERI de la Soledat i el Polígon de Llevant només es podrà realitzar una vegada hagi entrat en funcionament l&amp;apos;ampliació de l&amp;apos;EDAR II.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;2. D&amp;apos;acord amb l&amp;apos;informe d&amp;apos;impacte ambiental de 19 de desembre de 2022, es considera que l&amp;apos;execució del Projecte d&amp;apos;urbanització de la UE-04J Pla Especial de Protecció d&amp;apos;Es Jonquet C/Cerdà i C/Gambins no s&amp;apos;ha de condicionar a l&amp;apos;entrada en funcionament de l&amp;apos;ampliació de l&amp;apos;EDAR II, ja que en el projecte que s&amp;apos;ha avaluat no es generen aigües residuals.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;3. &lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;A&lt;/em&gt;&lt;em&gt; &lt;/em&gt;la vista del resultat de la consulta, posteriorment s&amp;apos;ha realitzat idèntica gestió per a cada un dels projectes relacionats. En aquest sentit, cal posar de manifest respecte del projecte de la UA 32 (EL-AP-11) del Pla de Reconversió Integral de la Platja de Palma, que la CMAIB ha ratificat l&amp;apos;informe d&amp;apos;impacte ambiental de 16 de novembre de 2020 (BOIB núm. 200, de 26 de novembre de 2020), en considerar que l&amp;apos;execució del projecte no s&amp;apos;ha de condicionar a l&amp;apos;entrada en funcionament de l&amp;apos;ampliació de l&amp;apos;EDAR II ja que no es generen aigües residuals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Exclosos els supòsits de la UA -32 (EL-AP-11) i de la UE 04-J, on la Comissió considera que els projectes es poden aprovar degut a que no es genera un increment d&amp;apos;aigües residuals, el pronunciament que emet respecte dels altres projectes és que &lt;em&gt;«&lt;/em&gt;&lt;em&gt;la connexió del pro&lt;/em&gt;&lt;em&gt;j&lt;/em&gt;&lt;em&gt;ecte d&amp;apos;urbanització a l&amp;apos;estació &lt;/em&gt;&lt;em&gt;d&lt;/em&gt;&lt;em&gt;epura&lt;/em&gt;&lt;em&gt;d&lt;/em&gt;&lt;em&gt;ora, així co&lt;/em&gt;&lt;em&gt;m&lt;/em&gt;&lt;em&gt; &lt;/em&gt;&lt;em&gt;l&lt;/em&gt;&lt;em&gt;&amp;apos;ocupació efec&lt;/em&gt;&lt;em&gt;t&lt;/em&gt;&lt;em&gt;iva de &lt;/em&gt;&lt;em&gt;q&lt;/em&gt;&lt;em&gt;ualsevol edifici en &lt;/em&gt;&lt;em&gt;l&lt;/em&gt;&lt;em&gt;&amp;apos;&lt;/em&gt;&lt;em&gt;à&lt;/em&gt;&lt;em&gt;mbit [...] &lt;/em&gt;&lt;em&gt;q&lt;/em&gt;&lt;em&gt;ueda supeditat a &lt;/em&gt;&lt;em&gt;l&lt;/em&gt;&lt;em&gt;&amp;apos;entrada en &lt;/em&gt;&lt;em&gt;f&lt;/em&gt;&lt;em&gt;u&lt;/em&gt;&lt;em&gt;n&lt;/em&gt;&lt;em&gt;cionamen&lt;/em&gt;&lt;em&gt;t&lt;/em&gt;&lt;em&gt; de l&amp;apos;am&lt;/em&gt;&lt;em&gt;p&lt;/em&gt;&lt;em&gt;liació de &lt;/em&gt;&lt;em&gt;l&lt;/em&gt;&lt;em&gt;&amp;apos;EDAR de Palma II»&lt;/em&gt;, i puntualitza:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;&amp;quot;Correspon a l&amp;apos;ajuntament valorar si ajorna l&amp;apos;aprovació del projecte d&amp;apos;urbanització fins a disposar de plenes garanties que, a la seva finalització, l&amp;apos;ampliació de la depuradora estirà operativa, o si aprova el projecte tot assumint el compromís d&amp;apos;adoptar les mesures de publicitat escaients per advertir d&amp;apos;aquesta condició a tots els possibles afectats i, en tot cas, en la concessió de qualsevol dret edificatori en l&amp;apos;àmbit de [...]. Així mateix, en cas d&amp;apos;aprovar el projecte d&amp;apos;urbanització abans de la posada en servei de la nova depuradora, precisarà el règim de responsabilitats davant eventuals retards en la finalització de les obres de l&amp;apos;EDAR&amp;quot;.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Partint de l&amp;apos;anterior, el Departament de Gestió Urbanística va sol·licitar en data 18/09/2023 informe a EMAYA sobre la previsió del calendari d&amp;apos;execució de les obres a escometre, qui ha resolt, en data 02/10/2023, el següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;«Segons el darrer cronograma presentat per ACUAES sobre les obres d&amp;apos;ampliació de l&amp;apos;EDAR 2 Fase 1 la construcció de dites instal·lacions comença el 10 de gener de 2024 i finalitza el 10 de juliol de 2026.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Després de la finalització de la construcció de les instal·lacions es planteja realitzar 12 mesos de posada en marxa i proves de la mateixa, donant-se llavors per finalitzades les obres».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Vist el que s&amp;apos;ha exposat, l&amp;apos;Ajuntament ha decidit traslladar l&amp;apos;opció de continuar o no amb la tramitació dels projectes d&amp;apos;urbanització iniciats als propis promotors, imposant-los per al cas que optin per la primera opció, una sèrie de mesures de publicitat extraordinàries a l&amp;apos;objecte de protegir els interessos de tots els possibles afectats, i particularment, a aquells interessats en exercir el dret edificatori sobre l&amp;apos;àmbit de que es tracti. Per això, mentre l&amp;apos;Ajuntament garanteixi la publicitat de la condició imposada per la CMAIB respecte de la connexió del projecte d&amp;apos;urbanització a l&amp;apos;entrada en funcionament de l&amp;apos;EDAR II, a l&amp;apos;Acord d&amp;apos;aprovació que es publica en el BOIB (inicial i definitiu), el promotor haurà de, com a condició per a l&amp;apos;aprovació definitiva del seu projecte:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;«1. Inscriure una nota marginal a cada una de les finques lucratives de l&amp;apos;àmbit sobre la condició de recepció de les obres d&amp;apos;urbanització a l&amp;apos;entrada en funcionament de l&amp;apos;ampliació de l&amp;apos;EDAR II, en els termes de l&amp;apos;art.9.a.2n del Decret de 8 de febrer de 1946 pel qual s&amp;apos;aprova la nova redacció oficial de la Llei Hipotecària.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;2. Formalitzar un acte de manifestació expressa sobre la renúncia a sol·licitar responsabilitat patrimonial en via administrativa i/o jurisdiccional a l&amp;apos;Ajuntament o a una entitat pública municipal (EMAYA) en cas de demora en l&amp;apos;execució de les obres d&amp;apos;ampliació de l&amp;apos;estació depuradora, i en conseqüència, l&amp;apos;assumpció del risc inherent a aquesta circumstància».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Per tot el que s&amp;apos;ha exposat, la Gerència sol·licita que la &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Comissió&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; estudii la possi&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;b&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ilitat d&amp;apos;estendre la interpretació efectuada respecte dels projectes iniciats als projectes que es presentin desp&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ré&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;s d&amp;apos;entrar en vigor e&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;l&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; nou Pla Ge&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;n&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;eral, i en conseq&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;üè&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ncia, consideri du&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;r&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; a terme una modi&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;fi&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;cació de la Declaració Ambiental &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Estratègica&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; en el sentit de pe&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;rme&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;tre trami&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;t&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ar i aprovar els projectes d&amp;apos;urbanització, fixant co&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;m&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; a prescripció d&amp;apos;aquests els condicionats que, en cada cas, determini la pr&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ò&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;pia Comissió en el seu informe preceptiu e&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;mè&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;s &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;d&amp;apos;acord &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;amb el &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Decret legislatiu 1/2020, de 28 d&amp;apos;agost, pel qual s&amp;apos;aprova el Text refós de la Llei d&amp;apos;avaluació ambiental de les Illes Balears i &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;la Llei 21/20&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3, de 9 de desembre, d&amp;apos;Avaluació Ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Es considera, a criteri d&amp;apos;aquesta Gerència, que la no tramitació de cap projecte d&amp;apos;urbanització, al igual que la dels instruments de planejament i de desenvolupament del Pla afectat per la Norma 1.3.2.5 del PG, demoraria en excés la projecció del propi Pla. En canvi, el que es proposa és anar avançant amb la tramitació dels instruments de planejament i de gestió urbanística mentre s&amp;apos;executen les obres de l&amp;apos;EDAR II de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Es sol licita que previs tràmits que considereu legalment oportuns procediu a modificar la Declaració ambiental estratègica del Pla General de Palma, formulada per acord del Ple de la Comissió de Medi Ambient de les Illes Balears en sessió de dia 23 de març de 2023, d&amp;apos;acord amb les circumstàncies assenyalades a la present petició. Tot això als efectes que des de l&amp;apos;Ajuntament es pugui promoure la modificació de la Norma 1.3.2.5 del PG.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Consultes a les administracions públiques afectades i persones interessades&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- SFM de data 8 de gener de 2024 que conclou que les competències d&amp;apos;SFM, en allò que correspon a les línies ferroviàries actuals i les projectades, no es veuen afectades per la sol·licitud efectuada per l&amp;apos;Ajuntament de Palma, per la qual cosa no hi ha impediment per part d&amp;apos;aquesta entitat pública empresarial perquè es procedeixi a tramitar la modificació de la declaració ambiental estratègica sol·licitada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Associació del Petit i Mitjà Comerç de Mallorca (PIMECO) que fetes les al·legacions demana que es desestimi la sol·licitud de modificació de la DAE del PG de Palma presentada per l&amp;apos;Ajuntament de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Servei de Canvi Climàtic de la DG d&amp;apos;Economia Circular, Transició Energètica i Canvi Climàtic de la Conselleria d&amp;apos;Empresa, Ocupació i Energia de &lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;data &lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;11 de gener de 2024&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; que&lt;/span&gt;&lt;/span&gt; conclou:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 80px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;«En relació amb la perspectiva climàtica en la tramitació ambiental i l&amp;apos;afecció al canvi climàtic, s&amp;apos;arriba a les següents conclusions:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 80px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;1. En les circumstàncies argumentades a la sol·licitud de modificació no s&amp;apos;hi troba justificació que motivi la revisió de la Declaració Ambiental Estratègica (DAE) en el sentit de l&amp;apos;article 28 de la Llei 21/2013.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 80px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;2. La situació del municipi de Palma segueix essent de insuficiència de recursos hídrics i execució de l&amp;apos;ampliació de l&amp;apos;EDAR II i no s&amp;apos;han observat canvis cap a la millora d&amp;apos;aquesta situació. Els efectes previsibles del canvi climàtic fan suposar que augmenti el risc de disminució de la disponibilitat d&amp;apos;aigua, per tant en un context de canvi climàtic, els recursos hídrics son un recurs clau a preservar.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 80px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;3. La mesura adoptada per la DAE 6 a) i transposada a la Norma 2.1.17 del PG es veu adequada en un context de canvi climàtic, ja que permetrà assegurar la disponibilitat d&amp;apos;aigua i el retorn en adequades condicions al medi.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 80px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Per tot l&amp;apos;anterior, no es veu necessària la modificació de la Declaració Ambiental Estratègica des de la perspectiva climàtica.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 80px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Es recorda a l&amp;apos;Ajuntament de Palma el condicionant 6 d) de la DAE quant a donar compliment a la Llei 10/2019 de canvi climàtic en la tramitació de l&amp;apos;EAE del POD pel que fa a la quantificació de les emissions de gasos d&amp;apos;efecte hivernacle, consum energètic i vulnerabilitat davant del canvi climàtic i també als nous desenvolupaments.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Subdirecció General d&amp;apos;Aeroports i Navegació Aèria del Ministeri de Transports i Mobilitat Sostenible, de data 22 de març de 2024, que conclou: &lt;em&gt;«Al respecto, este Centro Directivo no tiene consideraciones que realizar en relación con el procedimiento d evaluación ambiental estratégica del &lt;/em&gt;&lt;em&gt;P&lt;/em&gt;&lt;em&gt;lan General de Palma»&lt;/em&gt;. En tot cas, indica que &lt;em&gt;«se recuerda la necesidad de disponer de informe expreso favorable por parte de la Dirección General de Aviación Civil para la aprobación definitiva del planeamiento, y que la solicitud oficial deberá realizarse antes de su aprobación inicial o trámite equivalente.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- Direcció general de Recursos Hídrics, de data 10 de maig de 2024, que indica:&lt;em&gt; «L&amp;apos;informe que va elaborar el Servei d&amp;apos;Estudis i Planificació de la Direcció General de Recursos Hídrics va concloure que la capacitat de depuració «per les noves actuacions de transformació urbanística en sòl urbà i els nous sòls urbanitzables, estarà garantida quan estigui en funcionament la nova EDAR Palma 2 prevista en el Pla Hidrològic i en el Pla General». Aquest pronunciament fa referència a què no es poden generar aigües residuals de les noves actuacions de transformació urbanística en sòl urbà i els nous sòls urbanitzables fins que no estigui en funcionament la nova EDAR 2. L&amp;apos;informe &lt;/em&gt;&lt;/span&gt;&lt;em&gt;no es pronuncia, per no ser competència de la Direcció General de Recursos Hídrics, si mentrestant es poden anar tramitant o no els projectes d&amp;apos;urbanització d&amp;apos;aquestes unitats.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;La Declaració Ambiental Estratègica del Ple de la CMAIB sí que es va pronunciar sobre si es podien anar tramitant els planejaments derivats quan va dir que «a) L&amp;apos;aprovació del planejament derivat o dels projectes d&amp;apos;urbanització només es podrà dur a terme quan: Estigui en funcionament l&amp;apos;ampliació de la EDAR II-fase 1 fins a la capacitat per a 676.000 habitants equivalents». &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Per tant, i d&amp;apos;acord amb les competències que corresponen a la Direcció General de Recursos Hídrics, el que s&amp;apos;ha d&amp;apos;assegurar és que no es generin aigües residuals derivades de les noves actuacions de transformació urbanística en sòl urbà i els nous sòls urbanitzables fins que no estigui en funcionament la nova EDAR 2; i, per altra banda, que estiguin garantits els recursos hídrics necessaris per atendre la demanda d&amp;apos;aigua que es generaria amb els nous desenvolupaments. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Tenint en compte que les obres de la remodelació de l&amp;apos;EDAR II estan en execució, amb una previsió de posada en funcionament de la primera fase de les obres prevista pel mes de juny 2026, i que la segona fase d&amp;apos;aquesta infraestructura ha iniciat la tramitació del projecte, tot d&amp;apos;acord amb els convenis signats per part d&amp;apos;EMAYA (Ajuntament de Palma) i l&amp;apos;empresa estatal ACUAES que pertany al Ministeri de Transició Ecològica (MITECO), aquesta Direcció General entén que hi ha prou elements que aporten les solucions necessàries per garantir a curt termini la correcta depuració i gestió de les aigües residuals de la ciutat previstes en el nou planejament.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Pel que fa a la garantia de recursos hídrics necessària per qualsevol nou desenvolupament, la possibilitat de disposar de cabals procedents de la IDAM Badia de Palma permetrà, amb els convenis corresponents amb l&amp;apos;Agència Balear de l&amp;apos;Aigua, garantir els recursos necessaris definits al nou instrument de planejament que s&amp;apos;informa. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;En conclusió, entenem que no és necessari modificar l&amp;apos;informe redactat en el seu moment però, d&amp;apos;acord amb el que s&amp;apos;exposa en el cos d&amp;apos;aquest document, es podria considerar favorablement la proposta de l&amp;apos;Ajuntament de Palma per tal de poder avançar amb els instruments de planejament, en paral·lel amb les obres de millora de les infraestructures de depuració que estan ja &lt;span style="color: rgb(0, 0, 0)"&gt;iniciades.»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;- &lt;/span&gt;&lt;/em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Autoritat Portuària de Balears, de 21 de maig de 2024, que indica: &lt;/span&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;«Així mateix, l&amp;apos;esmentada modificació vendria justificada per la necessitat de desbloquejar la tramitació dels instruments de planejament i de gestió urbanística limitada per la regulació de la Norma 1.3.2.5 del Pla General, i permetre el seu avenç mentre s&amp;apos;estan executant els obres de la EDAR II de Palma (&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;la finalització de la qual està prevista pel mes de juliol de 2027), amb l&amp;apos;objecte de no demorar en excés la projecció de l&amp;apos;esmentat pla). En resposta a la sol·licitud, havent-se analitzat la documentació annexa, s&amp;apos;informa favorablement la tramitació de la modificació de la Declaració Ambiental Estratègica, segons el sol·licitat per part de la Gerència d&amp;apos;Urbanisme de l&amp;apos;Ajuntament de Palma, d&amp;apos;acord amb les condicions i els termes prevists»&lt;/span&gt;&lt;/em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Consideracions tècniques&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1.L&amp;apos;Acord del Ple de la CMAIB de data 23 març 2023 sobre la revisió del PG de Palma, publicat al BOIB núm. 51 de 22 d&amp;apos;abril de 2023, formula Declaració Ambiental Estratègica favorable amb una sèrie de condicions, entre les quals hi ha les recollides a les normes urbanístiques del Pla General de Palma aprovat definitivament el 2023 (PG 2023) i que l&amp;apos;Ajuntament de Palma sol·licita modificar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 80px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Norma 1.3.2. Actualització de la programació del Pla General.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 80px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;5. L&amp;apos;aprovació del planejament derivat o dels projectes d&amp;apos;urbanització només es podrà dur a terme quan:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left: 80px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Mentre no estigui totalment garantida la suficiència i la disponibilitat es tindrà en compte l&amp;apos;ordre de prioritat establert en la norma 2.1.17.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 80px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Això s&amp;apos;estableix, sense perjudici de comptar amb l&amp;apos;informe preceptiu de l&amp;apos;administració hidràulica en relació a la suficiència de recursos per a satisfer la nova demanda hídrica, que s&amp;apos;estableix a l&amp;apos;article 25.4 del text refós de la Llei d&amp;apos;aigües.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 80px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Norma 2.1.17. Ordre de prioritats de la demanda hídrica.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 80px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;El Pla General estableix el següent ordre de prioritats a l&amp;apos;hora d&amp;apos;atendre la demanda de recursos hídrics, mentre no estigui totalment garantida la suficiència i la disponibilitat de recursos hídrics conforme a la previsió de la Norma 1.3. 2 apartat 5:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 120px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;- En primer lloc l&amp;apos;aigua s&amp;apos;ha de destinar a atendre la demanda compromesa, és a dir, la procedent del sòl urbà consolidat o amb projecte d&amp;apos;urbanització aprovat. Aquí s&amp;apos;inclou el volum real subministrat actual (no consum), més el volum de subministrament dels habitatges buits existents, més el volum dels habitatges ubicats en solars vacants no edificats i els habitatges en parcel·les edificades de manera ineficient.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 120px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;- En segon lloc, i sempre i quan hi hagi un volum excedent de recursos hídrics quant a suficiència i disponibilitat després d&amp;apos;atendre la demanda compromesa anterior, aquest volum es podrà destinar a satisfer la demanda de les noves actuacions de transformació urbanística en sòl urbà, seguint l&amp;apos;ordre de programació marcat pel Pla General”.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;A l&amp;apos;ofici de l&amp;apos;Ajuntament de Palma s&amp;apos;indica que la no tramitació de cap projecte d&amp;apos;urbanització, al igual que la dels instruments de planejamen&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;t &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;i de desenvolupament del Pla afectat per la Norma 1.3.2.5 del PG, de&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;m&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;oraria en excés la projecció del propi Pla. En canvi, el que es proposa és anar avançant amb la tramitació dels instruments de planejament i de gestió urbanística mentre s&amp;apos;executen les obres de l&amp;apos;EDAR II de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;De la consulta efectuada per l&amp;apos;Ajuntament de Palma a la CMAIB sobre si podia continuar amb la tramitació dels projectes d&amp;apos;urbanització va quedar clar que el que estava condicionat era la connexió a la EDAR II, és a dir, la connexió dels projectes d&amp;apos;urbanització queda condicionada a l&amp;apos;entrada en funcionament de l&amp;apos;ampliació de l&amp;apos;EDAR de Palma II.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Amb la documentació aportada per l&amp;apos;Ajuntament de Palma, s&amp;apos;adjunta el cronograma de l&amp;apos;empresa ACUAES que realitza l&amp;apos;ampliació de l&amp;apos;EDAR II-fase 1, amb un inici d&amp;apos;obres el &lt;span style="color: rgb(0, 0, 0)"&gt;10 de gener de 2024,&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;i una finalització estimada&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; el juliol de 202&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6, amb un posterior període de proves estimat de 12 mesos&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;. &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;D&amp;apos;acord amb &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;el posterior escrit de la Direcció General de Recursos Hídrics, les obres de remodelació de l&amp;apos;EDAR-II està en execució, amb una previsió de posada en funcionament de la primera fase de les obres prevista pel mes de juny de 2026. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Apart del compliment de que l&amp;apos;ampliació de l&amp;apos;EDAR II-fase 1 estigui en funcionament, s&amp;apos;ha de tenir en compte&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;la condició de la norma 1.3.2.5. : «&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;que quedi garantida la disponibilitat efectiva d&amp;apos;aigua potable»&lt;/em&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;, &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;i que: «&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Mentre no estigui totalment garantida la suficiència i la disponibilitat es tindrà en compte l&amp;apos;ordre de prioritat establert en la norma 2.1.17». &lt;/em&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;A&lt;/em&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; la norma 2.1.17 els nous urbanitzables són el darrer punt de l&amp;apos;ordre de prioritat. &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Al respecte l&amp;apos;escrit de la Direcció General de Recursos Hídrics indica que «&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;aquesta Direcció General entén que hi ha prou elements que aporten les solucions necessàries per garantir a curt termini la correcta depuració i gestió de les aigües residuals de la ciutat previstes en el nou planejament. &lt;/em&gt;&lt;/span&gt;&lt;em&gt;Pel que fa a la garantia de recursos hídrics necessària per qualsevol nou desenvolupament, la possibilitat de disposar de cabals procedents de la IDAM Badia de Palma permetrà, amb els convenis corresponents amb l&amp;apos;Agència Balear de l&amp;apos;Aigua, garantir els recursos necessaris definits al nou instrument de planejament que s&amp;apos;informa.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El que està condicionat per la DAE al funcionament de l&amp;apos;ampliació de l&amp;apos;EDAR II i a la disponibilitat efectiva d&amp;apos;aigua potable és: &lt;em&gt;«l&amp;apos;aprovació del planejament derivat o dels projectes d&amp;apos;urbanització» &lt;/em&gt;i la motivació de la sol·licitud de l&amp;apos;Ajuntament de Palma és: &lt;em&gt;«anar &lt;/em&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;avançant amb la tramitació dels instruments de planejament i de gestió urbanística mentre s&amp;apos;executen les obres de l&amp;apos;EDAR II de Palma&lt;/em&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;». &lt;/em&gt;En aquest sentit com que el que està condicionat és l&amp;apos;aprovació i no la tramitació, fins i tot sense modificar la DAE es poden anar tramitant instruments de planejament o projectes d&amp;apos;urbanització, encara que no es podria dur a terme la seva aprovació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Cal tenir en compte, &lt;span style="color: rgb(0, 0, 0)"&gt;finalment,&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; el que indica la Direcció &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;G&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;eneral de Recursos Hídrics en data &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;10 de maig de 2024: &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;«&lt;/em&gt;&lt;/span&gt;&lt;em&gt;En conclusió, entenem que no és necessari modificar l&amp;apos;informe redactat en el seu moment però, d&amp;apos;acord amb el que s&amp;apos;exposa en el cos d&amp;apos;aquest document, es podria considerar favorablement la proposta de l&amp;apos;Ajuntament de Palma per tal de poder avançar amb els instruments de planejament, en paral·lel amb les obres de millora de les infraestructures de depuració que estan ja iniciades»&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;L&amp;apos;article 28 de la Llei 21/2013, de 9 de desembre, d&amp;apos;avaluació ambiental, sobre la modificació de la declaració ambiental estratègica, determina al punt 1: &lt;em&gt;«La declaració ambiental estratègica d&amp;apos;un pla o programa aprovat es pot modificar quan hi hagi circumstàncies que determinin la incorrecció de la declaració ambiental estratègica, incloses les que sorgeixin durant el procediment d&amp;apos;avaluació de l&amp;apos;impacte ambiental, tant per fets o circumstàncies que s&amp;apos;esdevinguin posteriorment a aquesta última, com per fets o circumstàncies anteriors que, al seu moment, no van ser o no van poder ser objecte de la valoració adequada»&lt;/em&gt;. En aquest cas la nova circumstància posterior a la DAE a tenir en compte és el començament efectiu de les obres de l&amp;apos;ampliació de l&amp;apos;EDAR de Palma II i la previsió d&amp;apos;un calendari de finalització de la mateixa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Per tot això, no s&amp;apos;aprecia impediment a la proposta de l&amp;apos;Ajuntament de Palma a l&amp;apos;hora de permetre &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;la &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;trami&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;t&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ció&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; i aprova&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ció &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;els projectes d&amp;apos;urbanització &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;de manera simultània, amb la finalitat d&amp;apos;avançar amb els instruments de planejament, atenent als condicionants que s&amp;apos;han exposat, &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;concretament&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;, &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;e&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;l relatiu a que no es podrà connectar la urbanització a l&amp;apos;estació depuradora fins &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;que&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; l&amp;apos;ampliació de la fase 1 de les obres de la EDAR de Palma II &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;entri en&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; funcionament, &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;atès que el concepte «tramitació», en aquest cas, implica la possibilitat d&amp;apos;agilitzar, gestionar o avançar en un procediment complex com és l&amp;apos;urbanístic. Així mateix, és precís mantenir que serà responsabilitat de l&amp;apos;òrgan substantiu informar als promotors sobre l&amp;apos;estat del procediment, especialment, en cas de demora en l&amp;apos;execució de les obres de l&amp;apos;EDAR. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Per tant, atès que es donen les circumstàncies de l&amp;apos;article 28 de la Llei 21/2013 i atès el que indica la Direcció General de Recursos Hídrics, es pot modificar l&amp;apos;apartat a) dels condicionants de la DAE del Pla General de Palma, en el sentit de que la connexió de la urbanització a l&amp;apos;estació depuradora quedi supeditada a l&amp;apos;efectiva entrada en funcionament de l&amp;apos;ampliació de la fase 1 de les obres de la EDAR de Palma II, en el mateix sentit que l&amp;apos;informe que es va emetre per part de la CMAIB en data 12 de juny de 2023, sobre la tramitació de determinats projectes d&amp;apos;urbanització.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Per tot l&amp;apos;exposat, d&amp;apos;acord amb l&amp;apos;apartat primer de l&amp;apos;article únic del Decret 5/2024, de 29 de maig, de la presidenta de les Illes Balears, pel qual s&amp;apos;estableixen les competències i l&amp;apos;estructura orgànica bàsica de les conselleries de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears, amb la Disposició Transitòria Primera del Decret llei 3/2024, de 24 de maig, de mesures urgents de simplificació i racionalització administratives de les administracions públiques de les Illes Balears, i vist l&amp;apos;informe i proposta de resolució de 25 de maig de 2024, dict la següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Primer.-&lt;/strong&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;Aprovar la modificació de la declaració ambiental estratègica del Pla General de Palma&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;de 23 de març de 2023 (publicada al BOIB núm. 51, de 22 d&amp;apos;abril de 2023), en el següent sentit:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Allà on diu:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;«a) l&amp;apos;aprovació del planejament derivat o dels projectes d&amp;apos;urbanització només es podrà dur a terme quan:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li style="margin-left: 40px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;estigui en funcionament l&amp;apos;ampliació de la EDAR I&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;I-fase I fins a l&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;a capacitat per a 676.000habitants equivalents.»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ha de dir:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;«a) es podrà tramitar &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;i aprovar&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; el planejament derivat o els projectes d&amp;apos;urbanització, però la connexió del&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;s&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; projecte&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;s&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; d&amp;apos;urbanització a l&amp;apos;estació depuradora així com l&amp;apos;ocupació efectiva de qualsevol edifici en l&amp;apos;àmbit d&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;e la urbanització&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;, qued&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;en&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; supeditad&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;es&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; a l&amp;apos;entrada en funcionament de la fase 1 d&amp;apos;ampliació de la EDAR &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;II. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Correspon a l&amp;apos;ajuntament valorar si ajorna l&amp;apos;aprovació del projecte d&amp;apos;urbanització fins a disposar de plenes garanties que, a la seva finalització, l&amp;apos;ampliació de la depuradora estarà operativa, o si aprova el projecte tot assumint el compromís d&amp;apos;adoptar les mesures de publicitat escaients per advertir d&amp;apos;aquesta condició a tots els possibles afectats i, en tot cas, en la concessió de qualsevol dret edificatori en l&amp;apos;àmbit de la urbanització.
