font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>1.</strong> Mitjançant Resolució núm. 14740, de 9 d'agost de 2023, el president de l'Institut Mallorquí d'Afers Socials (IMAS) va aprovar l'expedient de convocatòria de la concertació social pel procediment d'urgència del <span style="background-color:#ffffff">servei de centre de dia per a persones amb discapacitat intel·lectual i/o trastorn del desenvolupament, inclòs a la xarxa pública de serveis per a persones amb discapacitat de Mallorca</span> (BOIB núm. 112, de 12 d'agost de 2023), on es preveia</span><span style="color:#000000"><span style="background-color:#ffffff"> l</span></span><span style="color:#000000">'ampliació del servei de centre de dia fins a 240 dies, corresponent a 20 dies del mes d'agost, segons el disposat a l'apartat 3 del Plec de prescripcions tècniques ( CSV: </span><span style="color:#333333">K9AA U2N7 QW9U 7H3U WWRQ</span><span style="color:#000000"> ).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>5. </strong>En relació a la sol·licitud d'una plaça realitzada per l'entitat Fundació Patronat Joan 23 , es proposa la denegació , atès que aquesta sol·licitud es realitza des d'una entitat,que no té concert vigent amb l'IMAS, atès que es troba pendent d'un canvi de titularitat, amb l'adjudicatària del concert Patronat de la Agrupació pro minusvàlids psíquics de las Comarca d'inca.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>6. </strong>Juntament amb l'informe proposta, s'adjunta el llistat d'usuaris admesos que han sol·licitat aquest servei per al mes d'agost de 2024, així com els documents comptables que justifiquen l'existència de crèdit adequat i suficient per fer front a aquestes despeses.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>Consideracions jurídiques</strong></span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Pel que fa a la competència,</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>1.</strong> La Llei orgànica 1/2007, de 28 de febrer, de reforma de l'Estatut d'Autonomia de les Illes Balears (<em>BOIB</em> núm. 32 ext., d'1 de març de 2007; correcció d'errades <em>BOIB</em> núm. 29, de 28 de febrer de 2008).</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>2.</strong></span><span style="color:#000000"> </span><span style="color:#000000">La Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears (</span><span style="color:#000000"><em>BOIB</em></span><span style="color:#000000"> núm. 89 de 18 de juny de 2009 i BOE </span>núm. 163 de 7 de juliol de 2009<span style="color:#000000">) preveu a l'article 27 i a la disposició final quarta, que cada Consell Insular, en el marc de les seves competències, ha de definir les prestacions pròpies de serveis socials, complementant la cartera bàsica de serveis socials que aprova el Govern de les Illes Balears, la qual va ser aprovada mitjançant el Decret 32/2023, de 26 de maig, pel qual s'aprova la Cartera bàsica de serveis socials de les Illes Balears 2023-2027, s'estableixen principis generals per a les carteres insulars i locals i es modifiquen diverses normatives de l'àmbit social.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>3.</strong> Els Estatuts de l'Institut Mallorquí d'Afers Socials (<em>BOIB</em> núm. 67, de 18 de maig de 2019) aprovats per acord del Ple del Consell de Mallorca de data 11 d'abril de 2019, en especial l'establert a l'article 2 d'acord amb el qual l'Institut Mallorquí d'Afers Socials, com a organisme autònom creat pel Consell de Mallorca, adscrit al Departament de Benestar Social del Consell de Mallorca, és l'organisme que exerceix les competències atribuïdes per qualsevol títol al Consell de Mallorca en matèria de serveis socials i protecció de menors.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong><span style="background-color:#ffffff">4. </span></strong><span style="background-color:#ffffff">Decret de la Presidència del Consell de Mallorca, </span></span><span style="background-color:#ffffff">de 10 de juliol de 2023, pel qual es creen els departaments que n'han d'estructurar el govern (</span><em><span style="background-color:#ffffff">BOIB</span></em><span style="background-color:#ffffff"> núm. 95, d'11 de juliol de 2023), entre els quals es troba el Departament de Benestar Social.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>5. </strong><span style="background-color:#ffffff">Decret de la Presidència del Consell de Mallorca pel qual es nomenen els membres del Consell Executiu de 10 de juliol de 2023 (</span><em><span style="background-color:#ffffff">BOIB</span></em><span style="background-color:#ffffff"> núm. 95, d'11 de juliol de 2023) pel qual es nomena el Sr. Guillermo Sánchez Cifre conseller executiu de Benestar Social.</span></span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>6. </strong>L'òrgan competent per aprovar aquesta resolució és la Presidència de l'IMAS, d'acord amb l'article 7.2.28 dels Estatuts de l'IMAS (<em>BOIB</em> núm. 67, de 18 de maig de 2019). </span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>15. </strong>La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques (BOE núm. 236, de 2 d'octubre de 2015).</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>16. </strong>L'article 214 del Reial Decret Legislatiu 2/2004, de 5 de març, pel qual s'aprova el Text refós de la Llei reguladora de les Hisendes Locals, i atès l'acord d'aprovació del règim de fiscalització i intervenció limitada prèvia de requisits bàsics i presa de raó en ingressos del Consell Insular de Mallorca i de les entitats del seu sector públic subjectes a funció interventora de data 12 de desembre de 2019, l'expedient ha estat sotmès a la Intervenció delegada de l'IMAS per a l'emissió del preceptiu informe de fiscalització prèvia ( BOE núm. 59 de 9 de març de 2004).</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
