&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En data 18 d'abril de 2023, es va publicar el BOIB núm. 49 la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova, per l'any 2023, la convocatòria d'ajudes destinades al foment de producció integrada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. De conformitat amb l'apartat sisè de l'esmenada Resolució, el termini de presentació de sol·licituds de la convocatòria va acabar dia 30 de juny de 2023. Es varen registrar un total de 300 sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han duit a terme el control administratiu de la sol·licitud i de la documentació aportada d'acord amb les bases reguladores d'aquestes ajudes, constatant que no compleix el requisits establerts en la convocatòria establert a l'apartat tercer punt 1.b) d'inscripció en el Registre d'operadors de producció integrada i/o l'article10.1.g) del Decret Legislatiu 2/2005, de 28 de desembre, per la qual s'aprova el text refós de la llei de subvencions (estar al corrent de pagament d'obligacions per &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;reintegrament&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt; &lt;/strong&gt;de subvencions en els termes que es determinin per reglament).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En data 1 de juliol de 2024 es va publicar a la pàgina web del FOGAIBA la Proposta Provisional de Denegació per la línia Foment de Producció Integrada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. L'interessat no ha presentat al·legacions a la proposta provisional de denegació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Resolució de la Presidenta del fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 18 d'abril de 2023 per la qual s'aprova la convocatòria per a l'any 2023 al foment de producció integrada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. L'ordre 10/2023 de la consellera d'Agricultura, Pesca i Alimentació, de 5 d'abril de 2023, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc de les intervencions per al desenvolupament rural de les Illes Balears 2023-2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. S'ha constat que l' interessats assenyalat a l'&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Annex I&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;no compleix&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; amb el requisit de la convocatòria establert a l'apartat tercer punt 1.b) d'inscripció en el Registre d'operadors de producció integrada i/o l'article10.1.g) del Decret Legislatiu 2/2005, de 28 de desembre, per la qual s'aprova el text refós de la llei de subvencions (estar al corrent de pagament d'obligacions per &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;reintegrament&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt; &lt;/strong&gt;de subvencions en els termes que es determinin per reglament).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Proposta resolució de denegació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot això, s'informa i es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Denegar la sol·licitud d'ajuda a la persona beneficiària detallat a &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;l'annex I.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Informar als beneficiaris que els seus expedients es troben a la seva disposició i consulta al Servei d'Ajudes al Desenvolupament Rural del FOGAIBA (carrer de Reina Constança, núm. 4 de Palma).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Publicar a BOIB&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d'alçada davant el conseller de Medi Ambient, Agricultura i Pesca, en el termini d'un mes,&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i els articles 114 i 115 de la Llei 30/92, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, modificada per la Llei 4/99, dede gener.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
